    SC refuses to stay AP HC’s order on Amaravati; setback for YS Jagan’s govt

    In a blow for the YSRCP-led state government in Andhra Pradesh, the Supreme Court has refused to grant the state’s motion to postpone a March last year high court ruling ordering the YSRCP government to construct Amaravati as the state’s capital within six months.

    The court will consider the plea, along with other petitions related to the subject on July 11, Justices KM Joseph and BV Nagaratna said.

    In the state assembly, chief minister Jagan Mohan Reddy declared that he will relocate to Visakhapatnam and work from the coastal city beginning in July.

    Justice Joseph will retire on June 16, and the case will be heard by a new bench in July.

    After the erstwhile Andhra Pradesh’s bifurcation into Telangana and a new Andhra Pradesh (Seemandhra) in 2014, both were supposed to share Hyderabad as their capital for ten years.

    But, then AP chief minister Chandrababu Naidu declared plans to establish a world-class greenfield capital in Amaravati and all the state bureaucracy was moved from Hyderabad to under plan Amaravati. Prime Minister Narendra Modi attended the seminal event.

    Hundreds of acres of land were purchased, and large plans were put up for the construction of the new capital, despite the fact that funding proved to be a major obstacle.

    Later, in May 2019, when YSRCP won the Assembly elections and YS Jagan Mohan Reddy became the chief minister, he alleged that the Naidu-led previous government committed a massive land purchase fraud, abandoned plans for a new capital in Amaravati, and abolished the AP Capital Area Development Authority (AP-CRDA).

    Jagan announced decentralisation in new legislation, saying the state will have three capitals: a judicial capital in Kurnool, a legislative capital in Amaravati, and an executive capital in Vizag.

    But this resulted in legal complications. In November, the government withdrew its decentralisation bill and cancelled the AP-CRDA.

    In March 2022, the Andhra Pradesh High Court ruled in favour of Amaravati farmers, ordering that the capital be erected at Amaravati according to the master plan outlined in the Capital Area Development Authority Act within six months. The state government filed a petition with the Supreme Court.

    This was in reaction to various applications filed by farmers challenging the repeal of the CRDA Act, which had been approved by the Telugu Desam Party (TDP)’s administration in order to create a magnificent capital at Amaravati, for which they had provided the land.

    A high court division bench led by Chief Justice Prashant Kumar Mishra issued its final decision on a slew of petitions contesting the Decentralisation Act and the repeal of the Andhra Pradesh CRDA Act.

    The state administration then repealed the AP Decentralisation Act and the CRDA Repeal Act in November.

    The case was resumed by the high court when several petitioners stated that there were additional unsolved concerns related to the CRDA legislation, such as the transfer of developer plots to land owners who had handed away their farm lands, development or basic infrastructure, and land mortgaging in banks.

    Amaravati: Telugu Desam Party (TDP) national president N. Chandrababu Naidu on Monday alleged that a TDP MLA in the Andhra Pradesh Assembly was attacked by ruling YSR Congress Party (YSRCP) MLAs at the behest of Chief Minister Y.S. Jagan Mohan Reddy.

    The former chief minister alleged that the attack on Dalit MLA, Dola Bala Veeranjaneya Swamy, was pre-planned and carried out with the encouragement from the chief minister.

    Strongly condemning the attack on TDP MLA inside the Assembly, he termed it the darkest day in the history of Assembly.

    Never in the history of Andhra Pradesh, a MLA was attacked inside the House and today is the darkest day in the Assembly’s history, Chandrababu Naidu said.

    He stated that Chief Minister Jagan Mohan Reddy will remain as a tainted chief minister who spoiled the image of the legislative bodies. “With the physical attack on the MLA right on the floor of the Assembly, the people clearly understood the policies of the YSRCP,” he said.

    Terming the ongoing session of the Assembly as a “Kaurava Sabha”, Chandrababu Naidu felt that Jagan has gone “totally mad” with the latest results of the elections to the Legislative Council.

    The state Assembly on Monday witnessed unprecedented scenes when the TDP members were staging a protest by surrounding Speaker Tammineni Seetharam. They were demanding the government to withdraw an order imposing restrictions on public meetings on roads.

    Amid the ruckus, an MLA of the ruling party rushed to the Podium and pulled back Swamy, who fell down. Another YSRCP MLA had also joined the manhandling. MLAs of both the parties blamed each other for the attack.

    Amaravati: The Central Bureau of Investigation (CBI) on Friday questioned Krishna Mohan Reddy, Officer on Special Duty (OSD) for Andhra Pradesh Chief Minister Y.S. Jagan Mohan Reddy in former minister Y.S. Vivekananda Reddy’s murder case.

    The central agency also quizzed Naveen, who works in the house of the chief minister.

    The CBI officials questioned the duo for six-and-a-half hours in Kadapa.

    The federal agency had issued notice to Krishna Mohan Reddy and Naveen on the basis of call data of Kadapa MP Y.S. Avinash Reddy.

    The CBI officials are understood to have questioned the duo as to what had happened on the day when Vivekananda Reddy was murdered. They collected information about phone calls made or received by them.

    Last week, the CBI questioned Avinash Reddy, who is a cousin of the chief minister. He was grilled for more than four-and-a-half hours.

    Vivekananda Reddy, paternal uncle of Jagan Mohan Reddy, was found murdered mysteriously at his residence at Pulivendula in Kadapa district on March 15, 2019, a month ahead of the 2019 general elections.

    The 68-year-old former state minister and former MP was alone at his house when unidentified persons barged in and killed him. He was killed hours before he was to launch the YSR Congress Party’s election campaign in Kadapa.

    Though three Special Investigation Teams (SITs) conducted the probe, they failed to solve the mystery.

    The CBI took over the investigation into the case in 2020 on the direction of Andhra Pradesh High Court while hearing a petition of Vivekananda Reddy’s daughter Sunitha Reddy, who raised suspicion about some relatives.

    The CBI filed a chargesheet in the murder case on October 26, 2021, and followed it up with a supplementary chargesheet on January 31, 2022.

    In November last year, the Supreme Court transferred to a CBI court in Hyderabad the trial and probe into the larger conspiracy behind the murder.

    The apex court observed that doubts raised by Sunitha Reddy about getting a fair trial and investigation in Andhra Pradesh were reasonable.

    Amaravati: The Central Bureau of Investigation (CBI) has summoned Kadapa MP Y.S. Avinash Reddy for questioning in his uncle and former Andhra Pradesh minister Y.S. Vivekananda Reddy’s murder case.

    Avinash Reddy, a cousin of Andhra Pradesh Chief Minister Y.S. Jagan Mohan Reddy, has been asked to appear before CBI officials in Hyderabad on Tuesday.

    The YSR Congress Party (YSRCP) MP, however, is reported to have conveyed his inability to appear on January 24 due to his busy schedule in Pulivendula and has sought another date. He assured the central agency that he will fully cooperate with it in the investigation.

    The CBI served the notice on the day when it conducted search at the offices of Avinash Reddy and his father Bhaskar Reddy.
