PDP president visited the family of a slain bank guard, Sanjay Sharma at their ancestral residence in Achan Pulwama on February 27, 2023. Sanjay was killed on Sunday by unidentified militants in his village.

Sanjay Sharma’s family was the only Pandit family living in the otherwise Muslim-majority Achan village as they had refused to leave their native village in the 1990s. Of the four brothers, only one had migrated and is living in Udhampur. His parents also stayed put and passed away in the same village.

The Jammu and Kashmir police are suspecting the role of The Resistance Front (TRF), a shadow militant outfit of the Lashkar-e-Taiba ( LET) in the killing of Sanjay Sharma.
Quoting Additional Director General (ADGP) Vijay Kumar, The Hindu reported that LeT’s TRF is behind the killing and police have stepped up the search for three local and two foreign militants active in the region.

To denounce the killing and to express condolence and solidarity with the family silent candlelight protests were held at many places in the valley. One such protest was reported from Pulwama’s main Chowk.

“In a fight between Muslim Kashmir and Hindu India, religious minorities living in Kashmir are becoming a scapegoat,” KPSS, a Srinagar-based Pandit group said. It called for initiating a “brutal operation” against the killers.

BJP also held protests at several places in Kashmir and burnt an effigy of Pakistan, holding the neighbouring country responsible for the killing. The main protest was held in the Jawahar Nagar area of the city where dozens of party workers protested against the killing. Protesting party workers appealed to the LG administration to ensure the security of minorities and take steps to prevent such incidents in future.

  • Targeted killing a matter of grave concern, says DPAP chief Azad

Targeted killing a matter of grave concern, says DPAP chief Azad

    [ad_1]

Srinagar: Democratic Progressive Azad Party (DPAP) chairman Ghulam Nabi Azad condemned the killing of a Kashmiri Pandit ATM guard in Jammu and Kashmir’s Pulwama district on Sunday, saying it was a matter of grave concern.

“Any killing, especially a targeted killing, is a matter of grave concern and condemnable. We condemn it,” Azad told reporters here.

A 40-year-old Kashimir Pandit named Sanjay Sharma, who worked as an ATM guard, was shot in the chest at point-blank range by terrorists in the Achan area of the south Kashmir district around 11 am on Sunday, police said.

The DPAP chief said every targeted killing is condemnable, be that of a Kashmiri Pandit or a Muslim or a Sikh and whether the victim is from Jammu or Kashmir.

However, the former Jammu and Kashmir chief minister said the most unfortunate part is that while many people were arrested in connection with such incidents over the last 30 years, “not one killer has been arrested for these targeted killings in the last two years”.

Azad said while it was a reality that militancy has decreased in J-K, what is worrisome is that such target killings have been taking place for the last few months.

He said such mysterious killings pain him and he requested the government to make security agencies, intelligence agencies and law and order enforcement agencies answerable for such killings as “no one was arrested for such killings”.

The former Union minister said except the targeted killings taking place, there was “no militancy in J-K”.

“There is no hartal, there is no stone-pelting. So, there is no justification for the LG’s rule and delaying elections,” he added.

On the issue of the proposed imposition of property tax, Azad, who has earlier demanded that it be put on hold for a few years, said he was not against the imposition of the tax which will eventually benefit the people.

“We oppose its implementation here because of the economic situation. Let it be imposed after six years when the economic situation improves The state has witnessed militancy for the last 33 years, the people here are not in a position to pay such tax,” he said, adding “if need be, the party will launch an agitation against it”.

  • Yogi vows to destroy mafias ‘nurtured’ by SP after killing of witness in high-profile case

Yogi vows to destroy mafias ‘nurtured’ by SP after killing of witness in high-profile case

    [ad_1]

Lucknow: Facing flak over the brazen killing of a prime witness in the 2005 case of a BSP MLA’s murder, Uttar Pradesh Chief Minister Yogi Adityanath on Saturday accused the Samajwadi Party of nurturing mafias and vowed to destroy them.

“The mafia whose name is emerging … is it not true that the Samajwadi Party had made him an MP… He was a mafia nurtured by the SP. Our government is working to break their back. ‘Mitti me mila denge’ (We will destroy the mafias),” Adityanath said in the Assembly.

He was speaking after Samajwadi Party chief Akhilesh Yadav sought to corner him over the killing and raised questions over the law and order situation, while the opposition and treasury benches traded charges.

“They (SP) are the mentors of criminals, and they have been doing it continuously. Crime flows in their veins. They have learnt nothing except crime. The entire state knows about this, and today they are giving justification,” said a visibly agitated chief minister, who spoke for more than two hours in the Assembly while replying to the debate on the motion of thanks to the governor’s address.

He alleged that the SP was not just nurturing mafias but making them MPs and MLAs.

