    Vijayawada: A special court here has sentenced to life imprisonment a suspended Telugu Desam Party (TDP) leader for sexually harassing a 14-year-old girl and abetment of suicide.

    The POCSO Special Court awarded the sentence to 50-year-old Vinod Kumar Jain on Wednesday.

    Special Court Judge S. Rajini also imposed a fine of Rs 3 lakh on him. Out of this fine amount, Rs 2.4 lakh will be paid to the girl’s family.

    Unable to bear the sexual harassment, the girl had committed suicide by jumping from a five-storey apartment building on January 29, 2022.

    In a suicide note, which police later recovered from her bedroom, the student of class 9 wrote that she was ending her life due to sexual harassment by Vinod Jain, who resides in the same building.

    On a complaint by the girl’s grandfather, police had registered a case against Vinod Jain under sections 305, 306, 354, 509 and 506 of the Indian Penal Code (IPC) and Section 8 and of Protection Of Children from Sexual Offences (POCSO) Act and arrested him.

    Following the incident, TDP suspended Vinod Jain, who had contested in Vijayawada municipal elections on the party ticket.

    Police investigation into the case had revealed that the accused had been sexually harassing the girl by inappropriately touching her for two months. The girl wrote in her suicide note that Vinod Jain was resorting to harassment everyday in the apartment premises.

    The victim wrote that she did not reveal this to her parents due to fear and shame.

    The accused has remained in jail since February 2022. Police said 20 witnesses recorded their statements in the case and based on the evidence and after examining the witnesses, the court found him guilty.

    Vinod Jain has been sentenced for life under IPC section 305 (abetment of suicide of child) and fined for Rs 1 lakh. The court also sentenced him for seven years and imposed fine of Rs 50,000 under POCSO section 9 (L) and 10, three years imprisonment and Rs 50,000 fine under section 12 of POCSO, five years imprisonment and Rs 50,000 fine under IPC section 354 and three years imprisonment and Rs 50,000 fine under IPC section 509.

    SRINAGAR: Srinagar drunkard, who kidnapped, raped and brutally murdered a minor in 2007 was today awarded life imprisonment. The sentence is to be confirmed by the High Court.

    “I award life imprisonment to the convict Zahoor Ahmad Sheikh S/o Abdul Rashid Sheikh R/o Akhrajpora Rajbagh Srinagar for the commission of the offence under section 302 RPC,” the judgement delivered by Renu Dogra Gupta, the Second Additional Session Judge, reads. “Further the convict is sentenced to rigorous imprisonment of 7 years for offence punishable under Section 363 RPC and also sentenced to rigorous imprisonment for 10 years for the offence punishable under Sections 376 RPC. The sentences shall run concurrently.”

    The accused was convicted by the court on March 10, 2023, in an offence involving the kidnapping of a minor girl – the daughter of his cousin, and later murdering her brutally after rape in a deserted migrant house in the Ikhrajpora area.

    The court observed that the case does not fall in the rarest of the rare cases but is “almost on the border of the rarest of rare case”. The prosecution was seeking a death penalty but the amicus curie, appointed by the court, pleaded for a lenient view while imposing the sentence. His plea was that the case was decided on circumstantial evidence and not direct evidence.

    Convict Zahoor, who was 21 at the time of the commission of the heinous offence, is 37 now. For all these years he has been in judicial custody.

    The shocking case was reported on August 23, 2007, when the father of the Ikhrajpora girl reported to police that his daughter is missing. Her body was recovered a day later from a deserted migrant house in the same locality.

    SRINAGAR: An army court has recommended a life sentence for Captain Bhupendra Singh for his involvement in the killing of three civilians in a staged encounter in Amshipura, Shopian, in July 2020. The court-martial proceedings, which found that Captain Singh exceeded his powers under the Armed Forces (Special Powers) Act (AFSPA), were completed in less than a year.

    A Special Investigation Team (SIT) formed by the Jammu and Kashmir Police charged three people, including Captain Singh, for “staging a fake encounter”. Reports suggest that higher army authorities will need to confirm the sentence.

    The three youths, who came from the Rajouri district of Jammu, were killed in a remote hilly village in Shopian district on July 18, 2020, and were falsely labelled as “militants”. Social media raised concerns about the killings, leading to the army forming a Court of Inquiry that found evidence that the troops had exceeded their powers under AFSPA.

    The JKP’s SIT charge sheet alleges that Captain Singh provided false information to his superiors and the police about the staged encounter. The three accused allegedly destroyed evidence and spread false information as part of a criminal conspiracy aimed at receiving cash rewards, the SIT that was investigating the case in a parallel investigation had stated. However, the army denied that Captain Singh staged the encounter for a cash reward, claiming no such system exists for any acts in combat situations or otherwise in the line of duty.

    During the court martial proceedings, Mohammed Yusuf, Abrar Ahmed’s father, was called upon to provide a missing report about his son. Lieutenant Governor Manoj Sinha visited the families in Rajouri and conveyed Prime Minister Narendra Modi’s message that the government would support them. Through a DNA test, the three youths’ identities were confirmed, and their bodies were returned to their families and buried in their native village in Rajouri.
