    Delhi excise policy ‘scam’ conspiracy by big leaders of AAP, Kavitha, YSRCP MP: ED charge sheet

    New Delhi: The alleged Delhi excise policy scam was a “conspiracy” by some of the big political leaders of the Aam Aadmi Party (AAP) and the ‘South group’ comprising BRS leader K Kavitha, YSR Congress MP M Srinivasulu Reddy and others who “used” proxies to conceal their involvement, the Enforcement Directorate (ED) has claimed in its latest charge sheet filed in the case.

    A local court took cognisance of this prosecution complaint, filed by the ED on April 27.

    “The scam included conspiracy hatched by government functionaries and political leadership cutting across states and payment of bribes to get undue favours,” the federal agency said.

    “The main arm of the entire Delhi liquor scam rests on the conspiracy orchestrated by the top leaders of AAP through Vijay Nair on one hand and the South Group which consisted of Raghav Magunta, Magunta Srinivasulu Reddy, Sarath Reddy and K Kavitha on the other hand.”

    Raghav is YSRCP Ongole MP Magunta Srinivasulu Reddy’s son.

    “They (South group) were represented by Arun Pillai, Abhishek Boinpally and Buchi Babu,” the agency alleged.

    In this conspiracy, it added, some of the big political leaders of various political parties have been found to be involved by using “proxies, dummies and web of exchanges/transactions to conceal their involvement”.

    “On one hand it is Manish Sisodia (AAP leader and former Delhi deputy chief minister) and other top leaders of AAP and Vijay Nair who was working under the overall guidance and sanction of Manish Sisodia,” the ED said.

    The agency has arrested a dozen people in this case till now including Sisodia, Nair (AAP communication in-charge), Raghav Magunta, and businessmen Reddy, Pillai and Boinpally. It has questioned and recorded the statement of Kavitha and Buchi Babu, alleged to be her accountant.

    The agency has furnished a statement of Buchi Babu, recorded under the provisions of the Prevention of Money Laundering Act (PMLA) on March 28, in which he said that he bought a property from Srihari of Phoenix Group in the name of Engrowth Capital.

    “D R Anilkumar, husband of Kavitha, was also a partner in this firm (Engrowth Capital). This firm has bought this land at a much-discounted rate from the market because K Kavitha is a big politician in Telangana.

    “Similarly, K Kavitha has bought another property of 25,000 sqft from Srihari and Buchi Babu coordinated this paperwork on the directions of K Kavitha,” he told the ED.

    “The market value of this property was Rs 1,760 per sqft while she only paid RS 1,260 per sqft. This was done by Srihari for K Kavitha because she is a big politician,” the ED quoted his statement.

    Kavitha, the MLC daughter of Telangana Chief Minister K Chandrashekhar Rao, has denied any wrongdoing. The AAP too has called these charges politically motivated.

    The ED also appended the statement of Arun Pillai, who is alleged to be the representative of Kavitha in the ‘South Group’, where he said that “in exchange of the kickbacks paid by K Kavitha to the AAP leaders, she got partnership stakes in Indo Spirits (an accused company in this case with its promoter being Sameer Mahandru)…”.

    “The amount of kickbacks paid was Rs 100 crore for this deal,” Pillai told the ED.

    “The excise policy scam has multiple branches which involved numerous business entities, persons, groups, key government functionaries and a number of middlemen.

    “The scam included conspiracy hatched by government functionaries and political leadership cutting across states and payment of bribes to get undue favours.”

    “The scam initiated with the drafting of the excise policy of 2021-22 by the AAP leaders, specifically by Manish Sisodia with an objective of generating illegal funds followed by a nexus/understanding between key players of the South Group and Manish Sisodia and thereafter managed by Vijay Nair, who is a representative of AAP, payment of advance kickbacks from the former to the latter in exchange of undue favours,” the ED said.

    This was followed by the usage of seemingly simple business entities for the ulterior motive of recouping and recovering the kickbacks paid, it said.

