SC to hear on Apr 28 plea seeking independent probe into Atiq killing

    [ad_1]

New Delhi: The Supreme Court on Monday agreed to hear on April 28 a plea seeking an independent probe into the killing of gangster-turned-politician Atiq Ahmad and his brother Ashraf in Uttar Pradesh’s Prayagraj.

Atiq Ahmad (60) and Ashraf were shot dead at point-blank range by three men posing as journalists in the middle of a media interaction on April 15 night while police personnel were escorting them to a medical college in Prayagraj for a checkup.

The plea, filed by advocate Vishal Tiwari, has also sought an inquiry into the 183 encounters that have taken place in Uttar Pradesh since 2017.

Tiwari mentioned the matter for urgent listing on Monday before a bench comprising Chief Justice D Y Chandrachud and Justice P S Narasimha.

He told the bench that his plea was slated to come up for hearing on Monday but it has not been listed.

“Since five judges are not available, some cases in which dates were given have not been listed. We will try to list this on Friday (April 28),” the CJI said, adding, some apex court judges are down with COVID-19 while some others are indisposed due to other reasons.

The Uttar Pradesh Police had recently said that it has gunned down 183 alleged criminals in encounters in the six years of the Chief Minister Yogi Adityanath-led government and this included Ahmad’s son Asad and his accomplice.

The plea filed in the apex court has sought the setting up of an independent expert committee to probe the killing of Atiq and Ashraf.

“Issue guidelines/directions to safeguard the rule of law by constituting an independent expert committee under the chairmanship of a former Supreme Court justice to inquire into the 183 encounters which had occurred since 2017 as stated by Uttar Pradesh Special Director General of Police (Law and Order) and also to inquire into the police custody murder of Atiq and Ashraf,” it said.

Referring to Atiq’s killing, the plea said “such actions by police are a severe threat to democracy and rule of law and lead to a police state”.

“In a democratic society, the police cannot be allowed to become a mode of delivering final justice or to become a punishing authority. The power of punishment is only vested in the judiciary,” the plea submitted.

It said extra-judicial killings or fake police encounters have no place in the law.

When the police turn “daredevils then the entire rule of law collapses and generates fear in the mind of people against the police which is very dangerous for democracy and this also results in more crimes,” the plea stated.

New Delhi: A day after gangster-politician Atiq Ahmad and his brother Ashraf were shot dead under police escort, a plea was filed in the Supreme Court on Sunday seeking the constitution of an independent expert committee headed by a former apex court judge to probe the killings.

The plea, filed by advocate Vishal Tiwari, also sought an inquiry into the 183 encounters that have taken place in Uttar Pradesh since 2017.

Ahmad (60) and Ashraf, who were in handcuffs, were shot dead by three men posing as journalists when they were answering reporters’ queries while being escorted by police personnel to a medical college in Uttar Pradesh’s Prayagraj for a checkup on Saturday night.

Just hours before the shooting, the last rites of Ahmad’s son Asad, who along with one of his associates was gunned down in a police encounter in Jhansi on April 13, were held.

Uttar Pradesh Police had said on Friday that it has gunned down 183 alleged criminals in encounters in the six years of the Chief Minister Yogi Adityanath-led government and this included Asad and his accomplice.

The plea sought the creation of an independent expert committee to probe the killings of Atiq and Ashraf.

Referring to Atiq’s killing, the plea said “such actions by police are a severe threat to democracy and rule of law and lead to police state”.

“In a democratic society the police cannot be allowed to become a mode of delivering final justice or to become a punishing authority. The power of punishment is only vested in the judiciary,” the plea stated.

The plea said extra judicial killings or fake police encounters have no place under the law.

When the police turn “Dare Devils then the entire rule of law collapses and generates fear in the mind of people against police which is very dangerous for democracy and this also results into further crime,” it stated.

  • SC verdict on pleas for independent mechanism to appoint ECs on Thursday

SC verdict on pleas for independent mechanism to appoint ECs on Thursday

    [ad_1]

New Delhi: The Supreme Court will deliver judgment on Thursday on a batch of petitions seeking a collegium-like system for the appointment of Election Commissioners (ECs) and the Chief Election Commissioner (CEC).

A constitution bench, headed by Justice K.M. Joseph and comprising Justices Ajay Rastogi, Aniruddha Bose, Hrishikesh Roy, and C.T. Ravikumar had reserved judgment in the matter on November 24, 2022. According to the causelist, two judgments, each by Justices Joseph and Rastogi, will be pronounced at 10.30 a.m. on Thursday in the matter.

During the arguments, Attorney General R. Venkataramani had told the Supreme Court that if it were to begin to doubt every step taken by the government in the process of appointment of the Election Commissioner, then it has implications on the integrity and independenceA of the institution.

The five-judge constitution bench, headed by Justice Joseph, had then shot a volley of questions at the country’s top law officer in connection with the appointment of Election Commissioner Arun Goel. It posed some critical questions to the AG in connection with Goel’s appointment: what deliberation could have been done to finalise his name within 24 hours, same day clearance, same day process completed, and the appointment was made not even in 24 hours.

The Centre had, however, maintained that there is no trigger point for the Supreme Court to interfere in the appointment process of the Election Commissioner.

After hearing detailed arguments, the Supreme Court reserved the judgment on a batch of petitions seeking a collegium-like system for the appointment of the ECs and the Chief Election Commissioner (CEC).

During the hearing, the Supreme Court had told the Centre that it wants to see the files relating to the recent appointment of Goel as the Election Commissioner and emphasised that it wants to see by what mechanism, “he was picked up”, and “there is no danger to produce it (files)”.

  • Odisha minister murder case: Munda demands probe by an independent agency

Odisha minister murder case: Munda demands probe by an independent agency

    [ad_1]

Bhubaneswar: Senior BJP leader and Union Tribal Affairs Minister Arjun Munda on Saturday demanded investigation by an independent agency into the brutal murder of Odisha minister Naba Kishore Das.

Speaking to media persons here, Munda said the murder of the minister is a major concern for the law and order situation of the state. “If such an incident happens to a minister, then what would be the condition of the common people in the state?” he asked.

If such a situation arises in between police and a minister, whom will the common people trust? Munda further asked.

Therefore, the case should be investigated by an independent agency so that truth can come out, he demanded.

The Tribal Affairs Minister also blamed the Odisha government for non-inclusion of 169 communities into Odisha ST List.

“It is not a political issue. It is a constitutional matter. It cannot be resolved by making political statements,” he said.

The state government has not submitted a concrete proposal for inclusion of the communities in the ST list, Munda said.

As per process, he said, proper anthropological research is needed to be done about the communities. After examining those, the Centre can include the genuine tribals in the list.

“In the 120 cases, there is no document, no research is done. If we will take those into consideration after receiving just a piece of paper, the entire India will tell us to make them tribals,” the Minister said.

Munda is here to inform the people about the programmes and welfare measures taken by the Modi government in the Union Budget 2023-24.

Meanwhile, the state crime branch, which is investigating the minister’s murder case, has got another four-day remand of accused police ASI Gopal Krushna Das (now dismissed).

Crime branch ADG Arun Bothra briefed justice J.P Das about the status of investigation. Justice Das, a retired judge of Orissa High Court has been appointed to monitor the high-profile case.

Das said he was briefed about the status of investigation in the case and overall, it is going in the right direction. However, he is yet to see the documents. Das also informed that he will soon visit the crime spot at Brajarajnagar in Jharsuguda district.

The investigation in the sensational murder case is on the right track, justice Das reportedly said after crime branch ADG Arun Bothra met him at his house in Cuttack and briefed him on the progress in the probe.
