    SC judge recuses from hearing Punjab govt plea against bail to Majithia

    New Delhi: Supreme Court judge Justice Surya Kant on Monday recused himself from hearing a Punjab government plea challenging the high court order, which granted bail to Shiromani Akali Dal leader and former minister Bikram Singh Majithia in a drug case.

    The matter was listed for Monday before a bench of Justices Surya Kant and J.K. Maheshwari.

    As soon as the matter came up for hearing, Justice Surya Kant said he was part of the high court bench which passed directions to set up a special task force to investigate the matter.

    Majithia, the brother-in-law of SAD President Sukhbir Singh Badal and brother of former Union minister Harsimrat Kaur Badal, had been lodged in the Patiala jail onFebruary 24 last year.

    The Punjab government, represented by senior advocate Shyam Divan, moved the apex court challenging the Punjab and Haryana High Court order dated August 10, 2022.

    The bench ordered: “Let the matter be listed before a bench in which one of us (Justice Kant) is not a member.”

    Granting bail to Majithia, the high court had observed that there were “reasonable grounds” to believe that he is not guilty. Majithia was released after spending more than five months in the Patiala jail in the drug case.

    However, the high court had clarified that the trial court should proceed independently of the observations made by it. Majithia was booked on the basis of a 2018 report of the anti-drug special task force (STF) into a drug racket in the state.

    Lucknow: All India Muslim Majlis-e-Mushawarat President Navaid Hamid on Monday questioned the delay in action against Mahant Raju Das who has announced a reward for beheading SP leader Swami Prasad Maurya.

    In a tweet, Hamid said: “The government announces reward on those who proclaim ‘Sar tan se juda’ so why is action not being taken against others who have made similar proclamations? Will any legal action be taken against Mahant Raju Das and others like him?”

    “By the way these people (Mahant Raju Das and others) are not Muslims and that probably explains the delay”, he added.

    The UP DGP has been tagged in the tweet.

    All-party meet ahead of Budget: YSR Cong demands caste-based economic census

    New Delhi: The YSR Congress on Monday demanded a nationwide caste-based economic census at an all-party meet convened by the government ahead of the Budget session of Parliament.

    It is necessary to know the economic status of the backward castes who are “lagging behind” on social and development indicators, the party said.

    YSR Congress leader Vijaysai Reddy said backward castes are over 50 percent of the total population and the census will help find their economic status.

    The ruling party in Andhra Pradesh has joined the likes of the JD(U) and the RJD, both of which have demanded a caste census.

    The grand alliance government in Bihar has rolled out a state-wide caste census.

    Reddy said his party also demanded the women quota bill for ensuring reservation for them in Parliament.

    Parties including the TRS, TMC, and the BJD also supported the demand.

    Hyderabad: The stalemate between Telangana Governor Tamilisai Soundararajan and the Bharat Rashtra Samithi (BRS) government over the state budget for 2023-24 was amicably resolved through talks on Monday on the suggestion of the High Court.

    Hearing the state government’s petition seeking direction to the Governor to approve the budget, the court suggested both sides resolve the issue through talks.

    On the court’s suggestion, the state government’s lawyer Dushyant Dave and Raj Bhavan’s lawyer Ashok Anand held talks.

    It was decided that the Governor will give a nod to the budget and the state Assembly session will begin with her address.

    The lawyers of both sides informed the court of the breakthrough after which the agreement, the government withdrew its lunch motion petition and the case was dismissed.

    A resolution to the row came after both sides softened their stand. While the government agreed to conduct the budget session with a speech from the Governor, the latter agreed to approve the budget.

    The court took up a hearing of the lunch motion petition moved by the state government. During the hearing, the division bench asked the Advocate General how the court could give notice to the governor, and also wanted to know why the court is being dragged into a controversy between the government and a Constitutional institution.

    Appearing on behalf of the government, Supreme Court lawyer Dave submitted that when the Constitution is violated, courts can intervene. He cited some judgments of the Supreme Court.

    However, the court advised the lawyers from both sides to sort out the issue through talks. They both agreed to the suggestion and it finally led to a patch-up.

    With the budget session of the state legislature scheduled to begin on February 3 and the Governor not approving the budget, the government led by K. Chandrasekhar Rao had approached the court.

    The government informed the court that the state government sent the draft budget to the Governor on January 21 but she was yet to approve the same.

    The government received a communication from Raj Bhavan if arrangements had been made for the Governor’s address on the opening day of the budget session.

    The government last year conducted the budget without the customary address by the Governor, drawing a strong reaction from her. The BRS government defended its move on the ground that it was not a new session but a continuation of the previous session.

    The Budget session of the Assembly and Legislative Council is scheduled to begin on February 3. With only four days to left and no approval of the budget coming from the governor, the government approached the High Court.

    The BRS leaders anticipated a crisis as seven Bills passed by the Assembly and Council have been languishing at Raj Bhavan since September last year.

    The government has taken exception to the Governor’s delaying approval of the budget. It argued that the Governor’s speech and the Budget presentation were unrelated matters. It also says that there is no clause in the Constitution that requires the Governor to address the Budget session.

