    Big relief for land holders vested land under section 6, 7 and 12 of the Agrarian Reforms Act, 1976

    Jammu, Jan 22 (GNS): The Administrative Council (AC) which met here under the chairmanship of the Lieutenant Governor, Manoj Sinha gave its assent for authorizing Revenue Department to move an amendment in Section 21 and Section 28-A of Agrarian Reforms Act, 1976
    Rajeev Rai Bhatnagar, Advisor to the Lieutenant Governor and Dr. Arun Kumar Mehta, Chief Secretary, J&K attended the meeting.

    The proposed amendments shall lift prohibition on transfer of land vested under section 6,7 and 12 of the Act and to bring these lands at par with the land vested under section 8 of the said Act. The proposed amendment bill will be submitted to the Ministry of Home Affairs, Government of India, for placing before the Parliament for enactment. The enactment will be a big relief to such land holders who were vested land under section 6, 7 and 12 of the Agrarian Reforms Act, as this would enable them to sell off their land parcels which was earlier prohibited under the Agrarian Reforms Act, 1976.

    The amendment will also lead to vesting of revisional power to the Financial Commissioner Revenue which shall facilitate to dispose of the cases arising out of the said Act in the larger interest of the public.(GNS)

    SRINAGAR: Acting tough against illegal land encroachers, the District Administration Ganderbal today retrieved 983 kanals of state and Kahcharie land across the district.

    Giving details, the Additional Deputy Commissioner (ADC) Ganderbal, Mehraj-ud-Din Shah said that on the directions of Deputy Commissioner, Shyambir, Revenue department is acting tough against the land grabbers who have illegally occupied State/ Kahcharai land and anti-encroachment drives against such persons shall continue till each patch of government land is retrieved in the district.

    He further said that strict directions have been given to all Tehsildars for intensifying the anti-encroachment drives in the district for retrieval of all encroached State/ Kahcharie land at an earliest.

    Following these directions, teams from the revenue department have launched massive anti-encroachment drives across all tehsils and in the last two days administration has retrieved more than 1701 Kanals of encroached State/ Kahcharie land.

    With these 1701 Kanals, the total retrieved land has increased to 13431 Kanals throughout the district and so-far 56 percent of State land and over 47 percent of Kahcharai land has been retrieved during anti-encroachment drives in the district.

    SRINAGAR : Over 4021 kanals of State/kahcharie land was retrieved in Kupwara district during the present drive initiated against the land encroachers by the government.

    On the directions of Deputy Commissioner Kupwara, Dr.Doifode Sagar Dattatray, a major anti encroachment drive was held across Kupwara district from 11th of this month till date. The teams of Revenue Department headed by concerned Tehsildars conducted operation on state/ kahcharie land which was illegally occupied by encroachers in different parts/ tehsils of the district.

    Accordingly, over 4021 kanals of kahcharai/ state land have been retrieved from the encroachers in all Tehsils of the District during the present drive, till date.

    As per the reports of Tehsildar Drugmulla, 301 kanals of kahcharai land have been retrieved in Drugmulla tehsil of Kupwara district which include 276 kanals single patch of land and 25 kanals which was used as commercial purposes.

    Likewise, as per Tehsildar Kupwara, 280 kanals of land have been retrieved during the drive till date in Kupwara tehsil which include 205 kanal kahcharai Land and 75 kanal state land.

    In Keran tehsil, 712 kanals of land have been retrieved as per Tehsildar Keran, which include 617 kanals of state land and 95 kanals of kahcharie land.

    In Vilgam tehsil of Kupwara district, 1863 kanals including 758 state land and 1105 kanals kahcharari land have been retrieved till date, as reported by Tehsildar Vilgam.

    Likewise, in Kralpora Tehsil, as per concerned Tehsildar 247 kanals of land have been retrieved in the tehsil which include 142 kanals state land and 105 kanals Kacharie land.

    In Sogam and Lalpora tehsils, as reported by respective Tehsildars, 114 kanal and 14 marlas retrieved from Dardpora Lolab, 20 kanals from Chandigam and 20 kanals from Sogam tehsil.

    Similarly, 70 kanals of kahcharari/ state land have been retrieved from Trehgam tehsil, 50 kanals in Karnah Tehsil, 46 kanal 15 marlas in Handwara tehsil, 26 kanal 5 marlas in Zachaldara tehsil, 5 kanals in Taratpora tehsil , 80 kanals in Langate, 70 kanals in Qalamabad tehsil and 116 kanals in Qaziabad-kralgund tehsil during the ongoing drive against land encroachers.

