  • Excise policy case: Delhi court grants bail to 2 accused citing ‘insufficient evidence’

Excise policy case: Delhi court grants bail to 2 accused citing ‘insufficient evidence’

    [ad_1]

New Delhi: A Delhi court has granted bail to two accused persons in a money laundering case related to alleged excise scam, saying the evidence was not sufficient for the case against them to be considered prima facie “genuine”.

Special Judge M K Nagpal granted the relief to Rajesh Joshi and Gautam Malhotra on a personal bond of Rs two lakh each and one surety of like amount.

The same judge had dismissed AAP leader Manish Sisodia’s bail plea in the case on April 28 and in a related corruption case, being probed by the CBI, on March 31.

    MS Education Academy

In connection with the bail plea by Joshi, the court said it was of the prima facie view that the evidence was not sufficient to make it believe that the case against him was genuine or that he was going to be held guilty of the offence of money laundering.

On Gautam Malhotra, the court said that the case of the prosecution as based on oral and documentary evidence “cannot be prima facie considered to be a genuine case”.

The judge further said in the order passed on May 6 that the mere apprehension that the accused may resort to commission of an offence again will not be sufficient to oppose bail.

He observed that Joshi was not in the liquor business and admittedly, he was also not a participant in any of the meetings which allegedly took place among the other co- accused or conspirators of the criminal conspiracy in connection with the formulation of the now-scrapped excise policy or its implementation.

Joshi is also not alleged to be a member of the ‘South lobby’ or the ‘liquor lobby’ of any region and hence, admittedly, he is not among the persons who are alleged to have paid the kickbacks to co- accused Sisodia or his other associates, and he is also not a recipient of the kickbacks or bribes, he noted.

On the ED’s claim that Joshi was involved in the transfer of advance kickback amount of around Rs 20 -30 crore that was allegedly used in the AAP election campaign for the 2022 Goa assembly polls, the court said there was nothing on record at this stage to link these payments.

It noted Joshi was arrested on February 8 and even prior to that, he was stated to have joined the investigation of this case, as well as that of the connected case being probed by the CBI.

Regarding Malhotra, it noted the ED had claimed that he had paid Rs 2.5 crore as bribe or kickbacks for the ‘South liquor lobby’ and this fact was specifically stated by co-accused Amit Arora.

However, it pointed out that approver Dinesh Arora expressed total ignorance about this transaction. “The statements on this aspect made by the approver cannot be sidelined or ignored at this stage as he is a star witness,” the judge said.

The court further dismissed the ED’s contention that Malhotra formed a cartel by participation in the liquor business of Delhi at all the three levels of manufacturing, wholesale and retail, and thus, he became a member of the super cartel and the criminal conspiracy with the other co- accused.

“Though the above cartel might have been formed in violation of provisions of the excise policy… it appears to be a pure business cartel formed to push the sale of liquor brands of the manufacturing unit(s) of the applicant,” it said.

The court noted it was the admitted case of prosecution that Malhotra had not played any role in the formulation of the excise policy and was even not a part of the ‘South lobby’ paying advance kickbacks of Rs 100 crore.

“Again, he is also not alleged to have paid any such advance kickbacks to co -accused Vijay Nair, other politicians of AAP or other public servants before or in connection with the formulation of the said policy,” the judge said.

The only allegation of payment of any money or bribe against him is in the form of payment of Rs 2.5 crore to co -accused Amit Arora in May 2022, when this policy had already been in operation for a considerable time, he noted.

Even the evidence in the form of a statement by co -accused Amit Arora about the payment of Rs 2.5 crore bribe by him is not convincing enough, the court said.

Regarding the ED’s claim that the accused received proceeds of crime of Rs 48.9 lakh through excess credit notes, it said no specific or connecting evidence showing any such cash payments against the amounts of credit notes has been produced.

The judge said Malhotra also deserved to be granted default bail since the ED filed an “incomplete” supplementary complaint against him and “it has apparently been filed to scuttle or defeat the right of applicant to seek default bail”.

He added that neither Joshi nor Malhotra can be considered a flight risk. The court directed both the accused persons not to leave the country without its permission or threaten or influence witnesses.

However, it is made clear that the observations made in this order are only for the purpose of deciding the bail applications of the applicants and nothing contained in this order shall tantamount to the expression of any opinion on merits of the case, the judge said.

Sisodia, who was arrested on March 9, is currently in judicial custody in the case. The court on April 28 dismissed his bail application in the case, saying the evidence prima facie “speaks volumes of his involvement in commission of the offence”.

