    UP: Folk singer Neha Singh Rathore served notice for targeting govt

    Kanpur Dehat: Famous folk singer Neha Singh Rathore, who is known for her ‘UP Mein Ka Ba’ songs, has been served a 160 CrPC notice by the Akbarpur Kotwali police.

    Neha had taken a jibe at the state government by posting several songs including ‘UP Mein Ka Ba’ from her Twitter handle, Facebook and YouTube channel after a mother-daughter were burnt alive in Madauli village in Kanpur Dehat during an anti-encroachment drive.

    CO Akbarpur Prabhat Kumar said that various tweets and oral complaints were received that Neha’s songs are spreading discrimination and disharmony in society.

    Taking cognizance of this, an explanation has been sought from her through a notice within three days.

    It has been asked in the notice whether the internet media platforms on which these songs were posted are run by her herself or by someone else.

    The police asked her whether the songs she sang were written by her or given by someone and also what is the basis of writing and singing songs.

    If the explanation is not given, the police will take further legal action, the CO said.

    Neha had sung the song ‘UP Mein Ka Ba’ even before the 2022 Assembly elections and this as apparently a rejoinder to BJP MP and Bhojpuri star Ravi Krishan’s ‘UP Mein Sab Ba’.

    New Delhi: The Delhi High Court on Tuesday asked the Centre to file its reply, within six weeks, on a PIL challenging provisions of Protection of Children from Sexual Offences (Pocso) Act, 2012, requiring compulsory reporting of sexual offences against minors.

    A division bench of Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad, dealing with lawyer Harsh Vibhore Singhal’s matter, issued notice on the petition and listed the case for pleadings to be complete before the Joint Registrar in July.

    Singhal has sought “judicial invalidation” of various sections of the POCSO Act, as these violate minors’ right to give informed consent for not reporting the matter and are against Article 21 of the Constitution.

    “… the law is well settled that neither law, nor police nor any court can force a sexual assault survivor to report an offence by filing an FIR and no police or court can force any minor in consensual sex to report her sexual activity. Thus, the impugned sections requiring mandatory reporting are untenable, arbitrary and unconstitutional and deserve to be set aside,” the petition contends.

    The petitioner argued that these provisions deprive minors and grown-up women of seeking prenatal, reproductive, and sexual healthcare.

    “…consensual sexual acts by under 18 minors fall squarely within the penumbra of the right to privacy which has also been recognised by a nine-judge SC bench in Puttaswamy v. Union of India”, the petitioner stated.

    The bench was urged by Singhal to declare the challenged provisions “unconstitutional”.

    Hyderabad: The Telangana High Court on Monday issued notices to the department of personnel and training, the Ministry of Personnel Public Grievances and others seeking counters over a PIL challenging the rules and practices governing the recruitment of members to the Central Administrative Tribunal (CAT).

    President of the CAT’s Bar Association, B Gurudas, a petitioner and an attorney in this case has brought up the legal question of how someone without legal expertise could be appointed as a judicial member of the tribunal.

    The petition states that according to Section 6 (2) (b) of the Administrative Tribunals Act, the judicial member shall not be a member of the Administrative Tribunal unless he is a judge of a High Court or is qualified to be one or has held the position of member-secretary, Law Commission of India for at least two years, or has held the position of additional secretary to the Government of India in the department of legal affairs and Legislative department at least for a period of five years.

    The petitioner held the act as a breach of the law for selecting someone who has only held administrative positions without having a background in law.

    He further argued that a person from the legal profession must be recruited for the post.

    Delhi: Continuing the action against unruly MPs in the Rajya Sabha following the suspension of Congress MP Rajni Patil for the entire Budget Session, Vice President Jagdeep Dhankar has given his consent for the privilege committee to examine the conduct of 12 MPs from the opposition.

    “Members are informed that the Chairman, Rajya Saba has referred a question of the alleged breach of privilege arising out of gross disorderly conduct displayed by the Rajya Sabha MPs in violation of rules and etiquette of Rajya Saha by repeatedly entering the well of the Council, shouting slogans and persistently and wilfully obstructing the proceedings of the Council, compelling the Chair to repeatedly adjourn the sittings of the Council, under rule 203 of the Rules of Procedure and Conduct of Business in the Council of States (Raiya Sabha) to the committee of Privileges for examination, investigation and report,” said a Rajya Sabha bulletin.

    The names of the Rajya Sabha MPs include those from the Congress and Aam Aadmi Party (AAP) in particular. These 12 MPs are Sanjay Singh, Shaktisinh Gohil, Sushil Kumar Gupta, Sandeep Kumar Pathak, Naranbhai J Rathwa, Syed Nasir Hussain, Kumar Ketkar, Imran Pratapgarhi, L Hanumanthaiah, Phulo Devi Netam, Jebi Mather Hisham and Ranjeet Ranjan.

    In addition to this, there has been another privilege notice against AAP Rajya Sabha MP Sanjay Singh for repeatedly submitting a notice for suspension of the Zero Hour in Parliament to discuss the Adani stock issue.

    In fact, during the first part of the session, the Rajya Sabha chairman had pulled up Sanjay Singh for giving identical notices.

    “Members are informed that the Chairman, Rajya Sabha has referred a question of an alleged breach of privilege arising out of non-adherence to the directions of the Chair vis-a-vis repeated submission of identical notices under rule 267 by Sanjay Singh, Member, Rajya Sabha, under rule 203 of the Rules of Procedure and Conduct of Business in the Council of States (Rajya Sabha) to the Committee of Privileges for examination, investigation and report, the Rajya Sabha bulletin further elaborated.

    With the opposition parties demanding a Joint Parliamentary Committee (JPC) to probe the Adani stock matter, the Upper House of Parliament witnessed a massive ruckus in the recently concluded first half of the Budget Session. Ruckus and sloganeering took place in the middle of Prime Minister Narendra Modi’s speech for the Reply to the Motion of Thanks to the President address.

    After repeated warnings to the opposition members, the Rajya Sabha chairman had suspended Congress MP Rajni Patil for recording mobile videos of the ruckus.

    After the recess, the second part of the Budget Session will resume on March 13 and will continue till April 6.