    While talking about the anti-encroachment drive, the Deputy Commissioner Kupwara said that anti-encroachment drives will continue in all the parts of the district to retrieve the entire State and Kahcharai land encroached by the land grabbers. He sought cooperation of the general public in its action against encroachments and also warned of action under CrPC in matters of encroachment on state/kahcharie lands.

    The District Administration has given strict directions to the Tehsildars and enforcement teams to speed up the drive against the land encroachments in their respective jurisdictions with added zeal and dedication so that all State/Kahcharai land is retrieved in the district, which can be subsequently used for public purpose.

    Despite brewing resentment the Jammu and Kashmir administration has asked the concerned revenue officers to ensure 100 per cent  removal of encroachments from state land, including Roshni and Kahcharai by January end.

    The order by Vijay Kumar Bidhuri, Commissioner Secretary Revenue to all deputy commissioners of the Union Territory was passed even as several review petitions challenging Roshni Act judgment lie pending before the High Court of Jammu and Kashmir and Ladakh.

    Bidhuri has also listed a set of instructions for effective monitoring of the anti-encroachment drive. The encroachment list involves highly influential persons of J&K including politicians from all major political parties and businessmen who have taken prized locations for peanuts.

    SRINAGAR: On Friday, the Supreme Court of India refused to stay a circular issued by Jammu & Kashmir government directing deputy commissioners to remove encroachments on State Land including Roshni Land and Kachharie land by January 31, 2023, reported LiveLaw.in.

    A bench of Justices MR Shah and CT Ravikumar, though expressed its disclination in not passing an order today, it orally asked the Union Territory to not demolish any houses.

    “We are not passing any order today. You instruct them orally not to demolish any houses. But we will not grant a general stay…. others should not get benefit,” the bench orally told the counsel of J&K, according to report published in Livelaw.in.

    During the hearing, the advocate for the petitioner argued that many tribals are residing on the land and took the Court through the reliefs prayed for.

    “If stay is granted then it will benefit land grabbers also?”, Justice Shah asked.

    The counsel appearing for the Union Territory clarified that the circular is mainly focused on the Roshni land. He also questioned the locus of the applicants.

    “The Application was served on me yesterday. It does not even mention that the applicants live there”, he pointed out while adding that the said land only had shops and such establishments.

    The Court then adjourned the matter. The matter was mentioned before the Chief Justice DY Chandrachud, earlier this week.

    The Jammu and Kashmir government, on January 9, directed the removal of all encroachments on State Land, including Roshni Land and Kachharie land, by January 31, 2023. The order was passed while several review petitions challenging Roshni Act Judgment remain pending before the High Court of Jammu and Kashmir and Ladakh.

    In 2020, the Jammu and Kashmir High Court held that the Jammu and Kashmir State Land (Vesting of Ownership to the Occupants) Act 2001, [popularly known as Roshni Act] is completely unconstitutional.

    Earlier, on 17 jan the administration in Baramulla and Boniyar areas of north Kashmir’s Baramulla district has asked the encroachers to remove illegal encroachments over state land within three days, failing which strict action would be taken against the encroachers.

    However Revenue Department retrieved over many kanals of encroached upon land during an anti-encroachment drive in Pattan & Singhpora Tehsils of North Kashmir’s Baramulla.

    A revenue department team on directions of Deputy commissioner Baramulla led by SDM Pattan & Tehsildar along with Naib Tehsildar, Patwaris, concerned Numberdar and Chowkidar visited the site and freed the land from the occupation of encroachers.

    Furthermore, Tehsildar Pattan warned the encroachers to vacate the encroached land within one week or elsewhere they will bear the consequences of it.

    A man on Tuesday brutally murdered down his younger brother and his wife due to a “land dispute” in the village of Marheen in the Kathua district of Jammu and Kashmir.

    Ramesh Kotwal, senior superintendent of police in Kathua, said that accused Raj Kumar, a resident of Chak Wazir Labzoo, killed his younger brother Naresh Kumar, 32, and his wife Asha, 24, at their home in the tehsil Marheen.

    “Land disputed is stated to the cause of brutal crime,” said the top cop.

    He added, “When the police party got there, they found the accused had done two murders.”

    “The accused has been detained and the weapon of offence (sharp weapons) has also been seized,” the SSP said, “and the FSL team collected the samples and all legal requirements are fulfilled.”

    A board of doctors has taken possession of the bodies and transported them to the Government Medical College in Kathua for postmortem examination.

    At Rajbagh Police Station, a case has been filed under the relevant laws, and an investigation has started.
