    Srinagar, Apr 08: A local court on Saturday sentenced a man to two years imprisonment in a cheque ‌bounce case and imposed a penalty of Rs 10 lakh on him.

    The Court of Special Magistrate (PT&E) sentenced the accused, who was identified as Altaf Hussain Rather, to two years simple imprisonment after finding him guilty for the commission of offense under section 138 of the Negotiable Instrument Act.

    “A fine of Rs 1000000 (Rupees ten lacs) which is double the cheque amount is also imposed upon the accused. The fine of Rs 1000000(Rupees ten lacs) so imposed shall be paid as compensation to the complainant,” the judge Fariqa Nazir said, in an order, a copy of which is in possession of news agency—Kashmir News Observer (KNO)—(KNO)

    Hyderabad: Telangana BJP president and MP Bandi Sanjay was on Friday released from Karimnagar jail after he was granted bail in the SSC paper leak case.

    Sanjay was detained by police late Wednesday night from his Karimnagar residence. He was granted bail by a magistrate court in the paper leak case on Thursday.

    “The court accepted our request and a bail was granted to Bandi Sanjay on sureties worth Rs 20,000. On production of the release order, he will be released from the Karimnagar jail, ” Bandi Sanjay’s lawyer Shyam Sunder Reddy informed on Thursday.

    “However, the court set a condition that he can’t leave India without permission,” the advocate added.

    On Wednesday, Bandi Sanjay along with three others was sent to judicial custody till April 19 in the SSC paper leak case.

    “Bandi Sanjay and 3 others have been sent to judicial custody till April 19 and will be shifted to Karimnagar jail,” advocate Karuna Sagar, another lawyer of the BJP state chief, had said.

    “We will file contempt proceedings against the investigating officer for violating the SC guidelines. We are planning to challenge the order in High Court tomorrow,” the lawyer had added.

    Hyderabad: Bharatiya Janata Party Telangana unit president and Karimnagar MP Bandi Sanjay, who was arrested and indicted as the main culprit in the Warangal question paper leak case, appeared in court in Hanamkonda and was sent to 14 days of judicial custody.

    He and two other detained individuals were sent to the Khammam jail.

    The Kamalapur police charged Sanjay with IPC Sections 120 (B) (conspiracy), 420 (cheating), 447 (criminal trespass), and 505 (1) (b). (intent to cause fear or alarm to the public). He was brought before the magistrate in the latter’s official quarters behind the Hanamkonda Court Complex and remanded at about 8 p.m.

    On Tuesday, three people were detained in connection with the matter, including a NaMo employee and Sanjay’s social media advisor, Booram Prashanth.

    Bandi Sanjay was arrested by the Warangal police criminal conspiracy along with three other persons to create rumours and provoke a breach of peace in the ongoing SSC examination. All of them have been remanded to 14 days judicial custody. His lawyer ˙as also filed a bail petition.

    The Warangal police had arrested three persons including a minor in the SSC Hindi paper leak. The paper was shared on Whatsapp minutes after the exam began. After his arrest, security has been tightened by the police in Karimnagar and Warangal districts.

    Bandi Sanjay has been named the prime accused (A1) in the case.

    Dismissing all claims of ‘illegal arrest’ Warangal Commissioner AV Ranganath stated that the Lok Sabah Speaker was informed about the MP’s arrest, as per the law.

    Addressing the media, AV Ranganath, said that the SSC paper in the second language Hindi was leaked at the exam centre on Tuesday.

    “Bandi Sanjay gave instructions to Prashanth to exploit the situation of the SSC paper leak in the Vikarabad stating that if it also happens on Wednesday it will defame the government and show it as a failure of the state government,” the remand report of police stated. The police alleged Karimnagar MP conspired with other BJP workers.

    “Technical evidence by analysing the call details of the phones of the accused and Whatsapp chats of the accused proved beyond the reasonable doubt, that the accused persons are involved in a conspiracy regarding the leaking and copying of the question papers on April 4,” the police informed the court.

