    New Delhi: While hearing a bath of pleas for same-sex marriages, Supreme Court on Tuesday queried whether anyone has a fundamental right to marry, or is there no fundamental right to marry at all and stressed that the Constitution itself is a tradition breaker.

    A five-judge bench headed by Chief Justice of India D.Y. Chandrachud asked senior advocate Rakesh Dwivedi, representing the Madhya Pradesh government, “forget the issue of same sex, does anyone have a fundamental right to marry? Or, is there no fundamental right to marry at all? Because your submission is that no one has a fundamental right to marry”.

    Dwivedi said that so far the marriage is between two heterosexual individuals.

    The bench, also comprising Justices S.K. Kaul, S. Ravindra Bhat, Hima Kohli and P.S. Narasimha, said it is not on heterosexual, “does any citizen of this country for whom this court, our society, our polity, has placed the individual at that highest pinnacle. And, we have gone ahead carved and discovered so many rights — to personhood, right of choice, right of left alone, privacy, dignity… with all this, the question is does a person or citizen have a right to marry”.

    Justice Bhat asked: “Is it part of Article 21 or not part of it? We have to start with the premise that there is no unqualified right. Right to free speech is not unqualified right, right to association is not unqualified, personal liberty is not unqualified, right to life. Therefore, there is no absolute right, if we start with that premise. Does the right to life have the concomitant right to marry.”

    The bench asked Dwivedi to not start the debate that same sex people do not have right to marry, rather start with is right to marry or is there a right to marry.

    Dwivedi said heterosexual couples have the right to marry in accordance with their custom, personal law, and religion, and that is the foundation of their right.

    The Chief Justice observed: “Therefore, you concede the fact that there is a right to marry under the Constitution, but it is only confined to only heterosexual persons according to you, or is it your argument that there is no right to marry at all as a fundamental right?”

    Justice Bhat said: “Custom, culture, religion, rewind 50 years ago inter-caste marriages were not permitted. Even inter-faith marriages unheard of, therefore, the context of marriage has changed.”

    Dwivedi said: “these changes have been brought about by legislation and legislature can alter the customs. The Constitution only gives a fundamental right to form relations, associations, which is in Article 19 (1) (c) which can be regulated. He added that marriage over the years has resulted in social institutions as a result of society’s evolution, and the right to marriage which was existing as a part of social institutions will be accommodated in the right to associate in a particular manner.

    Justice Bhat said: “The Constitution has not granted anything. It only recognizes and guarantees, nothing is granted. We’re free citizens. We have taken this to ourselves. Right to speak, to associate, these are part of our inherent rights. The Constitution doesn’t grant it… Even legislation has only recognised the right to marry is inherent. If we say the right to marry is inherent then it is part of the Constitution. You may locate it in (Articles) 19 or 21a.”

    Justice Bhat said “the moment you bring tradition, the Constitution itself is a tradition breaker. Because the first time you brought in (Articles) 14, you brought in 15, and 17, those traditions are broken”.

    The bench queried, “if those traditions are broken, what is held hallowed in our society in terms of caste?”

    “We made a conscious (decision)… and said we don’t want ita.outlawing untouchability in the Constitution. But at the same time let us be alive to the fact that the concept of marriage has evolved.”

    Dwivedi submitted that the point is that all these reforms are made by the legislature for the interest of women and children and they do not alter the core aspect of the social institution of marriage, “namely that it’s an institution. Hindu marriage is regarded as a Sanskar”.

    Dwivedi contended that the core aspect of marriage remains and pointed at alimony, maintenance, divorce, inter caste and added that ultimately the marriages remain heterosexual marriages.

    The bench observed that to state at the extreme that there was no fundamental right to marry under the Constitution would be far-fetched.

    “What are the core elements of marriage? If you look at each element, each is protected by constitutional values,” it said.

    The Chief Justice said one, marriage itself postulates two individuals to cohabit; two, marriage accompanies with it the existence of family; three, marriage has procreation as a very important ingredient; four, marriage in a significant way is exclusionary to all others; and five, social acceptance of existence of marriage.

    The top court will continue to hear arguments in the post -lunch session.

    Mahendar Kumar, a resident of Mumbai, came to Sukkur along with his family to get married to Sanjugata Kumari, reports Geo News.

