    Kerala HC directs govt to post adequate faculty in state-run law colleges

    Kochi: The Kerala High Court has now directed the state government to take appropriate decisions, in four months, on creating permanent posts and appointments of faculty members in government law colleges from 2023-24.

    Justice Shaji P. Chaly held that as per Bar Council of India (BCI) rules, the state government and the respective universities are duty bound to take adequate steps immediately to create posts and make permanent appointments, or else the students will suffer.

    The court was hearing a case filed by four students pursuing LLB from three different government law colleges in Kerala.

    They moved the court seeking a direction to the authorities concerned including the Bar Council of India (BCI) to disallow LLB courses in those government law colleges unless they employ sufficient permanent faculties as per the BCI Rules of Legal Education, 2008 and its guidelines/resolution.

    They, therefore, sought a direction to the authorities to immediately fill up the vacancies of permanent faculties in government law colleges in the state to comply with the said Rules.

    The petitioners also pointed out that as per the rules, the university has to ensure that the core faculty members for each course should be in the ratio of at least be 1:40, so that the students do not suffer because of shortage of faculty members.

    The counter affidavit filed by the respondents submitted that even though a consolidated proposal from the government law colleges was forwarded to the government’s Finance Department, it did not grant approval to create posts and make permanent appointments.

    After going through the facts, the Court noted that the state government has not taken adequate steps to satisfy the requirements of the Act of 1961 and the Rules of 2008 with respect to the appointment of required faculty and the Finance Minister is yet to take a final decision.

    Therefore, the court directed the State to take appropriate decisions by four months on creating permanent posts and appointments of faculty members in government law colleges within Kerala, at least from the year 2023-24.

    Kochi: The Kerala High Court on Wednesday dismissed actor Mohanlal’s plea against a trial court order rejecting the state government’s move to withdraw prosecution proceedings against him in a case related to illegal possession of ivory tusks.

    Justice A Badharudeen was of the view that an accused in a case “have no right to challenge an order refusing withdrawal of prosecution” since the said procedure is the prerogative of the prosecution.

    The court, however, also set aside the trial court order and directed it to consider afresh the state government’s plea to withdraw prosecution in the case.

    “…the prayer for withdrawal of prosecution of the present case sought for by the government requires reconsideration by the trial court,” the high court said.

    It directed the parties to appear before the trial court on March 3.

    “There shall be a direction to the trial court to hear and pass fresh orders as expeditiously as possible from the date of receipt of copy of this order, at any rate within a period of six months,” the high court said.

    The state government had sought withdrawal of the prosecution contending that it would be a futile exercise and wastage of the court’s time.

    The magisterial court, in its June 2022 order, indicated that it was not inclined to grant the prayer as the withdrawal petition was filed in a hasty manner without addressing the challenges raised before the High Court regarding legality of the ownership certificate issued to Mohanlal.

    The state government had on February 7, 2020 extended consent for withdrawal from prosecution in this case.

    The trial court, in its order, had noted that there was no gazette notification in this case and hence the alleged certificate of ownership of the tusks has no legal sanctity and was void ab initio.

    Four elephant tusks were seized from the actor’s house in a raid conducted by the Income Tax authorities in June 2012, following which a case was registered against him.

    The complainant had alleged that the top actor had used his clout to bury the case without any further investigation.

    Thiruvananthapuram: While sitting at the waiting lounge of the railway station here recently, a middle-aged woman conservancy staff was seen dragging a bundle of waste, collected from the toilet, in a huge carry bag.

    “I don’t know why these people (women travellers) are dumping napkins in the toilet and clogging it! We are cursed to clean it!” the gloves-clad woman said to herself angrily and walked away.

    This was not an isolated scene in a railway station in Kerala, but overflowing garbage bins and clogged toilet bowls with used sanitary napkins and those manually segregating it are apparently witnessed in the majority of public places, including schools and hospitals across India.

    For the first time in the country, the Left government in Kerala is getting ready to address the issue of the accumulation of enormous quantities of biodegradable waste generated by napkins in the environment and reduce it by offering a sustainable alternative- menstrual cups.

    The Pinarayi Vijayan-led government will soon kickstart a revolutionary drive at the grassroots level to promote menstrual cups among women and has set aside Rs 10 crore for the same.

