    New Delhi: A Delhi court on Monday extended AAP leader and former Delhi Deputy Chief Minister Manish Sisodia’s judicial custody till May 23 in connection with the Delhi excise policy case being investigated by the Enforcement Directorate (ED).

    The ED has alleged that Sisodia was the mastermind behind the entire excise policy case and that he had deliberately leaked the policy to the co-accused to generate financial kickbacks.

    Sisodia is currently in judicial custody.

    The ED had arrested Sisodia on March 9 after the Central Bureau of Investigation (CBI) arrested him on February 26 this year.

    Last month, Special CBI Judge M. K. Nagpal of Rouse Avenue Court had denied bail to Sisodia, holding that the evidence, prima facie, “speaks volumes” of his involvement in the offence.

    Last week, High Court judge Dinesh Kumar Sharma sought the ED’s response to Sisodia’s bail plea and another application seeking interim bail on the ground of his wife’s ill-health and listed the matter for further consideration on May 11.

    New Delhi: Congress MP Manish Tewari on Wednesday moved an adjournment notice in the Lok Sabha to discuss reports of the Government searching for new spyware and alleged that it violates Right to Privacy.

    The notice states the Indian Government is in the market for new spyware. “The NSO, the company that manufactures and sells Pegasus, has been blacklisted by some countries.

    “The report further reveals that the Government is willing to spend up to $120mn or around Rs 1000 crore.”

    Around a dozen spyware sellers are expected to bid to the Indian Government.

    “The procurement of such Surveillance Technology without parliamentary oversight has grave implications for the right to privacy of individuals guaranteed under Article 21 of the Indian Constitution.

    “Under these circumstances, the House must adjourn to discuss the matter of the Government reportedly seeking to procure Pegasus-like surveillance technology.”

    The notice says that this House does suspend Zero Hour and other businesses of the day to discuss the reported procurement of Pegasus-like surveillance equipment by the Government.

    New Delhi: Congress MP Manish Tewari on Monday moved an adjournment notice in the Lok Sabha against Rahul Gandhi’s disqualification.

    The notice states, “That this House do suspend Zero Hour and other businesses of the day to discuss the disqualification of Shri Rahul Gandhi.

    “The disqualification of Shri Rahul Gandhi from the membership of the House was a hasty and erroneous decision and not in consonance with the provisions of the Constitution of India.

    “Article 102 (1) (e) of the Constitution provides that a person shall be disqualified for being chosen as, and for being, a member of either House of Parliament if he is so disqualified by or under any law made by Parliament.”

    The notice says, “Article 103(1) provides that the decision as to the disqualification of members lies with the President of India. Further, Article 103(2) lays down that a decision on disqualification by the President must be preceded by mandatory consultation with the Election Commission of India.”

    The notice further states, “Section 8(3) of the Representation of People’s Act, 1951 which triggered the disqualification mandates conviction and sentencing as two conjunctive prerequisites for disqualification which were not fulfilled since Shri Rahul Gandhi’s sentence has been suspended for 30 days.”

    Tewari said the action is in violation of the basic principles of natural justice, contrary to the provisions of the Constitution, and beyond the legal competence of the Secretariat of Parliament.

    “Under these circumstances, the House must adjourn to discuss this matter concerning the disqualification of Rahul Gandhi,” the notice said.

    New Delhi: The former Delhi Deputy Chief Minister Manish Sisodia, who was arrested by the Central Bureau of Investigation (CBI) in connection with the Delhi excise policy scam, will be produced before the Rouse Avenue District Court after the expiry of his custodial remand, sources said.

    The source said that Sisodia will be produced by 2 p.m. on Saturday.

    The sources have also claimed that they would further seek the custodial remand of Sisodia.

    The CBI sources have claimed that the former Aam Aadmi Party Minister was still evasive and was not cooperating.

    The central probe agency sources said that in January they seized a computer from the office of Sisodia. Later, it was learnt that files and other data were deleted from the computer. The CBI then sent the computer to Forensic Science Laboratory (FSL) to retrieve the deleted files. Now the FSL has given them a report and retrieved the whole file deleted from the computer.