    Another aspect, it claimed in the charge sheet, of the scam involved various entities involved in a conspiracy to form cartels to increase their profits illegally and in violation of the principles/objectives of the Excise policy 2021-22.

    It is alleged that the Delhi government’s excise policy for 2021-22 to grant licences to liquor traders allowed cartelisation and favoured certain dealers who had paid bribes for it, a charge strongly refuted by the AAP.

    The policy was subsequently scrapped and the Delhi lieutenant governor recommended a CBI probe, following which the ED registered the case under the PMLA.

    On Monday night, Senate Majority Leader Chuck Schumer teed up two pieces of legislation: the debt-limit bill House Republicans passed last week that includes significant spending cuts and one that would suspend the debt limit through the 2024 election with no strings attached. While his actions don’t guarantee a floor vote on either, a Schumer spokesperson said “this process will ensure that once a clean debt ceiling is passed, the House bill is available for a bipartisan agreement” on spending and taxes “as part of the regular budget process.”

    Biden’s invite included Schumer, McCarthy, House Minority Leader Hakeem Jeffries and Senate Minority Leader Mitch McConnell. The president’s calls were first reported by The Washington Post.

    Senate Republicans praised the president for heeding calls that he meet with McCarthy, insisting that it’s time for the White House to get serious about haggling over fiscal concessions after House Republicans narrowly passed their proposal last week to make substantial cuts to government spending in exchange for staving off default.

    “Joe Biden better get his butt in gear and start getting serious about it,” said Sen. Kevin Cramer (R-N.D.). “He’s the president, he’s got a bill that’s been offered up, and it’s time to get Kevin McCarthy back to the White House and start working on it.”

    Democratic leaders continue to insist that Republicans hike the debt limit with no strings attached, as they have done repeatedly since the GOP took the House majority. Instead, they insist spending should be debated as part of the annual government funding process.

    The House GOP package — which would lift the borrowing cap by $1.5 trillion or until the end of March 2024, whichever comes first, and slash $130 billion in government funding next fiscal year — represents a major victory for Republican leaders hoping to gain leverage in stalled talks with the president.

    In the letter to top lawmakers Monday, Yellen noted that federal cash flow is “inherently variable,” so the nation’s debt default date could still come “a number of weeks later” than the worst-case prediction.

    “Given the current projections, it is imperative that Congress act as soon as possible to increase or suspend the debt limit in a way that provides longer-term certainty that the government will continue to make its payments,” Yellen said, noting that it is impossible to predict the exact date the nation could default.

    Cash from tax season has come in substantially lower than expected, prompting the Treasury Department’s warning that the U.S. could be at risk of default far sooner than forecasters had originally warned — with Congress’ nonpartisan budget office saying earlier this year that the country could hit the debt ceiling as late as September. Now the Congressional Budget Office is echoing Yellen’s appraisal, also warning Monday that “there is a significantly greater risk” of running out of borrowing ability in early June.

    There’s still some hope for a later deadline than early June: If the Treasury Department can scrape by for a few weeks beyond that point, a gush of revenue from quarterly tax receipts on June 15 is likely to help buoy the nation’s borrowing power for several more weeks, along with an accounting maneuver the department is allowed to execute at the end of June.

    To give the U.S. extra borrowing power before then, Yellen is taking another unexpected action. The Treasury Department will stop helping state and local governments shift their own debt to fall in line with tax rules, the secretary told lawmakers on Monday.

    Yellen noted that the move “is not without costs, as it will deprive state and local governments of an important tool to manage their finances.”

    Even before the secretary’s latest warning, the partisan standoff had begun to worry Wall Street traders and executives. They’ve laid out concerns about the likelihood of default in notes to investors but remain wary of pleading more directly to Congress for action to head off a default — one expected to devastate the global economy.

    Independent forecasters expect to issue their own updated debt-limit forecasts by mid-month. Those analyses from the Congressional Budget Office and the Bipartisan Policy Center typically offer more detail than the timeframe the Treasury Department publicly releases.