    An environment-friendly, sustainable and cost-effective alternative for sanitary napkins, the menstrual cups alias M-Cups are reusable containers to collect period fluid.

    Finance Minister K N Balagopal, in his February 3 budget speech, had announced the state government intends to promote the M-Cups instead of sanitary napkins.

    “Awareness programmes and campaigns will be conducted at the government level in schools, colleges and workplaces. An amount of Rs 10 crore is earmarked for this,” he had said.

    Talking to PTI, Balagopal said it would be a large-scale initiative in the areas of environmental protection and menstrual hygiene management. “Kerala may be the first state in the country which comes up with such a massive campaign to promote sustainable alternatives for non-biodegradable sanitary napkins,” he said.

    Over 100 tons of non-biodegradable waste is generated through the usage of sanitary napkins by just 5,000 women for five years, he said, quoting figures. Several pro-women groups, activists, environmentalists and women legislators had been pressing the government to implement some healthy and affordable alternatives for menstrual hygiene management.

    “As per the figures, thousands of tons of non-biodegradable waste are generated in Kerala yearly. Some recent studies pointed to possible health issues also due to the constant use of pads. The cost of buying napkins also seems to be high,” he pointed out.
    Thus, the government came up with a sustainable, eco-friendly and cost-effective alternative for menstrual hygiene and decided to promote M-cups, he said.

    Considering the number of women belonging to the age group of 13-45 years, it could be assumed that 80 lakh to one crore ladies are using sanitary napkins in the state. “Then, how many tons of napkin waste will be generated annually in the state. It poses environmental as well as health hazards,” he added.

    A mass campaign, with the coordination of health, social welfare and environment departments and panchayats, is planned for the menstrual cup drive giving special focus on schools.

    Balagopal admitted it would not be easy to remove the “mental block” of women to switch to a completely different menstrual hygiene product, but expressed hope the campaign would help remove it at least to some extent.

    There were a handful of civic bodies in the southern state which had already carried out awareness campaigns by distributing M-Cups among a selected number of women on an experimental basis as the disposal of napkins posed a serious concern in their locality.

    Among them, the “Thinkal” project implemented by Alappuzha Municipality in 2019 was considered as one of the first such M-Cup awareness drives in the country implemented at the government level.

    Under the drive, nearly 5,000 menstrual cups had been distributed by the Hindustan Lifecare Limited (HLL), a central PSU, with the support of health practitioners, experienced users and community development society.

    Kumbalangi in Ernakulam district and Muhamma in Alappuzha became ‘sanitary napkin-free’ villages recently by distributing M-Cups and cloth pads as part of panchayat-level sustainable menstruation campaigns.

    Thiruthiparambu hamlet in Thrissur and Palakuzha panchayat in Ernakulam also had announced similar campaigns.
    Anitha Thampi, Technical and Operations Director, HLL Lifecare Ltd, said the “Thinkal” project in Alappuzha was a huge success as its acceptance rate was 91.5 per cent among those women who started using M-Cups, as per a study.

    There was some reluctance and reservations initially, but those who started using it whole-heartedly accepted this sustainable alternative, she said. “By allocating Rs 10 crore for the awareness and promotion of menstrual cups, the Kerala government has done a historical thing. I think it may be the first such initiative in the world by any government to allocate funds for a menstrual hygiene product,” she told PTI.

    M-Cups would be a game-changer in the lives of women and would surely play a key role in environmental protection, she said.
    “As per our figures, there is a diversion of 100 ton sanitary napkins if 5,000 women use menstrual cups for five years. We assure a five year lifespan for our M-Cups. Considering the napkin cost, these 5000 beneficiaries together can save upto Rs 10 lakh during the period,” she added.

    However, experienced users pointed out that a grassroot level awareness is needed for the success of the M-Cup campaign.
    Geethu, an aviation trainer who has been using M-Cup for some years, said several factors, right from cultural myths to the mental block to experiment a completely strange product, should be busted to ensure its acceptance among common women.

    “There might be a reluctance among ordinary women to accept an insertion product. It may also be difficult for many of them to accept that a menstrual hygiene product can be reused,” she told PTI.

