    New Delhi: A court here has rejected the bail plea of an accused from whom the mobile phone of a man allegedly killed during the 2020 northeast Delhi riots was recovered, saying the finding was “circumstantial evidence” for the murder charge and “concrete evidence” for the offence of dishonestly receiving property stolen during dacoity.

    The court, meanwhile, allowed the bail plea of eight others in the case, saying “concrete and sound evidence” was not found against them.

    Additional Sessions Judge Pulastya Pramachala was hearing the bail pleas of Himanshu Thakur, Sahil Babu, Tinku, Sandeep, Vivek Panchal, Pankaj Sharma, Sumit Chaudhary, Prince and Ankit Chaudhary.

    According to the prosecution, the accused were part of an unlawful assembly formed on February 25 and 26, 2020 that bludgeoned to death a man named Mursaleen whose body was found floating in a drain near Johripur Tiraha.

    “The recovery of the mobile phone of the deceased from Himanshu Thakur and the evidence in the form of call detail record (CDR) to show its use by his family members subsequent to the killing of Mursaleen is a kind of circumstantial evidence in respect of the charge under section 302 (murder) read with section 149 (every member of unlawful assembly guilty of offence committed in prosecution of common object) of the Indian Penal code,” the judge said in an order passed on Monday.

    ASJ Pramachala said the recovery was also “concrete evidence” for the charge under section 412 ( dishonestly receiving property stolen in the commission of a dacoity) of the IPC.

    “Even section 412 is punishable up to life and hence, that charge cannot be treated as a lighter charge In these circumstances, keeping in view the severity of the charges and severity of the punishment provided for the same as well as the additional evidence his bail application is rejected,” the judge said.

    The judge said the evidence against Thakur was not the same as the co-applicants for bail and other accused who were granted bail earlier.

    Regarding the bail pleas of eight others, the judge said, “I do not find very concrete and sound evidence against the applicants in respect of alleged charges till this stage, and since all the material witnesses have already been examined, on the grounds of parity as well, it will not be appropriate to keep the applicants behind bars till the conclusion of the trial.”

    The judge then granted bail to Sahil Babu, Tinku, Sandeep, Vivek Panchal, Pankaj Sharma, Sumit Chaudhary, Prince and Ankit Chaudhary on furnishing a personal bond and surety bond of Rs 30,000 each along with one surety in the like amount.

    There are 12 accused in the case of whom co-accused Rishabh Chaudhary and Jatin Sharma were granted bail on March 7.

    The prime accused in the case, Lokesh Solanki, was allegedly a member of the Kattar Hindu Ekta’ WhatsApp group.

    The name of the WhatsApp group had surfaced in a supplementary charge sheet filed by Delhi Police on September 26, 2020 against nine people for the alleged murder of a man named Hashim Ali during the riots.

    According to the charge sheet, ‘Kattar Hindu Ekta’ group was created on February 25 and its alleged aim was to exact revenge for the troubles faced by Hindus and promote enmity between different groups on the ground of religion.

    Predecessor ASJ Virender Bhat had discharged the accused in the present case from the charge of criminal conspiracy for allegedly being a member of the group in March last year.

    The Gokalpuri police station had filed a charge sheet against the accused persons under various sections of the IPC, including rioting, murder and dacoity.

    SRINAGAR: Body of a 67-year-old man was found and retrieved from a river after remaining elusive to his family since March 5, officials said.

    They said that semi-decomposed body of one Mohammad Shaban Sofi son of Mohammad Shukoor, resident of Arampora Drugmulla was sighted by passersby from a river at Braripora Handwara. Soon after a police team reached the spot and took the body to DH Handwara for medico-legal formalities.

    Confirming the retrieval of the body, a police official said that the person has been missing from his home since March 5. “We have taken the body to DH Handwara for medico-legal formalities to ascertain the nature of the death”, he said. (GNS)

    A man in Bengaluru caught his wife cheating on him after he found his car’s GPS history following which he petitioned a local court to direct the police to file an FIR against her.

    The man, a private company employee who worked night shifts, married the woman in 2014 and the couple has a six-year-old daughter.

