    Kadapa: Kadapa MP, Y.S. Avinash Reddy, whose father Y.S. Bhaskar Reddy was on Sunday arrested by the CBI in former minister Y.S. Vivekananda Reddy’s murder case, alleged that ignoring some key facts in the case, the CBI was projecting them as the accused.

    He claimed that Vivekananda Reddy’s son-in-law knew about murder but he did not inform the police. The MP claimed that the CBI did not question the slain leader’s son-in-law about suppressing the information.

    Avinash Reddy, who rushed to Kadapa from Hyderabad after learning about his father’s arrest, said the investigation should be based on facts and not to target individuals.

    He said the new investigating officials of the CBI were doing the same thing which earlier officers had done. He said they had already brought this to the notice of the higher-ups.

    The YSR Congress Party MP, who is cousin of Chief Minister Y.S. Jagan Mohan Reddy, said though Dastagiri (Shaik Dastagiri, one of the accused in the case) murdered Vivekananda Reddy, the CBI officials made him an approver and released him on bail.

    The Lok Sabha member alleged that the CBI did not take into account the statement of Dastagiri or watchman Ranganna.

    He said the CBI officials and Vivekananda Reddy’s daughter Suneetha were taking the probe into a particular direction.

    “We will uphold the good and we will prove our innocence,” he said, adding that they are ready to face any probe.

    The Kadapa MP said truth and justice should prevail in the case but unfortunately the CBI has stooped to this level by ignoring facts and giving importance to small things.

    Avinash Reddy claimed that the CBI did not probe the disappearance of stamp paper from the house of Vivekananda Reddy and also did not take into consideration the letter written by the slain leader.

    He reiterated that Vivekananda Reddy had changed his name to Sheikh Mohammed Akbar in 2010 to marry another woman and that he had a son Shaenshah from second wife. He claimed that Vivekananda Reddy wanted to give his property to second wife and that round seals and documents relating to this were found in his house. He wondered why the CBI was not probing the missing stamp papers.

    Kadapa: Stepping up the investigation into the 2019 murder case of former Andhra Pradesh minister Y. S. Vivekananda Reddy, the Central Bureau of Investigation (CBI) on Friday made a key arrest.

    The Special Investigation Team (SIT) of the CBI arrested G. Uday Kumar Reddy at Pulivendula in Kadapa district. He is said to be a close follower of Kadapa MP Y. S. Avinash Reddy, the nephew of the deceased, who has been questioned by the agency multiple times in recent months.

    The CBI team arrested Uday after issuing him a notice under section 41 A of the Criminal Procedure Code. He was earlier questioned by the CBI in the past.

    The investigation agency was shifting Uday to Hyderabad, where a CBI court is hearing the case since November last year following direction of the Supreme Court.

    The development has come a couple of weeks after the Supreme Court constituted a new Special Investigation Team (SIT) of the CBI and directed it to complete the investigation by April 30.

    Uday, said to be an employee of Uranium mine at Tummalapalli in Kadapa district, had filed a private case against CBI S.P. Ram Singh in Kadapa Court last year. On the court’s direction, police had booked against Ram Singh in February last year following a complaint by Uday that the officer coerced him to give false testimony in the murder case. However, Andhra Pradesh High Court later stayed the case against the CBI SP.

    On the day when Vivekananda Reddy was murdered at his residence, Uday had allegedly gone there along with Avinash Reddy and Shiva Shankar.

    Uday was allegedly present at the residence of Y. S. Bhaskar Reddy, brother of the deceased and father of Avinash Reddy.

    Vivekananda Reddy, brother of former chief minister Y. S. Rajasekhara Reddy and uncle of present Andhra Pradesh chief minister Y. S. Jagan Mohan Reddy, was found murdered at his residence in Pulivendula of Kadapa district on the night of March 15, 2019, a few days before the elections.

    The 68-year-old former state minister and former MP was alone at his house when unidentified persons barged in and killed him.

    The CBI took over the investigation into the case in 2020 on the direction of Andhra Pradesh High Court while hearing a petition of Vivekananda Reddy’s daughter Suneetha Reddy, who raised suspicion about some relatives.

    The Supreme Court transferred the case to Hyderabad in November last year while observing that doubts raised by Suneetha Reddy about getting a fair trial and investigation in Andhra Pradesh were reasonable.

