  • Minor Girl’s Harassment Case, Man Goes To Jail For Three Years

    SRINAGAR: A special Fast Track court in Srinagar presided over by Judge Aarti Mohan; dealing with cases registered under POSCO Act sentenced a man to an imprisonment of three years along with fine of Rs. 50000 under section 7/8 of POCSO Act.

    The matter pertained to the harassment of an 11-year-old girl and an FIR No.52 /2019 in this regard was registered at Kursoo Rajbagh police station Srinagar in 2019.

    The convict has been held guilty of offences punishable under section354, 354-A RPC and section 7/8 of POCSO Act 2018 by virtue of judgment dated 28-04-2023.

    Public Prosecutor Meena Gowher said that the accused should be awarded the maximum punishment  of five years as prescribed under law along with fine, which this court deems fit in the facts and circumstances of the case.

    Stating that the deterrence against the convicts in such cases is the need of the hour, the Public Prosecutor said, “The offence committed by the convict is against a minor girl and as such the convict does not deserve any leniency by the court and should be awarded the maximum punishment prescribed under law.”

    The convict was produced before the court from central jail in presence of the public prosecutor Meena Gowher and Advocate Mushtaq Ahmad Dar, convicts counsel in the case and heard the quantum of punishment.

    On the other hand counsel for the convict said that the court should take into consideration the mitigating circumstances while awarding the punishment to the accused.

    “The convict is a man of advanced age and falls in the category of senior citizen, a father of three daughters. Due to his involvement in the instant FIR, wherein he has been convicted, his reputation has suffered and two of his daughters have not been married,” the counsel submitted before the court, adding that court should also consider the fact that all the witnesses in the case were family members of the victim.

    “I have considered the arguments advanced by both the learned Public Prosecutor and learned defense counsel. The court while awarding punishment is influenced by numerous factors and no straight jacket formula is provided for determination of the quantum of punishment in law. The quantum of sentence depends upon the background facts of the case, antecedents of the accused, delay in conclusion of the case, age of the accused, his physical health condition, the nature of the offence and last but not the least the reformative deterrent and punitive aspects of punishment,” the court ruled.

    Court further ruled that, “In the case in hand the convict is senior citizen of more than 60 years of age at present having no prior criminal antecedents whatever. It also cannot be denied that he may be the sole bread provider for his family which comprises of two unmarried daughters. However, while awarding punishment the court is also required to take note that the object for which the penal laws have been enacted do not remain unfulfilled. The POCSO Act was enacted since a strong need was felt to take stringent measures to deter the rising trend of child sex abuse in the court. Its purpose is to ensure that there is a healthy physical, emotional, intellectual and social development of the child. The convict has committed sexual assault on a minor girl forgetting that he himself is a father of three daughters.” it said.

    Court stated that keeping in view the above facts while taking into account the mitigating the circumstances also the accused is awarded simple imprisonment of 3years along with fine of Rs. 50000/- under section 7/8 of POCSO Act.

    On failure of payment of fine accused shall undergo further imprisonment of 6 months.

    Court ruled that offence against the victim, who at the time of commission of offence was merely of 11 years of age caused her mental and psychological trauma. As such a compensation of Rs two lakh shall be awarded to the victim.

  • Shop Owner Arrested For ‘Secretly’ Recording Minor In Changing Room

    SRINAGAR: Baramulla police on Friday said to have arrested a ready-made garments shop owner for secretly recording videos in a changing room.

    In a statement, a police spokesman said that police Station Chandoosa received a written complaint from one minor girl (name withheld) accompanied by her sister wherein she stated that on April 26th, 2023 she went to a readymade shop at Bandi Payeen belonging to one Aijaz Ahmad Sofi S/O Gh Nabi Sofi R/O Bandi Payeen Chandoosa and selected some clothes and went to changing room for trial. After entering in the changing room she found a hidden mobile phone which was kept there for secretly recording the customer’s videos while changing clothes, he said.

    Acting promptly upon the complaint, case FIR under sections of IPC, IT acr & POCSO Act was registered in Police Station Chandoosa and investigation was taken up, the statement said.

    He said, during the course of investigation, a team headed by SHO PS Chandoosa, Inspector Irfan Ahmad under the supervision of SDPO Kreeri, Khalid Aahraf was constituted and the accused person namely Aijaz Ahmad Sofi S/O Gh Nabi Sofi R/O Bandi Payeen Chandoosa (owner of the shop) was taken into custody immediately in the instant case. Mobile devices of the accused have also been seized and further investigation is going on.

    Community members are requested to be careful while using trail rooms, the spokesman added. (KDC)

    Baramulla, Apr 28: Amid the rise in moral degradation in Kashmir Valley, a case has emerged in which a readymade garments shopkeeper had been allegedly secretly taking videos of female customers changing clothes in the changing room of this shop. The case was being reported from North Kashmir’s Baramulla district.

