    Defamation case: Maha court grants Rahul permanent exemption from appearance

    Thane: A court in Maharashtra’s Thane district on Saturday granted a permanent exemption to Congress leader Rahul Gandhi from appearing before it in a defamation case filed against him by a Rashtriya Sawyamsevak Sangh (RSS) functionary.

    Bhiwandi First Class Judicial Magistrate Laxmikant C Wadikar who heard Gandhi’s application filed through his counsel Narayan Iyer observed that the Congress leader deserves a permanent exemption.

    The magistrate also set June 3 for recording evidence in the defamation suit filed by local RSS worker Rajesh Kunte.

    Kunte had in 2014 filed a private complaint before the Bhiwandi magistrate’s court after watching Gandhi’s speech where he allegedly accused the RSS of Mahatma Gandhi’s assassination. Kunte claimed this statement slandered the reputation of the RSS.

    Gandhi had appeared before the court in June 2018 and pleaded not guilty.

    “Accused Rahul Rajiv Gandhi is hereby exempted from appearance in the court till the further order passed by the court subject to following conditions,” reads the order, a copy of which was accessed by PTI.

    “Accused to undertake that his duly designated advocate punctually and regularly appears before court on each and every scheduled date and conduct the trial in absence of accused,” says one of the conditions. “Accused to remain present in court as and when directed,” reads another.

    Rahul Gandhi, who was recently disqualified as an MP after his conviction by a Surat court in a defamation case, had last year sought exemption from appearance in the Bhiwandi court on the grounds that he was a Delhi resident and a Lok Sabha member who had to visit his constituency (Wayanad), attend party work and travel a lot. Gandhi had requested that whenever required, he be allowed to be represented by his lawyer in the hearing.

    Kunte recently argued that since Gandhi is no longer a parliamentarian, he should not be given an exemption in the matter.

    The Surat court had on March 23 sentenced Gandhi to two years in jail in a 2019 criminal defamation case filed against him over his “why all thieves have Modi surname” remarks. The court also granted him bail and suspended the sentence for 30 days to allow him to appeal in a higher court. The next day, he was disqualified as a member of the Lok Sabha.

    New Delhi: The Supreme Court has asked police officers in Maharashtra to compensate a woman for keeping her in illegal detention despite she being granted interim protection and two weeks to surrender it.

    A bench of Justices S.K. Kaul and A. Amanullah observed that the woman, an accused in a criminal case, got the interim protection on November 17, 2021 and the apex court had granted her two weeks’ to surrender and apply for regular bail.

    Expressing discontent with the illegal detention of the woman, the bench noted that the court had given interim protection to the petitioner and despite the same, she was taken into custody.

    The petitioner had submitted before the court that she had also shown the court’s order to the police, though she was bailed out next but she was in custody for a day.

    The top court ordered that the petitioner should be compensated with Rs 15,000 for the illegal detention for one day which will be shared by the two police officers and the payment to be made within a period of two weeks.

    The bench noted that two police officers filed their affidavit seeking to express unconditional apology. However, the bench said that behaviour of the officers was in the teeth of the court’s order and cautioned the police officers to be careful in future.

    The top court passed the order on a contempt plea filed by the woman against two police officers. In a previous order passed in January this year, the bench had noted petitioner’s counsel arguments that despite the November 2021 order, within two days the woman was arrested from a hospital where she was working as a nurse.

    The bench noted that the police officers were ready to compensate the woman from their own pocket in the matter.

    In 2021, the woman had moved the apex court challenging the Bombay High Court order, passed in August 2021, refusing to entertain her plea for anticipatory bail in the case.

    Mumbai: Maharashtra minister and senior Bharatiya Janata Party leader Chandrakant Patil on Monday said not a single worker of the Shiv Sena was near the Babri Masjid in Ayodhya when it was brought down by the Bajrang Dal and Durga Vahini on December 6, 1992.

    Patil, minister of higher and technical education in the Eknath Shinde government and a former Maharashtra BJP chief, made the comment while speaking to a regional news channel.

    Incidentally, Shiv Sena founder late Bal Thackeray has often been quoted as saying that he was proud if any of his Sainiks took part in the demolition of the disputed structure.