    Echoing her views, K S Damodaran, councillor of Muhamma ward, said many women were unwilling to switch to menstrual cups when the panchayat had distributed it with the support of a Bengaluru-based NGO by the end of 2019.

    “It was really a good initiative and we found that these alternative products were both economic and environment-friendly. Several women accepted it whole-heartedly but some were very adamant to change their traditional habit,” he said.

    Meanwhile, Manju M M, a school teacher and a mother of two girls, is hopeful that the government campaign, focussing on schools and colleges, will surely help achieve the desired result.

    “It is comparatively easier to instill fresh thoughts in the minds of youngsters than bringing change in the mindset of adults. So, the catch-them-young policy will surely work in the case of M-Cups also,” she told PTI.

    The teacher-homemaker is also elated that she can save at least Rs 2000 in their family budget if sanitary napkins are replaced with reusable menstrual cups.

    Sounding like a rebel with a cause, Pinarayi Vijayan, Kerala Chief Minister has made many heads turn around, with his remarks that may not be music to the ears of the people in the ruling Bhartiya Janata Party at the center.

    While delivering the speech inaugurating the ruling CPM’s march ‘Janakeeya Prathirodha Jadha’, in Kasaragod on February 20, 2023, CM Vijayan gave some contrarian views that have all the ingredients to spark controversy.

    First, he spoke about the BJP’s move to criminalize divorce for Muslims alone, and then he tried the BJP’s move to make religion to be the basis of citizenship, and he also took a dig at the law minister criticizing the Supreme Court of India and finally expressing reservation at the Parliament’s inability to agree on the basic structure of the Constitution.

    Pinarayi Vijayan on Triple Talaq said, “Divorce happens in all religions. All others are seen as civil cases. But in the case of triple talaq, it is made a criminal offense for Muslims alone? Can we use a different mode of punishment for each religion? For a person following a certain religion, there’s one law and for another, there is another law. In the case of a divorce, if it’s a Muslim, then he can be jailed, and others are not punished. “Isn’t this what we are seeing in the case of triple talaq ?” he asked.

    On the issue of citizenship, the Chief Minister said, “We are all Indians. Can we say that we got our citizenship because we were born into a particular religion? Has religion ever been the basis for citizenship?”

    ‘The Centre used religion to decide citizenship through the Citizenship Amendment Act, CM alleged, adding, “We have already cleared our stand on it. Citizenship Amendment Act will not be implemented in Kerala at any cost.

    Vijayan said, “Our parliament cannot decide on the basic principles of our Constitution. This was decided by a 13-member constitution bench of the Supreme Court in the Kesavananda Bharati case.”

    The Sangh Parivar knows that the judgment is not in favor of their agenda and that’s why they denounce the landmark judgment by the Supreme Court.

    Vijayan said, “The Vice-President is a constitutional post but he still chose to denounce the judgment in the Kesavananda Bharati case.”

    The Chief Minister also criticized India’s Vice-President and Law Minister for attacking the Supreme Court’s Collegium system. ‘The law minister often criticizes the Supreme Court,’ he said.

    Meanwhile, BJP leaders have come down heavily on Kerala Chief Minister Pinarayi Vijayan over his remark on triple talaq and said that the CM is indulging in appeasement and wanted to create a narrative that does not exist.

    Jerusalem: Authorities in Israel have registered a police case against a 48-year-old Kerala farmer, who reportedly went missing in Israel earlier this month while visiting the country on a state government-sponsored trip to study Israeli modern agricultural techniques.

    Biju Kurian, a native of Ulikkal panchayat in Kannur district, was part of a 28-member Kerala government’s delegation of farmers, sent to Israel to study state-of-the-art techniques such as hydroponics and precision farming.

    On February 17, Kurian reportedly went missing.

    Despite Israel’s law enforcement agencies’ best efforts to trace him, Kurian’s whereabouts were not known.

    “We have registered a police case against him. He will be deported once we nab him,” an official said.

    The delegation, led by Principal Secretary B. Ashok, left for Israel on February 11. The farmers’ delegation left Israel on Sunday without Kurian, they added.

    Kurian’s family in Kannur are also clueless about his mysterious disappearance and were making desperate attempts to reach out to him.

    Thiruvananthapuram: The Kozhikode Government Arts and Science College on Sunday directed the participants of a public programme in which Kerala Chief Minister Pinaryai Vijayan was the Chief Guest not to wear black clothes or even black masks.

