    Chinese mobile masts loom over the Munich Security Conference

    MUNICH, Germany — As the world’s security elite gathers in Munich this week, they’ll be connecting their mobile phones to Chinese telecoms equipment surrounding the venue.

    Heads of state, security chiefs, spooks and intelligence officials head to Germany on Friday for their blue-riband annual gathering, the Munich Security Conference. On the event’s VIP list are U.S. Vice President Kamala Harris, German Chancellor Olaf Scholz, French President Emmanuel Macron and hundreds more heads of state and government, ministers and foreign dignitaries.

    The gathering takes place at the five-star Hotel Bayerischer Hof. From its ice-themed Polar Bar on the hotel’s rooftop, you can overlook the city’s skyline, spotting multiple telecommunications antennas poking between church steeples. Some of these antennas, within 300 meters of the hotel, are equipped with hardware supplied by controversial Chinese telecoms giant Huawei, POLITICO has learnt through visual confirmation, talks with several equipment experts and information from industry insiders with knowledge of the area’s networks. 

    One mast, on top of the Hotel Bayerischer Hof building itself, is also potentially equipped with Huawei gear, talks with two industry insiders suggested.

    The question of whether to allow Chinese 5G suppliers into Western countries in past years became a bone of contention between Berlin on the one hand and Washington and like-minded partners on the other. This week’s gathering also comes as the U.S. continues to call out Germany’s economic reliance on Beijing, with a new report showing the German trade deficit with China exploded in 2022, and amid sky-high tensions between Washington and Beijing over surveillance balloons hovering over the U.S., Canada and elsewhere.

    “The dependence on Huawei components in our 5G network continues to pose an incalculable security risk,” said Maximilian Funke-Kaiser, liberal member of the German Bundestag and digital policy speaker for the government party Free Democratic Party (FDP). 

    “The use of Huawei technology in the mobile network here runs counter to Germany’s security policy goals,” Funke-Kaiser said, calling the vendor’s involvement in German 4G and 5G “a mistake in view of the Chinese company’s closeness to the state.”

    Huawei has consistently denied posing a security risk to European countries. 

    Delving into data

    Despite extensive reporting, POLITICO was unable to gather on-the-record confirmation of which vendor’s telecoms equipment was used for which masts. Operators and vendors refused to disclose the information, citing contractual obligations, and local authorities said they didn’t have the information available.

    The security risks associated with Huawei equipment also vary, and differ even among close allies in the West. Some capitals argue the real risk of Chinese telecoms equipment is the overreliance on a Chinese firm in an unstable geopolitical situation — much like Europe relied on Russian gas for its energy needs.

    But others argue that the risk runs deeper and that China could use Huawei’s access to equipment and data in European mobile networks — especially in areas of critical importance and high sensitivity — to put the West’s security at risk. Huawei has been implicated in a number of high-profile espionage cases, including at the African Union Headquarters.

    When asked about Huawei’s presence in Munich, Mike Gallagher, a Republican and Chairman of the U.S. House select committee on China, said POLITICO’s findings were “troubling” and “should concern every individual attending the conference.” 

    The chair of the U.S. Senate intelligence committee, Mark Warner, a Democrat who’s attending the conference, said it was “a timely reminder that we must continue to work with like-minded allies to promote secure and competitively priced alternatives to Huawei equipment.”

    U.S. Senate intelligence committee Vice Chair Marco Rubio (Republican, Florida) said U.S. diplomats “should be aware of the risks and take necessary precautions.”

    Munich networking

    From a 2007 speech by Russia’s Vladimir Putin to U.S. President Joe Biden’s virtual address at the start of his mandate in February 2021, the conference strives to set the global diplomatic and international relations agenda. Its organizers see it as an open space for debating geopolitics and world affairs, with attendees ranging from across the world and an advisory board where Chinese state officials sit alongside Western diplomats and titans of industry.

    The conference’s guest list reveals something else too: The gathering is seen as critical by U.S. government officials. This year, the U.S. is sending its largest delegation yet, with Harris flanked by dozens of government officials, security chiefs and congresspeople, including Democrat leader Chuck Schumer, Republican leader Mitch McConnell and others.

    For these U.S. attendees — and the Western partners that see eye to eye with the U.S. position on China’s telecoms giant Huawei — the networks around the premises prove troublesome.

    An online map on the website of Germany’s telecoms agency, the Bundesnetzagentur, shows 13 locations for masts and antennas surrounding the Hotel Bayerischer Hof. The agency also provides information about which of the country’s three main operators — Deutsche Telekom, Vodafone and Telefónica — use which locations. 

