  • SC asks CBI, Gujarat why they want activist Teesta Setalvad, her husband back in jail

SC asks CBI, Gujarat why they want activist Teesta Setalvad, her husband back in jail

    [ad_1]

New Delhi: The Supreme Court on Wednesday questioned the CBI and the Gujarat government as to why they want to send social activist Teesta Setalvad and her husband Javed Anand back in jail after they have been out for over seven years on anticipatory bail.

A bench of Justices Sanjay Kishan Kaul, Abhay S Oka and BV Nagarathna said, “Question is how long can you keep someone in custody. Seven years have passed since anticipatory bail was granted. You want to send her back to custody.”

Advocate Rajat Nair, appearing for the CBI and the Gujarat government said some additional material needed to be placed before the court with regard to the cases and, therefore, four weeks time may be given.

Senior advocate Kapil Sibal and advocate Aparna Bhat, appearing for Setalvad and her husband Anand, said in one of the proceedings in which the CBI has come in appeal, anticipatory bail was granted following which a charge sheet was filed and after that regular bail was granted to her.

He said since a regular bail was granted, the appeal of the probe agency against anticipatory bail does not survive.

Nair said this had happened in one case but there are more than one case against her and requested the court to grant him four weeks to place additional material on record.

“A bench of two judges has referred this matter to a larger bench and has framed questions which need to be decided by this court,” Nair said.

The bench posted the matter for further hearing after four weeks.

Sibal submitted a note to the bench pursuant to the earlier direction giving details of issues as to which of the appeals survive for consideration and what is the subject matter to be decided as the passage of time may have taken care of some aspects.

The top court was hearing a batch of pleas filed by Setalvad, Anand, the Gujarat police and the CBI arising out of three FIRs lodged against the couple.

On March 19, 2015, the top court had referred to a larger bench the anticipatory bail plea of Setalvad and her husband in the case of alleged embezzlement of funds for a museum at Ahmedabad’s Gulbarg Society devastated in the 2002 riots and extended its interim order protecting them against arrest.

It had said the question that arises for consideration is whether liberty on the one hand and fair and effective investigation on the other make out a case for extending the benefit under Section 438 CrPC (anticipatory bail).

In 2014, an FIR was registered against them with DCP, Crime Branch, Ahmedabad, on charges of cheating, breach of trust and under the IT Act in a matter related to the construction of the “Museum of Resistance” in the Gulbarg housing society.

Teesta Setalvad and her husband, who were trustees of two trusts- ‘Citizens for Justice and Peace’ (CJP) and ‘Sabrang Trust’- were accused by Feroz Khan Saeed Khan Pathan of having raised a few crore of rupees as donation from certain donors from India and abroad after projecting to them the plight of the riot-affected people of Gulbarg Society.

The top court had noted in its order of March 19, 2015 that Pathan had alleged in his complaint that the couple entered into a conspiracy and promised the residents of the housing society they will build a museum in the honour of the 2002 riot victims. The court had also noted that the couple had asked the residents to not sell their properties in the housing society.

Pathan alleged the couple neither built the museum as promised nor spent the amount for the benefit of the members of the Gulbarg Society nor did they fulfil the assurance made to the victims regarding the sale of their properties.

In the second case, the CBI has moved the apex court against grant of anticipatory bail to Setalvad and her husband in a case where they have been accused of misusing foreign funds.

The probe agency has alleged that a company floated by the couple-Sabrang Communication and Publishing Pvt Ltd (SCPPL)- had received Rs 1.8 crore from US-based Ford Foundation allegedly without the mandatory approval of the Centre.

It has sought cancellation of their anticipatory bail claiming the Bombay high court had erred in giving them the relief after prima facie finding that provisions of the Foreign Contribution Regulation Act (FCRA) had been violated.

In the third case, the Ahmedabad police had moved the apex court against the April 5, 2018 order of the Bombay High Court by which the couple was protected from arrest in an FIR registered on March 31, 2018 for allegedly securing central government funds worth Rs 1.4 crore “fraudulently” for her NGO Sabrang Trust between 2010 and 2013.

According to the Gujarat police, the funds were obtained for a project launched in some districts of Maharashtra and Gujarat to help the victims of the 2002 post-Godhra riots but were misappropriated or used for other purposes.

The couple has denied all the allegations made in the FIRs which are being probed by Gujarat police and the CBI.

  • Students, political parties resist ban on BBC’s Modi documentary

Students, political parties resist ban on BBC’s Modi documentary

    [ad_1]

BBC on Wednesday released the second episode of the two-part documentary – ‘India: The Modi Question‘ – which directly blames Prime Minister Narendra Modi’s role in the 2002 Gujarat riots when he helmed the state as its chief minister.

