    Could trouble for Adani trip up Narendra Modi?

    Gautam Adani is a hard man to avoid in India. Whether it’s electricity, ports, power plants, coalmines, airports, cement, solar panels, apples, edible oils, storage of data or grains or even a television news channel, the colossal empire of India’s most powerful billionaire has reached into almost every corner of Indian life.

    According to Adani, his staggering rise from a nondescript diamond merchant in Gujarat to Asia’s richest man – whose wealth at one stage surpassed Jeff Bezos – and with whom much of India’s future development has been entrusted, is due only to “hard work, hard work, hard work”. His own successes, he has said, are the successes of the “India growth story”.

    Yet, as many have pointed out, Adani’s meteoric rise has mirrored that of another powerful man from Gujarat: Narendra Modi, who has been prime minister since 2014. In the past five years, the Adani Group, a sprawling conglomerate of companies, rose in value by 2,500%, with a private sector monopoly on everything from electricity to coal, and Adani’s net worth touched $127bn. That was, until two weeks ago.

    It was a bombshell report by a US-based investment research firm Hindenburg that that has brought much of the Adani empire crashing down to earth. In a highly detailed document that took two years to research, Hindenburg said Adani was pulling off the “largest corporate con in history” through stock manipulation, eye-watering levels of debt and secret offshore accounts.

    The Adani Group hit back, denying all the allegations as baseless in a response that stretched to 413 pages. It said the report was an “attack on India itself” and that its debt levels conformed to industry standards.

    The impact continues to reverberate through the domestic and international markets. The Adani Group has lost over $100bn in market value, been forced to cancel a major share offering and its stocks continue to fall, while Adani himself dropped off list of the world’s top 20 richest men. But given the well-documented close relationship between Adani and the Modi, who has himself been dogged by allegations of indulging in crony capitalism, the repercussions have also reached into the political sphere.

    Modi has been silent on all questions about his ties to Adani. Attempts by the opposition parties to get the matter debated in parliament have been shut down, causing the parliament session to be suspended for two days, and the government has refused to entertain demands for a supreme court investigation into the alleged fraud. Over 200 members of the opposition Congress party were arrested for holding protests outside offices which has stakes in the conglomerate.

    After Congress party leader Rahul Gandhi stood up in parliament with photos of Modi and Adani on a plane together and accused the government of giving Adani preferential treatment, all of his remarks were ordered to be expunged from parliamentary record.

    Speaking on Tuesday, home minister Amit Shah said the government had “nothing to hide or be afraid of” on the controversy over Adani Group.

    A shared vision, a shared rise

    The relationship between Modi and Adani dates back more than two decades to 2002. As chief minister of Gujarat, Modi’s close links with big industrialists like Adani helped him reinvent himself as the pro-business face of modern economic progress, while Adani was granted highly beneficial concessions on tax and regulation in the state that allowed his wealth and stature to grow exponentially.

    “Adani’s astounding, debt-fuelled rise mixed entrepreneurial dynamism, extravagant risk taking and canny political connections,” said James Crabtree, author of The Billionaire Raj.

    After Modi won the 2014 general election, he flew back to Delhi on Adani’s plane, captured in a now iconic photo of him in front of the Adani logo. Adani also became a regular companion on Modi’s international trips, sometimes officially as part of a business delegation but other times unofficially, and, according to a 2015 report, was present during Modi’s visits to the United States, Australia, Brazil, Japan, France and Canada.

    Adani has repeatedly denied that his longstanding connection with the prime minister has led to preferential treatment, as has the Indian government. Yet it has been evident that much of Modi’s vision for the development of India, particularly his infrastructure and energy ambitions, have been placed in the hands of the Adani Group, even as accusations of tax evasion, over-valuation and heavy debt swirled for years. The industrialist’s personal wealth went from $2.8bn in 2014 to $127bn by the end of 2022.

    Over the past decade, the Adani Group won an endlessly expanding list of nationally significant projects. It now owns a string of strategic ports along India’s coast that handle about 30% of all India’s international freight and been able to acquire some of India’s most valuable tracts of land, be it Dharavi slum in Mumbai for redevelopment or the ancient Hasdeo Arand forest in Chhattisgarh for coal mining. Many of their projects face ongoing protests for causing environmental devastation or displacing communities.

