    Kerala Muslim remarriage: Police step up vigil around couple’s house

    Kasaragod: Kerala police on Thursday said it intensified surveillance around the house of a Muslim lawyer, who remarried his wife under the Special Marriage Act to ensure their daughters’ financial security.

    The vigil has been stepped in the area of advocate-actor C Shukkur’s house in Kanhangad here in the wake of news reports on threats by some outfits against the man and his family, a senior police officer told PTI.

    Shukkur, on Wednesday, remarried his wife Sheena, the former Pro-Vice Chancellor of Mahatma Gandhi University, under the Special Marriage Act (SMA) in the presence of their three daughters at a Sub-Registrar’s office at Kanhangad in Hosdurg taluk.

    The couple decided to get remarried under the SMA as under the Muslim personal laws, which also govern inheritance of property, daughters will only get two-thirds of their father’s property and the rest will go to his brothers in the absence of a male heir.

    “As of now, there is nothing like personal protection. There is no full-time security for the family or the house. But, we have strengthened the vigil around the premises of their house,” the officer said.

    When asked whether there was any intelligence input on any possible attack against the advocate, he replied in the negative.

    “The media has extensively reported on the remarriage incident in the last two days. Today, some newspapers have carried reports about an alleged fatwa issued by certain religious institutions against the family,” he said.

    Though the state police have no first-hand information regarding the threat, a decision has been taken to intensify the surveillance in the area based on media reports, the officer added.

    The Muslim couple’s remarriage has received both criticism and approval on social media.

    A prominent Sunni higher education institute in Kerala had opined that the couple’s decision was an attempt to disrespect Muslim personal laws and Islam.

    It said that the remarriage was a “drama” and an indication of “narrow-minded thinking” that Shukkur’s brothers should not get the one-third share of his property after his death.

    While the institute was of the view that every believer would strongly oppose the couple’s decision, Shukkur had reacted to it on his Facebook page by saying that the educational institution would be responsible for any physical attack on him.

    A 47-year-old Muslim man was lynched to death by a Hindu mob who accused him and his nephew of carrying beef. The incident happened in Rasulpur of Chhapra district, Bihar on March 7.

    In a press release, police said that three people have been arrested and the hunt is on for the remaining accused.

    According to Maktoob Media, the deceased Naseeb Qureshi and his nephew Firoz Qureshi were returning home when they were attacked by a mob of 10-15 people.

    Arey yeh tho gaaye waale hai (Look! those are people who deal with cows),” Firoz told he heard one of them saying.

    Firoz managed to escape as he was sitting in the back of the vehicle. However, his uncle Naseeb came under the angry mob’s clutches and was attacked with sharp objects.

    “I saw a huge crowd from a distance. I got very scared about my uncle and ran to the police station for help. However, the officials just laughed at me and told me to go home,” Firoz narates.

    Later, he found out that his uncle was killed. Naseeb’s body was shifted to the Daroda Hospital, which was later referred to Siwan Sadar Hospital.

    “When I asked again, I was subjected to verbal abuse, including a threatening comment: “Those individuals did not harm you; you deserve to be harmed’,” Firoz Qureshi said as quoted by Maktoob Media.

    Three accused – Sushil Singh, Ravi Shah, and Ujjwal Sharma – all residents of Jogia of Rasulpur have been arrested. The police have registered a case under Section 302 (Punishment for murder), 379 (Punishment for theft) 34 (Acts done by several persons in furtherance of common intention) of the Indian Penal Code.

    Thiruvananthapuram: On International Women’s Day on March 8, a unique “marriage” will be seen in Kerala’s Kasargod district where a couple married for nearly 29 years will solemnise their union again – for sake of their three daughters.

    Present at the marriage at the Hosdurg sub-registrar office will be their three girls besides their family members and friends.

    C. Shukkur, an eminent lawyer from Kasargod, married Dr Sheena in October 1994 and their wedding was conducted by Indian Union Muslim League’s supreme leader Panakkad Syed Hyder Ali Shihab Thangal.

