Not afraid of jail: BJP MLA Raja Singh on Telangana HC gag order

    [ad_1]

Hyderabad: Openly defying his gag order, suspended Goshamahal BJP MLA T Raja Singh took a dig at the Telangana government and city police for issuing him a show cause notice over his provocative comments made at a rally in Mumbai last week. The Mangalhat police issued Raja Singh the notice after his speech since he is currently out on bail, and has restrictions placed on him by the Telangana high court.

The suspended BJP MLA released a video after the police issued him a notice and asked why the Hyderabad or Telangana police is bothered when he made the comments at a meeting in Mumbai. He was arrested for a few months and was lodged in the Cherlapally jail under the Preventive Detention Act last year. Raja Singh had passed derogatory comments against Prophet Muhammad in a video, as a reaction to the state government allowing comedia Munawar Faruqui to hold a show in Hyderabad.

“I demanded the central government and the state government (Maharashtra) bring in laws to stop love jihad, religious conversions and cow killings. The Telangana is ruled by Nizam government and VIII th Nizam and his slaves working in police are issuing notices,” said Raja Singh in the video.

The MLA further said “I am not a political leader, I fight for ‘dharma’ and live for dharma.  When I am not afraid of going to jail, do you think I will get afraid of a notice?”. Raja Singh also challenged the ruling BRS government saying, “Now I will see if you would send to me to jail, or extern me from Telangana. I am ready for anything.”

Singh asked to explain statements in notice

The high court had quashed his detention under the PD Act and released him in November on bail after his arrest. The court however imposed certain conditions for his release, including that Raja Singh should not make any provocative speeches against any religion or post any derogatory or offensive posts on any social media platforms.

“But on January 29 your speech during ‘Janakrosh Morcha’ at Dadar was circulating in social media. In the video your speech is very much provocative to a particular community regarding demands of laws on love jihad, cow slaughter, conversion and a few other words,” the notice issued to Raja Singh by the Mangalhat police stated.

It further added, “Your speech with potential to provoke a particular religion is violation of conditions imposed by the HC.” The police has asked Raja Singh to explain why action should not be initiated against him for violating the conditions imposed by the High Court.

  • I struggled, says Siddique Kappan after coming out of jail

I struggled, says Siddique Kappan after coming out of jail

    [ad_1]

Lucknow: “I struggled,” Kerala journalist Siddique Kappan said minutes after he walked out of jail on Thursday to camera crews, a small curious crowd and to his wife and teen son, waiting patiently, just as they had for the more than two years since he was imprisoned on his way to Hathras.

The relief was writ large on their faces but so was the pain. Kappan and three others were arrested in October 2020 while they were going to the Uttar Pradesh town where a Dalit woman died allegedly after being raped. They were accused of trying to instigate violence over the death of the Hathras woman.

“I am coming to Delhi. I have to stay there for six weeks,” Kappan told PTI.

“I struggled more,” he laughed when asked how life had been in jail without saying anything more.

In his two and a half years in jail, his mother died.

“Her name was Kadijah. She is not there to see Kappan coming home,” Kappan’s wife Raihana said.

“The Supreme Court granted bail in the UAPA case and his innocence was revealed. Two and a half years is not a short time. We have experienced a lot of pain and suffering. But I am happy that justice, though belated, has been served,” she told PTI.

“I repeat that Kappan is a media person,” Raihana stressed.

The couple has three children — Muzammil (19), Zidhan (14) and Mehnaz (nine).

“Our children are waiting to welcome him home. Their happiness was taken away. Can they forget their father? They are proud to say that Sidhique Kappan, a journalist, is their father.”

Waiting outside with his mother was their eldest Muzammil, who also reiterated that his father was a journalist.

“What is the cause of my father’s severe suffering for two and half years? Now we are waiting for his freedom. We are very happy. We thanks all those who have been with us.”