    Modi stands accused of helping Adani secure lucrative deals for coal and renewable energy projects in neighbouring Sri Lanka and Bangladesh. India’s ongoing commitment to coal has also been linked to the Adani group’s mammoth investment in India’s coal sector. “It’s interesting how the bigger Adani got in coal mining in India, the less momentum towards decarbonisation the Indian government seemed to be pursuing,” said Tim Buckley, a Sydney-based energy finance consultant.

    The powerful connections wielded by the Adani Group have also appear to enable them to get projects done quicker than most, often sidestepping the entangled bureaucratic systems and regulations of India. On more than one occasion, legislation and regulations were amended or weakened to allow Adani to enter into new sectors or gain a significant tax advantage, including rules being changed so he could take ownership of six airports in Maharastra, India’s second busiest in Mumbai among them. The group denied any wrongdoing.

    The activities of the group also became notoriously difficult to scrutinise, with journalists and news companies who reported critically on Adani slapped with lawsuits. After Adani recently pulled off a stealth take-over of India’s popular TV news channel NDTV, which had been seen as one of the last remaining bastions of mainstream independent journalism, the space for critical reporting on the Adani empire appeared to shrink further.

    Paranjoy Guha Thakurta, one of the few journalists who produced critical reports on the Adani businesses, is currently subject to six defamation suits brought by the Adani Group and a gag order from the court. “No one else has built a corporate empire so vast, sprawling, diversified and dominant in so many sectors of the Indian economy than Mr Adani,” said Thakurta, who said he felt “vindicated” after the Hindenburg report.

    What next for India?

    With around 10% of India’s future infrastructure projects in the hands of the Adani Group, as well as a promised $100bn investment in India’s green energy sector in India, there is concern that India’s development could falter if the fortunes of the Adani Group worsen and it is unable to raise capital. The Adani group has insisted “all ongoing projects will continue according to plan”.

    “If the bubble hasn’t already burst it has at least halved in size,” said Geoff Law, who runs Adani Watch, a website funded by an Australian non-profit that has reported on the Adani Group’s actions in Australia and India.

    “It is inevitable that their more ambitious projects will be re-examined and authorities and corporations will have second thoughts about the ventures that they’ve entered into with Adani.”

    This week, the country’s market regulator, Securities and Exchange Board of India, said it was “inquiring” into the allegations made in the Hindenburg report, while the government told the supreme court it had no objection to an expert committee looking into the impact on Indian investors.

    Nonetheless, Crabtree was among those who were doubtful that Adani would be brought down entirely by the Hindenburg report, given the powerful political actors vested in his conglomerate.

    “But it does suggest that a corporate growth model that combines heavy debt, complex financing and opaque governance might not be in India’s long-term interest,” he said.

    Washington: The landmark Air India-Boeing deal will create up to 1 million jobs across 44 states in the US and will further deepen bilateral ties, President Joe Biden has told Prime Minister Narendra Modi.

    Boeing and Air India announced a mega deal on Tuesday under which the Tata Group-owned airline will purchase 190 B737 MAX, 20 B787, and 10 B777X for a total of 220 firm orders valued at USD 34 billion at list price.

    The deal will also include customer options for an additional 50 Boeing 737 MAX and 20 Boeing 787, totalling 290 airplanes for a total of USD 45.9 billion at the list price.

    While discussing the landmark deal with Prime Minister Modi, Biden said, he was looking forward to deepening the ties between India and the US.

    This purchase will support over one million American jobs across 44 states, and many will not require a four-year college degree, Biden said in the call.

    The Air India order is Boeing’s third biggest sale ever in dollar value and second in terms of the number of planes.

    During the call, the two leaders also reaffirmed the strength of the US-India relationship and committed to continue working together and in groups like the Quad to advance economic growth for our two countries and expand cooperation on our shared priorities.

    This announcement follows the inaugural launch of the US-India initiative on Critical and Emerging Technology (iCET) last month.

    iCET is being launched at the direction of US President Joe Biden and Prime Minister Narendra Modi who after their Tokyo meeting in May 2022 had announced to elevate and expand the strategic technology partnership and defence industrial cooperation between the governments, businesses, and academic institutions of the two countries.