The first part was released on January 19 and was shared by many on all social media platforms which encouraged debates around the 2002 Gujarat riots and the role of then chief minister Narendra Modi during the riots that killed more than millions and displaced many, especially Muslims.

The one-hour documentary reveals ‘never-seen-before’ or ‘restricted’ documents in detail. It looks at the escalating tension between the Muslim community and the Bharatiya Janata Party (BJP) as well as Hindu right-wing organisations – Vishwa Hindu Parishad (VHP) and the Rashtriya Swayamsevak Sangh (RSS).

The documentary holds Modi directly responsible for the riots and states that such large-scale mass murder or in other words, a pogrom, was not possible without steady help from the state.

Modi government was quick to respond calling the documentary propaganda material ‘designed to push a particular discredited narrative.’

The Ministry of External Affairs (MEA) spokesperson Arindam Bagchi said, “The documentary is a reflection on the agency that has made it. We think it is a propaganda piece designed to push a particular discredited narrative. The bias, lack of objectivity, and continuing colonial mindset are blatantly visible. Can’t dignify such a film.”

As the documentary created interest and buzz on the internet, the Central Government banned its airing in the country as well as directed all social media platforms to remove any posts and links pertaining to the documentary, creating a protest call from netizens and Opposition parties.

With the help of Rule 16 of the IT Rules, 2021 — formally known as the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 — notified on February 25, 2021, describes the government’s power with regard to “Blocking of information in case of emergency”.

The Ministry of Information and Broadcasting used emergency powers stating the documentary is based on a ‘colonial mindset’.

Following the ban, several student unions and political parties across India screened or tried to screen the documentary leading to tensions or conflict. Here are a few cities and states where the documentary was screened.

    Hyderabad

In Hyderabad, the BBC documentary was screened at the University of Hyderabad (UoH) campus by a student group called the Fraternity Movement. Around 200 students turned up.

However, members of the ABVP complained to the university registrar who then released a statement saying no prior permission was taken by the students to screen the film.

    Kerala

The documentary was screened in various places, including colleges, in Kerala on Tuesday with the BJP youth wing going up in arms in protest against the screenings.

In Thiruvananthapuram, the Youth Congress organised a screening at Manaveeyam Veedhi, a cultural space on Tuesday. The Democratic Youth Federation of India (DYFI) held one at Poojappura Maidan.

Not just Thiruvananthapuram, Kerala’s financial capital Kochi saw many screenings. The Students’ Federation of India (SFI) conducted screenings for students of the Cochin University of Science and Technology, Kalady Sree Sankaracharya University of Sanskrit, Maharaja’s College Ernakulam, and Government Law College.

The Communist Party of India (Marxist) state secretary V Govindan came out in support of the screening saying, “Banning the documentary is an undemocratic stand. Ideals should not be banned in a democratic society.”

    Delhi

In New Delhi, the Jawaharlal Nehru University (JNU) saw the screening turned into a protest on Tuesday when student unions ignored the administration’s statement to cancel the screening which was supposed to take place on the same night at 9 pm.

The administration went ahead and snapped current and internet supply thus halting the screening. However, determined students started watching it on their laptops and phones. Protests between the college authorities and students broke out and incidents of stone pelting were also reported.

On Wednesday, a day after the ruckus in JNU, students at Delhi’s Jamia Milia Islamia university announced it would screen the banned BBC documentary at 6 pm.

While there are reports that several SFI students have been detained, the university has categorically said that no permission was given for the screening.

“The University reiterates that no meeting of students or screening of any film will be allowed in the campus without permission. University is taking all measures to prevent people/orgs having vested interest to destroy peaceful academic atmosphere here”, the university said in a circular.

By the time of publishing this report, Delhi Police has detained over 70 students who were gathered at Jamia Millia Islamia to protest against the detention of four activists over the proposed screening of a BBC documentary on Prime Minister Narendra Modi, the Students’ Federation of India said.

Member of Parliament A A Rahim from CPM party has strongly condemned the detention which includes female students also. In a tweet, he described the ban as a cowardly act by the Modi government. He demanded the immediate release of the students.

    Kolkata

SFI of Presidency University in Kolkata has asked for permission from the university’s administration to show the banned BBC documentary on January 27 at 4 pm.

The student union sent an email to the university administration seeking permission to book the badminton court on the campus where the screening will take place. The university is yet to respond.