290 Palestinian homes demolished by Israel during Q1 of 2023

    [ad_1]

The Israeli occupation authorities demolished 290 Palestinian homes in the West Bank and East Jerusalem during the first quarter of 2023.

This came in a report issued by the United Nations Office for the Coordination of Humanitarian Affairs (OCHA) in the occupied Palestinian territory.

As a result, 413 people—including 194 children—have been forced to flee their homes, while more than 11,000 others have had difficulties with their access to services or their ability to support themselves.

    MS Education Academy

The number of structures targeted in the first quarter of 2023 increased by 46 per cent compared to the same period in 2022, which already saw the highest number of demolitions recorded in the West Bank, including East Jerusalem, since 2016.

The incident that led to the demolition of most of the buildings took place on February 27 in the town of Livjem in Nablus, when 15 buildings were demolished under the pretext of not having the necessary permits.

It is reported that, the incident that affected the largest number of people occurred on January 23, when the Israeli authorities shut down a water well under construction in Habla (Qalqilya) in Area B, without prior notification.

As a result, a total of 8,000 Palestinians from 1,300 families in three nearby villages were affected.

  • Priyanka Gandhi’s Telangana visit: KTR calls her ‘political tourist’

Priyanka Gandhi’s Telangana visit: KTR calls her ‘political tourist’

    [ad_1]

SC issues notice to Centre on pleas challenging decision to block BBC documentary on 2002 Gujarat riots5

Hyderabad: Terming Congress General Secretary Priyanka Gandhi as a political tourist, Bharat Rashtra Samithi’s (BRS) working president and minister KT Rama Rao said that politicians who are unemployed are provoking the youth of Telangana.

He said that the parties which did not work for the welfare of people while in power are now “preaching the state governments like Telangana which consistently ranked high in performance”.

Responding to Priyanka Gandhi’s Telangana visit for a political rally on youth issues, the BRS working president reminded her of the ‘decades-long history of failures of Congress Party’.

KTR criticized Congress for ‘exploiting’ youth, and employment issues solely for its politics. He said that the country would not have experienced an ‘unemployment crisis’ if Congress and Bharatiya Janata Party (BJP) announced employment policy and worked like BRS. The Minister said that the Telangana government under the leadership of chief minister K Chandrashekar Rao provided employment to 2.2 lakh youth in the government and 22 lakh youth in the private sector.

The Minister said that Congress was at the ‘end of its wits’ as it was away from power for the past 10 years. He cited this as the reason for the ‘political unemployees’ of Congress trying to provoke the youth of Telangana.

Asserting that they will not be successful in the ‘vicious’ attempts, he asked them to compare the number of posts filled by Andhra Pradesh Public Service Commission (APPSC) in the erstwhile united Andhra Pradesh and by the Telangana government after formation of the state. He reminded about the ‘bitter experiences and injustice’ done to Telangana youth in interviews even after clearing written exams with merit.

He demanded Priyanka Gandhi apologize on behalf of the Congress party for taking the lives of hundreds of Telangana youth during the separate Telangana movement, by delaying the formation of the state for their political gains. KTR said that even the current Telangana Pradesh Congress Committee’s (TPCC) president Revanth Reddy termed Sonia Gandhi as the culprit (balidevatha) behind all the suicides.

Stage set for Priyanka Gandhi’s maiden public rally in Telangana

The Minister said that Hyderabad is a global city that welcomes lakhs of tourists every day and it also welcomes ‘political tourists’ like Priyanka Gandhi.

He termed the Congress as a ‘sinking ship’ and suggested Priyanka Gandhi turn her political tour into an ‘educational tour’. He asked her to witness the growth of Telangana and learn by seeing the world class roads, flyovers, cable bridge and offices of the top MNCs in Hyderabad. KTR suggested that she ask fellow congressmen what people like superstar Rajinikanth spoke about Hyderabad. He invited her to understand local conditions and learn from what she sees there.

KTR highlighted the ‘failures’ during Congress rule like lack of drinking and irrigation water, issues with electricity, and lack of support for agriculture.

The Minister said that in stark contrast to the Congress rule, BRS led Telangana government provided 24*7 power, Rythu Bandhu, Aasaea pensions for the needy, Mission Bhagiratha etc. He suggested Priyanka learn from the inclusive and holistic developmental activities, and policies of Telangana, and implement them in Congress-ruled states.

He said that the people of Telangana who are ‘astute’ will secure their future by electing KCR who achieved formation of the state and that the ‘political tourist’ Priyanka Gandhi will realize this in the tour.

