    Oppn leaders target UP govt after Atiq Ahmad, brother shot dead

    Lucknow: Opposition leaders on Saturday questioned the law and order situation in Uttar Pradesh and demanded that the state government be dismissed after gangster-turned-politician Atiq Ahmad and his brother Ashraf were shot dead in Prayagraj.

    The “cold-blooded” killings are the “height of anarchy” in Uttar Pradesh, BSP MP Danish Ali claimed.

    Samajwadi Party chief Akhilesh Yadav said crime has reached its peak in Uttar Pradesh and criminals are unfazed.

    Ahmad (60) and Ashraf were shot dead at point-blank range by three men posing as journalists in the middle of a media interaction on Saturday night while police personnel were escorting them to a medical college here for a checkup.

    The brothers, both jailed in Prayagraj, were in handcuffs when they were killed in full view of camera crews around 10 pm. The horrifying visuals were circulated widely on social media platforms and television channels.

    Reacting to the incident, SP president Akhilesh Yadav said in a tweet in Hindi: “Crime has reached its peak in Uttar Pradesh and the criminals are unfazed. When someone can be shot dead amidst a police cordon, then what about the safety of the general public? An atmosphere of fear is being created among the public due to this and it seems that some people are deliberately creating such an atmosphere.”

    Rashtriya Lok Dal (RLD) chief Jayant Chaudhary asked if ‘jungle raj’ prevails in the state.

    “Nobody is sympathising with Atiq Ahmad because a criminal should be punished. But anyone who will see this video will question if we are a democracy. Every criminal has the right to be heard in court and be convicted there. But you can see they were killed in police custody in the open,” he said.

    He further said, “The chief minister should answer what kind of law and order he has established in the state. Is this not jungle raj and a ground to call for emergency rule in UP?”

    Video footage showed a man thrusting a gun at Ahmad’s head as he talks to reporters and the former SP MP collapsing. The footage also showed the three assailants firing at Ahmad and Ashraf even after they had fallen.

    The bullet-riddled bodies of Ahmad and Ashraf were taken away from the spot as tension gripped the area after the sensational killings.

    In a tweet, Rajya Sabha MP Kapil Sibal said, “Two murders in UP: 1) Atiq Ahmed and brother Ashraf 2) Rule of law.”

    Bahujan Samaj Party (BSP) MP from Amroha Danish Ali said the “cold-blooded” murder of Ahmad and his brother is the “height of anarchy” in Uttar Pradesh.

    “This can’t happen without a go-ahead from the top. In any other democracy the state government must have been dismissed for such a heinous crime against the rule of law,” he said in a tweet.

    The three assailants who fired at Ahmad and Ashraf were arrested immediately after the incident.

    In a tweet in Hindi, Uttar Pradesh minister Swatantra Dev Singh said, “Sins and virtue are accounted for in this birth…”

    The tragic end of Ahmad and his brother came on a day the ex-MP’s son Asad, who was killed in a police encounter in Jhansi on April 13, was buried in Prayagraj.

    Ahmad and his brother were brought to Prayagraj for a court hearing in connection with the Umesh Pal murder case and were remanded in police custody.

    Umesh Pal, a key witness in the murder case of BSP MLA Raju Pal, and his two police security guards were shot dead outside his Dhoomanganj residence here on February 24.

    Based on a complaint lodged by Umesh Pal’s wife Jaya Pal, a case was registered on February 25 against Ahmad, Ashraf, Ahmad’s wife Shaista Parveen, two sons, aides Guddu Muslim and Ghulam, and nine others.

    New Delhi: A host of leaders paid tributes to Bhim Rao Ambedkar, the architect of India’s Constitution, on his 132nd birth anniversary on Friday, with many recalling his efforts to uplift the marginalised sections of society and others stressing the need to build strong institutions and create an egalitarian society.

    President Droupadi Murmu, Prime Minister Narendra Modi and several others remembered the social reformer, economist and jurist, who went on to become the first law minister of the country.