    Mumbai: A special court on Monday rejected a plea of Purvi Mehta, sister of fugitive diamond trader and PNB scam accused Nirav Modi, seeking a direction to the Enforcement Directorate to intervene in bankruptcy proceedings underway against him in the United States where she has been made a defendant.

    In the plea, filed in April last year before the special court for cases under the Fugitive Economics Offenders (FEO) Act, Mehta (47) had said the ED should be directed to intervene in the case before a US court and seek injunction at least with respect to assets concerning her.

    She has turned an approver in the bank fraud case filed under provisions of the Prevention of Money Laundering Act (PMLA).

    Special judge S M Menjoge, after hearing prosecution and defence sides, rejected Mehta’s plea, saying there was no provision in the FEO Act by which the relief sought by her can be granted.

    This court cannot prevent any person from prosecuting any matter either in India or outside the country, the judge observed.

    Nirav Modi, a key accused in the Rs 13,000-crore scam at state-run Punjab National Bank (PNB), was declared a fugitive economic offender in December 2019. The 51-year-old diamantaire is currently lodged in a UK prison.

    In June 2020, a special PMLA court in Mumbai ordered confiscation of his properties which the ED claimed had been bought using proceeds of crime.

    In her plea, Mehta, who has turned an approver in the PMLA case against Nirav Modi and others, said she had been made a defendant in bankruptcy proceedings against her brother in a US court.

    It means her properties are also being considered by the US court and its proceedings overlap with those in India related to her, Mehta’s plea had said.

    The ED should be directed to intervene in the case before the US court, and seek an injunction at least with respect to assets concerning her, said the plea.

    Lawyers representing PNB, which is the victim of the multi-crore fraud, submitted before the court that Mehta’s plea was not maintainable.

    The ED also strongly objected to her plea, saying Mehta’s properties had been already attached as per provisions of the FEO Act.

    There was no provision in the FEO Act to direct the central agency to intervene in US court proceedings, it told the court.

    The special court, while rejecting Mehta’s plea, pointed out that she’s an approver in the PMLA case and not in this matter (filed under the FEO Act) and therefore she cannot claim be an interested party.

    Nirav Modi and his uncle Mehul Choksi, owners of prominent jewellery firms, are accused of cheating the nationalized bank to the tune of Rs 13,000 crore by fraudulently obtaining Letters of Undertaking which act as bank guarantee while taking loans in foreign countries.

    Purvi Mehta and her husband Maiank Mehta were made approvers in the bank fraud case in January 2021 on condition of making full and true disclosure before the PMLA court.

    Thiruvananthapuram: Congress MP from Wayanad, Rahul Gandhi, told a public meeting at his constituency on Monday that Prime Minister Narendra Modi will be the last person he would be scared of.

    “It doesn’t matter if he has all the agencies with him, because truth is not with him. One day he will have to face the truth,” Rahul Gandhi said.

    At the public meeting, the Congress leader distributed keys of newly-built homes by the party in his constituency to 25 beneficiaries.

    Rahul Gandhi used the latter part of his speech to take on Modi, saying that he spoke at length in the Parliament about Modi’s equation with Gautam Adani but the PM didn’t reply to any question.

    “The truth will always come out,” he said.

    “The only thing he told me was why I am not being called Nehru instead of Gandhi. In India, the surname that we use is that of our father,” the COngress leader said.

    Agartala: Prime Minister Narendra Modi said at an election rally in Tripura on Monday that the BJP is the guaranty of development while the Congress-CPI(M) promote violence, corruption and tried to keep the people poor.

    Modi in his third election rally in three days said that the Left and Congress are doing ‘kushti’ (fight) in Kerala and ‘dosti’ (friendship) in Tripura. “Many people belonging to the Congress party were killed by the Left cadres in Tripura. The victim Congress family members would never vote for the Left parties. All of you should reject the unholy alliance for the betterment of Tripura,” the Prime Minister said.