    “I was placed there by the Bajrang Dal for three-four months to facilitate kar sevaks arriving in Ayodhya. People participating were either from Bajrang Dal, VHP or Durga Vahini. Former Bihar state deputy CM (and senior BJP leader) Sushil Kumar Modi, legislator Harendra Kumar and I were given the task to manage the kar sevaks and ensure their safe passage,” Patil claimed.

    “We three were working there as national general secretaries. The RSS’ strength was behind us but it did not participate openly. It had distributed its work to like minded organisations,” Patil claimed.

    Patil further said Shiv Sena (UBT) Rajya Sabha MP Sanjay Raut keeps talking about the Babri Masjid demolition, adding he wondered if the latter was even there at the temple town in Uttar Pradesh at the time.

    He also took a swipe at Uddhav Thackeray for accusing Chief Minister Eknath Shinde of stealing the legacy of Bal Thackeray.

    The late Shiv Sena founder was not the property of anyone and was someone who was hugely respected by the people, Patil added.

    “Balasaheb is the property of all Hindus and everyone is free to use his name (legacy),” said Patil.

    The Shiv Sena split in June last year after the rebellion by Shinde, who got the party name and ‘bow and arrow’ symbol, while Uddhav Thackeray’s faction was christened Shiv Sena (UBT) with a flaming torch as its symbol.

    Pune: Maharashtra Minister and senior BJP leader Chandrakant Patil on Monday said he believed civic polls in the state would be held in October-November if the Supreme Court gives it order on reservation for Other Backward Classes as well as ward delimitation by May.

    Speaking to reporters, Patil said if the decisions on these matters come by May, then delimitation and other aspects can be carried out by the Election Commission during the monsoons, when it would not be feasible to hold polls, and the civic elections can take place by October-November.

    The SC will begin its one-and-half month long recess on May 9, Patil, a former state Bharatiya Janata Party chief, said.

    Civic polls in Mumbai, Pune, Kalyan Dombivali, Pune, Pimpri Chinchwad, Vasai-Virar, Kolhapur, Aurangabad, and Navi Mumbai are due since early 2022 but were not held because of the coronavirus pandemic.

    These municipal corporations are currently under administrators.

    Pune: Maharashtra Leader of Opposition and NCP leader Ajit Pawar on Monday condemned the use of unsavoury words such as “worthless” and “kartoos” (bullet) in politics and said people should follow the path shown by former chief ministers Yashwantrao Chavan, Vasantdada Patil and NCP chief Sharad Pawar.

    Ajit Pawar’s comment has come as an apparent jibe against former chief minister Uddhav Thackeray who dubbed Deputy Chief Minister Devendra Fadnavis as “worthless” and the latter’s reaction that he was “kartoos” (bullet), which will not bow down, but pierce.

    “People don’t understand what to say when they get a mike their hand…We inherited good thoughts and values from former chief minister Yashwantrao Chavan, who laid the foundation for a cultured Maharashtra during the Samyukta Maharashtra movement,” the NCP leader said at an event in Satara.

    He exhorted people to follow the paths shown by former chief ministers Chavan, Vasantdada Patil, Vasantrao Naik and Sharad Pawar.

    “Today, all unwanted things are happening in the state. We did some work (when the Maha Vikas Aghadi government was in power), but now the work has been stalled,” Ajit Pawar said.

    Hyderabad: The Bharat Rashtra Samithi (BRS) on Saturday organised a ‘Maha Dhama’ to protest against the Centre’s decision to auction Singareni Collienes Company Limited (SCCL) coal mines during Prime Minister Narendra Modi’s visit to the city on Saturday.

    BRS party working president and IT minister KT Rama Rao (KTR) took to Twitter to share a news report of the central government removing four Tamil Nadu coal blocks from the auction list following strong objections in the state. He said that the BRS is demanding the same reaction from the union government.

    KTR alleged that the BJP is discriminating against Telangana in comparison with other states.

    Welfare Minister Koppula Eashwar, MLA Korukanti Chander and other leaders took forward the Maha Dhama in Godavarikhani chowk.