    Hate speech against the Muslim community dominated the Hindu Janjagaran Dharmsabha, an event organised by a Hindutva organisation called the Sakal Hindu Samaj in Daighar Gaon in Thane district, Maharashtra.

    The event occurred on Sunday, on the eve of Maharashtra Formation Day which falls on May 1.

    Many right-wing leaders took part and spun a narrative regarding how the Hindu community is in constant danger from the Muslim minorities in the country.

    One of them, Muni Nilesh Chandra Maharaj, went as far as crediting Nathuram Godse (assassin of Mahatma Gandhi) as the sole reason why India is still dominated by the Hindus.

    Using the metaphor chand-sitaare (which translates to the moon and the stars), symbols in an Islamic flag, he said, “Gandhiji ka prem sirf chand-sitaare see tha. Godse ne yadi seene mein goli nahi thoki hothi tho aaj tho aaj poora Hindu samaj Makkah-Madina mein namaz pad raha hotha (Gandhiji was only interested in stars and moons. Had Godse not shot Gandhi on his chest, the whole Hindu community would be offering namaz in Makkah-Madina).”

    Chandra Maharaj further added that it is required to transform oneself into a hardcore Hindu to save the community.

    Other speakers such as Bharatanand Saraswati Maharaj urged Hindu women to carry a weapon in order to ‘safeguard themselves from Muslim men’.

    “These (Muslim) graveyards in Mumbra should be destroyed. If the Forest Department does not take any action, then kar sevaks will do the needful,” the seer said.

    He also appealed to the crowd to watch ‘The Kerala Story’, an upcoming Hindi movie that allegedly speaks about religious conversions of Kerala Hindu women and how the Muslim community ‘trap’ and recruits them into ISIS (a Muslim terror organisation).

    “I would ask everybody to support The Kerala Story movie. It says around 32,000 Hindu women are trapped as part of ‘love jihad’,” Saraswati Maharaj claimed.

    Sadhvi Saraswati targeted Muslims by discouraging the crowd from doing any kind of business with the Muslim community.

    “Take that car you always wanted to buy after two years, but refrain from doing any kind of business with them (Muslims). Do not sell your land to Muslims,” she said referring to ‘land jihad’.

    “Hindu ko Hindu ki kaatha hai. Secularism ke vajah se (Only a Hindu can destroy another Hindu and secularism is to blame),” she said.

    Referring to AIMIM president Asaduddin Owaisi as a jackal, Sadhvi said, “Bhool ja geedar, tera sapna sapna reh jayega kyunki is dharthi pe keval Hindutva raaj karega (Your dream will remain a dream. Only Hindutva will rule in this soil).”

    On April 28, the Supreme Court of India passed an order giving a free hand to the police force of all states and Union Territories to file a suo moto case against those inflicting hate speech.

    The order shall be made applicable irrespective of religion and warned that any delay in registering cases will be treated as contempt of the court.

    “Where have we reached in the name of religion? What have we reduced religion to is really tragic,” the apex court had then observed and directed Uttar Pradesh, Delhi and Uttarakhand to crack down hard on those making hate speeches, calling them shocking for a country that is religion-neutral.

    Amaravati: The Andhra Pradesh Police’s CID on Sunday arrested former Telugu Desam Party (TDP) MLC Adireddy Appa Rao and his son and TDP state Executive Secretary Adireddy Srinivasa Rao in a case relating to financial irregularities in a chit fund company.

    The CID sleuths arrested the father-son duo from their residence in Rajamahendravaram and shifted them to the CID office. Appa Rao, who is the husband of TDP Rajahmundry MLA Adireddy Bhavani and their son Srinivasa Rao are said to be directors in Jagajjanani Chit Funds Private Ltd.

    The main opposition party condemned the arrests. Several party leaders and workers reached the party office in Rajamahendravaram and voiced their protest over the arrests.