Chief Minister Adityanath has frequently stressed that reining in mafias and improving the law and order situation had been one of the major achievements of his government since the BJP came to power in the state in 2017.

Umesh Pal, the prime witness in the 2005 murder of Bahujan Samaj Party (BSP) MLA Raju Pal, was shot dead outside his residence in Prayagraj on Friday, the police said. One of his gunners, who too was hit in the firing, died later.

An FIR was registered on Saturday against several people, including former MP Atiq Ahmed. The mafia-turned-politician is currently lodged in a Gujarat jail. Atiq was an SP MP from Phulpur parliamentary constituency (in Prayagraj).

When the House assembled for the chief minister’s reply to the debate on the Governor’s address at 11 am, the SP tried to raise the issue of Pal’s killing with chief whip Manoj Kumar Pandey demanding a discussion.

“The way in which a witness and a security personnel have been shot dead in Prayagraj, what is the double-engine government doing?” Leader of Opposition Akhilesh Yadav said.

He said that had the injured had got timely treatment, their lives would have been saved.

Speaker of UP Legislative Assembly Satish Mahana said no notice has been received for discussion, and it was decided in advance that the Leader of the House (CM) will speak on the motion of thanks.

Speaking on the killing, Adityanath said, “I would assure the House that action has been taken under the zero-tolerance policy. Its result will be out soon.”

“The mafia leader who had perpetrated this act yesterday is out of Uttar Pradesh, and became MLA and MP because of the assistance of the Samajwadi Party.

“Is it not true that in 1996, that mafia leader became an MLA from Allahabad West seat? In 2004, these people made him the Lok Sabha MP. Our government will finish them off,” he said.

Chief Minister Adityanath also attacked the Samajwadi Party over the Ramcharitmanas row and alleged that it has insulted crores of Hindus living in India and abroad by burning this sacred text.

“The office of the Samajwadi Party is running a campaign against ‘Sant Tulsidas’ jee. It (SP office) is making efforts to insult a sacred text like Ramcharitmanas,” he alleged.

The UP chief minister said Tulsidas had united the society through Ramlilas.

“The way efforts were made to tear the Ramcharitmanas, what would have happened if this had happened to another religion,” he said.

Adityanath also lashed out at the Samajwadi Party for disrupting Governor Anandiben Patel’s address, alleging its conduct was “anti-women”.

He said the behaviour of the Opposition during the Governor’s address on February 20 had “shattered the dignity of the House”.

“Those who cannot give respect to a female governor, the one who symbolises women power (‘matri shakti’), expecting them to give respect to half the population (the women), will be dishonesty,” the chief minister said.

Adityanath accused the previous Samajwadi Party government of indulging in a “game of scams” and said that a report has shown embezzlement of Rs 97,000 crore during its reign.

“In their government, there were only games and games. There was a game of laptop scam, a game of food grain scam, and the game of Gomti riverfront scam. Now, a report of one of the scams is out,” he said.

“In one tenure, there was a report of a scam amounting to Rs 97,000 crore,” the chief minister said but did not elaborate.

He said the BJP government speaks about providing houses, electricity connection, water for irrigation and employment, but the Samajwadi Party talks only about caste.

“We speak about industrialisation and ease of doing business. We strive to take forward UP, while they have a regressive approach,” he said.

He also took a jibe at the SP while referring to SP founder Mulayam Singh Yadav “boys commit mistakes” remark.

Pointing out to the state guest house incident in 1995 at Lucknow, Adityanath said their behaviour had become public during that time.

To this, Akhilesh Yadav objected, saying, “Netaji has been honoured by the Centre…they should feel ashamed.”

The guest house incident took place when Mayawati had withdrawn support from the Mulayam Singh Yadav government, reducing it to a minority.

According to reports, agitated SP workers cornered Mayawati at a guest house and besides hurling abuses, allegedly cut off the electricity and water supply. As Mayawati found herself surrounded by a mob of angry SP men, Bharatiya Janata Party (BJP) lawmaker Brahmdutt Dwivedi had come to her her rescue.

The House later passed the motion of thanks to the Governor’s address.

Civilian killing: NIA files supplementary charge sheet against Maoist cadre in Bihar

    [ad_1]

New Delhi: The NIA on Saturday filed a third supplementary charge sheet against a Maoist cadre who was involved in the killing of a civilian after a “kangaroo court” dubbed him as a police informer in Bihar’s Aurangabad district in 2018, an agency official said on Saturday.

Naresh Singh Bhokta was abducted on November 2 and taken to a “jan adalat or kangaroo court” where the top leadership of the CPI(Maoist) issued instructions to their cadres to kill him after declaring him as a police informer. His body was found near Badhai Bigha village in the Madanpur police station area the same day.

The National Investigation Agency (NIA) took over the investigation into the case on June 24 last year. The case was initially registered at Madanpur police station in Aurangabad district in Bihar.