    Eashwar said that the Union government is “selling” Indian Airlines, ports, Life Insurance Corporation (LIC), Bharat Sanchar Nigam Limited (BSNL) and other public sector units to PM Modi’s “frends” Adani and Ambani. “On similar lines, Singareni, which is running in profits, will be privatised and the employees will lose their jobs because of the lack of mines”

    Panchayatraj minister Errabelli Dayakar Rao and ST Welfare Satyavathi Rathod participated in the Maha Dharna in Jayashankar Bhupalpally.

    Forest minister Allola Indrakaran Reddy, MLA N Diwakar Rao and other party leaders were present at the protest staged at Naspur mandal centre. BRS whip Balka Suman demanded the centre abandon its plans to auction the Satthupalli, Shravanapalli and Penugadapalli coal blocks.

    Speaking at the protest, Suman dubbed the auction of coal blocks as “a conspiracy” to wreck the economical condition of Telangana and warned that failure in stopping the auction will lead to a boycott of BJP leaders from the coal belt area.

    Transport minister Puvvada Ajay Kumar, MP Vaddiraju Ravichandra, MLAs Vanama Venkateshwar Rao, and K Upender Reddy continued the Maha Dhama in Kothagudem.

    Talking about the Maha Dharna, the BJP MLA Eatala Rajender held that the state government was responsible for the debts incurred by Singereni Collieries Company Limited (SCCL).

    After the amendment of the Mines and Minerals Regulation Act in 2015 that gave leverage to the Telangana government to get coal blocks allocated through Coal India, it failed to apply and secure even one of the four coal blocks directly under its control since 2017,” said Eatala.

    Rajender further alleged that the BRS willfully made the Singareni write to the Centre that mining the Tadicherla block wasn’t feasible. “Genco was allocated the Tadicherla coal block, and it requested Singareni to do the mining. But Singareni was asked to submit that it wasn’t viable,” said Eatala.

    Nashik: More than 60 persons suffered food poisoning at a religious programme in Maharashtra’s Nashik district on Friday and the condition of two of them was serious, a police official said.

    These persons had “mahaprasad” at an ‘Akhand Harinam Saptah’ organised in Thangaon Barhe village in Surgana tehsil to mark Hanuman Jayanti, he said.

    “They complained of vomiting, uneasiness and stomach pain and were rushed to the sub district hospital in Barhe. The condition of two of them is serious and they have been shifted to district civil hospital in Nashik. Samples of the food have been sent for analysis,” he said.

    The number of those affected may rise as it was a well-attended programme, the official added.

    Hyderabad: Bharat Rashtra Samithi’s (BRS) working president and Telangana minister KT Rama Rao on Thursday gave a call for a massive protest against the centre’s decision to auction Singareni Collieries Company Limited (SCCL) coal mines.

    Stating that the centre issued a notification to auction the mines in Sathupalli Block 3, Shravan Palli, Penagadapa, KTR demanded the auctioning process, which was scheduled to be conducted from March 29 to May 30, to be rolled back.

    Vehemently opposing the central government’s ‘veiled attempts’ to privatise the SCCL, KTR gave a call for Maha Dharna, a press release stated.

    Further, he demanded that SCCL should allocate the mines without auctioning. “BRS leaders and activists along with Singareni employees will protest against the centre, in Mancherial, Peddapalli, Ramagundam on April 8,” said the minister.

    KTR spoke about the economic significance of SCCL, the centre’s conspiracy to impede Telangana’s growth by privatising SCCL, and the disastrous impact of its privatisation on various sections of the state.

    ‘Why privatise when SCCL is profitable?’

    “Can anyone from the Centre dare to reason the need for privatising SCCL when it is setting records in terms of production, profits and Plant Load Factor (PLF)?” he said.

    BRS’s working president said, “The centre is conspiring to push Singareni, which is currently reaping profits, into losses by not allocating the coal mines. The Centre sold many Public Sector Units (PSU) which made profits. Vizag Steel Plant (VSP) was also pushed into losses by not allocating mines to it”.

    KTR slams PM Modi

    He informed that the chief minister and BRS president K Chandrashekar Rao had already written to the centre stating that the coal mines needed for SCCL be allocated to it.