    However, the marriage was under the Sharia law and according to Muslim Personal Law, daughters get only two-thirds of the share of their father’s property, with the rest going to his brothers.

    The couple, in order to ensure that their hard-earned property should go to their children only, will marry again under the Special Marriage Act which states that the succession to the property of any person solemnised under it will be governed by the Indian Succession Act.

    Sheena is a former Pro-Vice Chancellor of the Kottayam-headquartered Mahatma Gandhi University.

    Bareilly: Maulana Shahabuddin Razvi Barelvi, president of All India Muslim Jamaat (AIMJ) and well-known Islamic scholar, has issued a fatwa that says Muslim women who wear ‘sindoor’, ‘kalava’ and ‘bindi’ after marrying non-Muslim youth, are going against the tenets of Islam.

    He said that Shariat does not allow women to wear symbols belonging to other religion.

    In a fatwa, the cleric said that women who follow such practices are actually not adhering to the Islamic way of life and can be ex-communicated.

    He said that Uttar Pradesh and several other states had adopted the anti-conversion law but incidents, where couples are marrying after concealing their religious identities, are still being reported and Muslim youth are largely being blamed for luring non-Muslim girls into marriage.

    “The Barelvi sect terms such marriages as illegal and null and void,” he said.

    Dr Mohd Naeem, a commoner, had put up a query in this regard to which the fatwa was issued.

    The cleric said, “It is seen on the social media that Muslim youth conceal their religious identity and can be seen sporting ’tilak’ and adopting Hindu names. This cannot be termed in accordance with Shariat and is illegal.”

    Citing the Quran, the Maulana said that it was clearly stated that one should not marry a non-Muslim till the time she does not adopt Islam.

    New Delhi: A Delhi court has granted bail to a man accused of murder during the 2020 North East Delhi riots, saying in the name of opposing the bail plea the prosecution tried to mislead the court as eyewitnesses did not establish his culpability.

    The court also asked the Commissioner of Police Sanjay Arora to sensitise all Investigating Officers (IOs) about their duty towards assisting the court in a fair manner.

    Additional Sessions Judge Pulastya Pramachala was hearing the bail plea of Rishabh Chaudhary in a case of rioting and alleged murder of a man called Mushraff, whose body was found in a drain near Johripur Pulia in Gokalpuri on February 27, 2020.

    According to the postmortem report, there were 12 external injuries on the body and the cause of death was injuries to the brain produced by blunt force impact.

    “…Cited eyewitnesses have been examined, but they did not establish the incident in question and the other two remaining witnesses did not claim having seen any person in the mob I find the applicant to be entitled to bail,” the judge said in an order passed on Friday.

    “Hence, the bail application is allowed and applicant Rishabh Chaudhary is admitted to bail on his furnishing personal bond and surety bond in the sum of Rs 30,000 each with one surety in the like amount,” the judge added.

    The judge said the statement of an eyewitness before the Investigating Officer (IO) identifying the accused had no evidentiary value and that the same witness in his testimony before the court categorically stated he had not identified anyone in the riotous mob.

    But the IO’s reply did not mention the witness’ statement before the court, the judge said.

    “It is well within the knowledge of the Special Public Prosecutor (SPP) and IO that statement under section 161 (examination of witnesses by police) of the code of criminal procedure (CrPC) cannot stand before the testimony given before the court and hence, the purpose of not mentioning the testimony of this witness given before the court appears to be nothing but to mislead this court ,” the judge said.

    The judge noted the submissions of the SPP that one of the prosecution witnesses had identified Chaudhary as a member of the riotous mob and that the IO had mentioned him in the reply.

    But in his testimony before the court, the other alleged eyewitness did not say anything about the incident which allegedly occurred on February 25 from around 7.30 pm to 8 pm, and which was being probed in the present case, the judge said.

    “Thus, I find that in the name of opposing bail application through a reply the prosecution has attempted to mislead the court rather than assisting in a fair manner to project the correct picture of the developments taking place in the case,” the judge said.