The All India Congress Committee (AICC) general secretary will lead a rally and address a public meeting at Saroornagar stadium on Monday.

This is her maiden political visit to Telangana since the state’s formation in 2014.

  • Musk credits father for teaching ‘physics, engineering & construction’

Musk credits father for teaching ‘physics, engineering & construction’

    [ad_1]

New Delhi: Billionaire Elon Musk on Sunday credited his father for teaching fundamentals of “physics, engineering and construction”.

The world’s second richest man said that the teaching of his father Errol Musk, a South African politician, “is more valuable than money”.

Musk, who owns several companies like Twitter, Tesla and SpaceX said that he has not “inherited anything ever from anyone”, quashing the long-running rumour which claims his father owns an emerald mine in South Africa and that he has given him financial assistance.

    MS Education Academy

Errol Musk had previously claimed in an interview that he used emeralds from an “under the table” mine in Zambia to finance his son’s escape from South Africa to America.

Musk said nobody has provided him with “a large financial gift” and that his father did not support him “financially after high school in any meaningful way”.

Instead, Musk and his brother had to financially support their father after his small electrical/mechanical engineering company “fell on hard times”, making him “essentially bankrupt for about 25 years”.

“Our condition of providing him financial support was that he not engage in bad behaviour. Unfortunately, he nonetheless did. There are young children involved, so we continued to provide financial support for their well-being,” Musk said.

He again denied the existence of the emerald mine. Earlier this month, he also tweeted: “I will pay a million Dogecoin for proof of this mine’s existence!”

He noted Errol Musk told him that he owned a share in a mine in Zambia, which he believed “but nobody has ever seen the mine, nor are there any records of its existence”.

“If this mine was real, he would not require financial support from my brother and me”.

MP: Cong takes out silent march to protest vandalisation of its Jabalpur office

    [ad_1]

Jabalpur: Congress leaders on Sunday took out a silent march in Madhya Pradesh’s Jabalpur to protest the vandalisation of their city office. The party has blamed Bajrang Dal for the vandalism.

The Congress has been facing backlash from BJP and right-wing outfits for bracketing Bajrang Dal with the Popular Front of India (PFI) in its manifesto for the May 10 Karnataka polls.

The party leaders started from Shahid Smarak and ended their protest at the statue of Mahatma Gandhi in Town Hall, said a Congress functionary.

    MS Education Academy

“Congressmen are Gandhians. We are not going to storm their office. We are going to do a peaceful protest till 200-odd Bajrang Dal men, some of them history-sheeters, are not arrested,” mayor and city Congress president Jagat Bahadur Singh told PTI.

The Congress has also demanded action against two inspectors from Kotwali and Lordganj police stations. These inspectors were deputed at the “Bajrang Dal’s protest site but were conspicuous by their absence”, Singh said.

After the Congress’ office in the Baldeo Bagh area was vandalised on Thursday, the Bajrang Dal had claimed that it was involved in the act.

Two days ago, police said that they had arrested 10 persons, including prime accused Sumit Singh Thakur who is the “vibhag prachar pramukh” of the Vishwa Hindu Parishad (VHP). Bajrang Dal is the youth wing of the VHP.

Earlier, a police official had said that they had booked 25 people on the basis of video footage and a complaint for rampaging through the Congress city office.

Additional Superintendent of Police Priyanka Shukla could not be reached contacted despite repeated attempts to know how many people have been arrested till date.

The protesting Congress workers included Rajya Sabha member Vivek Tankha and MLAs Tarun Bhanot, Sanjay Yadav, and Lakhan Gangoria.

Cyclonic storm ‘Mocha’ won’t affect TN: Regional Met office

    [ad_1]

Chennai: The cyclonic system prevailing over Bay of Bengal that is likely to intensify into cyclonic storm by May 9 will not have an impact on Tamil Nadu, the Regional Meteorological Centre (RMC) here said on Sunday.

The cyclonic storm, named ‘Mocha’, according to the RMC, will have less impact on Tamil Nadu as it will move towards the northern direction.

It is likely to intensify into a depression over southeast Bay of Bengal and adjoining South Andaman Sea around May 9 and later expected to intensify into a cyclonic storm while moving nearly northwards towards central Bay of Bengal and adjoining north Andaman Sea.

    MS Education Academy

As the cyclonic storm may not have any impact on Tamil Nadu, the maximum temperature in the state’s interior and coastal districts is expected to surge by two to four degrees Celsius.

The RMC officials said that ‘Mocha’ is at the preliminary stage and the other parameters of the cyclone will be made public only after it develops into a strong cyclone.