    Three accused M Siva Ganesh, 18, B Prasanth, 33, a former journalist and G Mahesh, a lab assistant were arrested while the Warangal police issued a notice to the juvenile boy on Tuesday.

    The minor along with his friend wanted to help another write the exam at the Uppala Government School under Kamalapur police station limits. On Tuesday, the minor went through the rare gate inside Government Boys School under Kamalapur Police Station at 9:30 am after the exam had begun.

    The teenager then went to the first floor and with the help of a mobile phone took a photo of the question paper. He then shared it with another Ganesh through WhatsApp. The message was forwarded to a WhatsApp group `SSC 2019- 20’ by Siva Ganesh at 9:59 am.

    “Mahesh saw the message and forwarded it to Prashanth, who in turn forwarded the photo of the question paper to various groups including ‘Cnu Friends’, reportedly adding captions including ‘breaking news’ and ‘question paper leaked’. The photo and message then went viral via different WhatsApp groups. Prashanth also sent the same to Bandi Sanjay and is said to have made 146 calls in about an hour.

    Hyderabad: Two men were held for allegedly organising prostitution rackets in the limits of Medipally police station under the PD act under the Rachakonda police limits.

    The accused were sent to Central Prison in Cherlapally on Sunday. The accused were identified as Banala Srikanth (24) resident of Peerzadiguda and Koramatla Srinivas Rao (27) from Khammam.

    According to the press release from the Cyberabad police, accused Banala Srikanth and Koramatla Srinivas Rao posted pictures of women on the “Skokka Website” named website and provided their phone numbers to buyers over Whatsapp. They also hired women from the Khammam District, rented a space in Medipally, and set up prostitution, enabling male clients to enter the property in exchange for large sums of money.

    Before the project arrests in 2022 by the Medipally Police, the offender Banala Srikanth was also placed in detention under the PD Act by the police commissioner at the time. After being released from preventive prison, he again started unlawful activities, said a press release.

    On receiving information, the Medipally Police raided the house at Krishna Nagar, Boduppal on 2, February 23 and arrested both the organizers and rescued one victim woman.

    New Delhi: The Supreme Court has observed that the danger of unjust imprisonment is that inmates are at risk of suffering from “prisonisation”. It pointed out that incarceration has other deleterious effects as well, especially for an accused from weaker economic strata.

    The deleterious effects listed by the apex court included the immediate loss of livelihood, scattering of families as well as loss of family bonds, and alienation from society. And if the trials are not concluded on time, injustice wreaked on the individual is immeasurable.

    A bench of Justices S. Ravindra Bhat and Dipankar Datta said: “Jails are overcrowded and their living conditions, more often than not, appalling. According to the Union Home Ministry’s response to Parliament, the National Crime Records Bureau had recorded that as on 31st December 2021, over 5,54,034 prisoners were lodged in jails against a total capacity of 4,25,069 in the country. Of these 122,852 were convicts; the rest 4,27,165 were undertrials.”

    The bench added that incarceration has further deleterious effects — where the accused belongs to the weakest economic strata: immediate loss of livelihood, and in several cases, scattering of families as well as loss of family bonds and alienation from society.

    Justice Bhat, who authored the judgment on behalf of the bench, said: “The courts therefore, have to be sensitive to these aspects (because in the event of an acquittal, the loss to the accused is irreparable), and ensure that trials – especially in cases, where special laws enact stringent provisions, are taken up and concluded speedily.”

    The top court noted that it would be important to reflect that laws which impose stringent conditions for grant of bail, may be necessary in public interest; yet, if trials are not concluded in time, the injustice wrecked on the individual is immeasurable.

    The bench noted the danger of unjust imprisonment is that inmates are at risk of “prisonisation” — a term described by the Kerala High Court in A Convict Prisoner v. State as “a radical transformation”.

    The court noted that the prisoner loses his identity, he is known by a number, loses personal possessions, has no personal relationships and also psychological problems result from loss of freedom, status, possessions, dignity, and autonomy of personal life.