    Prime Minister Modi said in a tweet Babasaheb dedicated his life to the empowerment of the deprived and exploited sections of society. He also shared an audio clip of his earlier remarks on Ambedkar’s life.

    At a ceremony in the Parliament complex, President Murmu and the prime minister were joined by Vice President Jagdeep Dhankhar and Lok Sabha Speaker Om Birla in paying floral tributes to Ambedkar. Birla called him an architect of social transformation who fostered equality, freedom, justice and brotherhood.

    Union Home Minister Amit Shah paid a floral tribute to Ambedkar in Birbhum in West Bengal. “Dr Babasaheb Ambedkar sought to illuminate the nation by kindling the spark within every Indian. He laboured to create a constitution that provides justice, equality, and freedom to every citizen,” he said in a tweet.

    Defence Minister Rajnath Singh said he “respectfully remembers and salutes” him on his birth anniversary. “Along with his contribution to the making of the Constitution, his active role in building the institutions of independent India is incomparable. Babasaheb is an inspiration for all of us in building a strong India,” he added.

    Telangana Chief Minister K Chandrasekhar Rao unveiled a 125-ft-tall statue of Ambedkar in Hyderabad. Flower petals were showered on the statute from a helicopter. The statue was built using 360 tonnes of stainless steel and 114 tonnes of bronze, at a cost of Rs 146.50 crore.

    Born in 1891 in a Dalit family in Mhow, near Indore, in the then Central Province (now Madhya Pradesh), Ambedkar rose from a humble background to become a leading voice of the marginalised people during the freedom struggle and is credited with introducing several social reforms.

    BJP chief JP Nadda paid his tribute to Ambedkar at the party headquarters in Delhi. He said Prime Minister Modi is working to fulfil his dream by working for the development and prosperity of all sections of society.

    However, Congress president Mallikarjun Kharge took a swipe at the government, saying the “culture of forcing silence” and branding people “anti-nationals” is a dangerous trend that will finish our democracy and destroy the Constitution. He recalled that Ambedkar had warned about the ills of ‘hero-worship’ or ‘Bhakti’ in the context of Indian politics.

    In an article in The Telegraph, former Congress chief Sonia Gandhi said, “As we honour Babasaheb’s legacy today, we must remember his prescient warning that the success of the Constitution depends on the conduct of the people entrusted with the duty to govern.”

    She also said the regime in power is “misusing and subverting” the institutions of the Constitution, and the people must act to defend the Constitution from this “systematic assault”.

    “Equality, liberty, fraternity & justice – the universal values Babasaheb Ambedkar championed, will always remain our guiding light & strength! Tributes to the architect of India’s Constitution on his birth anniversary,” said Rahul Gandhi.

    BSP president Mayawati said Ambedkar laid the strong foundation of a modern India by giving an ultra-humanist and welfare Constitution. “His life struggle is a ray of hope for crores of poor, labourers, deprived and other toiling people even today,” she said.

    In a tweet, she said, “Taking inspiration from him, the Bahujan Samaj Party was established on this day, 14th April, in 1984, to take forward the stalled caravan of self-respect and to unite the people who were divided on the basis of caste, which has set an example of social change and economic liberation, especially in UP.”

    Addressing a gathering at the Municipal Corporation of Delhi (MCD) headquarters, Delhi Chief Minister Arvind Kejriwal extolled Ambedkar for laying out a vision for equality and egalitarianism in society. He hailed his pursuit of higher education during the British era when not many Indians thought about getting degrees from institutions such as Columbia University and the London School of Economics.

    Ambedkar knew the value of education and its role in lifting society from poverty and bringing equality among people, he added.

    Several other chief ministers and governors also remembered Ambedkar’s efforts to make India a developed society.

    Maharashtra Chief Minister Eknath Shinde garlanded the portrait of Ambedkar at “Varsha”, his official residence in south Mumbai, and greeted the people on the occasion. He later visited Chaitya Bhoomi, the memorial of the chief architect of the Constitution, at Dadar in central Mumbai, and paid tributes.

