Civilian killing: NIA files supplementary charge sheet against Maoist cadre in Bihar

    [ad_1]

New Delhi: The NIA on Saturday filed a third supplementary charge sheet against a Maoist cadre who was involved in the killing of a civilian after a “kangaroo court” dubbed him as a police informer in Bihar’s Aurangabad district in 2018, an agency official said on Saturday.

Naresh Singh Bhokta was abducted on November 2 and taken to a “jan adalat or kangaroo court” where the top leadership of the CPI(Maoist) issued instructions to their cadres to kill him after declaring him as a police informer. His body was found near Badhai Bigha village in the Madanpur police station area the same day.

The National Investigation Agency (NIA) took over the investigation into the case on June 24 last year. The case was initially registered at Madanpur police station in Aurangabad district in Bihar.

Earlier, the state police filed separate charge sheets against seven accused on January 26 and December 28 in 2019 and November 30 in 2021.

A spokesperson of the NIA identified the accused charge-sheeted on Saturday as Ajay Singh Bhokta, a resident of Kanaudi village in Madanpur, and said, “investigations have revealed that he, along with other CPI(Maoist) cadres, was actively involved in the abduction and murder of the civilian”.

“Ajay is an armed cadre of CPI(Maoist) and he was arrested in the instant case on September 1 last year upon production warrant. Charge sheet has been filed against him in the NIA Court, Patna under various sections of IPC, Arms Act and Unlawful Activities (Prevention) Act,” the spokesperson said.

The official said the weapons used in the incident have been seized and their forensic examination has been completed.

Three vehicles used by the CPI(Maoist) cadres in the incident have also been seized, the spokesperson said.

“During its investigations, NIA has also been able to unearth the involvement of top CPI(Maoist) commanders, including a politburo member, in the conspiracy for this brutal murder, which was done to create terror in the society while propagating the false and fallacious ideology of people’s war against the State,” the spokesperson said.

  • Anti-CAA case against Akhil Gogoi reopened by Spl NIA Court

Anti-CAA case against Akhil Gogoi reopened by Spl NIA Court

    [ad_1]

Guwahati: The Special NIA Court on Thursday reopened an anti-CAA case against Assam MLA Akhil Gogoi and his three associates following a directive of the Gauhati High Court.

On the first day, Gogoi’s advocate presented the Supreme Court’s order giving protection from arrest till February 24 in connection with the case related to anti-Citizenship (Amendment) Act stir and suspected Maoist links.

Considering the apex court ruling, Special NIA Judge Pranjal Das deferred the hearing and listed the case on February 28.

Hundreds of Gogoi’s supporters waited outside the court premises to express solidarity with the Raijor Dal chief.

On February 9, the Gauhati High Court had allowed the National Investigation Agency (NIA) to frame charges against Gogoi and three others in the case. Its order had come on an appeal of the NIA challenging the order of the Special NIA Court giving clean chit to the four.

The other three accused were Dhaijya Konwar, Bittu Sonowal and Manash Konwar, all of whom had got bail in the NIA case and were released from the jail.

Gogoi was the only one whose bail was rejected by the court and he was released after spending 567 days in jail once the Special NIA Judge Pranjal Das had cleared him along with the three others of all charges.

The NIA was investigating two cases of Gogoi related to anti-CAA violence. In one of those, the Special NIA Court had granted him bail, which was upheld by the Gauhati High Court too in April 2021 after the probe agency challenged it.

The RTI activist-cum-peasant leader continued to be in judicial custody as his bail was rejected in the second case related to anti-CAA violence and was being investigated by the NIA.

Later, the Special NIA Court on July 1, 2021 released Gogoi and his three associates for their alleged role in the violent anti-Citizenship (Amendment) Act stir in the state in December 2019 and observed there was nothing to indicate “talk of blockade” threatened the country’s economic security or was “a terrorist act.”

The NIA then moved the Gauhati High Court appealing to allow the agency to frame charges under various sections, including sedition, of the IPC and the Unlawful Activities (Prevention) Act, 1967.

In a strongly worded judgement, the Special NIA Court had said that in the interests of justice, it found the conduct and approach of the investigating authority in the case to be “discouraging”, to say the least.

“The court has high expectations from a premier investigating agency like the NIA, entrusted with the profoundly important task of protecting our country and us, citizens from the menace of terrorism.

“The court hopes and expects that, such high standards will be upheld, for sake of the country and this one will be just an exception,” the Special NIA Judge Pranjal Das had said in his order.