    He said any reply being filed by the IO or prosecution must be with the objective to assist the court and it was imperative to have a fair and transparent reporting of the facts.

    “If the reply is filed in a jealous manner, thereby suppressing the material facts, it cannot be said to be assistance to the court. Hence, I find that there is a requirement to sensitise all the IOs in respect of their duty towards the court, so as to assist in a fair manner, rather than adopting the practice of hide and seek,” the judge said.

    “Hence, once again I call upon the Commissioner of Police to do the needful for proper sensitisation of all the IOs in this respect,” the judge added.

    The Gokalpuri police station had registered an FIR against 12 accused, including Chaudhary for various offences under the Indian Penal Code, including rioting, murder, criminal conspiracy and kidnapping or abducting in order to murder.

    The other accused in the case are Lokesh Kumar Solanki, Pankaj Sharma, Sumit Chaudhary, Ankit Chaudhary, Prince, Jatin Sharma, Vivek Panchal, Himanshu Thakur, Sahil, Sandeep and Tinku Arora.

    In his bail plea, Chaudhary said he was arrested on the basis of the disclosure statement of the main accused Solanki but no recovery was effected from his possession and he was never related to Kattar Hindu Ekta’ WhatsApp group, directly or indirectly.

    Chaudhary’s counsel said the applicant is a student of graduation aged 22 years and no fruitful purpose would be served by keeping him in jail.

    The name of the WhatsApp group had surfaced in a supplementary charge sheet filed by the Delhi Police against nine accused, including Chaudhary, for the alleged murder of a man named Hashim Ali during the riots.

    According to the charge sheet, ‘Kattar Hindu Ekta’ group was created on February 25. Its alleged aim was to exact revenge for the troubles faced by Hindus and promote enmity between different groups on the ground of religion. It allegedly acted in a way which was prejudicial to maintenance of harmony.

    In the excerpts from the chats exchanged by the group filed in the charge sheet dated September 26, 2020, one of the members claimed RSS (Rashtriya Swayamsevak Sangh) activists had come to support them.

    Communal clashes had broken out in North East Delhi on February 24 between the supporters and opponents of the new citizenship law. The violence soon spiralled out of control leaving at least 53 people dead and around 200 injured.

    Hyderabad: Senior Congress leader Mohammed Shabbir Ali has called for an investigation into the recent confusion regarding the 4% quota for Muslims under the BC-E category in jobs and education in Telangana.

    Shabbir Ali stated that a one percent decrease in the Muslim BC-E reservation would have hurt the interests of thousands of poor Muslims.

    “A copy of Roster Point No 69 of General Rules showing a reduction in the 4% Muslim quota to 3% was circulated on social media in November 2022,” said Shabbir Ali.

    Congress party sought clarification from the state government regarding the reduction in the quota. In response, an unsigned rejoinder was sent to the media claiming that there was no change in the percentage.

    In her note issued on January 23, Chief Secretary A Shanti Kumari clarified that no changes had been made to the rules regarding the Muslim (BC-E Category). Roster Point Nos 19, 44, 69, and 94 pertain to the BC-E category (Muslim), which is 4% and remains unchanged.

    A few days later Telangana Home Minister Mahmood Ali went on record to say that the roster was morphed by some miscreants.

    “These clarifications are essential for the continuation of the 4% Muslim quota introduced by the previous Congress regime in 2004-05,” said Shabbir Ali.

    Congress party alleged that there was a larger conspiracy behind the confusion over the 4% Muslim BC-E quota. It said that the miscreants involved in spreading false rumors must be punished severely to maintain peace and order in Telangana.

    Shabbir Ali demanded that the state government register a proper FIR with the Cyber Crime cell to trace and punish the miscreants.

    AIMIM adopts 9-point resolution, condemns rise of Muslim, Dalit attacks

    Hyderabad: At the national convention here on Sunday, the All India Majlis-e-Ittehadul Muslimeen (AIMIM) adopted a nine-point resolution, including condemnation of the increasing number of hate crimes against Muslim and Dalit communities nationwide, opposing the Uniform Civil Code, and scrapping of Maulana Azad National Fellowship among others.