    The wedding took place at a local hall in Sukkur, which was attended by the couple’s relatives and people from the Hindu community.

    Kumari along with her husband will leave for India in a few days after completion of legal formalities.

    The parents of the bride said that the couple became friends on social media and decided to get married.

    Later, the families contacted each other via WhatsApp and finalised the wedding ceremony, Geo News reported.

    Aishwar Lal Makeja, of the Mukhi Hindu Panjaat Sukkur, who attended the wedding function, said love has no borders and wished the couple a happy life.–(IANS)

    Kiran, a 24-year-old has reportedly decided to marry the ChatGPT, an artificial intelligence chatbot developed by OpenAI at a temple in the area, reported The Fauxy. Furthermore, she has also arranged an AI as a priest to solemnise the marriage.

     

    Kiran fell for ChatGPT after she asked it pickup lines, and ChatGPT gave some of the most original pickup lines, since then Kiran has been talking to ChatGPT for hours everyday. “ChatGPT has been the best husband one can get, he never gets angry even if I say the same things hundred times, he listens to me patiently and is the best when it comes to financial planning, he surprises me everytime” said Kiran.

     

    Reportedly, Kiran’s Mehendi will also be done by an AI design tool and same will be auto posted on her Instagram. Kiran has invited 50 of her close friends and family members, whereas from the ChatGPT side, 14 websites that work on ChatGPT input will be attending the ceremony.

    New Delhi: In a horrific incident, a Delhi man murdered his girlfriend after an argument over his impending marriage to someone else, stuffed her body in a refrigerator at his dhaba, and went on with his wedding the same day, police said on Tuesday.

    Accused Sail Gehlot was arrested after the body of a woman, a resident of Haryana’s Jhajjar, was found inside a fridge at a dhaba, owned by him, on the outskirts of village Mitraon in Delhi.

    According to police, on February 10, an inputs were received that a person named Sahil had killed his girlfriend and married another girl on the day of murder.

    “A police team was formed and on checking, no case or complaint about any missing girl was found reported. The team reached Mitraon village in search of the accused Gehlot, but his mobile phone was found switched off and he was not present in his house. Intensive search was made in the village and nearby area,” Special Commissioner of Police, Crime, Ravindra Singh Yadav said.

    However, Gehlot was nabbed by police from Kair village crossing.

    “On interrogation, initially, the accused tried to mislead the police. But on sustained interrogation, he disclosed that he had killed his girlfriend, Nikki Yadav, in the intervening night of February 9 and 10 Feb and kept her dead body in a refrigerator at his dhaba in a vacant plot situated on the outskirts of village Mitraon,” Yadav said.

    Sahil Gehlot further disclosed that in 2018, he met the woman at a coaching centre in Uttam Nagar area of west Delhi where he had joined to prepare for SSC exams.

    “At that time, Nikki was also preparing for a medical entrance examination in Akash Institute at Uttam Nagar. Both used to travel to their respective institutes daily in the same bus, and they became friends, and later on fell in love,” said the Special CP.

    “The duo started meeting before and after the coaching classes. In February 2018 the accused took admission in D. Pharma in Galgotia College at Greater Noida and she also took admission in the same college in BA (English Hons.). Thereafter, both of them started living together at Greater Noida in a rented house. They became very close to each other and also travelled to several places such as Manali, Rishikesh, Haridwar, Dehradun etc,” said the official.

    However, during Covid-19 pandemic lockdown, they returned to their homes and after the end of the lockdown, they again started living together in a rented house in Dwarka area.

    “The accused did not inform his family members about this relationship. His family was putting pressure on him to get married with some other girl and finally in December 2022, engagement and marriage of the accused with another girl were fixed for February 9 and 10,” the Special CP said.

    Gehlot did not inform Nikki about his engagement or marriage plans. “Somehow she came to know about this and confronted the accused and arguments started between the two. The accused strangulated the deceased with the help of a data cable of his mobile phone kept in his car. Thereafter, he went to the dhaba owned by him and put her dead body in a refrigerator,” he said, adding that Gehlot then went back to his home and solemnised his marriage with another woman.

    “The dead body of Nikki was recovered from the fridge at the instance of the accused. A case under relevant sections of the Indian Penal Code has been registered and the version disclosed by the accused is being verified during investigation,” said the official.
