    leaked documents investigation 61067

One possibility is that the judge could order Teixeira to be confined at his father’s home while awaiting trial, if not held in jail. Under questioning at the hearing, his father, Jack Michael Teixeira, said he was aware that if his son were to violate conditions of release or home confinement, he’d have to report him. The elder Teixeira said he owns firearms but no longer has any in his home.

Nadine Pellegrini, chief of national security division in the Massachusetts U.S. attorney’s office, told the judge the information prosecutors submitted to the court about the defendant’s threatening words and behavior “is not speculation, it is not hyperbole, nor is it the creation of a caricature. It is based on what we know to date … directly based upon the words and actions of this defendant.”

Late Wednesday, the Air Force announced it suspended the commander of the 102nd Intelligence Support Squadron where Teixeira worked and the administrative commander “overseeing the support for the unit mobilized under federal orders,” pending further investigation. It also temporarily removed each leader’s access to classified systems and information.

Court papers urging a federal judge to keep Teixeira in custody detailed a troubling history going back to high school, where he was suspended when a classmate overheard him discussing Molotov cocktails and other weapons as well as racial threats. More recently, prosecutors said, he used his government computer to research past mass shootings and standoffs with federal agents.

He remains a grave threat to national security and a flight risk, prosecutors wrote, and investigators are still trying to determine whether he kept any physical or digital copies of classified information, including files that haven’t already surfaced publicly.

“There simply is no condition or combination of conditions that can ensure the Defendant will not further disclose additional information still in his knowledge or possession,” prosecutors wrote. “The damage the Defendant has already caused to the U.S. national security is immense. The damage the Defendant is still capable of causing is extraordinary.”

Teixeira has been in jail since his arrest earlier this month on charges stemming from the greatest known intelligence leak in years.

Teixeira has been charged under the Espionage Act with unauthorized retention and transmission of classified national defense information. He has not yet entered a plea.

His lawyers are urging the judge to release him from jail, arguing in court papers filed Thursday that appropriate conditions can be set even if the court finds him to be a flight risk — such as confinement at his father’s home and location monitoring.

The defense said Teixeira no longer has access to any top-secret information and accused prosecutors of providing “little more than speculation that a foreign adversary will seduce Mr. Teixeira and orchestrate his clandestine escape from the United States.”

“The government’s allegations … offer no support that Mr. Teixeira currently, or ever, intended any information purportedly to the private social media server to be widely disseminated,” they wrote. “Thus, its argument that Mr. Teixeira will continue to release information or destroy evidence if not detained rings hollow.”

He is accused of distributing highly classified documents about top national security issues in a chat room on Discord, a social media platform that started as a hangout for gamers. The leak stunned military officials, sparked an international uproar and raised fresh questions about America’s ability to safeguard its secrets.

The leaked documents appear to detail U.S. and NATO aid to Ukraine and U.S. intelligence assessments regarding U.S. allies that could strain ties with those nations. Some show real-time details from February and March of Ukraine’s and Russia’s battlefield positions and precise numbers of battlefield gear lost and newly flowing into Ukraine from its allies.

Prosecutors wrote that Teixeira, who owned multiple guns, repeatedly had “detailed and troubling discussions about violence and murder” on the platform where authorities say he shared the documents. In February, he told another person that he was tempted to make a minivan into an “assassination van,” prosecutors wrote.

The Justice Department’s filing outlines a pattern of troubling behavior that officials say began well before he entered the military and continued in recent months, even as his position afforded him access to government secrets.

In 2018, prosecutors allege, Teixeira was suspended after a classmate “overheard him make remarks about weapons, including Molotov cocktails, guns at the school, and racial threats.” His initial application for a firearms identification card that same year was denied due to police department concerns over those remarks.

He applied again over the next two years, and cited in his 2020 application after joining the Guard “his position of trust in the United States government as a reason he could be trusted to possess a firearm,” prosecutors wrote.

The Justice Department said that it has also learned through its investigation that Teixeira in July used his government computer to look up a series of U.S. mass shootings and government standoffs, including the terms “Ruby Ridge,” “Las Vegas shooting,” “Mandalay Bay shooting,” “Uvalde” and “Buffalo tops shooting” — an apparent reference to the 2022 racist mass shooting at a Buffalo supermarket.

The searches of mass shootings on a government computer should have triggered the computer to generate an immediate referral to security, which could have then led to a more in-depth review of Teixeira’s file, according to Dan Meyer, a lawyer who specializes in military, federal employment and security clearance issues. The Air Force’s investigation will probably discover whether a referral was generated — and whether security officers did anything with the information.

Teixeira’s lawyers noted that he has no criminal history and would have no access to guns if he was released. The incident at his high school was “thoroughly investigated” and he was allowed to come back after a few days and a professional psychological evaluation, they wrote. That investigation was “fully known and vetted ” by the Air National Guard before he enlisted and when he obtained his top secret security clearance, they said.