BBC docu screening: 70 students protesting detention of 4 activists in Delhi detained, says SFI

    [ad_1]

New Delhi: Delhi Police has detained over 70 students who were gathered at Jamia Millia Islamia to protest against the detention of four activists over the proposed screening of a BBC documentary on Prime Minister Narendra Modi, the Students’ Federation of India said.

There was no immediate response from the police.

Heavy deployment of police personnel was seen outside the campus where the students were gathered. Personnel from the Rapid Action Force were deployed at the gate.

Pritish Menon, secretary of the Students’ Federation of India’s (SFI) Delhi state committee, said the police detained the protestors who had gathered there.

“We were about to begin the demonstration but they were detained before that. They were taken to the police station,” Menon told PTI.

The Left-backed SFI’s Jamia unit has released a poster informing that the documentary would be screened at the MCRC lawn gate 8 at 6 pm.

Delhi Police on Wednesday said they detained four students after the SFI announced its plan to screen the controversial documentary on the campus.

The university administration said the screening would not be allowed and that they were taking all measures to prevent people and organisations with a “vested interest to destroy the peaceful academic atmosphere of the university”.

The varsity administration also issued a statement, saying no permission had been sought for the screening of the documentary and it would not be allowed.

“It has come to the knowledge of the university administration that some students belonging to a political organisation have circulated a poster about screening of a controversial documentary film on the university campus today,” it said in the statement.

The university had earlier issued a memorandum/circular reiterating that no meeting/gathering of students or screening of any film shall be allowed on the campus without permission from the competent authority.

It said strict disciplinary action shall be taken against organisers in case of any violation.

“The university is taking all possible measures to prevent people/organisations having a vested interest to destroy the peaceful academic atmosphere of the university,” it said.

The SFI’s attempt to screen the documentary at the Jamia campus comes a day after a similar event was organised at Jawaharlal Nehru University during which students claimed that power and Internet were suspended and stones hurled at them.

  • Saudi Arabia set to receive two million pilgrims for Haj 2023

Saudi Arabia set to receive two million pilgrims for Haj 2023

    [ad_1]

Riyadh: The Kingdom of Saudi Arabia (KSA) is prepared to receive two million Muslim pilgrims, to perform Haj this year, as the kingdom has lifted COVID-19 pandemic-induced limits, the Saudi Press Agency (SPA) reported.

The Minister of Haj and Umrah Dr Tawfiq Al-Rabiah disclosed the number on Tuesday during an official visit to Algeria, where he said Algeria would be given 41,300 spots for pilgrims.

Referring to services targeting pilgrims, Al-Rabiah mentioned projects worth Saudi Riyals 200 billion designed to keep pace with the expected rise in the numbers of pilgrims and the high-speed rail service linking the holy cities of Makkah and Madinah.

“The Ministry and all parties involved in the Haj and Umrah system are keen to provide the best health and logistical services to all pilgrims, in a way that saves time and effort,” he said.

On January 9, Saudi Arabia announced that it would not impose restrictions on the number of pilgrims for this year, after three years of restrictions to curb the COVID-19 pandemic.

For the last two years, Saudi Arabia had reduced the number of Muslims allowed to perform Haj to prevent the spread of COVID-19.

Haj – one of the five pillars of Islam, which all able-bodied Muslims are required to perform at least once – is scheduled for June.

In 2019, about 2.5 million people took part in the ritual. Over the next two years, the numbers were drastically reduced due to the COVID-19 pandemic.

In 2022, nearly 900,000 pilgrims, including about 780,000 from overseas, will be welcomed to Makkah and Madinah.

Women’s Premier League: BCCI earns Rs 4669.99 crore windfall for 5 teams

    [ad_1]

Mumbai: The BCCI on Wednesday earned a Rs 4669.99 crore windfall for the sale of five teams in the inaugural Women’s Premier League (WPL) with Adani Sportsline shelling out a massive Rs 1289 crore for the Ahmedabad team, which emerged the most expensive franchise.

IPL team owners Mumbai Indians, Royal Challengers Bangalore and Delhi Capitals made successful bids of Rs 912.99 crore, Rs 901 crore and Rs 810 crore respectively to enter the WPL.

Capri Global Holdings got the Lucknow franchise for Rs 757 crore.

“Today is a historic day in cricket as the bidding for teams of inaugural #WPL broke the records of the inaugural Men’s IPL in 2008! Congratulations to the winners as we garnered Rs.4669.99 Cr in total bid,” BCCI secretary Jay Shah tweeted.