    The couple’s relationship was stable until he came across his car’s GPS history which showed that the vehicle was taken out when he was away one night.

    The man had purchased the car in the year 2020 with a GPS-tracking system built in.

    “A detailed study of the GPS showed the car had moved in the KIA direction by midnight and stopped outside a hotel. It was driven back home a little after 5 am. I visited the hotel and found that my wife and her boyfriend had booked a room using their voter IDs,” the man was quoted by TOI.

    After the man confronted the duo, they reportedly threatened him with grave repercussions. The police have filed a case under IPC sections 417 (cheating), 420 (cheating and dishonestly inducing handover of property), 506 (criminal intimidation), and 120B in response to the court’s order. (criminal conspiracy).

    The woman has reportedly been served summons by the police.

    Lucknow: A unique friendship between a harvester operator in Uttar Pradesh and a sarus crane has finally ended after the wild bird was taken away by forest department officials.

    DFO, Amethi, Dev Nath Shah, said that the sarus is protected under the Wildlife Protection Act and hence cannot be kept in captivity.

    Mohammed Arif, 30, of Mandka village of Amethi’s Jamo development block had found the injured sarus in a field in February 2022 and brought it home.

    He nursed the bird back to health and after the sarus became perfectly healthy, it refused to go back.

    “Now, wherever I go, the sarus, whom everyone calls ‘Bachcha’, accompanies me. The bird takes a stroll when I am working and then we both have lunch together before returning home in the evening,” he had told reporters.

    “People stare at us and take our photographs. Some even make reels but now I enjoy the stares.”

    The bird, however, was not friendly with Arif’s family.

    Arif’s wife Mehrunissa said: “In the absence of my husband, whenever I have gone to feed him, I have been attacked. Neither I, nor my two kids, dare go near the sarus.”

    Wildlife experts had a different opinion of the incident and they advised caution.

    Sarus cranes are regarded as the least social crane species. They can be very protective when nesting and are aggressive towards intruders.

    Lucknow Divisional Forest Officer Ravi Singh said: “We have a system to protect and nurture it, but one should be cautious. You cannot touch its wings or hold it near you. No human touch is allowed.”

    The sarus must be allowed to live in the wild and cannot be domesticated and allowed contact with humans. A diet of insects, fish and pila must be given to the bird, he added.

    Arif is sad that his friend has been taken away but is also happy that the bird will now live in its natural habitat.

    Timely intervention by a physician at Help Hand Foundation’s Primary Health Care Center located in Shaheen Nagar, Hyderabad saved a man who suffered a heart attack.

    The man, aged 35 years, had collapsed due to cardiac arrest. At the center, the physician performed Cardiopulmonary resuscitation (CPR) and saved his life. He was also administered adrenaline with oxygen support.

    Later, the patient was immediately shifted to Osmania General Hospital in 108 ambulance.

    Earlier Hyderabad police saved man’s life

    It is not the first incident. Earlier too, a Hyderabad cop saved a man’s life who suddenly collapsed at the Aramghar Chowrastha.

    In the video that went viral after the incident, the constable, Rajashekhar who works at the Rajendranagar Police Station was seen conducting a CPR process on the man.

    Another cop saved a man’s life by performing cardiopulmonary resuscitation (CPR) on him in the Bhupalpally district.

    The incidents prove that CPR is a simple, yet effective technique that can be used to save lives in emergencies such as heart attacks, drowning, or choking. Knowing CPR can make all the difference in an emergency, and it is a valuable skill that everyone should learn.

    Incidents of cardiac arrest in Telangana

    In the past few days, many incident of cardiac arrests took place in Telangana.

    Recently, a 19-year-old boy died in the Adilabad district while dancing at a marriage function, and another young person collapsed while playing badminton and never recovered.

    Last week, an 18-year-old first-year engineering student at CMR Engineering College, located in the Gundla Pochampally municipal limits, died due to cardiac arrest.

    The deceased who is identified as Sachin collapsed suddenly while walking in the corridor on the campus. Though he was rushed to CMR Hospital, doctors declared him dead.