    Maharashtra Governor Ramesh Bais tweeted, “Respectful tributes to the Architect of Indian Constitution Bharat Ratna Dr Babasaheb Ambedkar on the occasion of his birth anniversary.”

    Andhra Pradesh Governor S Abdul Nazeer and Chief Minister Y S Jagan Mohan Reddy, Telangana Governor Tamilisai Soundararjan, Gujarat Chief Minister Bhupendra Patel also paid tributes to Ambedkar.

    Bengaluru: BJP leader and former Deputy Chief Minister Laxman Savadi on Friday met several Congress leaders here confirming the rumours that he will be jumping ship soon.

    He met the Karnataka Congress in-charge Randeep Singh Surjewala, state President DK Shivakumar and Opposition leader Siddaramaiah.

    Savadi was denied a ticket by the BJP from the Athani constituency in Belagavi. Instead, Mahesh Kumatalli, who joined the BJP through ‘Operation Lotus’, has been allotted the ticket. Savadi claimed that the party has done injustice to him, and also said that he was not contacted by any leader from New Delhi.

    “The discussion is ongoing. It is a social call. Lakshman is a seasoned politician in the state,” he added.

    Lakshmi Hebbalkar, the Congress MLA from Belagavi Rural constituency has stated that Lakshman Savadi is a seasoned politician, who was in the top post in BJP government and his entry to Congress would strengthen the party.

    According to sources in Congress, Shivakumar is planning to utilize the opportunity to deliver blows to his political opponent BJP leader from Belagavi, Ramesh Jarkiholi. The development is likely to strengthen the Congress to win more seats in Belagavi district which has 18 seats.

    New Delhi: Bihar Chief Minister Nitish Kumar met CPI(M) General Secretary Sitaram Yechury, CPI leader D. Raja and other leaders here on Thursday amid talks of opposition unity.

    Nitish Kumar is on a three-day visit to New Delhi to bring the non-BJP parties together to fight against the BJP in the 2024 Lok Sabha elections.

    Yechury, while speaking to the media, said that his party and the Left have always believed that democratic parties with secular ideology need to unite.

    Yechury said: “We have to save the Constitution today and for that we have to defeat the BJP in the 2024 elections. Talks are on with other political parties as well… The front that is going to be formed will always be there after the elections.”

    Yechury tweeted: “With Bihar CM Shri Nitish Kumar to carry forward the efforts to unite secular democratic parties to safeguard the Indian Republic, Constitution and Democracy, severely assaulted by the BJP & Modi govt. Defeat the BJP in order to save India & people’s livelihoods.”

    Commenting on the seat-sharing formula, Yechury said that the political alliance will be decided by the CPI(M) according to the circumstances in the states. He added that seats will be distributed as per the political situation in different states.

    Citing the example of Kerala, he said that the BJP has no hold there, so the competition will be between the Congress and the Left parties, but in the states where the BJP has to be fought, the opposition parties will coordinate on the seats.

    Patna: Bihar Chief Minister Nitish Kumar, who reached New Delhi on Tuesday to discuss the current political situation with opposition leaders, met RJD national President Lalu Prasad Yadav at the official residence of his daughter and Rajya Sabha member Misa Bharti.

    JD-U national President Lalan Singh and Bihar Minister Sanjay Jha were also present at the meeting.

    Nitish Kumar is on a three-day tour to New Delhi to meet opposition leaders of the country including Congress leader Sonia Gandhi, party President Mallikarjun Kharge and other leaders and prepare a plan for the Lok Sabha election.

    After the formation of Mahagathbandhan government in Bihar, he had urged Congress top leadership to take initiative in this matter as quickly as possible.

    Nitish Kumar himself claimed last week that he had a telephonic conversation with Kharge, who had reportedly invited Nitish Kumar for a meeting to discuss the future plan of action in Bihar.

    Bihar is crucial for the Narendra Modi government as it has 40 Lok Sabha seats. As the BJP is not ruling in the state, it would not be easy for it to succeed here.

