    ‘Lived together only for 40 days’: SC declines to dissolve marriage of couple

    New Delhi: The Supreme Court has declined to use its plenary powers under Article 142 of the Constitution to quash a marriage — where the parties had met on Facebook in December 2019 and got married in December 2020 as per Christian rites and customs at a Mangaluru church, noting that parties have lived together only for 40 days.

    A bench of Justices Rajesh Bindal and Aravind Kumar said: “We do not find this to be a fit case for exercise of power under Article 142 of the Constitution of India as good sense may prevail on the parties. They had lived together only for 40 days. It takes time to settle down in marriage.”

    The plea was filed by Mangaluru doctor and CEO of a global health organisation to use the court’s extraordinary power under the Constitution to dissolve his marriage with a permanent resident of Canada. He contended that there is an irretrievable breakdown of marriage and this court should exercise its jurisdiction under Article 142 to dissolve the marriage.

    The apex court also dismissed a plea by the wife to transfer the divorce proceedings filed by her husband from Mangaluru to a court in Mumbai.

    “Though, at present, considering the financial condition of the parties on the basis of material which has come on record, we do not find that any ground is made out for issuing direction to the respondent (husband) to pay the expenses to the petitioner for travelling to Mangaluru. However, still in case she feels like seeking reimbursement of expenses, she shall be at liberty to file an application before the court concerned, which may be examined on its own merits,” it said.

    The bench noted that both the parties are well-educated and engaged in their own jobs and professions. She can travel to Mangaluru to attend the hearing of the case and can also seek exemption from appearance whenever required, it said.

    “In our view no case is made out for transfer of the petition from Mangaluru, Karnataka to Mumbai, Maharashtra,” the bench said. The court pointed out the wife is a permanent resident of Canada and she must be travelling abroad regularly.

    The top court noted that a number of transfer petitions are filed in matrimonial cases, primarily by the wives for transfer of matrimonial proceedings, initiated by the husband.

    “This court normally has been accepting the prayer made while showing leniency towards ladies. In Anindita Das vs Srijit Das (2006), this court observed that may be this leniency was being misused by women. Hence, each and every case has to be considered on its own merits,” the bench said.

    Prayagraj: Two days after Chief Minister Yogi Adityanath announced that ‘mafia ko mitti mein mila denge (mafia will be finished)’, the Prayagraj Development Authority (PDA), on Wednesday, started demolishing the house of kin of mafia-turned-politician Atiq Ahmed.

    Atiq Ahmed along with his wife Shaista Parveen, their two sons and his brother Ashraf, have been named as accused in the Umesh Pal murder case.

    The house, located in Chakia under Kareli police station of Prayagraj, is said to belong to one Khalid Jafar where Shaista Parveen was currently residing after Atiq Ahmad’s own house was demolished for having been “illegally constructed” in September 2020 as part of an action against him.

    Confirming the demolition, PDA vice-chairman Arvind Kumar Chauhan said, “The house was illegally constructed in violation of set norms and is therefore being demolished. Notice was issued to the owner and all the requisite process was followed.”

    The cost of the house is estimated to be around Rs 2.5 crore.

    Umesh Pal was a key witness in the 2005 BSP MLA Raju Pal’s murder case in Prayagraj in which Atiq Ahmed and his brother Khalid Azeem besides many close aides are prime accused.

    On the evening of February 24, armed men opened fire on Pal and two policemen outside his residence in the Sulem Sarai area of Prayagraj.

    Umesh Pal and one of the policemen, Sandeep Nishad, died while another security personnel Raghvendra Singh is critical.

    On Monday, the local police eliminated Arbaaz in an encounter for his alleged role in the Umesh Pal murder case. Arbaaz’s link with former MP Atiq Ahmed has come to the fore.

    According to police, he worked as a domestic help in Atiq’s house since childhood. Later, Arbaaz worked as a driver for Atiq’s sons.

    A police inquiry has revealed that Arbaaz, a resident of the district’s Sallahpur area, drove the car in which assailants reached the spot and fired shots at Umesh Pal and his security guards on February 24.

    ILooking back, it becomes clear how badly Corona has raged among old people. Almost every second corona death in Germany comes from a nursing home, as the nursing report by the Barmer Krankenkasse, which is available to the Düsseldorf Rheinische Post, shows. “In relation to the years 2020 and 2021, the cumulative proportion of home residents among those who died with Covid-19 is 45 percent,” write the authors.

    At the same time, the report shows that North Rhine-Westphalia has done better than many other countries in the fight against Corona. In December 2021 – at the peak of the second wave – 2.87 percent of the residents of the home fell ill with Corona. That was more than in Bremen (0.57 percent) and Schleswig-Holstein (1.27 percent), but much less than in Thuringia (9.73 percent) and Saxony (10.3 percent). “Countries with a lower acceptance of the corona measures also had higher proportions of Covid in the population,” the authors write. Saxony and Thuringia have particularly low vaccination rates.

    The Corona years left deep marks on nursing staff nationwide. According to the Barmer study, almost 70 percent say that they are often physically exhausted, compared to 43 percent before the pandemic. The number of nurses who can no longer sleep through the night has risen from 29 percent to 43 percent. Now many want to get out: 43 percent have thought about giving up their job. Before the pandemic, it was just under 20 percent.

    “As a society, we cannot afford for the staffing situation in nursing homes to worsen because employees give up,” said Heiner Beckmann, head of Barmer in NRW, and called for more health management and nursing care reform from a single source.