Months later, after news outlets began reporting on the documents leak, Teixeira took steps to destroy evidence after news outlets began reporting on the documents leak. Authorities who searched a dumpster at his home found a smashed laptop, tablet and Xbox gaming console, they said.

Authorities have not alleged a motive. Members of the Discord group have described Teixeira as someone looking to show off, rather than being motivated by a desire to inform the public about U.S. military operations or to influence American policy.

Billing records the FBI obtained from Discord were among the things that led authorities to Teixeira, who enlisted in the Air National Guard in September 2019. A Discord user told the FBI that a username linked to Teixeira began posting what appeared to be classified information roughly in December.

Teixeira was detected on April 6 — the day The New York Times first published a story about the breach of documents — searching for the word “leak” in a classified system, according to court papers. The FBI says that was reason to believe Teixeira was trying to find information about the investigation into who was responsible for the leaks.

Owaisi slams Nitish Kumar govt over release of murder convict Anand Mohan

    [ad_1]

Hyderabad: Slamming the Nitish Kumar government for release of former MP Anand Mohan Singh who was convicted for his role in the murder of IAS officer G Krishnaiah in Bihar, AIMIM president Asaduddin Owaisi on Thursday demanded that the State government withdraw its decision.

He asked whether Bihar Chief Minister Nitish Kumar, who is visiting other States in the country claiming himself to be the Prime Ministerial candidate, would give the message that his government has released a man who is convicted for the murder of a Dalit officer. Krishnaiah hailed from Telangana.

Gangster-turned-politician Anand Mohan Singh, who was serving a life sentence, was released from Saharsa jail in Bihar today after being behind the bars for 15 years.

    MS Education Academy

Owasi described the Bihar government’s decision to release Singh as the murder of Krishnaiah for the “second time”.

It is regrettable that the IAS Officers’ Association in Bihar is silent on the issue, Owaisi said while addressing mediapersons here.

He asked as to why the prison rules have been amended to release one person.

The AIMIM president said he hopes that Nitish Kumar who used to claim that he would not compromise on corruption and criminal justice would rethink on his decision.

Owaisi said a wrong message is being given to the weaker sections, especially Dalits, and to public servants in the State with the government’s move. “We demand that the Bihar government withdraw its decision,” he said.

The government’s decision shows that the parties in power release such people from prisons for their political benefit whether it is BJP government in Gujarat or Nitish Kumar government in Bihar, he claimed.

Saying that Krishnaiah’s wife stands alone today seeking justice for the murder of her husband, he said where is the social justice that Nitish Kumar and RJD talk about.

When asked that no major political party in Bihar appears to be voicing opposition to the move, he alleged that the upper caste MPs in BJP are not opening their mouth. “What was done in the case of Bilkis Bano, you have done the same thing here by letting off the killers of Krishnaiah,” he said.

Singh was released under a jail sentence remission order after the State government’s recent amendment of prison rules which allowed the early release of 27 convicts, including him.

The former MP was convicted for his role in the 1994 murder of the then Gopalganj Collector Krishnaiah during the funeral procession of Muzaffarpur gangster Chotan Shukla.

Owaisi said he would visit Uttar Pradesh in connection with the local body polls where his party is contesting.

Telangana HC cancels bail of key accused in Viveka murder case

    [ad_1]

Hyderabad: The Telangana High Court on Thursday cancelled the bail of Yerra Gangi Reddy, the prime accused in the murder case of former Andhra Pradesh minister Y.S. Vivekananda Reddy.

It directed him to surrender before the Central Bureau of Investigation (CBI) court by May 5.

The court also clarified that if the accused failed to surrender, the CBI may arrest him.

    MS Education Academy

It ruled that as the CBI is scheduled to complete the hearing on June 30, Gangi Reddy may be granted bail on July 1 on a personal bond of Rs 1.50 lakhs.

The Supreme Court had recently extended the deadline for completing the investigation into the sensational case till June 30.

The CBI sought the cancellation of the bail on the ground that Gangi Reddy is the main accused and has been influencing key witnesses in the case.

The probe agency’s counsel had argued that Gangi Reddy is having political backing and is trying to put pressure on the witnesses through his connections.

The Special Investigation Team (SIT) of the Andhra Pradesh Police, which was then investigating the murder case, arrested Gangi Reddy on March 28, 2019.

Gangi Reddy was granted default bail by a local court at Pulivendula on June 27, 2019, as the SIT had failed to file charge sheet in the specified period.

After the CBI took over the investigation and filed its charge sheet, it had approached the court to cancel his bail. The court had dismissed the CBI petition. Later, the Andhra Pradesh High Court also upheld the decision of the lower court.