According to Kappan’s lawyer Mohamed Dhanish KS, the journalist had been lodged in the Mathura and Lucknow district jails and had been out twice — once when he got Covid and was admitted at AIIMS, Delhi, and the second time to meet his ailing mother.

Police alleged that Kappan had links with the now-banned Popular Front of India (PFI), and charged him under the Unlawful Activities (Prevention) Act and sections of the Indian Penal Code.

In September last year, the Supreme Court granted him bail in connection with that case. A bench headed by then Chief Justice Uday Umesh Lalit directed Kappan to remain in Delhi for six weeks after his release from an Uttar Pradesh prison.

However, he continued to be in jail because of a money laundering case filed by the Enforcement Directorate.

After two years in jail, Kerala journalist Siddique Kappan walks free

    [ad_1]

After spending two years in Lucknow jail, Kerala journalist Siddique Kappan finally walked out free on Thursday. The sessions court had ordered his bail the previous day.

“I will continue my fight against draconian laws. They kept me in jail even after I got bail. I don’t know who’s benefiting from me being in jail. These two years were very tough, but I was never afraid,” he told NDTV after his release.

Kappan was arrested by the Uttar Pradesh police in October 2020 while on his way to Hathras district where a Dalit woman had died after being allegedly gang raped. A case was lodged under the draconian UAPA (Unlawful Activities (Prevention) Act).

He was arrested by the Mathura police for having links with the Popular Front of India and being a part of a “conspiracy” to instigate violence.

However, after the Supreme Court of India granted bail to the journalist in the UAPA on September 9 and Allahabad High Court also granted the same in the PMLA (Prevention of Money Laundering Act), Kappan’s release was marred by difficulties in finding two local sureties.

A surety is a person that assures the defendant will attend his or her court hearing after being granted bail.

In 2020, a Dalit woman was allegedly gang-raped in the Hathras district of Uttar Pradesh. Her body was cremated by the police and village administration without the knowledge of her family members leading to widespread protests and condemnation.

  • Pakistan’s ex-information minister Fawad Chaudhry released from jail

Pakistan’s ex-information minister Fawad Chaudhry released from jail

    [ad_1]

Islamabad: Former information minister and senior Pakistan Tehreek-e-Insaf (PTI) leader Fawad Chaudhry was released from jail on Wednesday after a court granted him bail in a sedition case.

Chaudhry, 52, a close aide of former prime minister Imran Khan, was arrested from his residence in Lahore last week in a pre-dawn raid after a case was registered against him at Islamabad’s Kohsar Police Station on the complaint of the Secretary Election Commission of Pakistan for “threatening” the electoral body’s members and their families.

Additional sessions court Judge Faizan Gilani granted bail to Chaudhry in the sedition case against a surety bond of Rs20,000.

The judge said that he accepted the bail on the condition that Chaudhry would not repeat his allegation that led to his arrest and the case. “I am granting the bail on the condition that Fawad Chaudhry does not repeat such remarks,” he remarked.

Chaudhry was later released from the Adiala Jail in Rawalpindi.

“I said in court as well. I stand by all that I said, and I will not back down,” he said in his brief address to the party workers who had gathered outside the prison to welcome him.

He also said that he did not speak against any institution. “I never talk against the institutions. I am the biggest supporter of our institutions, and I never said anything against them. That is why I reiterate that whatever I said was right,” he said.

A judicial magistrate had sent him to jail on Monday on a 14-day judicial remand by rejecting a police request for custody to probe him in the case.

Chaudhry is facing sedition charges for publicly “threatening” the members of the election commission.

The detained PTI spokesperson has been vocal in highlighting the party policy and objectives as enunciated by the party chief Imran Khan.

The PTI, which rejected his arrest as politically motivated, had been demanding his release.

  • 5,000 under trials in jail despite bail granted, 1,417 released: NALSA to SC

5,000 under trials in jail despite bail granted, 1,417 released: NALSA to SC

    [ad_1]

New Delhi: The National Legal Services Authority (NALSA) on Tuesday informed the Supreme Court that about 5,000 under trial prisoners were in jails despite being granted bail and 1,417 of them have been released.

