Chennai: The Madurai bench of the Madras High Court on Tuesday directed that unauthorised and illegal fake websites running in temple names should be banned across Tamil Nadu.

The direction came on a petition seeking to block websites operating in the names of major temples in Tamil Nadu and action against the operators of those websites.

The petition, filed by Subramanian and Markandan, read, “Many people start fake websites in the name of important temples including Chennai Kapaleeswarar Temple, Madurai Meenakshi Amman Temple, Thanjai Periya Temple, Palani Murugan Temple, Srirangam Aranganathar Temple. Devottess give money thinking that the website belongs to the temple and therefore such websites should be blocked.”

“Cybercrime should find out how much money has been collected through those websites and confiscate the amount. The authorized website address of the temples should be made known to the public through the IT department,” said the bench of justices Mahadevan and Sathya Narayana Prasad.

The bench said steps should be taken to perform pujas, and donations through authorised websites. Devotees should be advised to deposit money in the temples or pay through authorised websites.

“If a complaint is received about fake websites, it should be investigated immediately and legal and criminal action should be taken against the operators of fake websites,” the bench said.

The judges stated further that Tamil Nadu temples, like Tirupati and Sabarimala shrines, should be run in a transparent manner.

  • Muslim women can approach only family courts for divorce: Madras HC

Muslim women can approach only family courts for divorce: Madras HC

    [ad_1]

Chennai: The Madras High Court has ruled that Muslim women should approach only family courts and not private bodies like Shariat Council consisting of a few members of Jamaat in order to seek ‘Khula’ (divorce).

The court held that the Khula certificates issued by the private bodies are invalid in law.

A bench of Justice C. Shivaraman quashed a Khula certificate issued by the Shariat Council of Tamil Nadu Towheed Jamath, Chennai, and directed the estranged couple to approach a family court or the Tamil Nadu Legal Services Authority to resolve their disputes.

The judge issued the direction while hearing a petition of a man seeking the court quash the Khula certificate obtained by his wife from the Shariat Council in 2017.

The petitioner also contended that the Shariat Council, registered under the Tamil Nadu Societies Registration Act, 1975, has no authority to issue such certificates. He also told the court that he had filed a petition restoring conjugal rights in 2017 and obtained an ex-parte decree also.

He said that a petition for executing the decree was pending before an additional family court judge.

The court heard the petitioner and the Shariat Council as the petitioner’s wife chose to remain absent and did not appear in person or through counsel.

The judge further said that only a judicial forum was empowered to pass a decree to dissolve a marriage under Section 7(1)(b) of the Family Courts Act, 1984.

Justice Shivaraman also said that the Madras High Court in the Badar Sayeed versus Union of India (2017) case had restrained Khasis from issuing Khula certificates.

2015 Dalit youth murder: Madras HC judges inspect crime spot, rail track

    [ad_1]

Chennai: Madras High Court judges Justice M.S. Ramesh and Justice Anand Venkatesh inspected the Tiruchengode Arthanareeswar temple and the rail track in Tamil Nadu’s Namakkal district where the body of Dalit youth Gokul Raj, abducted and murdered in 2015 for going around with an upper class girl, was found.

Gokul Raj was murdered by a gang headed by S. Yuvaraj, a self-proclaimed youth leader of a dominant caste outfit, for visiting the Tiruchengode temple along with a girl, Swathi, who belonged to an upper caste.

The Dalit youth was abducted by the members of the caste outfit and later his body was found with his head severed on the rail track near Pallipalayam in Namakkal.

Gokul Raj was in love with Swathi and had visited Tiruchendur temple along with her. Now, Swathi has turned into a hostile witness in the case and is facing perjury.

A special court for cases under the Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act in Madurai had sentenced Yuvaraj and ten others to life imprisonment while acquitting five others.

Gokul Raj’s mother Chithra, however, had moved the Madurai bench of the Madras High Court seeking capital punishment for Yuvaraj and others and against the acquittal of five others.

Justices Ramesh and Venkatesh decided to conduct an inspection of the crime scene to understand the topography of the area as also the exit and entrance gates as well as the CCTVs’ location in the temple.

The judges inspected the area on Sunday and inspected all eight CCTV cameras as well as all entrances and exits.

After the temple premises, the judges inspected the rail track at Pallipalayam where the body of Gokul Raj with his head severed was found.

Lawyers and family members of both Gokul Raj and Yuvaraj were present but they were not allowed to meet the judges.