    New Delhi: A Delhi court has granted bail to a man accused of murder during the 2020 North East Delhi riots, saying in the name of opposing the bail plea the prosecution tried to mislead the court as eyewitnesses did not establish his culpability.

    The court also asked the Commissioner of Police Sanjay Arora to sensitise all Investigating Officers (IOs) about their duty towards assisting the court in a fair manner.

    Additional Sessions Judge Pulastya Pramachala was hearing the bail plea of Rishabh Chaudhary in a case of rioting and alleged murder of a man called Mushraff, whose body was found in a drain near Johripur Pulia in Gokalpuri on February 27, 2020.

    According to the postmortem report, there were 12 external injuries on the body and the cause of death was injuries to the brain produced by blunt force impact.

    “…Cited eyewitnesses have been examined, but they did not establish the incident in question and the other two remaining witnesses did not claim having seen any person in the mob I find the applicant to be entitled to bail,” the judge said in an order passed on Friday.

    “Hence, the bail application is allowed and applicant Rishabh Chaudhary is admitted to bail on his furnishing personal bond and surety bond in the sum of Rs 30,000 each with one surety in the like amount,” the judge added.

    The judge said the statement of an eyewitness before the Investigating Officer (IO) identifying the accused had no evidentiary value and that the same witness in his testimony before the court categorically stated he had not identified anyone in the riotous mob.

    But the IO’s reply did not mention the witness’ statement before the court, the judge said.

    “It is well within the knowledge of the Special Public Prosecutor (SPP) and IO that statement under section 161 (examination of witnesses by police) of the code of criminal procedure (CrPC) cannot stand before the testimony given before the court and hence, the purpose of not mentioning the testimony of this witness given before the court appears to be nothing but to mislead this court ,” the judge said.

    The judge noted the submissions of the SPP that one of the prosecution witnesses had identified Chaudhary as a member of the riotous mob and that the IO had mentioned him in the reply.

    But in his testimony before the court, the other alleged eyewitness did not say anything about the incident which allegedly occurred on February 25 from around 7.30 pm to 8 pm, and which was being probed in the present case, the judge said.

    “Thus, I find that in the name of opposing bail application through a reply the prosecution has attempted to mislead the court rather than assisting in a fair manner to project the correct picture of the developments taking place in the case,” the judge said.

    He said any reply being filed by the IO or prosecution must be with the objective to assist the court and it was imperative to have a fair and transparent reporting of the facts.

    “If the reply is filed in a jealous manner, thereby suppressing the material facts, it cannot be said to be assistance to the court. Hence, I find that there is a requirement to sensitise all the IOs in respect of their duty towards the court, so as to assist in a fair manner, rather than adopting the practice of hide and seek,” the judge said.

    “Hence, once again I call upon the Commissioner of Police to do the needful for proper sensitisation of all the IOs in this respect,” the judge added.

    The Gokalpuri police station had registered an FIR against 12 accused, including Chaudhary for various offences under the Indian Penal Code, including rioting, murder, criminal conspiracy and kidnapping or abducting in order to murder.

    The other accused in the case are Lokesh Kumar Solanki, Pankaj Sharma, Sumit Chaudhary, Ankit Chaudhary, Prince, Jatin Sharma, Vivek Panchal, Himanshu Thakur, Sahil, Sandeep and Tinku Arora.

    In his bail plea, Chaudhary said he was arrested on the basis of the disclosure statement of the main accused Solanki but no recovery was effected from his possession and he was never related to Kattar Hindu Ekta’ WhatsApp group, directly or indirectly.

    Chaudhary’s counsel said the applicant is a student of graduation aged 22 years and no fruitful purpose would be served by keeping him in jail.

    The name of the WhatsApp group had surfaced in a supplementary charge sheet filed by the Delhi Police against nine accused, including Chaudhary, for the alleged murder of a man named Hashim Ali during the riots.