    The BRS government cited Article 202 of the Constitution, which mandates that a Governor must give permission for presenting before the House a statement of the estimated receipts and expenditures of the state for a financial year.

    With the BRS government approaching the court, the friction between the Governor and the government had taken a new turn.

    It came close on the heels of a row over the Republic Day celebrations. The Governor was unhappy over the government arranging the main official ceremony at Raj Bhavan.

    On a petition filed by a citizen, the High Court had directed the government to hold a police parade as part of the celebration. Though the government made last-minute arrangements for the police parade, the Chief Minister and his cabinet colleagues skipped the function at Raj Bhavan.

    The Governor had slammed the government for what she called not honouring the High Court orders.

    Bengaluru: Karnataka Chief Minister Basavaraj Bommai on Monday said that the priority would be given to all the communities in the coming budget and focus will also be on farmers, women and workers.

    On the Cabinet expansion, the CM said a suitable decision would be taken at a suitable time.

    Talking to reporters here on Monday after observing a two-minute silence on the Martyrs Day, he said that on this day when Mahatma Gandhi became a martyr, they must have self-introspection and make honest efforts to tread the path shown by the Mahatma.

    “As Gandhiji had said that his life is a message for everyone and his life history must be read and adopted in their lives. The Mahatma had propagated both truth and morality in life and would undergo self-test to ascertain whether he was following it or not to become clean. They have seen Gandhiji adopting this action throughout his life. It was the Mahatma who showed to the world the power of non-violence. He was in the forefront of the freedom struggle to get independence through non-violence,” the CM said.

    The CM said several unknown people sacrificed their lives and properties for the sake of independence. The new direction to the country’s freedom struggle was given by Subhas Chandra Bose, Bhagat Singh, Chandrashekhar Azad, Lokamanya Bal Gangadhar Tilak and others.

    “They created awareness about freedom and converted the satyagraha into a revolution and held tough talks with the Britishers to give freedom. The need of the hour was to ensure morality in public life on the basis of the ideology of Gandhi who had a national identity,” he said.

    Gangtok: Sikkim Chief Minister Prem Singh Tamang on Monday said his government will file a review petition in the Supreme Court with a prayer for rectification of its “inadvertent mention of the Sikkimese Nepali community as foreigners” in an order two weeks ago.

    “Let me reiterate and reassure that no injustice will be meted out to anyone with regard to the inadvertent mention of Sikkimese Nepali Community as foreigners in the observation part and not in the judgment part of the verdict of Hon’ble Apex Court in the matter of income tax exemption for the old settlers of Sikkim,” he said in a social media post.

    “I express my solidarity not only with Sikkimese Nepali Community but with all the communities of our dear state. We all are one, and will always remain united,” Tamang said.

    The state government has already initiated steps for filing the review petition for addressing the concerns of the Sikkimese Nepali community, the chief minister said.

    Tamang said he has already spoken to Union Law Minister Kiren Rijiju and the latter has assured that the Government of India will support the review petition of the Government of Sikkim, and if required will file a review petition itself as well on similar lines.

    Tamang appealed to all people to be patient and keep faith in the judiciary. It is just a matter of time that this issue will be addressed for the good of one and all, he said.

    The Supreme Court in its order dated January 13, 2023, had directed the Centre to amend the definition of ‘Sikkimese’ in Section 10 (26AAA) of Income Tax Act 1961 for including income tax exemption to all Indian citizens domiciled in Sikkim on or before the merger date of April 26, 1975.

    “The Union of India shall make an amendment to Explanation to Section 10 (26AAA) of IT Act, 1961, so as to suitably include a clause to extend the exemption from payment of income tax to all Indian citizens domiciled in Sikkim on or before 26th April, 1975.

    “The reason for such a direction is to save explanation from unconstitutionality and to ensure parity in the facts and circumstances of the case,” said the apex court while disposing of two writ petitions filed by Association of Old Settlers of Sikkim (AOSS) and others with a prayer for grant of income tax exemption at par with the Sikkimese people as given under Section 10 (26AAA) of IT Act following an amendment in 2008 by the Parliament.

    New Delhi: Law Minister Kiren Rijiju on Monday hit out at those moving the Supreme Court challenging the Centre’s decision to block a BBC documentary on the 2002 Gujarat riots, saying this is how they “waste” precious time of the top court.

    Responding on Twitter to news reports that veteran journalist N Ram, activist lawyer Prashant Bhushan and others have moved the Supreme Court challenging the Centre’s decision to block the documentary “India: The Modi Question” on social media, Rijiju said that “this is how they waste the precious time of Hon’ble Supreme Court where thousands of common citizens are waiting and seeking dates for justice”.

    A bench headed by Chief Justice D Y Chandrachud on Monday took note of the submissions of lawyer M L Sharma and senior advocate C U Singh, appearing for N Ram and Bhushan, seeking urgent listing of their separate PILs on the issue.

    On January 21, the Centre issued directions for blocking multiple YouTube videos and Twitter posts sharing links to the controversial BBC documentary.