    POLITICO shared photos of seven masts near the hotel with four experts specialized in telecoms radio access network (RAN) equipment. These experts established that at least two were equipped with gear of Chinese telecoms giant Huawei.

    If a network operator has one mast equipped with Huawei in Munich, it likely equips all masts in the area with the same vendor, two industry insiders said. Operators usually use one provider for larger areas. This means at least one other location is also likely equipped with Huawei gear, the insiders said. Three other locations, including the mast on the roof of the conference venue, are used by an operator using Huawei equipment but those locations are part of infrastructure that is shared by several operators, meaning there’s a chance these are equipped with Huawei gear but it’s unconfirmed. 

    The findings are in line with recent reports on Germany’s telecoms infrastructure.

    Europe’s largest economy is a stronghold for Huawei in the West. A report by boutique telecoms intelligence firm Strand Consult estimated that Germany relies on Chinese technology for 59 percent of its ongoing 5G network deployment. The country already had a massive reliance on Chinese equipment in its 4G network, where Strand estimated Huawei accounts for 57 percent.

    “If you look at the percentage of Chinese equipment in Germany, you could say it is the most unsafe country in Europe,” said John Strand, founder of Strand Consult. “Welcome to the Munich Security Conference: We can’t guarantee your security,” he quipped.

    Black hole of telecoms intelligence

    Establishing with certainty just how many of the 13 masts are equipped with Chinese telecoms gear is extremely difficult. Both German operators and their vendors have a policy to not communicate what equipment they’re using in which locations, citing contractual obligations on confidentiality. 

    Deutsche Telekom and Vodafone confirmed that they use Huawei in their German antenna networks. Telefónica said they use “a mix of European and international network suppliers” in Germany. Yet, all declined to comment on whether they use Huawei in Munich. 

    Ericsson, Nokia and Huawei all declined to comment on whether they were providing gear in the greater Munich area, referring questions to the local operators.

    Government regulators, too, divulge no details of which suppliers provide gear for certain locations. The Federal Network Agency and the Federal Office for Information Security admitted they don’t know which equipment is fitted to which mast; both referred to the interior ministry for answers. The interior ministry said it “does not usually know which critical components are installed on which radio mast in detail.”

    The Hotel Bayerischer Hof forwarded questions about mobile infrastructure on its roof to the security conference’s organizers.

    The Munich Security Conference itself said in a statement: “As a matter of principle, we do not comment on the exact details of the infrastructure used for the main conference in Munich. We are in close contact with all relevant authorities in order to secure the conference venue, the participants and the digital space accordingly.” 

    The Federal Office for Information Security (BSI) does provide its own security networks for official events, but the Munich Security Conference is “outside the responsibility of the BSI,” the BSI said in an email.

    Germany’s telecoms ambiguity

    Through its 5G equipment it is feasible for Huawei to spy on users of a network or to disrupt communications as the very design of 5G makes it harder to monitor security, the head of the U.K.’s intelligence service MI6, Alex Younger, said to an audience in his second public speech.

    But John Lee, director of the consultancy East-West Futures and an expert on Chinese digital policy, said it’s “not a clear cut technical case” as to whether Huawei equipment in current telecoms networks represents a material security risk.

    “Some non-Western countries are proceeding to upgrade their telecoms infrastructure with Huawei as a key partner,” Lee said. “This is still mainly a political issue of how much suspicion is placed on the ambitions of the Chinese state and its relationship with Chinese companies.”

    In an effort to coordinate a common approach to vendors, the EU developed “5G security toolbox” guidelines in 2019 and 2020 to mitigate security risks in networks. Some major European countries, including France, have imposed hard restrictions for their operators, including by limiting the use of “high-risk vendors” — a term widely understood across Europe to be Chinese vendors Huawei and ZTE — in certain strategic geographic areas.

    In Germany, however, policymakers took years to agree on their framework for 5G security. In April 2021 — more than a year after the EU’s joint plan came out — it passed measures that allowed the government to intervene on operators’ contracts with Chinese vendors. 

    But those interventions haven’t barred the use of Huawei in certain geographical areas yet. 

    And the interior ministry — which has veto power to ban or recall certain components if they see them as an “impairment of public order or safety” — hasn’t intervened much either, a ministry spokesperson said via email. 

    Up till now, the spokesperson said, specific orders to cut Huawei from German networks “have not been issued.”

    Russia wants to stage a coup d’état in Moldova, the country’s President Maia Sandu said Monday.