    The Bihar Chief Minister had also said that he will go to Delhi after the state Assembly’s Budget session, which concluded last week.

    Nitish Kumar has been advocating opposition unity ever since he formed the government in Bihar with the Mahagathbandhan. During his visit to the national capital in September last year, he had met Sonia Gandhi, Rahul Gandhi, Sharad Pawar, Arvind Kejriwal, D. Raja, Sitaram Yechuri and Akhilesh Yadav, a majority of whom he is likely to meet this time as well.

    New Delhi: The Supreme Court on Monday junked a plea moved by the Popular Front of India’s (PFI) student wing leader, K.A. Rauf Sherif, seeking a transfer of a money-laundering case lodged against him from Lucknow to Kerala’s Ernakulam.

    A bench of Justices V. Ramasubramanian and Pankaj Mithal said: “We find no legally valid and justifiable grounds to order this transfer. Therefore, this transfer petition is dismissed. Pending application(s), if any, stands disposed of accordingly.”

    The bench noted that the fact that the petitioner was sent to custody by the special judge at Ernakulam under Section 167(2) of the Code of Criminal Procedure and that, therefore, the filing of the complaint at Lucknow is impermissible, is not legally well-founded.

    The petitioner was arrested on December 12, 2020, in Kerala and he was produced before the magistrate on December 13, 2020, who sent him to judicial custody till December 24, 2020. “Therefore, the NIA moved an application under Section 167 of the Code before the Principal Sessions Judge, Ernakulam for the grant of Enforcement Directorate custody for a period of 14 days. An order under Section 167(2) of the Code had to be passed necessarily by the magistrate to whom an accused person is forwarded. In fact, Section 167(2) contains the words whether he has or has not jurisdiction to try the case. Therefore, the argument revolving around Section 167(2) of the Code also fails,” said the bench.

    It stressed that a special court in Lucknow dealing with cases lodged under the Prevention of Money Laundering Act (PMLA) cannot be said to be lacking in territorial jurisdiction to entertain the complaint. “In any case, the lack of jurisdiction of a court to entertain a complaint can be no ground to order its transfer. A congenital defect of lack of jurisdiction, assuming that it exists, inures to the benefit of the accused and hence it need not be cured at the instance of the accused to his detriment. Therefore, the first ground on which transfer is sought, is liable to be rejected,” it said.

    The bench noted that the second ground on which transfer is sought is that 7 out of 10 accused persons are residents of Kerala. “But this can hardly be a ground for ordering the transfer of investigation. Similarly, the third ground that a majority of witnesses are also from Kerala/south India is also no ground to order the transfer of the complaint,” it held.

    The ED had contended that Sherif had received huge amounts of money in his bank accounts through suspicious transactions.

    The Lucknow court had framed charges against Kerala-based journalist Siddique Kappan and six others in the PMLA case in December 2022. In October 2020, Kappan was arrested with three others on their way to Uttar Pradesh’s Hathras to report on the alleged gang rape and killing of a 19-year-old woman.

    Besides Kappan, the other accused in the case is Sherif and others. Sherif claimed that he was the General Secretary of Campus Front of India, which is now banned as an unlawful association, vide notification issued by the Union of India, Ministry of Home Affairs dated September 27, 2021 under Section 3 of the Unlawful Activities (Prevention) Act, 1967

    Hyderabad: The SSC exam paper leaks have taken an ugly political turn with political party leaders being accused as the primary culprits. BJP Lok Sabha MP from Karimnagar and state head Bandi Sanjay has been named as the main accused behind the leak of a Hindi SSC paper, and the Telangana Police had asked him to produce his mobile phone as part of the investigation.

    This demand for phones has been extended to other BJP leaders like Etala Rajender who has also been served with notices to produce his mobile phone. Bandi Sanjay has refused to share his mobile phone to the police and other leaders of BJP are expected to do the same. A day earlier, he wrote to the police stating that he lost his mobile. Bharat Rashtra Samithi (BRS) leaders have made this act of Bandi Sanjay not sharing his mobile phone political and have termed his refusal as a crime in itself.