Earlier, the state police filed separate charge sheets against seven accused on January 26 and December 28 in 2019 and November 30 in 2021.

A spokesperson of the NIA identified the accused charge-sheeted on Saturday as Ajay Singh Bhokta, a resident of Kanaudi village in Madanpur, and said, “investigations have revealed that he, along with other CPI(Maoist) cadres, was actively involved in the abduction and murder of the civilian”.

“Ajay is an armed cadre of CPI(Maoist) and he was arrested in the instant case on September 1 last year upon production warrant. Charge sheet has been filed against him in the NIA Court, Patna under various sections of IPC, Arms Act and Unlawful Activities (Prevention) Act,” the spokesperson said.

The official said the weapons used in the incident have been seized and their forensic examination has been completed.

Three vehicles used by the CPI(Maoist) cadres in the incident have also been seized, the spokesperson said.

“During its investigations, NIA has also been able to unearth the involvement of top CPI(Maoist) commanders, including a politburo member, in the conspiracy for this brutal murder, which was done to create terror in the society while propagating the false and fallacious ideology of people’s war against the State,” the spokesperson said.

Taking cognisance of the media report on the incident, the court initiated suo moto Public Interest Litigation (PIL).

The GHMC has also been asked to explain what steps it would take to ensure that such an incident is not repeated.

Expressing condolences over the death of the boy, the court said it would look into the matter of compensation for his family.

The court included the Chief Secretary, Principal Secretary of the Municipal Administration and Urban Development Department, GHMC Commissioner, GHMC Deputy Commissioner (Amberpet), GHMC Veterinary Officer, Hyderabad District Collector and Member Secretary of Telangana State Legal Services Authority as respondents in the case and asked them to file the counter.

After the meeting, Yadav told reporters the municipal authorities have been directed to undertake a month-long special drive to sterilise stray dogs.

The Department of Municipal Administration and Urban Development directed all the Municipal Commissioners to enhance the current capacity of conducting animal birth control including rationalisation centre wise, increasing the number of dog catching teams and vehicles in order to attend the dog complaints effectively and to achieve 100 per cent sterilisation of street dogs.

  • SC upholds life imprisonment to woman for killing her 5-year-old child

SC upholds life imprisonment to woman for killing her 5-year-old child

    [ad_1]

New Delhi: The Supreme Court has upheld the life term sentence handed down to a woman from Tamil Nadu for murdering her five-year-old female child, as she was forced to live with her mother-in-law at the matrimonial home for better education and upbringing of the kid.

A bench of Justices Dinesh Maheshwari and Bela M. Trivedi said: “In an overall comprehension of the material on record and the findings recorded by the trial court and the high court, in our view, no case for interference with the concurrent findings of fact is made out.”

The bench noted that the case was based on circumstantial evidence and even though the prosecution story presented a somewhat difficult proposition, it cannot be ruled out.

In a 43-page judgment, the bench said: “In the facts of the present case, when the prosecution evidence categorically established the fact that the victim child was last seen alive with the appellant only; she was required to explain the circumstances leading to the demise of the child.”

“Upon her failure to do so and failure to give the explanation with regard to the circumstances under which death may have taken place, burden of Section 106 of the Evidence Act operates heavily against the appellant.”

The woman was convicted for the murder of her five-year-old child in the house of her mother-in-law at Perambalur in the morning of June 21, 2007. According to the prosecution case, the appellant’s husband was living abroad for earning livelihood and the appellant was mostly living with her father at Kolakkudi. However, on being forced to live with her mother-in-law for the purpose of upbringing and education of the child, she found the child to be an obstacle in her desire to live separately and hence, strangulated the child to death when her mother-in-law had gone out of the house.

The woman’s counsel argued that the case does not fall under Section 302 IPC, but could only be of culpable homicide not amounting to murder as there was a quarrel between the accused and mother-in-law on the date of the incident because she wanted to go to her father’s place.

To this, the bench said: “Even if it be taken that there was a quarrel of the appellant with her mother-in-law in the morning of the date of incident because the appellant wanted to go the place of her father, it cannot be said that such a quarrel would make it a case of grave and sudden provocation.”

It noted that the circumstances as proved on record, and the manner of commission of crime, make it clear that the present case cannot be brought under any of the exceptions of Section 300 IPC; and conviction and sentencing of the appellant under Section 302 IPC cannot be faulted.

Vahitha was convicted of the offence of murder of her five-year-old child and according to the prosecution case, her husband was living abroad for earning livelihood and the appellant was mostly living with her father, Jamal Mohammed at Kolakkudi.

The trial court had relied upon the last seen evidence and convicted her, disregarding her plea for alibi that she was at her father’s place at Kolakkudi.

Vahitha moved the apex court challenging Madras High Court judgment, which dismissed her appeal against the judgment of conviction and order of sentence passed on October 15, 2009.