    Deceased’s brother Bhaskar Reddy and the latter’s son Avinash Reddy are facing allegations for their involvement in the murder. Avinash, cousin of the chief minister, has denied the allegations.

    New Delhi: Indian medical students, who returned home from Ukraine following the Russian invasion, will be allowed to take a key examination from India.

    This has been conveyed to the Indian side by Ukraine’s First Deputy Foreign Minister Emine Dzhaparova during her three-day visit to New Delhi.

    “On the issue of Indian medical students, the Deputy foreign minister mentioned that Ukraine will allow foreign medical students to take the Unified State Qualification Exam in their country of domicile,” the Ministry of External Affairs (MEA) said on Wednesday.

    The MEA issued a statement as Dzhaparova wrapped up her visit to India.

    Around 19,000 Indian students were studying in Ukraine when the Russian invasion began in February last year.

    According to estimates, approximately 2,000 Indian students have gone back to Ukraine and they are residing mostly in the western part of the East European country.

    Under the initiative of the Ukranian authorities, the students who are still in India can join online classes and have the option to appear for the Unified State Qualification Exam (USQE) in India.

    During the visit, the first deputy foreign minister held bilateral talks with Sanjay Verma, Secretary (West) in the MEA and called on Minister of State for External Affairs Meenakshi Lekhi.

    “Dzhaparova, during her visit, highlighted Ukraine’s desire to build a stronger and closer relationship with India,” the MEA said.

    “Dzhaparova’s visit to India would facilitate cooperation between the two countries,” it said.

    Hyderabad: In a significant development in the Telangana State Public Service (TSPSC) exam paper leak case, the Enforcement Directorate (ED) has entered the scene to question tge key accused.

    The central agency filed a petition in the Nampally court, seeking permission to question Praveen Kumar and Rajasekhar Reddy, both suspended employees of the TSPSC who are currently in judicial custody.

    As there were allegations of money laundering, the ED moved the court to record the statement of the accused under section 50 of the Prevention of Money Laundering Act (PMLA). The agency submitted to the court that it has the powers to take up investigation under Sections 48 and 49.

    The ED has registered an Enforcement Case Information Report, based on the media reports, information in public domain and preliminary inputs from intelligence.

    The court was told that a four-member team of ED officials will record the statements of the accused.

    The ED also sought court’s direction to Chanchalguda Jail superintendent to allow laptops, printer and other electronic gadgets into the jail for recording the statements.

    The agency also mentioned in its petition that it had written to the Central Crime Station (CCS) on March 23 seeking documents and details of the case. It sought a direction to the police to hand over the case details.

    The ED has also issued notices to two TSPSC officials, including confidential section officer Shankara Lakshmi. They have been asked to appear for questioning on April 12 and 13. The accused had stolen the question papers from Lakshmi’s computer.

    Meanwhile, the Special Investigation Team (SIT) of Hyderabad police probing the paper leak on Tuesday submitted its investigation report to the Telangana High Court in a sealed cover. Hearing the petition of NSUI leader Balamoori Venkat, the court had directed the SIT to submit the report.

    The Advocate General submitted to the court that out of 18 accused, 17 have been arrested by the SIT while efforts were on to arrest another accused who is in New Zealand.

    The petitioner’s counsel argued that he has no trust in SIT which works under the state government. He also submitted to the court that the SIT investigation is confined to few lower-rank employees of the TSPSC. Stating that the ED is talking about transactions from abroad, he said investigation by the Central Bureau of Investigation (CBI) alone can bring out the facts.

    The court asked the Advocate General whether candidates were allowed to appear in the examinations as per rules and sought details like the name of the agency which was outsourced the task of conducting the exams.

    The paper leak issue rocked the TSPSC last month. Two employees broke into a computer system in the confidential section of TSPSC, stole question papers, and shared them with others.

    The TSPSC has cancelled four examinations conducted by it including the preliminary exam conducted for recruitment to Group-1 posts in the government departments.

    The SIT has also recorded the statements of TSPSC Chairman, Secretary and a member and also questioned several candidates who had scored good marks in Group-1 exam.

    New Delhi: The Democratic Teachers’ Front (DTF) on Friday criticised the National Council of Educational Research and Training (NCERT) for making changes in textbooks of Class 11 and 12 that include omission of some chapters on Mughals and colonialism.

