    Kochi: The 93-year-old mother of superstar Mammootty, Fathima Ismail, passed away at a private hospital in the wee hours of Friday.

    She was suffering from age-related illness.

    She is survived by the superstar and his five siblings.

    Ismail was known for her the lady-next-door image and was popular in her village, Chembu, near Kochi.

    The last rites would be held in the evening at Chembu Muslim Jamath Mosque.

    New Delhi: The Supreme Court on Thursday observed that in heterosexual couples, a child may see domestic violence – a father becoming an alcoholic, thrashing the mother, and asking her for money as it questioned the arguments that two spouses, who belong to a binary gender, are essential for marriage.

    Senior advocate K.V. Viswanathan, representing Zainab Patel, submitted before a five-judge bench headed by Chief Justice of India D.Y. Chandrachud that it is incorrect to say that gay, lesbian, and same-sex couples do not provide the children safety, security, and the upbringing they require.

    “Long back in our country, the law was all that is required is the welfare of the child… if that is applied then it does not matter whether it is a heterosexual couple and homosexual couple,” he said, also cited findings based on evidence that they are as suited as heterosexual couple to bring up children.

    The Chief Justice said: “Mr Viswanathan, what happens when there is a heterosexual couple and child sees domestic violence… will that child grow up in normal atmosphere, of a father becoming an alcoholic and coming back home and thrashing the mother every night and asking for money for alcohol, so much for heterosexual couple, there no absolutes, as I said.”

    Making a passing reference to the bench being trolled on social media for various oral observations, the Chief Justice added: “Even at risk of getting trolled. Now this has become the name of the game for judges to confront, answers to what we say in the court are in the trolls, not in the court.”

    Viswanathan submitted that the Centre, in its counter-affidavit, has stressed the importance of procreation, and argued that as people in a same sex marriage cannot procreate, they need not be granted the right to marry. In response, he submitted that even many heterosexual females above the age 45 years may not be able to safely become pregnant, but are still allowed to marry, therefore, procreation cannot be a ground to deny the right to marry.

    The bench – also comprising Justices Sanjay Kishan Kaul, S. Ravindra Bhat, Hima Kohli, and, P.S. Narasimha – orally observed that heterosexual couples now with the spread of education, the pressures of the modern age, increasingly, couples are either childless or single child couples.

    The bench further observed: “As per us to redefine the evolving notion of marriage, is existence of two spouses who belong to a binary gender is necessary or the requirement for a relationship of marriage, or the law has now progressed sufficiently to contemplate the existence of binary genders may be not necessary for your definition of marriage.”

    Earlier during the day, senior advocate Abhishek Manu Singhvi, representing some of the petitioners seeking legal sanction for same-sex marriage, submitted that personal laws in the country “don’t discriminate” unlike the Special Marriage Act of 1954, while arguing against the mandatory 30-day notice period in it.

    He added that the period allows interference from khap panchayats and others opposed to such marriages and that it should not exist for heterosexual couples as well.

    The Chief Justice orally observed: “To put it bluntly, is the relationship between a man and a woman so fundamental to our law therefore, the Special Marriage Act… that for us to comprehend that it will also include a relationship between same-sex couples.”

    The bench queried Singhvi if his argument is that the institution of marriage in itself is so very important that denying it to same-sex couples, would be contrary to fundamental constitutional values?

    It asked that in a heterosexual relationship, there is a rape, then how in a homosexual relationship, will the same principle apply? And, if a marriage is registered, then there will be nuances which will arise, and can we take care of all future eventualities?

    Singhvi that there is a flip side, marital rape is not recognized in this country and it is an issue pending, and today, rape is not a recognized crime within marriage, it may be a ground for divorce or cruelty. To this, the bench asked if law which applies on a heterosexual relationship will equally apply on homosexual relationships.

    He submitted that their hope is not to be condemned to live in loneliness, excluded from one of civilisations, and they ask for equal dignity in the eyes of the law and the Constitution grants them that right.