    Adding that Singareni Employees have also placed the same demand he accused, “Though the state urged the union government for the past several years for the allocation of the mines to Singareni, the centre turned a deaf ear to it. This is despite the allocation of a large number of Lignite mines to Gujarat Mineral Development Corporation (GMDC) through nomination”.

    The minister alleged, “The prime minister who was generous towards Gujarat, discriminated against the progressive Telangana. PM Narendra Modi who visited Ramagundam on November 11, 2022, assured that Singareni would not be privatised. But the PM did not stand by his promise. How would Modi respond to it during his next visit to the state?”

    ‘SCCL privatisation – an attempt to gut agriculture and mar CM KCR’: KTR

    KTR termed the privatisation of the SCCL as an ‘attempt to mar CM KCR’s determination’ to provide 24-hour free electricity to farmers. He also alleged that the centre is trying to force the farmers to rely on bores for farming again.

    “Singareni plays a crucial role in thermal power generation in the State and provides high-quality power to agricultural needs, industries, and domestic requirements, the Centre is creating obstacles to this,” he said.

    “The centre is not able to digest the appreciation Kaleshwaram Lift Irrigation Project has been receiving and it is plotting to deprive the lift irrigation projects of power supply,” he further said.

    Mumbai: Amid a row over the removal of certain references in NCERT’s new class 12 textbooks, BJP’s Maharashtra chief Chandrashekhar Bawankule on Wednesday said some people had deliberately written “negative content” in history textbooks and there was a need to drop it.

    He also said that although he was against some “negative descriptions” in textbooks, facts need not be removed from them.

    “Gandhiji’s death had magical effect on communal situation in the country”, “Gandhi’s pursuit of Hindu-Muslim unity provoked Hindu extremists” and “Organisations like RSS were banned for some time” are among the portions missing from the class 12 political science textbook for the new academic session.

    A political row has erupted over it with the Congress accusing the government of distorting history and “whitewashing with a vengeance”. The National Council of Educational Research and Training (NCERT), however, claimed that no curriculum trimming has taken place this year and the syllabus was rationalised in June last year.

    Answering a query on the issue during a press conference, Bawankule said, “Some people have deliberately written negative content in our history books. It needs to be removed.”

    “Our country is marching ahead, progressing and going to be the greatest country in the world. There is no need for negative content,” he said.

    After the press conference, when the Bharatiya Janata Party (BJP) leader was asked about his remarks on the issue, he said he was making a general statement over it and not referring to any specific issue.

    Replying to a question about why historical facts were being removed from textbooks, he said, “I am talking in general and not particularly about the omission of some chapters or issues. Facts need not be removed from history. My objection is about some negative descriptions.”

    Thane: Taking forward the cause of “Hindutva”, Maharashtra Chief Minister Eknath Shinde on Sunday announced that he will visit Ayodhya on April 9.

    This will be a second visit by a Maharashtra CM to the upcoming Ram Temple – in March 2020, then Chief Minister Uddhav Thackeray had prayed there and now present Shinde will perform an ‘aarti’ there.

    Shinde will be accompanied by his party Ministers, MLAs, MPs and other leaders on their maiden trip to Ayodhya.

    Like Thackeray two years ago, Shinde will also perform the aartis and other rituals at the Sarayu River and worship Ram Lalla there, besides visiting the Shri Hanuman Garhi Temple.

    The developments follow an invite by a Mahant of Ayodhya who extended a personal invitation to the CM to visit the Lord Ram Temple, and a week after the Maharashtra government sent the first consignment of prized teak-wood from Chandrapur district for the temple construction.

    Earlier, then minister Aditya Thackeray had visited the Lord Ram Temple and offered prayers there in June 2022, barely a fortnight before the MVA government was toppled by a Shinde-led rebellion.

    However, Maharashtra Navnirman Sena President Raj Thackeray – the estranged cousin of Uddhav – was prevented from going to Ayodhya in early June 2022 in view of threats by the Uttar Pradesh BJP MP Brijbhushan Sharan Singh, though the MNS-BJP are now cosying up in this state.