    Attack on Minorities and Dalits

    The resolution was moved by AIMIM national spokesperson Waris Pathan.

    Apart from condemning Muslim/Dalit attacks, AIMIM stated that there was a direct connection between the patronage given by the BJP governments, frequent hate speeches and targeted violence, thus creating an environment of fear and insecurity in the country.

    “BJP and Congress-led governments have repeatedly participated in “Dahram Sansads”, making genocidal calls against Muslims. State governments’ inaction against such sansads has emboldened criminal elements,” the resolution said.

    It also acknowledged increasing sexual violence on women, violence for merely riding a horse to a wedding, and a call for socio-economic boycotts.

    “AIMIM also condemns the silence and unwillingness of self-identifying secular parties to counter such hate speech and violence,” the resolution said.

    The resolution also spoke about the clamp down on Love Jihad, crime in the name of cow protection, anti-conversion law, compensation to the victims, and rehabilitation of their families, strengthening the implementation of SC/ST Act and protection from religious-based discrimination.

    Reservation of Muslims

    AIMIM’s second point was on the reservation of Muslims. It was moved by AIMIM Aurangabad MP and Maharashtra president Imtiaz Jaleel.

    The Centre and several state governments have time and again refused to provide reservations to Muslims in the field of education and public employment.

    “Other communities with similar (or lower) levels of deprivation continue to enjoy reservations while the same is denied to Muslims,” the AIMIM resolution stated.

    It asked the Centre to breach the 50% ceiling limit on reservations by introducing constitutional amendments.

    The resolution asked for sub-classification in the Central OBC list and ensure the most backward get the highest bracket of reservation.

    It also asked the Telangana government to increase the reservation of backward Muslim groups from 4 to 12 percent.

    Uniform Civil Code

    The resolution was moved by AIMIM national spokesperson Waris Pathan.

    AIMIM vehemently opposes the implementation of the Uniform Civil Code (UCC) and termed it as a disaster that strips away every culture and religious group’s right to preservation under Article 29 of the Indian Constitution.

    “A uniform civil code already exists in India in the form of various laws such as the Special Marriage Act, Indian Succession Act, Juvenile Justice Act, etc. If individuals wish to be subjected to personal laws they have the option to choose, marry, divorce and adopt under non-religious laws,” the resolution stated.

    Love Jihad/ Freedom of Religion

    The resolution was moved by AIMIM national spokesperson Asim Waqar.

    It recognizes Love Jihad and interference in the freedom of religion as draconian laws that are used to persecute Christians and Muslims.

    AIMIM called for the repeal of such laws that restricts a person to chose a spouse/partner of their choice.

    Waqf properties

    The resolution was passed by AIMIM Maharashtra working president Ghaffar Quadari.

    It states that Waqf properties have recently been subjected to encroachments across India. It acknowledged that apart from Central and state governments, existing provisions of the Waqf Act have failed to ensure the safety of the properties.

    I also urged the Centre to amend the Waqf Act 1995 and provide judicial powers, similar to the power provided in case to Hindu Religious and Charitable Endowments.

    Violating Secularism, Hindu Rashtra

    The resolution was moved by AIMIM GHMC corporator Sameena Begum.

    AIMIM condemns the repeated calling for the establishment of a Hindu Rashtra by several MLAs and MPs.

    “India was never a Hindu Rashtra and it will never be. India also respects those who have no religion or worship no deity. India must honour everyone with equal respect and dignity. No person must be forced to forfeit their religious identity or forced to accept a majoritarian supremacy,” the resolution stated.

    It also demanded Prime Minister Narendra Modi defend the Places of Worship Act, 1991 in the Supreme Court.

    Talking to Sangh Parivar

    The resolution was moved by AIMIM national spokesperson Waris Pathan.

    It recognized Sangh Parivar as an organization rooted in anti-Muslim hatred and the promotion of Hindu supremacy.

    “The Sangh Parivar does not believe in democracy, secularism or pluralism and instead promotes assimilation of diverse Indians rather than accepting its diversity,” the resolution stated.