    He stated that during the Left regime “Chanda” (donation) collection was the only job of the Left cadres, who treated the people of Tripura as their “Ghulams” (servants). “Cadre Raj was prevailing in the police station to trade and business. If anyone hoisted flags other than CPI-M they were attacked. The BJP removed the red signal (defeated the Left parties) in the 2018 elections. The Left parties and Congress want to keep Tripura backward and the people to remain poor,” Modi claimed.

    The Prime Minister said that the Left and the Congress looted Central funds. “One Congress Prime Minister earlier himself confessed that only 15 paise of the Centre’s one rupee reached the people.”

    Highlighting the performance of the double engine government (Central and state governments), he said that the Ayushman Bharat Yojana provided the best cashless treatment to the people.

    Saying that Tripura topped in the country in providing concrete houses to the people under the Pradhan Mantri Awas Yojana, the Prime Minister said that Rs 500 crore was transferred directly to the farmers’ account as the BJP government started procurement of rice since it came to power in the state. With the initiative of the Tripura government, fruits were exported, benefiting the farmers.

    He said that an IIIT, National Forensic University, National Law University are being set up in Tripura and added that development of the tourism infrastructure is underway and can boost employment. “For the bright future of the coming generations people should remain alert against the disastrous plan of the Congress and Left parties’ joint politics,” Modi said, adding that the BJP government’s HIRA (Highway, I-way, Railway and Airway) model would boost the income and creation of jobs.

    Noting that Agartala airport is the only such modern airport in the entire northeast region, the Prime Minister said that most of the work on the Indian side of the Agartala-Akahura railway project has been completed and it is continuing on the Bangladesh side. “The new railway project would help Tripura and the other northeastern states in a big way.”

    The Prime Minister said that the “Maitri” bridge over the Feni river would boost the economy of the region and make Tripura a hub in southeast Asia. Referring to the visit of Rabindra Nath Tagore on a number of occasions to Tripura, Modi said that the BJP government was taking forward Tripura as guided by Gurudev and the erstwhile kings.

    Dausa: Prime Minister Narendra Modi on Sunday took a dig at Rajasthan Chief Minister Ashok Gehlot for reading portions from the state’s last year Budget speech while presenting the Budget for 2023-24, saying Congress governments’ “plans and announcements remained just on paper”.

    The prime minister was addressing a rally here after inaugurating a stretch of the Delhi-Mumbai Expressway.

    In his address during the rally, Modi also accused the Congress government in the state of lacking vision and hindering the state’s development and said a stable and growth-oriented government is needed Rajasthan to bring stability and to establish the rule of law.

    Modi also referred to Gehlot’s Budget speech gaffe, saying what happened was being discussed all around.

    “Anybody can make a mistake, but this shows the Congress has neither vision nor gravitas (wajan) and its plans and announcements remained just on paper,” Modi said.

    While presenting the Budget for 2023-24 on Friday, Gehlot, who also holds the finance portfolio, mistakenly started reading portions from his last year’s Budget speech, leading to an uproar in the House. The uproar ended after Gehlot apologised.

    Modi said Rajasthan would have progressed better if it had the double-engine government of the BJP, referring to the possibility of his party being in power both at the Centre and in the state

    Assembly elections are due this year-end in the Congress-run state.

    Dausa: Prime Minister Narendra Modi on Sunday said the Centre is committed to ensuring a regular supply of water for drinking and irrigation purposes in the 13 districts of eastern Rajasthan.

    He said a draft plan for a major project, combining the Eastern Rajasthan Canal Project (ERCP) and the old Parvati-Kalisindh-Chambal link, has been shared by the Centre with the governments of Rajasthan and Madhya Pradesh.

    “The draft has been included in the list of priority-based projects by the special committee on rivers. The Centre will definitely think of advancing it when the governments of both the states agree on it,” Modi said at a public rally organised by the Bharatiya Janata Party (BJP) in Rajasthan’s Dausa district.

    Earlier, at another programme held a few kilometres away, where Modi inaugurated the first phase of the Delhi-Mumbai Expressway, Rajasthan Chief Minister Ashok Gehlot reminded the prime minister that he had promised to accord priority to the ERCP at his election rallies in the past.