A bench of Justices S.K. Kaul and A.S. Oka is hearing a matter, which relates to policy strategy for grant of bail. Advocate Gaurav Agrawal, who is an amicus curiae in the matter, cited the NALSA report before the court.

The top court was informed that pursuant to the November 29 order, the NALSA wrote to the state legal services authorities (SLSAs) seeking details of such under trial prisoners (UTPs) within 15 days and they were also directed to provide necessary legal assistance for their release.

The SLSAs submitted the data with NALSA by December end last year and then they were asked to furnish a progress report on legal assistance and release of under trials, who were in custody despite being granted bail.

According to the report, there were about 5,000 under trial prisoners who were in jail, despite grant of bail and out of which, 2,357 persons were provided legal assistance, and 1,417 persons have since been released.

In November last year, the apex court flagged the issue of under trials, who continue to languish in jail despite being granted bail, as they were unable to fulfil the conditions of bail. It had asked the state governments to issue directions to jail authorities to provide details of such UTPs to NALSA.

The NALSA, in the report filed in the apex court, said it is in the process of creating a “master data” of all such under trial prisoners, who could not either furnish surety or bail bonds due to poverty.

According to the report, the accused continue to languish in jail despite being granted bail because they are accused in multiple cases and are not willing to furnish bail bonds until they are given bail in all the cases, as under trial custody will be counted in all the cases.

    [ad_1]

Tehran: The Iranian judicial authorities sentenced journalist Nazila Maroufian to two years in prison, for interviewing Amjad Amini, father of Mahsa Amini, whose death in a headquarters of the morality police sparked protests that have been going on in country for months.

Iranian journalist Nazila Maroofian on Saturday announced that the verdict was issued against her without court hearing, after she was arrested on Sunday, October 30, on the grounds of her interview with Mahsa Amini’s father.

“Based on the decision of Branch 26 of the Revolutionary Court headed by Judge Afshari, I have been sentenced to two years in prison, a fine…and a five-year ban from leaving the country,” Nazila Maroofian tweeted.

Nazila continued, “This verdict was issued without a hearing and defense pleadings,” adding that she was accused of “propaganda against the regime and spreading false news.”

It is noteworthy that the Iranian regime continues to suppress voices opposing it and the press, as Tehran journalists association estimates that at least 28 Iranian journalists have been arrested since the outbreak of the protests.

The demonstrations involved people from all walks of life and different sects in Iran after Amini’s killing.

Iranian women are at the fore in the demonstrations, in which many young people participate, to chants of “Woman life freedom” and “Death to the dictator.”

    Ashish Mishra released from jail

    [ad_1]

Lakhimpur Kheri: Ashish Mishra, son of Union Minister Ajay Mishra Teni and an accused in the Tikunia murder case, was released from jail on Friday evening after the Supreme Court granted him an interim bail of eight weeks.

Mishra was taken out of the jail from the rear gate to avoid the media which had gathered at the main gate and taken to his residence.

Family members refused to disclose where he would relocate to after one week as per Supreme Court directives.

The Supreme Court has directed Mishra to leave Uttar Pradesh within one week after his release from jail.

The court also said that the petitioner has to mark his attendance at the police station of jurisdiction where he relocates to.

The court also warned Mishra and his family members against influencing witnesses, violation of which would lead to the cancellation of his bail. “If it is found that Mishra is trying to delay the trial, it will be a valid ground to cancel his bail,” the court said in its order.

The case will now be taken up on March 14 again for further directions on the matter.

  • SC asks CBI, Gujarat why they want activist Teesta Setalvad, her husband back in jail

SC asks CBI, Gujarat why they want activist Teesta Setalvad, her husband back in jail

    [ad_1]

New Delhi: The Supreme Court on Wednesday questioned the CBI and the Gujarat government as to why they want to send social activist Teesta Setalvad and her husband Javed Anand back in jail after they have been out for over seven years on anticipatory bail.