    Meanwhile, TDP national President and former Chief Minister N. Chandrababu Naidu spoke to Bhavani over phone and expressed solidarity with her.

    Naidu said that the political harassment and vendetta by the YSR Congress Party (YSRCP) government is increasing by the day. He lamented that there is no change in the ruling party’s behavior.

    The TDP President said the YSRCP government believed only in illegal cases and illegal arrests. He said the arrest of Appa Rao and Srinivasa Rao is another example of the YSRCP government’s politics of vendetta.

    Naidu alleged that Chief Minister Y.S. Jagan Mohan Reddy does not want anybody to do business in the state. “Is CID a government investigation agency or YSRCP threatening agency,” he asked

    The TDP chief said despite courts reprimanding the government on many occasions, the Jagan government has not mend its ways.

    TDP’s Andhra Pradesh unit chief Atchanaidu said the party was not afraid of illegal cases and arrests. He alleged that there is no difference between YSRCP ‘goondas’ and CID officials. The former minister said while on one hand, YSRCP leaders were resorting to physical attacks on TDP workers, the CID, on the other, is raiding the houses of TDP leaders in the name of searches.

    SRINAGAR: The National Investigation Agency (NIA) has opposed the bail plea of separatist leader Nayeem Ahmad Khan in a case related to alleged terror funding under the Unlawful Activities Prevention Act (UAPA) before the Delhi High Court.

    Khan has been in judicial custody since August 14, 2017, and has been accused by the NIA of “creating unrest” in the Kashmir valley. He was arrested on July 24, 2017, and charges for various offences under the Indian Penal Code, including sedition and UAPA, were framed against him by a special NIA court on March 16 last year.

    The NIA has submitted that evidence collected in the case clearly establishes a prima facie case against Khan and that he was involved in terrorist and funding activities. Certain letters were found during search and seizure from Khan’s residence showing that he was getting students admitted for MBBS courses in Pakistan, according to the agency.

    The NIA has alleged that this shows Khan’s involvement in terror funding out of commission earned from getting students admitted to MBBS courses in Pakistan. Various videos have also been relied upon by the NIA to allege that Khan is seen leading a “pro-ISIS rally” and “visiting areas where terrorists were killed.” The NIA has stated that the videos have conversations by Khan about funding from Hizbul Mujahideen.

    The matter will be heard on May 03 by a division bench of Justice Siddharth Mridul and Justice Talwant Singh. The case alleges that there was a larger criminal conspiracy for causing disruption in the Kashmir valley by way of “pelting stones on the security forces, systematically burning of schools, damage to public property, and for waging war against India.” The case has been registered under various sections of the Indian Penal Code and the UAPA.

    While denying him bail, the special NIA judge had noted that a detailed scrutiny of evidence and statements of various witnesses was done at the time of framing of charges and it was concluded that there is sufficient evidence available raising “grave suspicion” regarding Khan’s involvement.     A source said that Congress has organised the meeting as the BJP is “trying to draw in Congress leaders to its fold in Dharwad and Hubballi”.

    Thousands of people participated in the roadshow of Priyanka Gandhi Vadra later in Kundagol.

    Addressing the crowd, she said “if the Congress is voted to power, the life of people would reform”.

    “During the regime of BJP, the woes of people were only aggravated,” she said.

    “The party has given guarantee cards to every house in Karnataka. We have assured that women heads of families would get Rs 2,000. The schemes such as Anna Bhagya and Ksheera Bhagya would be implemented. Women will get free travel facilities. We will fulfill all assurances,” she said.

    The vote should be given to the future of the state. The price rise has affected people. This election will shape the future of young children, she said.

    Priyanka Gandhi would address public meetings in Khanapur on Sunday. She is also scheduled to hold a public meeting at Jamakhandi in Bagalkot district as well as in north Karnataka.