    Addressing the gathering through a video link from the chief minister’s residence in Jaipur, Gehlot said during his election rallies in Jaipur and Ajmer in the past, Modi had said a decision would be taken on giving priority to the project. “It is expected that you will say something on the ERCP,” the Congress leader said.

    Modi said the people of Rajasthan have showered a lot of affection on the BJP but their progress would have been fast if there was a “double-engine” government in the state.

    He asserted that solving the problem of drinking water in Rajasthan is the priority of the BJP-led government at the Centre.

    The prime minister said the work on the Ken-Betwa river-linking project between Madhya Pradesh and Uttar Pradesh is about to start and similarly, the Centre is also committed to ensuring a regular supply of water for drinking and irrigation purposes in the 13 districts of eastern Rajasthan.

    The ruling Congress in Rajasthan has been demanding that the Centre accord the status of a national project to the ERCP, which was conceptualised by the previous BJP government in the state led by Vasundhara Raje.

    Dausa is one of the 13 districts covered under the project.

    In his address, Gehlot also raised other demands related to infrastructure development in the state.

    He said it was agreed in principle that 50 roads in Rajasthan will be converted into national highways, but a gazette notification to that effect is yet to be issued. The chief minister also said the detailed project report (DPR) of an elevated road in Jodhpur has been prepared and the project needs to be taken up further.

    He said it is expected that the pending proposals of the state government will be cleared by the Centre.

    Gehlot also highlighted the efforts of his government towards road and infrastructure development. He said 54,000 kilometres of roads have been laid in the state in the last four years and the work for an additional 46,000 kilometres is on.

    Besides, a budgetary provision of Rs 20,000 crore has been made for infrastructure development, Gehlot added.

    He said as a result of these efforts, investment is increasing in Rajasthan and his government is developing industrial areas at the block level.

    The chief minister also pointed out that according to a survey conducted by the Centre, Rajasthan ranks second in the country in terms of growth rate.

    Recalling the contributions of former prime ministers Atal Bihari Vajpayee and Manmohan Singh as regards highway construction and infrastructure development, Gehlot also lauded Union Minister for Road Transport and Highways Nitin Gadkari for the initiatives taken by him in this sector.

    Later in the day, Gehlot also took to Twitter to highlight the issue of ECRP.

    “Honourable Prime Minister Shri @narendramodi ji, you missed a good opportunity today. The people of the state would have welcomed you had you fulfilled the assurance made before the last Assembly polls that the status of a national project would be given to the ERCP.

    “Availability of water for drinking and irrigation purposes is very important for 13 districts in Rajasthan. The state government is taking forward the work related to the ERCP with its own resources. The prime minister should declare it a national project so that the work gets momentum and people get water,” he said in a series of tweets in Hindi.

    Former Rajasthan deputy chief minister Sachin Pilot also tweeted on the issue.

    “The prime minister came to Rajasthan for the second time in 15 days, but no step was taken even today towards giving the status of a national project to the ERCP. The project is a lifeline for 13 districts and a question of prosperity for lakhs of people. It is not right to refrain from giving it the status of a national project,” Pilot wrote on Twitter.

    The Assembly polls in Rajasthan are due later in the year.

    New Delhi: The Lok Sabha Secretariat has asked Congress MP Rahul Gandhi to respond by February 15 to notices given by BJP members regarding his remarks on Prime Minister Narendra Modi in the House.

    In a letter to Gandhi, dated February 10, the secretariat has asked him to furnish his reply on breach of privilege notices against him by BJP MPs Nishikant Dubey and Pralhad Joshi — also the parliamentary affairs minister — by February 15 for the Lok Sabha speaker’s consideration.

    Following Gandhi’s speech in Lok Sabha on the ‘Motion of Thanks on the President’s Address’ on Tuesday, in which he commented on the Hindenburg-Adani issue, Dubey and Joshi had moved the notices against him.

    Both the BJP leaders in their notices to Lok Sabha Speaker Om Birla have alleged that Gandhi’s comments were baseless and that he made “contemptuous, unparliamentary and dishonourable” allegations.

    Several remarks made by Gandhi were expunged by the speaker.