    According to the charge sheet, ‘Kattar Hindu Ekta’ group was created on February 25. Its alleged aim was to exact revenge for the troubles faced by Hindus and promote enmity between different groups on the ground of religion. It allegedly acted in a way which was prejudicial to maintenance of harmony.

    In the excerpts from the chats exchanged by the group filed in the charge sheet dated September 26, 2020, one of the members claimed RSS (Rashtriya Swayamsevak Sangh) activists had come to support them.

    Communal clashes had broken out in North East Delhi on February 24 between the supporters and opponents of the new citizenship law. The violence soon spiralled out of control leaving at least 53 people dead and around 200 injured.

    Srinagar, Mar 2 (GNS): A day after the body of Kupwara man was found, nearly three months after going missing after being allegedly detained by the Army, the Police on Thursday said that it has started “proper investigation” in the case.

    “On 1-03-2023, Police Station Trehgam received information that one dead body is lying in the forest area of Zurhama-PK Gali,” a police spokesperson said in a statement to GNS.

    Accordingly, he said, the Police party rushed to the spot and recovered the body which was later on identified to be of Abdul Rashid Dar son of Mohammad Sadeeq Dar of Kunan Poshpora against whom a missing report was lodged in Police station Trehgam.

    “Pertinently, the family members of the deceased had alleged that on 15-12-2022 the said person was taken by some army personnel from his house at Kunan. However, at the same time, the army had revealed that although he was taken for some questioning and subsequent identification of a particular place in the forest of Laderwan-Zurhama area but he jumped over and fled taking advantage of the darkness and topography,” he said, adding, “The Army further informed that they have launched a search to trace Abdul Rashid Dar and requested local police to further take necessary action as per law.”

    In the given circumstances, he said, a proper missing report was lodged in the concerned Police Station and efforts to trace the missing person was on.

    “During the course of investigation besides other procedural formalities, Post mortem was also got conducted through a designated team of doctors and after conducting medico legal formalities the body was handed over to his legal heirs for last rites,” he said, adding, “The Police has started proper investigation in the case to ascertain all facts and circumstances leading to his death. He said further details shall follow with the progress of the investigations.”

    Meanwhile PDP president Mehbooba Mufti said such incidents have been “normalised in the absence of any accountability” after the abrogation of Article 370.

    “Extremely disturbed to see pictures of the mutilated body of Abdul Rashid from Kunan Poshpora. Wasn’t allowed to visit the family under the pretext of security. What transpired after the Army picked him up for questioning months ago is anybody’s guess,” former Chief Minister Mehbooba said in a tweet.

    “In the absence of any accountability such incidents have been normalised after 2019,” she said, adding, “Probes & inquiries fail to nail culprits & deliver justice.

    Mehbooba said that “a genuine probe” was needed to be ordered into the incident.

    “Until then the least LG administration & Army can do is to take steps by providing a government job & financial assistance to the victim’s family who have lost their sole breadwinner,” she added. (GNS)

    Police says ‘cognizance taken for further investigations’

    Srinagar, March 1 (GNS): 75 days after going missing, body of a man from Kunan area was recovered from PK Galli forests in the north Kashmir’s Kupwara district on Wednesday, police said.

    “In continuation to missing of Abdul Rashid Dar of Kunan area of Kupwara on December 16,2022 today early in the morning a dead (body was) recovered from Zurhama -PK Galli forests,” a police spokesperson said in a statement to GNS, adding, “The body was brought to SDH Kupwara where it was identified by the relatives of (the) missing person). After completing all medico-legal formalities including post mortem by a team of doctors, he said, the body was handed over to the family members for burial. “Cognisance of the matter has been taken for further investigations,” he said, adding, “Further details will be shared.”

    At a presser, a police officer had said that the man was allegedly picked up by the army for questioning in connection with militancy related investigation. However the officer had said that he fled from custody.

    People’s Democratic Party president Mehbooba Mufti had also sought the intervention of commander of Army’s 15 Corps. “A youngster detained by Army on 13th December has allegedly escaped from their custody & is now missing. Worrying that a civilian goes missing in Army custody. Request the Core (sic) Commander to kindly intervene,” she had tweeted. (GNS)