    Some petitioners have challenged the provisions of the Special Marriage Act, 1954 which require parties intending marriage to give advance notice of 30 days, which will be published in the registrar’s office inviting public objections. Petitioners, seeking recognition for same-sex marriage, challenged these provisions and termed them as violative of fundamental rights to privacy. The petitioners claim that the ‘notice and objections’ regime exposes couples who enter into non-traditional marriages to threats and violence from families and vigilante groups.

    The bench will continue to hear the matter next week.

    The top court is hearing a batch of petitions challenging certain provisions of the Hindu Marriage Act, Foreign Marriage Act and the Special Marriage Act and other marriage laws, as unconstitutional on the ground that they deny same sex couples the right to marry or alternatively to read these provisions broadly so as to include same sex marriage.

    Jammu: A local court has awarded death penalty to a 45-year-old man for beheading his mother in 2014 over a piece of land in Udhampur district of Jammu and Kashmir.

    “The offence of murder committed by the convict seems to be pre-meditated one. The convict has committed the offence of murder upon the old defenceless mother by first attacking her with a sickle on the neck and thereafter chopping off her head with an axe in a very inhuman and barbaric manner,” Principal Sessions Judge, Udhampur, Haq Nawaz Zargar said in his judgement on Saturday.

    Jeet Singh, a resident of Ramnagar, murdered his mother Vaishno Devi on December 7, 2014 at their house. He also tried to kill his wife Santosh Devi when she tried to come to the rescue of her mother-in-law.

    The convict was demanding land rights from the deceased besides asking her to reside with the other son Mulakh Raj.

    “The convict had also attempted to kill his wife when she intervened and tried to save the deceased from the brutal attacks of the convict. Had the wife stayed there or the sickle had not dropped from the hand of the convict, he would have definitely killed his wife also,” the judge said.

    “This case falls within the ambit of rarest of rare cases and therefore, accused Jeet Singh does not deserve any leniency in the sentences to be awarded to him except sending the convict to gallows would be adequate”, the judge said.

    Besides the death sentence, the court also sentenced Singh to 10 years rigorous imprisonment and a fine of Rs 3,000 for attempt to murder, three years rigorous imprisonment of three years and fine of Rs 2,000 under Arms Act but said all the sentences shall run concurrently.

    SRINAGAR: A local court in Jammu and Kashmir’s Udhampur has awarded a death sentence to a man who brutally killed his mother for two kanals of land, and termed the crime as the gravest case of breach of trust.

    As per case details), Principal Sessions Judge Udhampur Haq Nawaz Zargar awarded the death sentence to Jeet Singh, son of Krishan Singh, caste Thakur, resident of Rassain Tehsil Ramnagar, for killing his mother Vaishno Devi, in 2014.

    The court observed that the convict was in full senses when he killed his mother with an axe for two kanals of land. “It was the gravest case of breach of trust where crime has been committed in a most brutal manner by the convict and the deceased was none other than the one who had given birth to the convict,” the judge said.

    It is clear that the instant crime has been committed for the reason that the convict was demanding two kanals of land from the deceased besides asking her to reside with the other son Mulakh Raj, the court said, adding, “These crimes besides being antisocial shake the very conscience of society where the relation of mothers are taken on the highest pedestal on the moral as well as religious grounds,” the court observed.

    The court observed, “Killing one’s own mother is the most sacrilegious act and it definitely hits the very existence of humanity where the mothers are being recognized none less than God for having been blessed with the capacity to conceive and to give birth to the young ones, symbolizing the power of God of creating this universe and furthermore, plays a pivotal role in shaping the future of her kids, who, being the first teacher of the child.”

    It is to be noted here that the convict had also attempted to kill his wife when she intervened and tried to save the deceased from the brutal attacks of the convict.

    The court further observed that in the instant case, the convict Jeet Singh has been convicted under section 302, 307 RPC and 4/25 Arms Act. “This court hardly finds any mitigating circumstance in favour of the convict. In view of the discussion made herein above and on the facts and circumstances of the case, the convict namely Jeet Singh has been awarded rigorous imprisonment for 10 years and a fine of Rs. 3000 for the commission of offence under section 307 RPC.”