    This has brought widespread criticism against the government, college authorities and the police.

    It may be recalled that since the state budget increased the fuel cess by Rs 2 per litre, the streets of Kerala witnessed widespread protests with agitators showing black flags at the Chief Minister and several have been taken to preventive custody.

    The Chief Minister is now in Kozhikode in North Kerala for some official programmes and the Government Arts College authorities have issued the order not to wear black clothes and black masks.

    Meanwhile, protests have been raging after the police took into custody a few Kerala Students Union (KSU) activists as a precautionary detainment due to the programme of the Chief Minister at Kozhikode Arts College.

    Kerala opposition leader, V.D. Satheeshan and KPCC president K. Sudhakaran has been relentlessly levelling criticisms Aof the police’s high-handedness against the people of the state while the Chief Minister was moving in a convoy to attend various programmes.

    There was widespread criticism against the Chief Minister using a chopper to attend public programmes even as the state is reeling under a severe economic crisis.

    Kochi: The Kerala High Court slammed the Kerala State Road Transport Corporation (KSRTC) for denying compensation to an accident victim on the ground that she is a housewife and does not earn any income.

    The High Court not only called the role of the housewife to that of a nation builder, but also ordered for a good compensation to be paid to her.

    Justice Devan Ramachandran said that such a stand by the transport body was ‘outrageous’ and urged that accident compensation should be same for a housewife and a working woman as the former also invests her time for the family and ensures that the next generation is fostered with the highest levels of excellence.

    He also went on to point out that the life of human beings can never be tested on the scales of their monetary worth but by their contribution and selflessness.

    Specifically on the role of a housewife, the judge said that her contributions as a mother and wife is invaluable.

    “At the outset, I must say that the contentions of the KSRTC, that a housewife earns no income and therefore, not eligible for compensation for disability and loss of amenities, is outrageous and beyond comprehension. The role of a mother and wife at home is beyond compare, and she is a true nation builder. She invests her time for the family and ensures that the next generation is fostered with the highest levels of excellence; and her efforts can never be taken trivially or brushed aside, as being without monetary value. The lives of human beings are never tested on the scales of their monetary worth, but by their contribution and selflessness,” the court said.

    The court made this directive while hearing an appeal moved by a housewife challenging the order of the Motor Vehicle Accidents Claims Tribunal (MACT) that awarded her only Rs 40,214 as compensation for the grievous injuries she sustained on account of a rash application of brake by a KSRTC bus driver.

    The woman instead sought Rs 2 lakh as she had to undergo extensive treatment and trauma for a long period of time after the incident.

    This prompted her to approach the High Court with an appeal and the judge termed it as outrageous stand taken by the KSRTC, granting the petitioner a compensation of Rs 1,64,654, instead of Rs 40,214 awarded earlier.

    Kochi: A special court here on Wednesday sent M Sivasankar, former Principal Secretary to Kerala Chief Minister Pinarayi Vijayan, to five-day Enforcement Directorate (ED) custody in connection with alleged violation of the Foreign Contribution (Regulations) Act in the Life Mission, a flagship housing project of the state government.

    Sivasankar was taken into custody on Tuesday night by the central agency which has been questioning the former IAS officer for the past three days. His arrest was recorded earlier in the day.

    The PMLA court here today granted till February 20 custody of Sivasankar to ED and issued a direction to produce him before it on that date.

    The ED was directed to provide relaxation time to Sivasankar during interrogation and also medical assistance if needed, court sources said.

    Meanwhile, his arrest triggered sharp political reactions in Kerala as opposition parties slammed the Left government and urged Chief Minister Pinarayi Vijayan to break his silence on the development.

    The opposition Congress, which had earlier raised several corruption charges in connection with the Life Mission project, today said truth would come out one day even if it is covered by a golden vessel and the arrest of Sivasankar is the latest proof for this.

    Leader of Opposition in the assembly, V D Satheesan said the person, who had been in a key position in the Chief Minister’s office, was earlier arrested in the gold smuggling case and now in the bribery case.

    With his arrest, the scandals that were covered up during the period of the first Vijayan government would come out one by one, he told reporters in Kochi.