    Apart from this, Sisodia was also confronted with the statement of an IAS official, who turned approver against him and got his statement recorded under section 164 of the CrPC.

    A day after his arrest Sisodia resigned from his post. Satyendar Jain, who is currently in jail and was holding the Delhi Health Minister’s post also resigned along with him.

    The CBI has alleged in the remand paper that Sisodia played a crucial role in the Delhi excise policy scam.

    “The report of the expert committee in connection with excise policy was changed by Sisodia only to benefit a few liquor businessmen. This was also done as through accused Vijay Nair, they had collected Rs 100 crore from South Group being controlled by South India-based liquor businessmen and politician. They would be more benefited through the policy.”

    “Payment of Rs 100 crore was done through hawala channel, which we have traced. We have learnt that between September and October 2021, Sisodia changed around 14 cellphones and four SIM cards. The purpose of changing the cell phone was nothing but to destroy the evidence. Devender Sharma, the secretary of Sisodia, had provided all these mobile phones, we have his statement in this respect,” said the source.

    The CBI has already filed a charge-sheet against seven persons and they are all set to file a supplementary charge-sheet in the case.

    New Delhi: Former Delhi Minister and Aam Aadmi Party (AAP) leader Manish Sisodia, who is presently in CBI remand, moved a regular bail petition in a trial court on Friday.

    Sisodia was recently arrested by the Central Bureau of Investigation (CBI) for alleged irregularities in the framing and implementation of the excise policy of GNCTD.

    According to the lawyer concerned, hearing on the bail plea will be held on Saturday. Sisodia is also scheduled to be produced on Saturday at the end of his remand period granted on February 27, 2023.

    Rouse Avenue Court on Monday while sending Sisodia to CBI remand directed that the interrogation of the accused during the remand period shall be conducted at some place having CCTV coverage in accordance with guidelines laid down by the Supreme Court and the said footage shall be preserved by the CBI.

    Special Judge MK Nagpal on February 27, 2023, decided to send Manish Sisodia to CBI remand till March 4, 2023. Sisodia was arrested on Sunday in an ongoing investigation of a case related to alleged irregularities in the framing and implementation of the excise policy of GNCTD.

    The court said, keeping in view the facts and circumstances, the accused is being remanded to CBI custody for a period of five days i.e. till March 4, 2023, for his further and extensive interrogation.

    The court observed that the accused had joined the investigation of this case on two earlier occasions, but it has also been observed that he has failed to provide satisfactory answers to most of the questions put to him during his examination and interrogation conducted and has thus, failed to legitimately explain the incriminating evidence which has allegedly surfaced against him in the investigation conducted so far.

    It is true that he cannot be expected to make self-incriminating statements, but the interests of justice and of a fair investigation require that he should come up with some legitimate answers to the questions which are being put to him by the Investigation officer.

    Some of his subordinates are found to have disclosed certain facts which can be taken as incriminating against him and some documentary evidence against him has also already surfaced a proper and fair investigation requires that some genuine and legitimate answers to the questions being put to him about the same are to be found and hence, in considered opinion of this court, this can only be done during custodial interrogation of the accused, noted the court.

    During arguments, CBI counsel told the court that the Delhi Deputy CM’s custodial interrogation is required for an effective investigation into the case. While seeking five days’ remand of Sisodia, CBI said, “Conspiracy was hatched in a very planned and secret manner.”
    Meanwhile, senior Advocate Dayan Krishnan appeared for Sisodia and opposed the remand application of CBI.

    “If someone is not willing to say something, that cannot be a ground for arrest,” argued Sisodia’s lawyer.

    “What should I do with a phone that I changed? I am a minister, I cannot send it to a second-hand shop, it would have important data. CBI confronted me with the material but I did not confess. The remand application says I gave evasive replies. This cannot be a ground for remand. They search my residence on August 19, 2022. I hand over my phone. They called me to join the investigation and I joined. I cooperated,” Advocate Dayan Krishnan argued for Delhi Deputy CM.