    A police spokesperson said that Police Station Chandoosa in North Kashmir’s Baramulla district received a written complaint from a minor girl accompanied by her sister wherein she stated that on 26th April this month, she went to a readymade shop in Bandi Payeen area of Chandoosa.

    The minor girl reported that she selected some clothes and went to changing room for trial.

    After entering the changing room she found a hidden mobile phone which was kept there for secretly recording the customer’s videos while changing clothes.

    Police took serious note of the complaint and after investigation arrested the shopkeeper identified as Aijaz Nabi Sofi, a resident of Bandi Payeen Chandoosa who is also the owner of the said shop.

    The police spokesperson said that mobile devices of the accused have also been seized and further investigation is going on. [KNT]

    Kupwara, Apr 27 (GNS): A 9-year-old boy was killed after allegedly hit by a motorcycle in Mughalpora area of north Kashmir’s Kupwara district.

    An official told GNS that one Abrar Ahmad Qureshi son of Farooq Ahmad Qureshi, resident of Batpora Haihama was critically injured after hit by a motorcycle this afternoon at Parraynard Mughalpora.

    The boy, the official said, was removed to SDH Kupwara, where he was declared as brought dead on arrival.

    The police has taken cognisance into the incident for due investigations. (GNS)

    Thane: The Government Railway Police has arrested a 26-year-old autorickshaw driver from Airoli in Navi Mumbai and detained a minor boy for allegedly killing a 23-year-old man whose body was found on tracks between Vashi and Sanpada railway stations recently, an official said on Wednesday.

    The investigation revealed that the deceased had stabbed and injured the autorickshaw driver and harassed the sister of the minor a year ago, due to which they bore a grudge against him.

    The duo allegedly pushed the 23-year-old man into a pit in Vashi and stoned him to death, the official said.

    Hyderabad: The XIIth Additional Metropolitan Sessions Judge, T Anitha, sentenced a man involved in a sexual assault case of a seven-year-old girl to 20 years of rigorous imprisonment and imposed a fine of Rs. 2000

    27-year-old Mohd Sajjad, a resident of Santoshnagar was arrested by the Santoshnagar police in June 2022 for sexually assaulting the victim girl aged seven years on the house’s terrace when the mother of the child went to work outside.

    The girl complained to the mother after returning and the victim’s mother approached the Santoshnagar police who booked a case. The police arrested Sajjad who admitted to sexually assaulting the girl. The police booked a case under Sections 366, 376AB and Section 5 r/w 6 of the Protection of Children from Sexual Offences Act 2012.

    After the trial, the court found Sajjad guilty, sentenced him to 20-year rigorous imprisonment, and imposed a fine of Rs. 2,000. The case was investigated by T Vamshi Krishna, Inspector of Police Santoshnagar and K Sreenivas Reddy, ACP Santoshnagar.

    New Delhi: The family of a nine-year-old boy who was declared brain dead at AIIMS, Delhi following a head injury donated his organs giving a new lease of life to two children.

    The parents of the child admitted to AIIMS Trauma Centre after suffering a severe head injury in a road accident on April 15 gave consent to donate the minor’s organs following counselling.

    The minor passed away on April 21.

    This is the fifth paediatric donation (in the 1-6 years of age group) amongst 19 donations to have taken place at JPN apex trauma centre, AIIMS, here since last April.

    Children are a very special group and need targeted approaches for brain death certification, maintenance of donor organs after brain death, subsequent organ retrievals and transplantations, Dr Deepak Gupta, Professor of Neurosurgery at AIIMS, Delhi.

    There is a large unmet need for organs by children suffering from end-stage diseases of the kidney, liver and heart across India and training of doctors in transplants in children needs to be reinforced at regular intervals.

    “Incidentally, 6 year old Master S was born with only one kidney (as was confirmed on CT and USG abdomen) and hence only one kidney was retrieved to be transplanted to another boy at AIIMS Delhi, while liver was transplanted at ILBS to another 16-year-old boy in Delhi as per allocation by NOTTO,” Dr Gupta said.

    National Organ & Tissue Transplant Organisation is an organisation set up under the Directorate General of Health Services of the Ministry of Health and Family Welfare.

    Both corneas retrieved by the RP Centre Eye bank team will be used to give new vision to patients in need at AIIMS in subsequent days, he said, adding that heart valves were also retrieved for later usage.

    However, the heart and lungs were not found to be suitable for transplantation by a team of experts from NOTTO.

    The entire process of brain death certification, donor organ management and counselling for consent and further retrievals was coordinated by a team of doctors, paramedic support staff from the Organ Procurement team (OPT), Organ retrieval banking organisation (ORBO) of AIIMS, transplant team of doctors and support staff from the hospital, said Dr Aarti Vij, Head of ORBO at AIIMS said.