    “The convict (shall be) sentenced to death for the commission of offence under section 302 RPC and he shall be hanged by the neck till he is dead and for the commission of offence under section 4/25 Arms Act, the convict is sentenced to undergo rigorous imprisonment of 03 years and fine of Rs 2000),” the judgment reads. “In case of failure to pay the fine, he shall further undergo rigorous imprisonment for one month. All the sentences shall run concurrently.”

    As per the prosecution story, on December 7, 2014, at about 5:30, information was received at the Police Station from reliable sources that accused Jeet Singh murdered his mother Vaishno Devi at his house and when his wife Santosh Devi tried to rescue her, the accused also made a murderous assault upon her due to which she got seriously injured.

    On the said information, police station Ramnagar registered a case vide FIR No.125/2014 for the commission of offences under sections 302/307 RPC and the investigation was ensued by SHO Deepak Pathania .(KNO)

    On the said information, police station Ramnagar registered a case vide FIR No.125/2014 for the commission of offences under sections 302/307 RPC and the investigation was ensued by SHO Deepak Pathania.

    Bhubaneswar: BJP national spokesperson Sambit Patra Tuesday walked on burning coal at the ongoing Jhamu Jatra in Puri district of Odisha.

    He walked about 10 m on burning coal bed.

    Later, Patra tweeted, “Today, I participated in the pilgrimage of Rebati Raman village of Samang panchayat in Puri district, worshiped my mother by walking on fire and took her blessings and wished the villagers happiness and prosperity.

    “In this pilgrimage, I am feeling blessed by walking on the fire and receiving the blessings of the Mother,” Patra said adding a reflection of this tradition is in the Jak and Jhamu Yatra.

    Speaking to reporters, the senior BJP said he had performed the task of walking on fire for the welfare of the people and peace in the area.

    Patra also attached a video footage showing him walking on the fire bed surrounded by villagers.

    Patra had contested from Puri Lok Sabha constituency in the 2019 Lok Sabha poll. But he lost to Pinaki Mishra of BJD by a margin of 10,000 votes.

    According to tradition, Jhamu Jatra is a penance and devotees inflict pain on themselves by walking on fire or piercing nails their bodies to appease the Mother Goddess for the fulfillment of desires.

    SRINAGAR: A son has allegedly killed his mother in Sopore area in north Kashmir’s Baramulla district, reports and officials said.

    Reports reaching the news agency GNS said that a youth strangulated his mother to death in Dangarpora village in Sopore area on intervening Wednesday and Thursday night.

    Confirming the unfortunate incident, a senior police officer told GNS that they have launched a large-scale manhunt to nab the accused.

    “We are looking into all possible angles regarding the incident”, the officer said adding, “Once any further details are available, same will be shared accordingly.” (GNS)

    Police sources said that the police have arrested the culprit and shifted the body to District Hospital Sopore for postmortem.

    Kochi: The mother of a 12-year-old girl has filed a petition before the Kerala High Court alleging that her daughter was used as a “drug carrier” by drug mafia and sought a CBI probe into the matter.

    In her plea, she said her daughter’s involvement with drug trade came to light when she was called to her school after her daughter was found in school washroom in an inebriated state with fully wet uniform and she was told that her daughter informed that someone made her smell a white powder and that she vomited four times.

    Her plea also points out that the authorities informed the matter either to the police or to Child line, the agency which monitors children.

    According to her daughter, she was first introduced to drugs by a fellow student during Kabbadi practice in October last year.

    Later she fell into the hands of few men and she was taught to make blade-cut injuries on the wrist to put MDMA for intoxication.

    The plea further submitted that at the police station, the child explained the entire incident to the police and lodged a complaint.

    Adhinan, an influential man who was allegedly behind this, was subsequently summoned to the police station and even though he was questioned, police colluded with him and recorded a false statement limited to the allegation that he touched the girl’s hand, the mother said.

    She further contended that Chief Minister Pinarayi Vijayan allegedly made statements exonerating the accused during a debate in the Assembly, terming the media reports of the drug mafia case as fake.