    The CBI on Sunday released a statement on Sisodia’s arrests, claiming he was giving evasive replies and wasn’t cooperating in the ongoing investigation of the liquor scam case.

    The arrest of Deputy Chief Minister of Delhi Manish Sisodia by the Central Bureau of Investigation has sharply drawn both Bharatiya Janata Party and Aap Party into a serious political battle.

    It may have been a routine arrest of Sisodia ostensibly for the alleged involvement in the Delhi liquor policy scam, but arrest of a top leader like Manish Sisodia and deputy chief minister has given sufficient fodder to the AAP to blacken the BJP and Modi, as also the BJP to drum up the fact that they have “zero” tolerance for corruption and that “no one is above the law”.

    Now it may not have any impact on the 2024 general elections but it does give a political talking point to both the parties.

    The AAP standing solidly behind Sisodia has said that the real target is Arvind Kejriwal and AAP party, as there was no other leader like Kejriwal who puts a scare into the BJP. In other words, it is Kejriwal and not Gandhi who can take on Modi come 2024.

    . The BJP’s intention to arrest Manish Sisodia and Satyendra Jain before that is attempt by the BJP to finish off the AAP party and its leaders, claim AAP members. The motivation, they say is clearly political.

    Countering the charge of political vendetta the BJP says the issue is entirely one of corruption as it stems out of the sudden withdrawal of the liquor policy once flagged by the Lt. Governor was suddenly withdrawn.

    But the AAP retorts that people who whisk away billions and trillions are not touched by the central government and roam around freely because they are their “friends” of the BJP.  Not even a notice is sent to them.

    The AAP asks if Manish Sisodia made thousands of crores “where is the money trail?”.

    There had been raids at Manish Sisodia’s office and home too and nothing incriminating had been found, the AAP claims.

    The CBI decided to arrest Sisodia after grilling for more than eight hours primarily on the grounds that he did not answer questions and was evasive.

    The BJP on its part says that Manish Sisodia has a lot to answer primarily as to why liquor policy was suddenly withdrawn once there was talk of corruption.

    The bone of contention is that the said liquor policy was allegedly meant to benefit the liquor lobby and had substantially enhanced the commission to around 12 percent from about 2 percent.

    The CBI would try to find out how certain contentious provisions had come into the final draft of the withdrawn liquor policy.

    The BJP asks why manufacturers of liquor were allowed in the retail business in the withdrawn policy.

    The AAP party feels that the arrest of Manish Sisodia was vendetta for the loss BJP faced in Delhi Municipal Corporation after years.

    The AAP party has decided to show a bold face in face of the arrest and said that Sisodia had become the victim of “dirty politics”. 

    The BJP alleging that AAP was encouraging liquor culture in the capital has also asked why many blacklisted companies were taken back. 

    Even though the BJP claims that the enforcement agencies are apolitical and purely go by the facts of the case, no one in the opposition is likely to accept their claim.

    The AAP has clearly said that arrests of their members were just a misuse of enforcement/investigative agencies by the central government.

    The BJP is definitely trying  to take as much advantage as possible by pointing that it is shameful that a  Minister of Education was getting arrested for excise policy

    The BJP is going to drum the fact that BJP has zero tolerance for corruption and that Satyendra Jain is still in jail not being able get bail from the courts.

    In this mutual blame game by political parties it will be difficult for the general public to know where the truth lies and who is accountable.

    New Delhi: Aam Aadmi Party to hit roads and stage protests across the country on Monday against the arrest of Delhi Deputy CM Manish Sisodia in connection with the alleged Delhi liquor excise policy case.

    AAP’s national General Secretary Sandeep Pathak said that they will protest across the country on Monday.

    Taking to Twitter, Pathak on Sunday said, “The great Education Minister Manish Sisodia, who has shaped the future of lakhs of children of the country, has been arrested in a fake case. Against this, the Aam Aadmi Party will protest across the country tomorrow.”