    Those directives, combined with the Fed’s implementation of a bipartisan bank deregulation law passed by Congress in 2018, “impeded effective supervision by reducing standards, increasing complexity, and promoting a less assertive supervisory approach,” according to the report.

    “We must strengthen the Federal Reserve’s supervision and regulation based on what we have learned,” Barr said in a press release.

    The document is the opening salvo in a renewed debate over bank regulation as the Fed and other agencies consider how to improve their policing of financial risks in the wake of banking industry turmoil. SVB and another regional lender, Signature Bank, failed after depositor runs during the same weekend in March, leading government officials to backstop all deposits for the two failed firms — even those not insured by the FDIC — in a bid to stem the panic.

    The fallout continues, with regulators and Wall Street now anxiously awaiting the fate of San Francisco-based First Republic, which was hammered by more than $100 billion of withdrawals after SVB’s collapse. The bank is furiously seeking avenues to stay afloat, and regulators are reportedly ready to put it in receivership if that effort fails.

    The findings on SVB are likely to lead to tougher rules on regional banks in particular, and Fed Chair Jerome Powell made clear he is backing efforts by Barr, who has been vice chair for supervision since July.

    “I welcome this thorough and self-critical report on Federal Reserve supervision from Vice Chair Barr,” Powell said in the release. “I agree with and support his recommendations to address our rules and supervisory practices, and I am confident they will lead to a stronger and more resilient banking system.”

    But House Financial Services Chair Patrick McHenry (R-N.C.) slammed the report as overly political.

    “While there are areas identified by Vice Chair Barr on which we agree … the bulk of the report appears to be a justification of Democrats’ long-held priorities,” McHenry said in a statement. He called it “a thinly veiled attempt to validate the Biden Administration and Congressional Democrats’ calls for more regulation.”

    “Politicizing bank failures does not serve our economy, financial system, or the American people well,” he said.

    McHenry and other lawmakers had been closely awaiting the post-mortem on the Fed’s supervision of SVB as they weigh further scrutiny of the bank’s failure. Barr, in a letter highlighting his conclusions from the report, said he welcomes an external examination of the central bank’s oversight of SVB, including from Congress.

    One major finding is that the central bank has a culture where examiners shy away from taking forceful enough action to get banks to make important changes in a timely way, a senior Fed official told reporters. That problem worsened under Quarles, according to the report.

    “Supervisory practices shifted,” the document states. “In the interviews for this report, staff repeatedly mentioned changes in expectations and practices, including pressure to reduce the burden on firms,” as well as to meet a high bar of evidence before taking action.

    That approach “contributed to delays and, in some cases, led staff not to take action,” according to the report.

    Another problem, the report said, was just how quickly SVB grew, tripling in size in just a few years. Once the bank was big enough to warrant more stringent supervision, it was given considerable time to comply with heightened standards that it wasn’t ready for.

    Barr in his letter said supervisors should begin preparing banks ahead of time for those types of standards.

    Other key policies that Barr said he wants to consider:

    — Raising standards for regional banks.

    — Requiring banks that aren’t well-managed to rely less on debt and have more cash on hand. That could “serve as an important safeguard until risk controls improve, and they can focus management’s attention on the most critical issues.”

    — Targeting incentive pay for senior bank officials as a means to focus their attention on solving serious problems more quickly.

    — Toughening oversight of how banks compensate their leaders more generally.

    — Looking more closely at how much banks are relying on uninsured deposits and safe assets that have dropped in value to be able to get cash quickly in a crisis.

    The Government Accountability Office in its own report released Friday criticized both the Fed’s supervision of SVB and the FDIC’s oversight of Signature Bank. It found that regulators had identified issues with both banks but failed to “escalate supervisory actions in time to prevent the failures.”

    GAO had previously warned in the wake of the 2008 financial crisis about the risks posed by not acting fast enough to make supervisory concerns a priority. The agency in 2011 recommended that federal banking regulators consider incorporating “additional triggers that would require early and forceful regulatory action to address unsafe banking practices” into their supervisory frameworks.