    Sandu called for heightened security measures in Moldova after the pro-EU government resigned last week, following months of pressure from Moscow which is waging an all-out war on neighboring Ukraine.

    “The plan included sabotage and militarily trained people disguised as civilians to carry out violent actions, attacks on government buildings and taking hostages,” Sandu told reporters at a press conference Monday.

    She added that citizens of Russia, Montenegro, Belarus and Serbia would be among those entering Moldova to try to spark protests in an attempt to “change the legitimate government to an illegitimate government, controlled by the Russian Federation to stop the EU integration process.”

    Moldova was granted candidate status to the European Union last June, together with Ukraine.

    Sandu’s remarks come after she nominated a new prime minister on Friday to keep her country on a pro-EU trajectory after the previous government fell earlier in the day.

    “Reports received from our Ukrainian partners indicate the locations and logistical aspects of organizing this subversive activity. The plan also envisages the use of foreigners for violent actions,” she said, adding that earlier statements from Ukrainian President Volodymyr Zelenskyy about Russia’s plans to stoke unrest have been confirmed by Moldova’s authorities.

    Zelenskyy told EU leaders during Thursday’s European Council summit in Brussels that Ukraine had intercepted Russian plans to “destroy” Moldova, which Moldovan intelligence services later confirmed.

    The Moldovan government has long accused Russia, which bases soldiers in the breakaway region of Transnistria in the east, of stirring unrest in the country, including protests in the capital, Chișinău.

    Sandu on Monday asked Moldova’s parliament to adopt draft laws to equip its Intelligence and Security Service, and the prosecutor’s office, “with the necessary tools to combat more effectively the risks” to the country’s security. “The most aggressive form of attack is an informational attack,” she said, urging citizens to only trust information they receive from the authorities.

    “The Kremlin’s attempts to bring violence to Moldova will not work. Our main goal is the security of citizens and the state,” Sandu said.

    Russia dismissed Sandu’s accusations as “completely unfounded and unsubtantiated,” and denied it had plans to destabilize the country, a spokeswoman to the Russian foreign ministry said in a statement released Tuesday.

    KYIV — Heads are rolling in President Volodymyr Zelenskyy’s expanding purge against corruption in Ukraine, but Defense Minister Oleksii Reznikov is denying rumors that he’s destined for the exit — a move that would be viewed as a considerable setback for Kyiv in the middle of its war with Russia.

    Two weeks ago, Ukraine was shaken by two major corruption scandals centered on government procurement of military catering services and electrical generators. Rather than sweeping the suspect deals under the carpet, Zelenskyy launched a major crackdown, in a bid to show allies in the U.S. and EU that Ukraine is making a clean break from the past.

    Tetiana Shevchuk, a lawyer with the Anti-Corruption Action Center, a watchdog, said Zelenskyy needed to draw a line in the sand: “Because even when the war is going on, people saw that officials are conducting ‘business as usual’. They saw that corrupt schemes have not disappeared, and it made people really angry. Therefore, the president had to show he is on the side of fighting against corruption.”

    Since the initial revelations, the graft investigations have snowballed, with enforcers uncovering further possible profiteering in the defense ministry. Two former deputy defense ministers have been placed in pre-trial detention.

    Given the focus on his ministry in the scandal, speculation by journalists and politicians has swirled that Reznikov — one of the best-known faces of Ukraine’s war against the Russian invaders — is set to be fired or at least transferred to another ministry.

    But losing such a top name would be a big blow. At a press conference on Sunday, Reznikov dismissed the claims about his imminent departure as rumors and said that only Zelenskyy was in a position to remove him. Although Reznikov admits the anti-corruption department at his ministry failed and needs reform, he said he was still focused on ensuring that Ukraine’s soldiers were properly equipped.

    “Our key priority now is the stable supply of Ukrainian soldiers with all they need,” Reznikov said during the press conference.

    Despite his insistence that any decision on his removal could only come from Zelenskyy, Reznikov did still caution that he was ready to depart — and that no officials would serve in their posts forever.

    The speculation about Reznikov’s fate picked up on Sunday when David Arakhamia, head of Zelenskyy’s affiliated Servant of the People party faction in the parliament, published a statement saying Reznikov would soon be transferred to the position of minister for strategic industries to strengthen military-industrial cooperation. Major General Kyrylo Budanov, current head of the Military Intelligence Directorate, would head the Ministry of Defense, Arakhamia said.