    In their defence≤ they are citing how BRS leader Kavita was equally demanded by the Enforcement Directorate to produce her mobiles as part of the Delhi Liquor Scam investigation.

    In the age of spyware, where most politicians and human rights activists are already being spied on by the intelligence agencies, the demand for mobile phones for investigations is taking it to the next level. All the national agencies like ED, IT, CBI and police departments have been conducting data raids on media houses and human rights activists to clone their mobile phones. There has been long opposition to this practice of weaponizing state institutions for political purposes. 

    The danger of data raids

    The dangers of these data raids can be witnessed in our political system with no space for opposition. Beyond the information threats these agencies can use to blackmail critical thinkers in our society, seizure of mobile phones creates new challenges. Any electronic device that is being seized at the time of seizure requires to be cloned and only a copy of this device needs to be ideally taken as per the Evidence Act.

    Instead our policing agencies seize the entire device and don’t even provide a copy of the seized device. This is important with the ability of these agencies to plant evidence against people and use this planted evidence to arrest them. 

    Beyond the issue of planting evidence, Indian agencies have had a long history of leaking this information to friendly media organisations. Whatsapp chats have been shared and televised with flashing slogans in case of Sushant Singh Rajput’s death investigation, Aryan Khan’s arrest and not to forget the arrest of Arnab Goswami and his Whatsapp chats. Beyond the arrests and detention of famous personalities, the whatsapp chats of victims of crime can be weaponized by opposing counsel as was seen in the tarun tejpal’s trial in Goa court. 

    The fundamental right to privacy grants individuals the right to keep his information private and not be subjected to undue surveillance by various arms of the nation-state. A mobile phone in the digital age represents all the private information of an individual and can’t be demanded to be produced for every basic crime he is being accused of. Under Article 20(3) of the constitution, every accused has a right against self-incrimination, where he can’t be compelled to be a witness against himself. This protection offers individuals the right to not give evidence against himself. 

    There is at-least one on-going case in the Supreme Court where few academics have petitioned for creation of rules for device seizures. In Rama Ramaswamy & Others Vs Union of India Supreme Court has issued notice to determine the contours of device seizures and what are the limitations of this practice in case of academics, who have been subjected to this treatment by the Government.  

    I cannot recommend you to be sympathetic to the BJP or its leaders with the ongoing political oppression across the country. But it is important to understand the evolution of policing practices and lack of checks and balances, that even fail for the most powerful in our society. These new policing practices and statecraft are going to harm individuals with legal precedents that can’t be undone. 

    The ruling BRS in Telangana has made it clear enough they are retaliating against BJPs actions against BRS leaders, making this a tit for tat response. Investigations of corruption and scams in India have always been political with retribution towards political leaders instead of actually addressing the issue at hand. Even in this case, neither political parties are interested in advancing the wheels of justice, but are finding excuses to retaliate. 

    The common people in India are used to this game of politicians targeting each other and the media continues to fuel this hype. It is not just opposition leaders who are now afraid of using their mobile phones, but normal people do not want to share any critical news about the government as they are worried about punitive actions by the police. It is in no one’s benefit to go down a path of a surveillance heavy police state that harms people for standing up for what they believe in.

    Hyderabad: Bharat Rashtra Samithi (BRS) has suspended former minister Jupally Krishna Rao and former MP Ponguleti Sudhakar Reddy for anti-party activities.

    The party’s central office announced on Monday that they have been suspended on the orders of party president and Chief Minister K. Chandrasekhar Rao.

    The suspension came a day after Krishna Rao joined Srinivas Reddy, who had already raised the banner of revolt against the leadership.

    Krishna Rao on Sunday attended an Athmeeya Sammelanam programme organised by Srinivas Reddy in Kothagudem, where he slammed KCR for what he called the suppression of democratic voices.

    Krishna Rao alleged that instead of acting as a trustee of the state government and protecting people, the KCR government is suppressing democracy.