    The DTF refused to agree with NCERT’s submission that omitting chapters on colonialism and Mughals would not make much of an impact on students’ learning process.

    The teachers’ body also did not back NCERT’s view that the latest change in syllabus would take “a certain extra pressure” off the students.

    The NCERT has also cited the impact of Covid on students across the country behind the changes in syllabus — a submission the DTF did not accept.

    DTF president Nandita Narain said most of the subjects in Class 11 and 12 are optional for CBSE students.

    “If any student picks History in Class 11, he or she needs to develop a deeper understanding of the historical episodes in the next class as well,” she said, adding the NCERT’s claims of rationalisation and rationalisation of the curriculum have no merit.

    DTF secretary Abha Dev Habib said the Constitution talks about development of the scientific perspective of the citizens, and “the NCERT’s latest move goes against this very idea”.

    “… also, from this point of view, India’s pluralistic and inclusive nature for diversity cannot be saved. This approach would also eliminate any possibility of India emerging as the centre of science and technology. If ‘WhatsApp University’ is given a free hand to have its say in schools, colleges and universities in the same way, it will seriously affect Indian democracy,” she said.

    The new revelations — and key questions — in the Trump indictment

    All 34 felony charges against Trump are identical, with each carrying the possibility of up to four years in prison, although judges rarely sentence defendants to jail for such offenses.

    The indictment is a bare-bones document that simply recites the alleged offenses in boiler-plate language. However, Manhattan District Attorney Alvin Bragg’s office also released a 14-page statement of facts laying out the case in greater detail.

    Here are details from the groundbreaking court filings that could make or break the case of People v. Donald J. Trump.

    The aggravating factor

    Going into Tuesday’s historic and much-previewed arraignment, a key mystery was exactly how Bragg planned to bring the charges as felonies. The charge at the heart of the case – falsifying business records – is typically a misdemeanor, but it becomes a felony if the defendant falsified the records to obscure a separate crime.

    The most obvious candidate for that aggravating element is the admission from Trump’s former lawyer, Michael Cohen, that he arranged a $130,000 payment to porn star Stormy Daniels in consultation with Trump and to aid Trump’s 2016 presidential campaign.

    “The defendant Donald J. Trump repeatedly and fraudulently falsified New York business records to conceal criminal conduct that hid damaging information from the voting public during the 2016 presidential election,” the statement of facts says.

    “The participants [in the scheme] violated election laws,” the statement continues, though it does not explicitly cite which ones. The statement also mentions Cohen’s guilty plea in 2018 to two federal campaign finance crimes. And in a press release, Bragg said Trump and others sought to conceal “attempts to violate state and federal election laws.”

    The references to federal election violations are virtually certain to be the focus of pre-trial motions from Trump’s attorneys, who have contended publicly that this state-law offense cannot be piggybacked on a federal-law crime.

    If defense attorneys prevail on such motions, it would not necessarily wipe out the criminal case against Trump. Instead, the case could remain as 34 misdemeanor charges. That would amount to a legal, public relations and political victory for Trump.

    Such a result would further diminish the chances of Trump being jailed if found guilty. The maximum sentence on a second-degree falsifying business records charge is up to one year in prison on each count. A downgrading of the case to a misdemeanor might also aid Trump’s efforts to delay a trial.

    A strange tax claim

    The charges against Trump do not include any tax fraud offenses that some legal experts said they hoped to see to buttress the seriousness of the case. However, the statement of facts Bragg filed along with the indictment makes a surprising claim: that Trump and his associates engaged in deception by paying New York state more in taxes than it was owed.

    “The participants also took steps that mischaracterized, for tax purposes, the true nature of the payments made in furtherance of the scheme,” the statement says.

    It alleges that Trump paid an increased reimbursement to Cohen – a procedure known as “grossing up” the payment – in order to compensate him for the taxes he would owe by booking the money as legal fees.

    These alleged contortions resulted in Cohen paying about $180,000 in state and federal income taxes, when he may have not owed anything if Trump had simply reimbursed him for the $130,000 and the payment had been properly recorded. That’s because the reimbursement of money Cohen already paid to Daniels wouldn’t have represented income for Cohen.