Subsequently, the CBI had approached the Supreme Court, challenging the order of the High Court.

The Supreme Court in November last year transferred the trial in the murder case from Andhra Pradesh to CBI court in Hyderabad.

Consequent to this, the apex court asked the CBI to approach the Telangana High Court for cancellation of bail of Gangi Reddy.

Vivekananda Reddy, brother of former Chief Minister Y.S. Rajasekhara Reddy, was murdered at his residence in Pulivendula of Kadapa district on March 15, 2019, weeks before elections.

The 68-year-old was alone at his house when unidentified persons barged in and killed him.

The CBI took over the investigation into the case in 2020 on the direction of Andhra Pradesh High Court while hearing a petition of Vivekananda Reddy’s daughter Suneetha Reddy, who raised suspicion about some relatives.

The Supreme Court transferred the case to Hyderabad while observing that doubts raised by Suneetha Reddy about getting a fair trial and investigation in Andhra Pradesh were reasonable.

Viveka murder case: Telangana HC completes hearing on CBI plea

    [ad_1]

Hyderabad: The Telangana High Court posted Thursday orders on the CBI petition to cancel the bail of Yerra Gangi Reddy, the main accused in former Andhra Pradesh Minister Y.S. Vivekananda Reddy’s murder case.

The court completed a hearing on the petition filed by the Central Bureau of Investigation (CBI) and adjourned the case to Thursday for judgement.

The judgement is eagerly awaited as the CBI investigation in the case has entered a crucial phase.

The CBI sought the cancellation of the bail on the ground that Gangi Reddy is the main accused and has been influencing key witnesses in the case.

During the previous hearing, the CBI counsel had argued that Gangi Reddy is having political backing and is trying to put pressure on the witnesses through his connections.

Justice D. Ramesh had asked the CBI to submit some evidence that Gangi Reddy is influencing witnesses.

The Special Investigation Team (SIT) of Andhra Pradesh police, which was then investigating the murder case, arrested Gangi Reddy on March 28, 2019

Gangi Reddy was granted default bail by a local court at Pulivendula in October 2021 on technical grounds as the CBI failed to file the charge sheet within 90 days of registering the FIR. Later, the Andhra Pradesh High Court also upheld the decision of the lower court.

The CBI had approached the Supreme Court, challenging the order of the High Court.

Hyderabad: The Central Bureau of Investigation (CBI) on Monday completed questioning of Kadapa MP Y.S. Avinash Reddy’s father Y.S. Bhaskar Reddy and their follower Uday Kumar Reddy in former minister Y.S. Vivekananda Reddy’s murder case.

After six days of questioning, the CBI presented the two before a court and they were later shifted back to Chanchalguda Jail.

The CBI court had sent them to six-day custody of the central agency last week.

The agency last week also questioned Rajasekhar Reddy, husband of Vivekananda Reddy’s daughter Suneetha Reddy.

Meanwhile, the Supreme Court on Monday set aside the Telangana High Court granting protection to Kadapa MP Avinash Reddy from arrest till April 25.

The apex court pronounced the order on Suneetha Reddy’s petition. A bench comprising Chief Justice D.Y. Chandrachud and Justice P.S. Narasimha also extended the deadline for completing the investigation into the case till June 30.

The Supreme Court had earlier fixed April 30 as the deadline for the CBI.

Avinash Reddy, cousin of Andhra Pradesh Chief Minister Y.S. Jagan Mohan Redddy, appeared before the CBI as per the interim order of the Telangana High Court on his anticipatory bail petition.

  • Karnataka: SDPI fields Ismail Shafi Bellare, accused in BJP leader’s murder

Karnataka: SDPI fields Ismail Shafi Bellare, accused in BJP leader’s murder

    [ad_1]

Bengaluru: The move by the Social Democratic Party of India (SDPI) to field Ismail Shafi Bellare, accused in the murder of BJP Yuva Morcha leader Praveen Kumar Nettaru, and Riyaz Farangipet as its candidates in the communally-sensitive Dakshina Kannada district has become a topic of discussion in Karnataka ahead of the May 10 Assembly elections.

Nettaru (32) was hacked to death by bike-borne assailants on the night of July 26 last year at Bellare in Dakshina Kannada district.

SDPI is fielding 19 candidates for the upcoming Assembly elections. Dubbed as a party of minorities, SDPI hopes to win four to five seats and make entry into the Karnataka legislature. According to sources, SDPI is likely to give a tough fight to former minister and senior Congress leader U.T. Khader in the Mangaluru (Ullal) Assembly constituency.

    MS Education Academy

The party emphasizes on ‘agitative politics’.

Talking to IANS, SDPI’s national secretary Riyaz Farangipet said that his party is not just active during elections, but throughout the year it represents the people on one issue or the other across India.