A bench of Justices Sanjay Kishan Kaul, Abhay S Oka and BV Nagarathna said, “Question is how long can you keep someone in custody. Seven years have passed since anticipatory bail was granted. You want to send her back to custody.”

Advocate Rajat Nair, appearing for the CBI and the Gujarat government said some additional material needed to be placed before the court with regard to the cases and, therefore, four weeks time may be given.

Senior advocate Kapil Sibal and advocate Aparna Bhat, appearing for Setalvad and her husband Anand, said in one of the proceedings in which the CBI has come in appeal, anticipatory bail was granted following which a charge sheet was filed and after that regular bail was granted to her.

He said since a regular bail was granted, the appeal of the probe agency against anticipatory bail does not survive.

Nair said this had happened in one case but there are more than one case against her and requested the court to grant him four weeks to place additional material on record.

“A bench of two judges has referred this matter to a larger bench and has framed questions which need to be decided by this court,” Nair said.

The bench posted the matter for further hearing after four weeks.

Sibal submitted a note to the bench pursuant to the earlier direction giving details of issues as to which of the appeals survive for consideration and what is the subject matter to be decided as the passage of time may have taken care of some aspects.

The top court was hearing a batch of pleas filed by Setalvad, Anand, the Gujarat police and the CBI arising out of three FIRs lodged against the couple.

On March 19, 2015, the top court had referred to a larger bench the anticipatory bail plea of Setalvad and her husband in the case of alleged embezzlement of funds for a museum at Ahmedabad’s Gulbarg Society devastated in the 2002 riots and extended its interim order protecting them against arrest.

It had said the question that arises for consideration is whether liberty on the one hand and fair and effective investigation on the other make out a case for extending the benefit under Section 438 CrPC (anticipatory bail).

In 2014, an FIR was registered against them with DCP, Crime Branch, Ahmedabad, on charges of cheating, breach of trust and under the IT Act in a matter related to the construction of the “Museum of Resistance” in the Gulbarg housing society.

Teesta Setalvad and her husband, who were trustees of two trusts- ‘Citizens for Justice and Peace’ (CJP) and ‘Sabrang Trust’- were accused by Feroz Khan Saeed Khan Pathan of having raised a few crore of rupees as donation from certain donors from India and abroad after projecting to them the plight of the riot-affected people of Gulbarg Society.

The top court had noted in its order of March 19, 2015 that Pathan had alleged in his complaint that the couple entered into a conspiracy and promised the residents of the housing society they will build a museum in the honour of the 2002 riot victims. The court had also noted that the couple had asked the residents to not sell their properties in the housing society.

Pathan alleged the couple neither built the museum as promised nor spent the amount for the benefit of the members of the Gulbarg Society nor did they fulfil the assurance made to the victims regarding the sale of their properties.

In the second case, the CBI has moved the apex court against grant of anticipatory bail to Setalvad and her husband in a case where they have been accused of misusing foreign funds.

The probe agency has alleged that a company floated by the couple-Sabrang Communication and Publishing Pvt Ltd (SCPPL)- had received Rs 1.8 crore from US-based Ford Foundation allegedly without the mandatory approval of the Centre.

It has sought cancellation of their anticipatory bail claiming the Bombay high court had erred in giving them the relief after prima facie finding that provisions of the Foreign Contribution Regulation Act (FCRA) had been violated.

In the third case, the Ahmedabad police had moved the apex court against the April 5, 2018 order of the Bombay High Court by which the couple was protected from arrest in an FIR registered on March 31, 2018 for allegedly securing central government funds worth Rs 1.4 crore “fraudulently” for her NGO Sabrang Trust between 2010 and 2013.

According to the Gujarat police, the funds were obtained for a project launched in some districts of Maharashtra and Gujarat to help the victims of the 2002 post-Godhra riots but were misappropriated or used for other purposes.

The couple has denied all the allegations made in the FIRs which are being probed by Gujarat police and the CBI.
