SRINAGAR: On Friday, the Supreme Court of India refused to stay a circular issued by Jammu & Kashmir government directing deputy commissioners to remove encroachments on State Land including Roshni Land and Kachharie land by January 31, 2023, reported LiveLaw.in.
A bench of Justices MR Shah and CT Ravikumar, though expressed its disclination in not passing an order today, it orally asked the Union Territory to not demolish any houses.
“We are not passing any order today. You instruct them orally not to demolish any houses. But we will not grant a general stay…. others should not get benefit,” the bench orally told the counsel of J&K, according to report published in Livelaw.in.
During the hearing, the advocate for the petitioner argued that many tribals are residing on the land and took the Court through the reliefs prayed for.
“If stay is granted then it will benefit land grabbers also?”, Justice Shah asked.
The counsel appearing for the Union Territory clarified that the circular is mainly focused on the Roshni land. He also questioned the locus of the applicants.
“The Application was served on me yesterday. It does not even mention that the applicants live there”, he pointed out while adding that the said land only had shops and such establishments.
The Court then adjourned the matter. The matter was mentioned before the Chief Justice DY Chandrachud, earlier this week.
The Jammu and Kashmir government, on January 9, directed the removal of all encroachments on State Land, including Roshni Land and Kachharie land, by January 31, 2023. The order was passed while several review petitions challenging Roshni Act Judgment remain pending before the High Court of Jammu and Kashmir and Ladakh.
In 2020, the Jammu and Kashmir High Court held that the Jammu and Kashmir State Land (Vesting of Ownership to the Occupants) Act 2001, [popularly known as Roshni Act] is completely unconstitutional.
A whistleblower who has highlighted absenteeism culture in a government school in the Chatroo area of Jammu and Kashmir’s Kishtwar district is reportedly face pressure through the police.
As per details available with The News Caravan, Burhan Dar, 24, a human rights activist from Kishtwar who is locally known for his social work and highlighting public issues, faces huge harassment after he posted a video story on his Facebook page about a government school in the Pehalgowra hamlet of Chatroo tehsil in Kishtwar district. In the video story, students complain that a female teacher has been absent for the past three to four months, and the school has only two staff members for students at the time when video was created.
Noting the issue Dar was seen in the video saying that he was in the school and reported the matter from there and requested administration to take quick action. The video was uploaded on November 19, and it became viral locally.

In the video, a female teacher who was on duty in the school told Burhan that she had also reported this issue to the education department. “When I complained about this issue with ZEO (Zonal Education Officer), ZEO sir told me that I shouldn’t have to be a leader,” she said. “Whenever we complain to authorities, we are pressured.”
A student in the video can be seen saying a female teacher appears only for some days in a year. When Dar asked staff about the midday meal, a staff member responded and said that the ration is over from some days.
On November 24, Dar was summoned by the Jammu and Kashmir Police in Chatroo after his video crossed 100k views on Facebook.

According to Human Rights Watch report, at least 35 journalists in Kashmir have faced police interrogation, raids, threats, physical assault, restrictions on freedom of movement, or fabricated criminal cases for their reporting since August 2019.
In the case of Burhan Dar, who raised local issues, the complainer used the police against Dar, as he was summoned by the police just for posting a video in which he highlighted “absenteeism of the teachers.”

The “Har Ghar Tiranga” campaign was in full swing in August 2022, both nationally and especially in Jammu and Kashmir. The people actively participated in this initiative.
On one side, people were busy decorating their homes’ roofs with the tricolour flag on August 13.
According to The Chenab Times video report, Mohammad Anwar, a native of Jammu and Kashmir’s Kapran Shahabad Veerinag, is a young man who came to Kishtwar district for study because of his poor financial situation and was forced to accept employment at a man’s home in Kishtwar. But Anwar described the good nature of his master, in whose home he was living in Kishtwar, as they paid his medical expenses until now after this incident.
The tragedy
The tragic incident with Anwar happened on August 13. When the landlord of Muhammad Anwar asked him to bring a pipe so that he can install the tricolour flag at the residence, Anwar held an iron pipe, and while standing the pipe, it came into contact with a power transmission line, due to which Anwar was electrocuted. The landlord of Anwar immediately took him to the District Hospital Kishtwar, from where he was referred to SKIMS Soura in Srinagar. In this tragic incident, Anwar lost his right hand and leg completely.
Unfortunately, as of November 15, there is no FIR regarding this incident, according to Anwar. When a Chenab Times correspondent asked him whether any police officials had met or visited him, he said that no one met him after this incident. On November 14, he went back to Kishtwar to lodge an FIR so that he could get compensation from the concerned authorities because he was now handicapped and could not earn for his family.
Police response
When CT tried to contact Jammu and Kashmir Police officials in Kishtwar, no calls were received. An official saw our WhatsApp message but didn’t respond until the day this report is filed. We contacted Anwar’s lawyer; he said that they had moved to court regarding this, and the court has directed the police to lodge an FIR.
The unanswered questions
The question is whether Anwar will get compensation for living his life or whether he will keep knocking on doors for help. For losing his hand and leg for the tricolour, whether the Jammu and Kashmir government give honour to him and help him or not. These questions will remain unanswered until some practical developments take place.