    Educational Schemes

    The resolution was moved by AIMIM Maharashtra working president Gaffar Quadari

    AIMIM strongly condemns the scrapping of the Maulana Azad National Fellowship and Pre-matric scholarships for minorities, SC and ST students.

    “The discontinuation of these schemes and slashing of the budget of union Ministry of Minorities Affairs by 40% is a clear expression of the government’s anti-minority agenda,” the resolution stated.

    Civil Liberties

    The resolution was moved by AIMIM Bihar youth president and spokesperson Aadil Hasan.

    AIMIM also condemned draconian laws such as the Unlawful Activities (Prevention) Act (UAPA), Armed Forces (Special Powers) Act (AFSPA), National Security Act (NSA) and the Public Safety Act (PSA).

    “These laws have been repeatedly used against Muslims, Dalits, Adivasis and intellectuals. The government must prosecute and punish officials involved in false prosecutions under anti-terror laws, and complete compensation for the victim’s families,” the resolution stated.

    Bengaluru: Names of 9,159 Muslim voters in the Shivajinagar constituency in Bengaluru have been removed from the voters’ list. This removal is done based on a complaint filed by a private agency named Chilume which has links to the BJP. The complaint was filed on November 16, 2022, and the action was taken by the Election commission in January 2023.

    It is reported that the private agency, Chilume prepared a list of 26,000 voters after collecting the data illegally since October 2022 for the Shivajinagar constituency. The complaint filed to the Election Commission alleged that 26,000 fake voters are identified in the Shivajinagar constituency who have either shifted from that place or are dead.

    The Election Commission published the final electoral roll for the Shivajinagar constituency on January 15, 2023. This is when the BJP private agency swung into action with its voters list some eight days after the electoral roll was published. The private agency of the BJP went to the Election Commission demanding that the 26,000 names mentioned in the EC list should be removed.

    The EC officials immediately cross-checked all the 26,000 names and found that 9,159 had either shifted out of their old home addresses or were dead. Accordingly, EC asked the suspected voters to appear before the authorities.

    However, media reports say the suspected names that were deleted were all wrong and it verified with those who received the notices found them to be alive and living at the same old addresses.

    Congress MLA Rizwan Arshad has reportedly said, “Voters are getting harassed. Many people replied to the first notice, despite the that they have been issued a second notice asking them to appear before the EC. This process is to tire people out.. I don’t know why Shivajinagar was chosen for this experiment. Maybe because this is a safe seat for the Congress, the BJP wants to see if deletion can help them win the election.”

    Further, the MLA asked, “how a private group can do door-to-door electoral roll calls and create a voter list of its own is something that is a mystery? The alarming part is the quick response of the election commission to such a complaint.

    The move is being seen as a violation of Election Commission rules issued on September 13, 2021, that says no deletion to the electoral rolls can be done six months prior to the end of the term of the Assembly. (Karnataka assembly term ends in the last week of May).

    Rules mandate that Form 7 has to be filled if anyone wants to raise an objection and delete a name from the existing electoral roll. Did the BJP fill 26,000 Form 7s? The Electoral Registration Office confirmed that the BJP did not fill any Form 7. If they didn’t, why did the CEO’s office accept their complaint?

    Shivajinagar, which is in the heart of Bengaluru, has around 1.91 lakh voters, 40% of whom are Muslims. The constituency has been represented by a Congress MLA since 2008.

    Ridwana Wallace-Laher has made history becoming the first Muslim woman to be appointed the new Chief Executive Officer (CEO) of Wakefield-based Penny Appeal, the Muslim international humanitarian charity.

    Ridwana’s appointment comes after being part of the Penny Appeal team on and off for eight years.

    “I’m really pleased, these are exciting times and I feel like a trendsetter,” the former Co-op Academy Grange teacher told The Telegraph & Argus.

    Penny Appeal took to Twitter and wrote, “📣 Welcoming our new Chief Executive Officer, Ridwana Wallace-Laher @RizzWL 😊🍊”