“Despite not being in power, SDPI ensures that the schemes of the government reaches the poor,” he said.

Other political parties which have opened online help centres are charging money for their services, but SDPI is doing it for free, he said.

“We are not power hungry. We want to be part of power. That is why we are focusing only on those constituencies where we can win,” said Farangipet, who is contesting from the Mangaluru (Ullal) Assembly constituency.

Ismail Shafi Bellare, who’s presently lodged in jail in connection with Nettaru’s murder, is contesting from the Puttur Assembly seat. The decision of the SDPI to field a candidate accused of murder has made national headlines. Even Farangipet has faced sedition charges and his movements are being closely watched by the National Investigation Agency (NIA).

According to sources, the SDPI has fielded a formidable candidate in the form of Farangipet to wrest the Mangaluru seat from the Congress. The constituency is considered as a Congress bastion.

Farangipet was accused of hatching a conspiracy to attack Prime Minister Narendra Modi in the Phulwari Sharif area in Bihar on July 12, 2022. A probe reportedly revealed his links with the accused persons. Even the NIA had filed an FIR against Farangipet, who allegededly took part in meetings with the accused persons.

There are also other cases lodged against him in Belthangady, Mangaluru South, Konaje, and Mangaluru North in Dakshina Kannada district. He is facing charges of creating enmity between groups, and obstructing the duty of policemen.

Farangipet had taken out a huge rally to file his nomination for the Mangaluru constituency. Sources said that the SDPI is aggressively campaigning against Congress candidate Khader in the wake of the hijab controversy and the boycott call on Muslim traders.

Khader has won from this constituency three times since 2008 by defeating BJP candidates. In 2018, Khader defeated Santhosh Kumar Rai Boliyaru of the BJP by more than 19,000 votes. The BJP had won this seat three consecutive times between 1994 and 2004.

Khader, known as a progressive leader, is facing stiff competition from the SDPI this time in the Muslim-dominated constituency. It was the only constituency that the Congress won in Dakshina Kannada district in 2018, as all the other seats were swept by the BJP.

Reacting to the sedition charges against him, Farangipet said, “Cases are always lodged against people who take up big agitations. We can see IPS officer Sanjeev Bhat being jailed. Our Prime Ministers and Chief Ministers have gone to jail. I will fight the cases lodged against me in the court.”

When asked about Nettare murder accused Shafi Bellare, he said that his arrest was pre-planned.

Bellare and his brother Iqbal Bellare have been arrested due to the pressure put by the Sangh Parivar, he claimed.

“We will question his arrest in the court,” Farangipet said.

Bellare was chosen as an SDPI candidate at the screening committee meeting before Nettare’s murder, but the announcement was pending, Farangipet claimed, adding that contesting elections from prison is not new in India.

“SDPI has created its own vote bank. If Bellare is elected, he will be the voice of the exploited and downtrodden, otherwise he will continue with his social work,” Farangipet said.

Atiq Ahmed lawyer booked for criminal conspiracy in Umesh Pal murder case

    [ad_1]

Prayagraj: Gangster-politician Atiq Ahmed’s lawyer Khan Shoulat Hanif has been booked for criminal conspiracy in the Umesh Pal murder case, an official said on Saturday.

Speaking to PTI, Deputy Commissioner of Police (City) Deepak Bhukar said Hanif’s name was added under Section 120-B (criminal conspiracy) of the Indian Penal Code to the FIR registered at Dhoomanganj police station in the Umesh Pal murder case.

“We came to know that Hanif shared pictures of Umesh Pal with Ahmed’s son Asad days before he was attacked,” Bhukar told PTI.

    MS Education Academy

Asad, the third of Ahmed’s five sons, was killed in a police encounter in Jhansi on April 13.

Sources said the police might soon file a remand application in court to interrogate Hanif, who is currently lodged in Naini Central Prison after being sentenced to life imprisonment in the Umesh Pal kidnapping case.

Umesh Pal, a key witness in the murder of BSP MLA Raju Pal, and his two security personnel were shot dead on February 24.

On February 25, the police registered a case against Ahmed, his brother Ashraf, wife Shaista Parveen, two sons, aides Guddu Muslim and Ghulam, and nine other accomplices at Dhoomanganj police station.

A special court here on March 28 convicted Ahmed, Hanif and Dinesh Pasi and sentenced them to life in prison in the 17-year-old kidnapping case.

Hanif and Pasi were detained in Naini Central Prison while Ahmed was sent to Sabarmati Central Jail in Gujarat’s Ahmedabad.

Ahmed, a former Samajwadi Party MP, and Ashraf were shot dead on April 15 by three assailants when they were being taken by the police for a medical examination. They were brought here in connection with the Umesh Pal murder case.