    However, on Monday, Arakhamia seemed to row back somewhat, and claimed no reshuffle in the defense ministry was planned for this week. Mariana Bezuhla, deputy head of the national security and defense committee in the Ukrainian parliament, also said that the parliament had decided to postpone any staff decisions in the defense ministry as they consider the broader risks for national defense ahead of another meeting of defense officials at the U.S. Ramstein air base in Germany and before an expected upcoming Russian offensive.  

    Zelenskyy steps in

    The defense ministry is not the only department to be swept up in the investigations. Over the first days of February, the Security Service of Ukraine, State Investigation Bureau, and Economic Security Bureau conducted dozens of searches at the customs service, the tax service and in local administrations. Officials of several different levels were dismissed en masse for sabotaging their service during war and hurting the state.     

    “Unfortunately, in some areas, the only way to guarantee legitimacy is by changing leaders along with the implementation of institutional changes,” Zelenskyy said in a video address on February 1. “I see from the reaction in society that people support the actions of law enforcement officers. So, the movement towards justice can be felt. And justice will be ensured.” 

    Yuriy Nikolov, founder of the Nashi Groshi (Our Money) investigative website, who broke the story about the defense ministry’s alleged profiteering on food and catering services for soldiers in January, said the dismissals and continued searches were first steps in the right direction.

    “Now let’s wait for the court sentences. It all looked like a well-coordinated show,” Nikolov told POLITICO.  “At the same time, it is good that the government prefers this kind of demonstrative fight against corruption, instead of covering up corrupt officials.”

    Still, even though Reznikov declared zero tolerance for corruption and admitted that defense procurement during war needs reform, he has still refused to publish army price contract data on food and non-secret equipment, Nikolov said.

    During his press conference, Reznikov insisted he could not reveal sensitive military information during a period of martial law as it could be used by the enemy. “We have to maintain the balance of public control and keep certain procurement procedures secret,” he said.

    Two deputies down

    Alleged corruption in secret procurement deals has, however, already cost him two of his deputies.  

    Deputy Defense Minister Vyacheslav Shapovalov, who oversaw logistical support for the army, tendered his resignation in January following a scandal involving the purchase of military rations at inflated prices. In his resignation letter, Shapovalov asked to be dismissed in order “not to pose a threat to the stable supply of the Armed Forces of Ukraine as a result of a campaign of accusations related to the purchase of food services.”

    Another of Reznikov’s former deputies, Bohdan Khmelnytsky, who managed defense procurement in the ministry until December, was also arrested over accusations he lobbied for a purchase of 3,000 poor-quality bulletproof vests for the army worth more than 100 million hryvnias (€2.5 million), the Security Service of Ukraine reported.  If found guilty he faces up to eight years in prison. The director of the company that supplied the bulletproof vests under the illicit contract has been identified as a suspect by the authorities and now faces up to 12 years in prison if found guilty.

    Both ex-officials can be released on bail.  

    Another unnamed defense ministry official, a non-staff adviser to the deputy defense minister of Ukraine, was also identified as a suspect in relation to the alleged embezzlement of 1.7 billion hryvnias (€43 million) from the defense budget, the General Prosecutors Office of Ukraine reported.  

    When asked about corruption cases against former staffers, Reznikov stressed people had to be considered innocent until proven guilty.

    Reputational risk

    At the press conference on Sunday, Reznikov claimed that during his time in the defense ministry, he managed to reorganize it, introduced competition into food supplies and filled empty stocks.

    However, the anti-corruption department of the ministry completely failed, he admitted. He argued the situation in the department was so unsatisfactory that the National Agency for the Prevention of Corruption gave him an order to conduct an official audit of employees. And it showed the department had to be reorganized.

    “At a closed meeting with the watchdogs and investigative journalists I offered them to delegate people to the reloaded anti-corruption department. We also agreed to create a public anti-corruption council within the defense ministry,” Reznikov said.

    Nikolov was one of the watchdogs attending the closed meeting. He said the minister did not bring any invoices or receipts for food products for the army, or any corrected contract prices to the meeting. Moreover, the minister called the demand to reveal the price of an egg or a potato “an idiocy” and said prices should not be published at all, Nikolov said in a statement. Overpriced eggs were one of the features of the inflated catering contracts that received particular public attention.

    Reznikov instead suggested creating an advisory body with the public. He would also hold meetings, and working groups, and promised to provide invoices upon request, the journalist added.

    “So far, it looks like the head of state, Zelenskyy, has lost patience with the antics of his staff, but some of his staff do not want to leave their comfort zone and are trying to leave some corruption options for themselves for the future,” Nikolov said.