    Talking about the challenges involving organ donations from very young donors, Dr Gupta said the Biggest myth amongst many is that organ donations can be done only between the 18-60 years of age group.

    Organs can be harvested for donations after a patient has been declared brain dead irrespective of age. For a patient, a set of 2 tests by a team of 4 doctors are conducted 6 hours apart in adults and 12 hours apart in children, giving new life to an average of 8 patients after due informed consent by relatives of the patient.

    “It is true that many neonatal donors are too small to recover organs for transplantation (especially those younger than a year), finding suitable recipients in such young donors can be a challenge too. Donations and subsequent successful transplantations have been reported from India even in children younger than 1 year of age,” he said.

    SRINAGAR: A minor girl was injured in a road accident in Padpawan area of South Kashmir Shopian district on Sunday.

    An official said that an accident took place at Padpawan Shopian when one motor cycle bearing registation no JK01l /1676 hit a four year girl who was critically injured.

    He identified her as Rameesa daughter of Showkat Ahmad Thoker resident of Padpawan. Rameesa was shifted to district hospital Shopian from where she was referred to Srinagar for advanced treatment, he said.

    Raiganj: A 20-year-old man was arrested on Saturday in connection with the alleged rape and murder of a teenage girl in West Bengal’s North Dinajpur district that triggered violent protests, police said.

    The 17-year-old girl, whose body was found in a canal in Kaliaganj police station area on Friday, knew the man, Superintendent of Police (SP) Md Sana Akhtar said, identifying him as the prime accused.

    A case has been filed under IPC section 302 (murder) and relevant sections of the Protection of Children from Sexual Offences (POCSO) Act based on the complaint filed by the girl’s mother, he said.

    The preliminary post-mortem report revealed no injury to the body, Akhtar said, adding that a bottle of poison was found near the body.

    “We are investigating the case from all angles,” he said.

    Violence rocked Kaliaganj, around 18 km from the Bangladesh border, as locals protested against the incident, prompting the police to use tear gas shells and charge batons to bring the situation under control, officials said.

    Several shops and e-rickshaws were set on fire by the mob, which demanded the arrest of those behind the incident. Roads were also blocked and stones were hurled at the police, they said.

    The RSS-backed ABVP gheraoed the Kaliaganj police station, while BJP state president Sukanta Majumdar sat on a dharna outside the SP office in Raiganj, demanding justice for the victim’s family.

    Rapid Action Force (RAF) was deployed to bring the situation under control, police said, adding that a few protestors were also detained.

    Three persons were injured in the police action and admitted to the Raiganj Government Medical College and Hospital, officials said.

    Majumdar, who visited the victim’s village along with local BJP MP Debasree Chaudhuri, demanded a CBI investigation into the incident.

    “We think the real truth will be revealed only if a CBI inquiry is conducted in this case,” he told reporters.

    State Minister for Women and Child Development and Social Welfare, Dr Shashi Panja hit out at the BJP leadership, particularly Leader of Opposition Suvendu Adhikari, for identifying the minor in his tweets.

    She alleged that the saffron party leaders were trying to instigate the people by misleading them.

    “The BJP is trying to play dirty politics. That the Leader of Opposition (LoP) has divulged the identity of the victim girl through his tweets is itself a crime. How can he do that? They are playing dead body politics (sic),” Panja said.

    The minister further said the post-mortem report would clear whether the girl was raped and killed or whether she died by suicide by consuming poison.

    “At the moment, police are trying to bring the law and order under control. We must think about the mental condition of the family. Culprits will definitely be brought to the book,” Panja said.

    The National Commission for Women (NCW) also sent a team to the area, and sought a report from the state police within three days.

    The girl went missing on Thursday evening after she left home for going to her tuition classes. Her body was found the next day floating in a canal amid hectic searches by her family and locals.

    Protests had started on Friday afternoon but quietened down by the day-end, only to restart on Saturday.

    Hyderabad: An eight-year-old was allegedly killed by a transgender here over financial issues with the boy’s father, police said Friday.

    Police received a complaint about the boy missing and they examined CCTV footage during investigation. The CCTV footage revealed that the boy went to the residence of the accused for playing but there was no evidence of him coming out, police said.

    An auto-rickshaw was seen arriving near the house and a bag being taken out. The accused killed the boy over financial disputes with the boy’s father, they said.

    On claims by some that the boy’s killing was a case of human sacrifice, police said no such evidence had been found.

    State Animal Husbandry Minister T Srinivas Yadav visited the spot and expressed anguish over the killing. He assured tough action against the culprits and justice to the family members of the deceased.