    It said there is a further danger of the prisoner turning to crime, “as crime not only turns admirable, but the more professional the crime, more honour is paid to the criminal”.

    The apex court made these observations while upholding that an undue delay in trial can be a ground for grant of bail to an accused charged under the Narcotics Drugs and Psychotropic Substances Act 1985 (NDPS Act), despite the stringent conditions provided under Section 37.

    The apex court granted bail to a man, after noting that he had spent over seven years in jail in a NDPS case and trial was proceeding at snail’s pace.

    It observed that the right to speedy trial of offenders facing criminal charges is “implicit in the broad sweep and content of Article 21 as interpreted by this court”.

    Petitioner Mohd. Muslim moved the apex court challenging the Delhi High Court order, which rejected his bail application even though he already undergone imprisonment for more than seven years, and the criminal trial had barely reached the half-way mark.

    The appellant was accused of committing offences punishable under Sections 20, 25, and 29 of the NDPS Act. The top court noted that at the time of his arrest, the appellant was 23 years old and he was not found in possession of the narcotic drugs but the co-accused were. Also, the prosecution has not shown involvement of the appellant, in any other case.

    Petitioner’s counsel argued that the period of long incarceration suffered, entitled the appellant to grant of bail and also 34 more witnesses were yet to be examined, with little or no progress to the trial since the high court’s direction to expedite the trial.

    It was contended that the main and other co-accused had already been granted bail by the high court and petitioner’s counsel urged the court for bail on the ground of parity.

    Additional Solicitor General Vikramjit Banerjee strongly opposed grant of bail, citing Section 37 of the NDPS Act and contended that the appellant was actively involved in the commission of the offence — with call records and bank transactions implicating him with the main accused.

    He submitted that such cases are deeply concerning, as the accused persons are said to be involved in a drug peddling network. It was further argued that the public interest of protection against sale and use of illegal drugs outweighed the concerns regarding individual liberty of the accused, and justified continued custody of the appellant.

    The top court noted that the petitioner has been in custody since October 3, 2015, barring grant of interim bail from time to time, for wedding ceremonies and to take care of his ailing mother.

    “The appellant has been in custody for over seven years and four months. The progress of the trial has been at a snail’s pace: 30 witnesses have been examined, whereas 34 more have to be examined,” it noted.

    In conclusion, it said that the appellant is directed to be enlarged on bail, subject to such conditions as the trial court may impose.

    Patiala: After spending about 10 months in Patiala’s central jail, Congress leader Navjot Singh Sidhu will walk free on Saturday.

    Several Congress leaders and supporters assembled outside the prison to accord the 59-year-old former cricketer a grand welcome upon his release and chanted ‘Navjot Sidhu zindabad’.

    ‘Dhol’ players have also been arranged by his supporters standing outside the jail to welcome the cricketer-turned-politician.

    Speaking to reporters at his residence on Saturday, Sidhu’s son Karan Sidhu said the family has been eagerly waiting for his release from the jail.

    He said it had been a tough time for the family but now they were happy to see him coming out of the jail.

    Several posters and hoardings of Navjot Sidhu were put up at many places in Patiala city by Sidhu’s supporters to welcome him.

    Party workers are quite ecstatic over the release of Sidhu, said one of the supporters outside the jail.

    Congress leader and former MLA Navtej Singh Cheema said people of Punjab are waiting for Sidhu to come out of jail.

    The former state Congress chief was jailed on May 20 last year after being sentenced to one-year rigorous imprisonment by the Supreme Court over the death of 65-year-old Gurnam Singh in a road rage case in 1988.

    Sidhu’s lawyer HPS Varma on Friday had said the release was happening earlier due to Sidhu’s good conduct during imprisonment, as allowed under the rules.

    Sidhu’s family had got an intimation from authorities regarding his release from the Patiala jail.

    The convicted police officer Avula Prasad, while working as a sub-inspector of Abids police station demanded and accepted a bribe of Rs. 20,000 from one person.

    He was trapped red-handed while accepting the bribe on 21 April 2013.