    Reznikov was not personally accused of any wrongdoing by law enforcement agencies.

    But the minister acknowledged that there was reputational damage in relation to his team and communications. “This is a loss of reputation today, it must be recognized and learned from,” he said. At the same time, he believed he had nothing to be ashamed of: “My conscience is absolutely clear,” he said.

    My last job in the U.S. government was overseeing the intelligence community’s role in the Committee on Foreign Investment in the United States (CFIUS), along with an interagency group formerly known as Team Telecom, and being responsible for the intelligence community’s engagement with our foreign allies’ own investment security efforts. The cases that come before CFIUS are privileged and not publicly disclosed. But I can say this: The most challenging ones usually revolved around issues of advanced or dual-use technology, an area in which the Department of Commerce plays a critical role given its international trade and export control responsibilities.

    Today, the Department of Commerce is an agency unexpectedly on the frontlines of vital U.S. national and economic security challenges, most prominently demonstrated by its leading role on ensuring critical access to semiconductors, and as evidenced by the CHIPS Act and recent rules promulgated by the department to protect against even knowledge transfers between the United States and China.

    But these efforts are certain to be a beginning for Commerce, not an end. And a dedicated in-house intel agency can better identify emerging threats and challenges from China that Commerce needs to tackle, including potential spyware and other intrusions embedded in foreign technology. For instance, in late November, the U.S. issued a ban on new Huawei and ZTE equipment — along with that of three other Chinese companies — for fear it would be used to spy on Americans. Last month, Congress proposed limiting U.S. exposure to Chinese 5G leaders, including Huawei, by restricting their access to U.S. banks, adding them to Treasury’s Specifically Designated Nationals List.

    In fact, Commerce’s current position is not unlike that of the Treasury Department’s in 2004.

    That year — as part of the Intelligence Authorization Act — Congress established the current iteration of Treasury’s intelligence agency, the Office of Intelligence and Analysis, and formally made it part of the broader intel community. Since then, OIA has played a critical role for almost two decades combating terrorist financing, helping support sanctions efforts and providing financial intelligence to Treasury policymakers.

    OIA’s successes would simply not have been possible without it being a full, integrated member of the intelligence community. Indeed, its assessments often find their way to the White House and to other senior policymakers across town, even as its primary focus is supporting the Treasury Department.

    In the same way, the Commerce Department cannot be expected to play a more fulsome role in U.S. national security if its leaders are not fully informed of the strategic goals and illicit tactical efforts of U.S. adversaries. To meet that expectation, requires the launch of a new, 19th intel agency to be housed at the department.

    Most Americans think of intelligence and by default conjure up images of the CIA. But there are 18 agencies that make up the U.S. intelligence community, most housed in various departments or military services, and dedicated to providing the kind of intelligence support to a secretary or commander, that CIA continues to lead the way in providing to the White House.

    Members of Congress who for the first time are serving on the Intelligence, Foreign Affairs, Armed Services or other prominent national security-related committees and sub-committees, may be surprised to learn that despite what they may have gleaned from the media, the intel community does not actually make predictions; it makes judgments. The difference is critical.

    Predictions are generally fleeting: right and wrong, winners and losers, black and white. Judgments are far more complicated. They address the likelihood of events and emergence of prospective capabilities; the potential follow-on implications and challenges from an event occurring — or not; and the associated risks and opportunities for U.S. national and economic security.

    These conclusions are what the intelligence community informs policymakers of, to help them make the best decisions possible.

    Not only would Commerce Secretary Gina Raimondo benefit greatly from having her own intel agency providing these types of assessments directly to her, but so too would the rest of the department, including the Bureau of Industry and Security, which is responsible for export controls, and the International Trade Administration, which defends U.S. industry against unfair trade practices of foreign allies and adversaries.

    In creating the new agency, the Director of National Intelligence and Congress must ensure it does not simply result from merging together overworked and under-supported disparate parts of the department that seem to fit. Less than two years ago, Commerce’s national security work was overshadowed by a rogue and illegal security operation at the department — and neither it nor the U.S. government can afford a repeat.

    Rather, a new agency must be stood up and staffed by leaders and analysts who are intel community professionals that know how to blend complex analytic efforts with the priorities of the department. Having this type of experienced leadership will ensure the development of novel and Commerce-centric analysis, all while adhering to intelligence tradecraft and community standards.

    A new intel agency at the Commerce Department won’t end the national security challenges the U.S. faces from China; but it will help policymakers mitigate and overcome them.