    But recording the money, falsely, as legal fees subjected Cohen to significant income-tax liability – meaning that any trickery the men engaged in may actually have benefitted state and federal coffers. That may be why Bragg’s team doesn’t deem the practice “fraud,” and why no tax fraud or evasion charge was included in the indictment.

    Is every record kept at a business a business record?

    For Trump to be convicted of falsifying business records, the records at issue have to be, well, business records.

    The New York law at issue requires that the falsification involve the records of “an enterprise,” and each count of the indictment claims that Trump falsified records “kept and maintained by the Trump Organization.”

    The facts are more complicated. It’s true that the checks sent to Cohen, which labeled the payments as legal expenses, were issued by employees working for Trump’s business empire. But they were not charged to Trump’s businesses. Instead, the payments were made from one of Trump’s personal accounts or from a Trump family trust.

    The key question, and one that is sure to feature in efforts by Trump’s lawyers to derail the case, is whether documents that happened to pass through the Trump Organization or handled by Trump Organization personnel are automatically classified as business records, even if the source of the funds was Trump’s personal accounts.

    Bragg’s statement of facts declares that “each check was processed by the Trump Organization” and gives further details about how Cohen arranged payment from bookkeepers at the Trump companies. Prosecutors say at least two of the payments were approved by longtime Trump Organization chief financial officer Allen Weisselberg, who pleaded guilty to unrelated tax evasion charges in 2021.

    “The TO CFO approved the payment, and, in turn, the TO Controller sent the invoice to

    the Trump Organization Accounts Payable Supervisor (the “TO Accounts Payable Supervisor”)

    with the following instructions: ‘Post to legal expenses. Put ‘retainer for the months of January

    and February 2017’ in the description,’” the prosecutors’ filing says.

    Legal experts said they expect Trump’s lawyers to argue to the judge and, if necessary, a jury that wholly personal expenses that are simply handled by an accountant or other clerical personnel don’t become the “records of an enterprise” just by virtue of that process.

    The Bharatiya Janata Party (BJP) has also taken up state-wide protests over the paper leak, alleging involvement of KCR’s son and state minister K.T. Rama Rao.

    The Telangana unit of the BJP has huge expectations from PM Modi’s visit in view of his recent statement about the state.

    “In the south, we have always been strong in Karnataka and in Telangana, people now have confidence only in one party, BJP, and in Andhra Pradesh also people are looking towards us,” Modi had said on March 28 while inaugurating the residential complex of the party in Delhi.

    Modi will be launching various railway projects at Secunderabad Railway Station and later a public meeting at Parade Grounds in Secunderabad.

    Union Minister for Tourism and Culture G. Kishan Reddy along with state BJP president Bandi Sanjay Kumar and party MP K. Laxman on Tuesday visited Secunderabad Railway Station and Parade Grounds to take stock of the preparations for the Prime Minister’s visit.

    Kishan Reddy, who is also an MP from Secunderabad, said the PM would lay the foundation stone for the re-development of Secunderabad Railway Station. The station is being revamped at a cost of Rs 719 crore and will provide world-class railway infrastructure and amenities.

    He will also lay the foundation stone of the new block of the All India Institute of Medical Sciences (AIIMS) at a cost of Rs 1,336 crore.

    Kishan Reddy said this would give a big boost to health infrastructure in Telangana. The expansion and new facilities include academic blocks, auditorium, staff quarters, hostels and guest houses. The hospital block renovation is also underway.

    Meanwhile, Telangana Chief Secretary Santhi Kumari on Tuesday reviewed arrangements for PM Modi’s visit. She instructed the officials to make foolproof arrangements.

    Presiding over a coordination meeting, she said that all the departments have to work in close coordination and make the brief visit of the Prime Minister a success.

    The police have to make adequate security arrangements, law and order, traffic and bandobast arrangements as per the blue book.

    The fire department was asked to arrange adequate fire fighting equipment and fire tenders should be positioned at the venue. Medical staff, ambulances and other facilities should be kept ready at all the venues.

    The Chief Secretary asked officials to repair roads to be used by the Prime Minister’s convoy. Uninterrupted power supply at all the venues should be ensured, she said.

    DGP Anjani Kumar, senior police officers and officials from various departments including railways attended the meeting.