Gogoi, who contested as Independent from Sibsagar in 2021, became the first Assamese to win an election remaining behind the bars without any physical campaigning.

He also became the first in Assam Assembly to take oath on May 21, 2021 as a prisoner MLA, coming from jail on a special permission by the court.

NIA raids over 70 locations linked to Bishnoi, Bawana, other gangsters

    [ad_1]

New Delhi: The National Investigation Agency (NIA) on Tuesday conducted raids across the country at more than 70 locations belonging to gangsters Lawrence Bishnoi, Neeraj Bawana and their aides.

The raids were conducted in Delhi-NCR, Rajasthan, Haryana, Madhya Pradesh, Gujarat, Chandigarh and Uttar Pradesh.

An official said that in a major crackdown on gangsters, working in tandem with terrorist groups and drug smugglers based in foreign countries including Pakistan and Canada, the NIA conducted raids at 76 locations across eight states and seized a large cache of arms and ammunition and cash of Rs 2.5 crore.

The NIA officials said that the raids were conducted on the basis of the three separate FIRs lodged by them.

“Three cases have been registered by the NIA since August 2022 and several people, including some Kabbadi players were identified and booked for their alleged involvement in terror and other criminal activities, including targeted hits and extortion from leading businessmen and professionals,” an official said.

The investigation has revealed that conspiracies for several such crimes, including the sensational killing of Maharashtra builder, Sanjay Biyani, and Sandeep Nangal Ambia, an international Kabbadi player, were being hatched in jails of different states and were being executed by an organised network of operatives based abroad, the official added.

The official said the NIA conducted raids in connection with the matter for the fifth time.

The official said that raids were focused on arms suppliers and Hawala operators working with these gangs.

“We have recovered 9 illegal weapons, including pistols, revolvers and rifles, and Rs 1.5 crore in cash. Incriminating materials, including documents, hard drives and mobile phones, were also seized,” the official said.

The official said that searches were conducted at the premises of Lakhvir Singh of Gidderbaha at Muktsar, Naresh at Abohar, Surender a.k.a. Cheeku at Narnaul in Haryana, Kaushal Choudhary and Amit Dagar at Gurugram and Sunil Rathi at Baghpat, Uttar Pradesh.

The official said that apart from them, some Hawala operators, kabaddi players, weapon suppliers, gun houses, businessmen and their alleged financers, were also raided.

“The investigation has established that many criminals, who were leading gangsters in India, had later fled to Pakistan, Canada, Malaysia and Australia. But they were in touch with criminals lodged in different jails in India. These groups were carrying out targeted killings and raising funds for their nefarious activities through smuggling of drugs and weapons, hawala and extortion,” the NIA said.

Delhi HC seeks NIA stand on plea against PFI probe

    [ad_1]

New Delhi: The Delhi High Court on Tuesday sought the stand of the National Investigation Agency (NIA) on a plea seeking quashing of its probe against the banned Popular Front of India (PFI) in connection with an alleged criminal conspiracy to carry out terror activities in the country.

Justice Jasmeet Singh issued notice on the petition by arrested PFI leader Oma Salam and asked the agency to file its response.

While the judge remarked during the hearing that “there is no question of stay” in the matter, the counsel for the petitioner said he was “not pressing it” either.

The counsel for the petitioner argued he was assailing the NIA case on “legal grounds” as the probe was not as per the NIA Act.

He contended that the offences being probed by the NIA have to be first registered by the state government, which has not been done in the present case.

The petitioner’s counsel also said no report under section 173 Criminal Procedure Code should be filed by the NIA in the case on completion of the investigation.

The case, registered in April last year, pertains to an alleged criminal conspiracy hatched by people associated with the PFI to raise funds from within India and abroad for committing acts of terror in various parts of the country.

The NIA has alleged that the accused were conducting training camps to indoctrinate and train their cadres to carry out terrorist activities.

A large number of alleged PFI activists were detained or arrested in several states during the massive raids preceding the nationwide ban imposed on it on September 28, 2022.

In near-simultaneous raids across the country as part of a multi-agency operation spearheaded by the NIA, several PFI activists were detained or arrested in 11 states for allegedly supporting terror activities in the country.

The arrests were made in states and Union Territories, including Kerala, Maharashtra, Karnataka, Tamil Nadu, Assam, Uttar Pradesh, Andhra Pradesh, Madhya Pradesh, Puducherry, Delhi and Rajasthan.

The government banned the PFI and several of its associate organisations for five years under the stringent anti-terror law UAPA, accusing them of having links with global terror groups like the ISIS.

The matter will be heard next on July 11.