    The party will also stage protests at the Bharatiya Janata Party’s Headquarters at the Deen Dayal Upadhyay Marg in the national capital at around 12 pm om Monday.

    It is believed that the party will also hold protests in Gujarat’s Gandhinagar, Haryana’s Rohtak, Noida, etc.

    Sisodia was arrested by the Central Bureau of Investigation after eight hours of questioning in the now-scrapped excise policy case.

    Shortly before arriving at the CBI office for questioning, the Deputy Chief Minister said false cases are being lodged against leaders of the party as Prime Minister Narendra Modi was “afraid” of Chief Minister Arvind Kejriwal.

    “Conspiracies are being hatched by the CBI and ED and false cases being lodged against our party leaders because PM Narendra Modi is afraid of CM Arvind Kejriwal’s rising popularity. As AAP grows further, BJP will continue to slap false cases on us. We are not afraid of the CBI, ED and their false cases,” Sisodia said, claiming that people were starting to regard the AAP as an alternative to the BJP.

    Sisodia also visited Mahatma Gandhi’s memorial Rajghat before his arrest.

    Reacting to the development his political aide and Delhi CM Arvind Kejriwal termed the arrest as “dirty politics” and claimed that he is innocent.

    Taking to Twitter, Kejriwal said, “Manish is innocent. His arrest is dirty politics. There is a lot of anger among the people due to the arrest of Manish.”

    “Everyone is watching. People are understanding everything. People will respond to this. This will boost our spirits further. Our struggle will get stronger,” he added in the tweet (roughly translated from Hindi).

    New Delhi: Security has been up outside and around the areas near the Central Bureau of Investigation (CBI) headquarters in the national capital after the probe agency on Sunday arrested Delhi Deputy Chief Minister Manish Sisodia in connection with the Delhi Excise Policy scam matter following a day-long questioning, an official said.

    According to an official, Rapid Action Force personnel have been deployed outside the CBI office to maintain the law and order situation.

    Meanwhile, the Delhi Police has also deployed additional force to prevent untoward incidents.

    Sisodia was arrested by the CBI after eight hours of questioning.

    Earlier on Sunday, Section 144 was imposed in and around the areas near the CBI headquarters to prevent gatherings.

    The police had said that it was being done to stop AAP workers from moving closer to the CBI office.

    AAP senior politician and Delhi deputy chief minister Manish Sisodia has been arrested by the Central Bureau of Investigation (CBI) after nine hours of questioning in connection with the excise policy scam case on Sunday.

    Earlier in the day, Sisodia had said that he was ready to go to jail for 7-8 months.

    “I have the love of lakhs of children and crores of countrymen with me. Even if I have to go to jail for a few months, I do not care. We are followers of Bhagat Singh. Bhagat Singh died for the country. If I have to go to jail over such false allegations, it is a small thing,” he said before leaving to the CBI office.

    As per sources, he was asked about kickbacks that were allegedly received to campaign in the Goa elections.

    He was also confronted with the statement of accused Dinesh Arora who has now turned approver.

    Sisodia was also asked about Hyderabad-based chartered accountant Butchibabu Gorantla, Telangana MLC and BRS leader K Kavitha, the daughter of Telangana Chief Minister K. Chandrasekhar Rao (KCR). Gorantla was arrested by the CBI earlier this month.

    The CBI has filed a charge sheet in the matter and will also file the first supplementary charge sheet soon.

    It is alleged that the Delhi government’s policy to grant licenses to liquor traders favoured certain dealers who had allegedly paid bribes for it, a charge strongly refuted by the AAP.

    Lending support, AAP chief and Delhi chief minister Arvind Kejriwal tweeted that his deputy need not worry about his family as the party will look after them.

    “God is with you Manish. The blessings of lakhs of children and their parents are with you. When you go to jail for the country and the society, it is not a curse but a matter of pride. I pray to god that you return from jail soon. Delhi’s children, their parents and all of us will wait for you,” Kejriwal said in a tweet in Hindi.