    “While the regulators took steps to address our recommendations, we continue to believe that incorporating noncapital triggers would enhance the framework by encouraging earlier action and giving the regulators and banks more time to address deteriorating conditions before capital is depleted,” GAO said in the report.

    The FDIC in a separate report on Signature’s collapse, also released Friday, conceded that “in retrospect, [it] could have escalated supervisory actions sooner.” But it attributed a large share of the blame to insufficient staffing.

    The team dedicated to overseeing Signature “experienced frequent vacancies and continuous turnover” from 2017 through March 2023. That group was steadily expanded from three in 2017 to nine in 2023, as the bank grew, but had “at least one vacancy 60 percent of the time and had 17 different staff assigned during this time period not including field territory resources that were temporarily assigned to cover gaps.” It also had difficulty finding a qualified person to be the examiner in charge of the bank.

    Amethi: The Amethi district Congress chief has been booked for allegedly abusing and beating up a party worker for donning a saffron kurta to the party office here, police said on Friday.

    On the complaint of Akhilesh Shukla, an FIR has been lodged against Congress district unit president Pradeep Singhal, Youth Congress district president Shubham Singh and others for abusing and beating Shukla and issuing life threats to him, Station House Officer of Amethi Kotwali police station Arun Kumar Dwivedi said.

    Shukla, a former vice president of the Amethi Congress unit, said when he visited the party office at Durgapur Road here wearing a saffron kurta and white pants on Thursday evening, party workers accused him of supporting the BJP through his attire instead of campaigning for the Congress for the upcoming municipal elections here, the police officer said.

    The argument escalated soon and a dozen people, including Singhal and Singh, thrashed him fiercely and tore his clothes, he said quoting the Shukla’s complaint.

    Subsequently, a case was registered late Thursday evening under the Indian Penal Code, Dwivedi said.

    Dismissing Shukla’s allegations as “baseless”, Singh said it was a conspiracy to tarnish the Congress’ image.

    He added that Shukla was making “wild allegations” as he failed to get a position in the district party leadership.

    A 23-year-old vlogger Bapan Nandi in Tripura was assaulted by the Bharatiya Janata Party (BJP) leaders for posting Eid greeting in a video.

    Nandi said he was trying to promote communal harmony.

    As the video went viral, BJP leader Anu Mura Singh and a few Hindutva politicians were irked with Nandi’s four-minute video.

    NewsClick reported that the BJP leaders allegedly took the matter to the Police Line Bazaar area and filed a complaint against the vlogger. Following this, the police called Nandi for interrogation.

    Meanwhile, Mura Singh and a few Hindutva leaders attacked Nandi. One of them recorded the assault and posted it on social media.

    Subsequently, the video went viral.

    In the video, a female BJP leader can be seen grabbing Nandi by his collar and thrashing him. She was also questioning why Nandi had portrayed himself “as a Muslim and demeaned Hindus.”

    He should have stuck with his “Hindu origins proudly,” she added.  

    Nandi could be seen begging for mercy while he was being thrashed by the group, according to NewsClick.

    “The Deputy Chief of East Gokul Nagar Panchayat called me and asked if I can visit his place. As I knew him I reached there and found about 40 men were waiting for me,” EastMojo quoted Nandi.

    “The Panchayat leader slapped me and thrashed me in front of everyone. I kept asking what was my fault? Nandi informed him that the video was produced by another channel and the casting was done by him.

    “No one was interested in listening to me,” he added.

    It is reported that the police have registered the case on orders of Vishva Hindu Parishad (VHP) leaders.

    Nandi claimed that he made the video for communal harmony. The video asked people not to get divided into communal lines and to celebrate the festival of Eid in harmony.

    Two artists who acted in the Eid video, Uma Debnath and Sneha Bhowmik issued statements saying they never thought that the video will be so problematic or that it would any ruckus.

    The artists and several other people have condemned the beating of Nandi and extended support to him.