    “The Chief Minister has a moral responsibility to answer the questions raised by the Opposition and the people of the state.”

    “If neither the government nor the CM is involved in corruption, why are they afraid of the CBI investigation? If there is nothing to hide, they should be ready to withdraw their petition in the apex court against the CBI probe in the case,” he said.

    Lawyers have been appointed by spending crores of rupees from the people’s tax money and the CM should give an answer to all these questions, the LoP added.

    Senior Congress leader and former home minister, Ramesh Chennithala also wanted Vijayan to break his silence on the matter.

    It is time for those who had said that the charges we raised against the Life Mission project were just politically motivated to give a reply, he said.

    “The Chief Minister is the chairman of the Life Mission. All the present developments are pointing fingers at the CM. So, he should break his silence and react,” he said.

    Noting that the present probe by the central agency was going in the right direction, Chennithala expressed hope that big sharks would be caught in the case soon if there was no political interference.

    “The truth will come out one day even if it is covered by a golden vessel.”

    Both Chennithala and Satheesan also claimed that the ED probe in the Life Mission case was slowed down for some time due to the settlement between the CPI(M) in Kerala and the BJP’s national leadership.

    However, senior BJP leader and union minister V Muraleedharan rejected the “settlement” charge raised by the Congress and said the retired IAS officer’s arrest is an eye-opener for those who alleged a BJP-CPI(M) understanding.

    “It’s a tight slap on @pinarayivijayan, who is the Chairman of Life Mission Project – who even tried to seize files to stall the investigation. Shame!” he tweeted.

    The union minister also alleged that Sivasankar’s arrest exposed the culture of kickbacks and corruption in the system run by the Vijayan government.

    “The arrest of M Shivshankar, Ex Principal Secretary at @CMOKerala exposed the culture of Kickbacks, Corruption & Rot in the system run by @pinarayivijayan & his cronies,” he said.

    Sivasankar, who retired on January 31, was earlier arrested in a related gold smuggling case involving diplomatic baggage to UAE consulate.

    The CBI had in 2020 filed an FIR in a Kochi court under section 120 B of the IPC and section 35 of the Foreign Contribution (Regulation) Act (FCRA), 2010 on a complaint by the then Wadakancherry Congress MLA, Anil Akkara, listing Santosh Eappen, Managing Director of Unitac Builder, Kochi as the first accused and Sane Ventures as the second accused.

    The alleged FCRA violation and corruption in the project had snowballed into a major political issue at that time with opposition parties charging that Swapna Suresh, a key accused in the gold smuggling case, had admitted before an NIA court that she had received Rs 1 crore as commission from the project.

    She had reportedly claimed that the money was for Sivasankar.

    However, Life Mission CEO had submitted before the court that Unitac and Sane Ventures had undertaken the construction based on the agreement entered into with them by Red Crescent and had directly accepted foreign contributions from Red Crescent, which is a foreign agency.

    It also said the companies which signed an agreement with the Red Crescent do not come under the categories of persons prohibited from receiving any foreign contribution as per Section 3 of the FCRA.

    Kerala man stabbed to death in Sharjah; suspect arrested

    In an unfortunate incident, a 34-year-old Indian man from Kerala was stabbed to death in Sharjah, United Arab Emirates (UAE) on Sunday, February 12, by a Pakistani citizen. The police have arrested the suspect, local media reported.

    The deceased, identified as HA, a native of Mannarkkad in Kerala’s Palakkad district was stabbed to death over a financial dispute. Two other Keralites and an Egyptian man were also injured in a brutal attack by the 38-year-old Pakistani man.

    As per media reports, the incident happened at 12:30 am at Bu Tina in Sharjah on Sunday.

    The victim, who was working as a supervisor at a hypermarket, had intervened to resolve an argument between his colleagues and the Pakistani citizen who worked in the nearby cafe. The man stabbed the victim.

    As per a report by Gulf News, police patrols and an ambulance rushed to the site after the Sharjah Police Operations Room received a call reporting the incident.

    As per Khaleej Times, during interrogation, the suspect admitted to stabbing the victim but claimed that the crime was not planned. He said that he got angry and stabbed the victim, but he did not want to kill him. The police returned the case to the prosecutor’s office on Tuesday for further action.