    “People who fought for Telangana statehood have been completely sidelined after KCR became the chief minister. People are suffering under KCR’s rule,” the former minister said.

    “Sarpanches are worried as the government failed to clear the pending bills and so are the contractors who completed irrigation projects,” he added.

    Krishna Rao also alleged that when people question KCR about these issues, they are harassed and police cases filed against them. He remarked that KCR and his family members are acting like kings and neglecting people and their problems.

    Srinivas Reddy said that KCR is dreaming of becoming a chief minister for the third time but it will remain a dream.

    Krishna Rao felt sidelined in the party after MLA Harshvardhan Reddy, who had defeated him in Kollapur constituency in Mahabubnagar district in 2018, switched his loyalties from the Congress to TRS (now BRS) after the Assembly polls. A few months ago, Krishna Rao had dared Harshvardhan Reddy for a debate on the constituency development.

    Krishna Rao had resigned from the Congress to join TRS in 2011. He was elected from Kollapur in 2014 on a TRS ticket.

    Srinivas Reddy, who was elected to the Lok Sabha from Khammam on YSR Congress Party ticket in 2014, later switched loyalties to TRS. He alleged that TRS leadership had made many promises but failed to fulfill them.

    He raised a banner of revolt after he was not even invited for the January 18 public meeting organised by BRS in Khammam. It was the first meeting of BRS after it changed the name.

    He recently met YSR Telangana Party (YSRTP) leader Y.S. Sharmila amid reports that he is planning to join the party.

    Hyderabad: A day after Telangana Chief Minister K. Chandrasekhar Rao skipped Prime Minister Narendra Modi’s programmes in Hyderabad, the war of words continued between BJP and BRS leaders on Sunday.

    BJP state President Bandi Sanjay Kumar took to Twitter and posted a picture of the shawl that he claimed was ready to be presented to KCR, as the Chief Minister is popularly called, at a public meeting at Parade Grounds.

    “Beautiful handloom shawl would have looked even better on CM KCR, if he had attended the meeting at Parade grounds yesterday,” he said.

    KCR had Saturday skipped the Prime Minister’s programmes which included flagging of Secunderabad-Tirupati Vande Bharat Express.

BRS govt is not cooperating for the development of TS even though Centre is committed to the development of the state,” Sanjay had tweeted after the meeting.

    Barpeta: Three leaders of the proscribed Popular Front of India (PFI) and Campus Front of India (CFI) were arrested by Assam police from Barpeta Road Railway station, police said on Saturday.

    Two of the three arrested are top leaders of PFI and one of CFI, superintendent of police Amitabh Sinha told reporters here.

    The trio were arrested from the railway station on Thursday night when they arrived there by train from Delhi, he said.

    The CFI leader was identified to be its national treasurer Jahidul Islam while the PFI leaders are its Assam secretary Jakir Hussain and state president Abu Sama, Sinha said.

    The police also seized Rs 1.5 lakh in cash and several documents from them, the SP said.

    Sinha said that the trio had fled from the state after both the outfits were banned in September 2022 and were continuing their activities from outside Assam.

    Police was on their trail for long and the three are being interrogated to ascertain the reason for their visit, he said.

    Islam and Hussain were residents of Baksa district, while Sama hails from Barpeta.

    A total 36 PFI activists were arrested from different parts of the state and New Delhi during a national crackdown against the outfit in September. It led to a ban on the outfit the same month.

    The organisation was found to be active in the minority-dominated districts, particularly in the char (riverine) areas, since 2014 when its activists began helping people from the community in filing documents for inclusion of their names in the National Register of Citizens.

    Prior to that, they were found to be mainly involved in educational activities in the riverine areas of Bengali-speaking Muslim dominated areas.

    PFI shot into prominence in the state during the protests against the Citizenship Amendment Act in 2019 and some of their activists were also arrested during the stir for alleged stone-pelting in the state.

    The CFI is the student wing of PFI. PFI, CFI and seven other associated outfits were banned by the Centre for unlawful activities in September, 2022.
