    Court summons Lucknow police commissioner, 8 other cops for disclosing juvenile accused’s identity

    Lucknow: A special court here has directed the Lucknow police commissioner and eight other police personnel to appear before it for allegedly making public the identity of a juvenile apprehended in connection with a case of fraud.

    The court fixed April 4 for appearance of these police personnel.

    Judge Vijendra Tripathi passed the order on Tuesday on a complaint filed by Sunil Kumar, who is ‘peshkar’ (reader) of the Juvenile Justice Board.

    Kumar had filed the complaint on the instructions of the board as it had been apprised that the police personnel had willingly disclosed the identity of the juvenile on the Facebook wall of Lucknow police commissioner.

    It was apprised to the Protection of Children from Sexual Offences (POCSO) court that the accused was held by the police in a fraud case and was produced in the court which referred the matter to the Juvenile Justice Board after learning that he was a juvenile.

    Kumar said in the court that despite the accused being a juvenile, his identity was disclosed on the Facebook wall of the Lucknow police commissioner on February 7 and 8, based on which several newspapers and news channels broadcast the news.

    The court was informed that the act of the police was “totally illegal” and against the provisions of the Juvenile Justice Act.

    Gurugram: In prompt action, three accused, including a juvenile, in an abduction and gang rape case of a 14-year-old school student in Gurugram have been taken into custody, police said on Monday.

    “Three, including a juvenile, have been apprehended, the juvenile has been produced before Juvenile Justice Board on Monday. The case is under investigation and the remaining accused will be apprehended soon. Strict action will be taken against all those who are involved in spreading the filmed video,” Gurugram police spokesman Subhash Boken said.

    The victim’s father had filed a complaint that his daughter, a Class 8 student, was abducted from her school during a sports programme on December 18 last year by three youths, who took her to a hilly area and took turns to rape her.

    They accused had also threatened to kill her if she disclosed the incident to anyone.

    The three accused also made an objectionable video of the girl and uploaded it on social media.

    Following the complaint, an FIR was registered against three accused under various sections of the IPC and the POCSO Act at Sohna Sadar Police Station on Saturday.

    Srinagar, February 24: Police on Friday evening released Statement about death of a juvenile at Budshah Nagar Srinagar.

    In a handout to GNS, the police said that on 15th Feb this month, Police Station Chanapora recieved an information that some shopkeepers of Budshahnagar had apprehended some suspects from Sky Park , an under construction building.
    Upon this a police party rushed to the spot and found the shopkeepers had apprehended one juveline (Name with held). While questioning the locals /shopkeepers disclosed that four persons were found on the rooftop of the said building and the other three had fled away from the-spot.

    The police spokesman further stated that the building premises were searched by Police along with the locals /Shopkeepers and one juvenile was found lying near the corner of the building in a critical condition, he was evacuated to hospital for treatment. Where doctors declared him brought dead. He was identified as Farhan Bashir Wani S/O Bashir Ahmad Wani R/O Iram Lane Budshahnagar .

    Consequently case FIR No.08/2023 U/S 304 IPC was registered and investigation taken up. During the Course of investigation the apprehended juvenile (name withheld) disclosed the names of other two juveniles (Name withheld )who were also apprehended.
    The apprehended persons disclosed that they had gone inside the building in order to consume some contraband substance. They also disclosed that the shopkeepers along with the building owner had arrived inside the building , which made all of them flee in panic. Resulting in the fall of one among them. Accordingly the building owner along with other shopkeepers namely(1) Sahil Ahmad S/O Mohd Subhan R/O Nowgam (2) Abdul Rashid Bhat S/O.Habib Ullah Bhat R/o Allochibagh (3) Ab Majeed Fufoo S/O Habib Ullah Fufoo R/O Mehboob Colony (4) Aijaz Ahmad S/O Gh Ahmad Farash R/o Mehboob Colony and (5) Mohd Yaseen S/O Ab Gani Khan R/o Pulwama were arrested for this rash and negligent act causing death of a juvenile, he said.

    Moreover, the other three Juvelines in conflict with law ( friends of the deceased) were also apprehended formally and were medically examined, where it came forth that all of them were under the influence of contraband substance. All the 08 accused (including 3 juveniles in conflict with law) were produced before the Honble court of Law and necessary remand was obtained. Investigation in case is in full swing and whole circumstances leading to death will be examined in detail, reads the statement.(GNS)

    Chandigarh: In a major breakthrough against trans-border smuggling, Punjab Police have arrested a juvenile after recovering 15 kg heroin, and Rs 8.40 lakh drug money from his possession, Director General of Police Gaurav Yadav said here on Thursday.

    The 17-year-old arrested drug smuggler is a resident of Amritsar. Apart from recovering heroin and drug money, the police have also recovered a motorcycle, on which he was travelling.

    The development came about 10 days after the police busted a trans-border drug smuggling cartel with the arrest of a drug smuggler. Five packets of heroin, weighing 5 kg, and Rs 12.15 lakh drug money, were recovered from his possession during a special checking at Thattha village in Lopoke in Amritsar.

    DGP Yadav said following inputs, teams of the Counter Intelligence (CI) Amritsar arrested the juvenile, who, along with his accomplice, identified as Resham Singh of Khasa village in Amritsar, was going to deliver the drug consignment after retrieving it from the area of Kakkar village.

    Preliminary investigations revealed the consignment of drugs was airdropped by Pakistan-based smugglers using a drone, he said.

    Resham Singh, who prima facie seems to be the mastermind of the trans-border narcotics smuggling racket, managed to flee from the spot. Police teams are on a manhunt to nab him, he added.

    AIG, CI, Amarjit Singh Bajwa said father and grandfather of the arrested juvenile are already undergoing imprisonment under the NDPS act.

    The Supreme Court on Wednesday ruled that one of the accused in the gang-rape and murder trial of an eight-year-old nomadic girl in Kathua was not a juvenile and can now be prosecuted again as an adult.

    The top court further stated that in the absence of statutory proof on the same problem, medical opinions on an accused person’s age cannot be “swept aside”, news agency PTI reported.

    “Medical opinion regarding age in absence of any other conclusive evidence should be considered to determine the age range of the accused…Whether medical evidence can be relied upon or not depends on the value of evidence,” a bench of justices Ajay Rastogi and JB Pardiwala said.

    It reversed the rulings of the high court and the Chief Judicial Magistrate of Kathua, which had determined that the accused was a minor and needed to be tried separately.

    “We set aside the judgments of the CJM Kathua and the high court and hold that the accused was not a juvenile at the time of commission of offence,” Justice Pardiwala said while pronouncing the verdict.

    The girl was raped in a Kathua village in 2019. Three men were given life sentences in this case by a special court in June 2019, and three police officers received five-year sentences for evidence destruction. However, the Juvenile Justice Board was given the case against one of the accused.