Earlier this month, the BCCI sold the media rights of the Women’s Premier League to Viacom18 for Rs 951 crore, getting a Rs 7.09 crore per match value for five years.

Adani Group, which had failed to buy an IPL team when the Lucknow and Ahmedabad franchises were up for sale in 2021, has made its official entry into Indian cricket by securing a women’s team for WPL.

Many were already calling the league Women’s IPL but BCCI secretary revealed the name on Wednesday.

“The BCCI has named the league – Women’s Premier League (WPL). Let the journey begin.

“Today is a historic day in cricket as the bidding for teams of inaugural #WPL broke the records of the inaugural Men’s IPL in 2008. This marks the beginning of a revolution in women’s cricket and paves the way for a transformative journey ahead not only for our women cricketers but for the entire sports fraternity.

“The #WPL would bring necessary reforms in women’s cricket and would ensure an all-encompassing ecosystem that benefits each and every stakeholder,” Shah said in a series of tweets.

The eight franchisees in the men’s IPL were sold for USD 723.59 million before the maiden edition in 2008.

The WPL player auction will take place next month with the first edition to be played in March.

The BCCI on Monday had cleared 17 technical bids for the closed door bidding that was held in a five star hotel here on Wednesday.

As many as seven IPL franchisees were in the race and the ones to miss out were Punjab Kings, Kolkata Knight Riders, Rajasthan Royals and Sunrisers Hyderabad.

Among the outsides, multinational sweets and snacks company Haldiram’s too had submitted its bid on Monday. The BCCI had not set any base price for the sale of teams.

A total of 22 games will be played in the inaugural season with the top-ranked team in the league stage qualifying directly for the final. The second and third placed teams will battle out for a place in the title clash.

Each team will have a purse of Rs 12 crore at the players’ auction next month and will need to buy a minimum of 15 players and maximum of 18. Up to five overseas players, including one from associate, will be allowed in the playing eleven.

“India’s women cricketers have always made the nation proud in the global sporting arena be it the World Cup, Asian Cup or the recent Commonwealth Games!

“This new Women’s League will once again shine a global spotlight on the talent, power, and potential of our girls. I’m sure our Women’s MI team will take the Mumbai Indians brand of fearless and entertaining cricket to a new level altogether,” said Mumbai Indians owner Nita Ambani.

Mumbai Indians also have their presence in the ongoing ILT20 in UAE and SA20 in South Africa.

The Diageo-owned RCB franchise said it was patiently waiting to become part of women’s cricket.

“At the core of Diageo, is the value of gender inclusivity that embraces diversity in the broadest possible sense and this enterprise champions us to welcome and celebrate women’s cricket for who they are and the value they bring in the journey of this sport, Cricket.

“Therefore, it is a fitting asset in the right direction for Diageo India owned franchise.

“We held back all our investments in overseas teams to own a team that
aligns with this philosophy and core value, and it gives us immense pleasure to have marked this accomplishment positively,” said RCB chairman Prathmesh Mishra in a statement.

  • Suryakumar Yadav voted ICC Men’s Cricketer of the Year

Suryakumar Yadav voted ICC Men’s Cricketer of the Year

    [ad_1]

Dubai: Swashbuckling Indian batter Suryakumar Yadav was on Wednesday named the ICC Men’s Cricketer of the Year for his ridiculously good run in the shortest format of the game.

Surya had a stellar 2022, breaking an array of records and setting a benchmark in the format.

He beat the likes of Sam Curran, Pakistan wicketkeeper-batter Mohammad Rizwan and Zimbabwe’s batting all-rounder Sikandar Raza for the top honour.

However, India vice-captain and last year’s Cricketer of the Year Smriti Mandhana lost out to Australia’s Tahlia McGrath in the women’s category.

Popularly known as ‘SKY’, the 32-year-old became just the second batter to make more than 1000 runs in a calendar year in T20Is and ended the year as the highest run-getter, scoring 1164 runs at a strike-rate of 187.43.

Surya hit a stunning 68 sixes during the year, easily the most recorded by anyone in a year in the format’s history.

The Indian was the key batter for his team through the year, smashing two hundreds and nine half-centuries.

Surya was at his stupendous best during the ICC Men’s T20 World Cup 2022 in Australia, recording three fifties in six innings and averaging nearly 60.

Notably, his strike-rate was yet again right up there at 189.68.

Having already recorded a ton earlier in the year, Suryakumar continued his brilliant year after the multi-nation tournament, making his second hundred in T20Is in the bilateral series in New Zealand.

Surya also became the top-ranked T20 player, achieving a career-high 890 rating points.
