    But people close to Biden still worry about the personal toll it will take on a father who has already felt anguish about a son’s struggles amid a long history of family tragedy. And they wonder how long he can compartmentalize personal anger with the attacks on Hunter and the political calculation that he’s better off not responding to it. Biden has long agonized over the fate of his surviving son, expressing that worry in phone calls with longtime friends and to Hunter himself.

    Attorneys for Hunter Biden met at Justice Department headquarters in Washington last week to discuss the tax- and gun-related case with prosecutors, according to a person familiar with the matter. Often a signal that an investigation is concluding, such meetings are used by defense lawyers to urge prosecutors to refrain from seeking an indictment or to consider reduced charges. The probe has centered on whether Biden failed to report all of his income and whether he lied on a form for buying a gun. His attorneys declined comment.

    “Obviously, the Biden team would hope that this investigation does not result in an indictment for a multitude of reasons,” said Jennifer Palmieri, who served as President Barack Obama’s communications director. “But the Republicans have failed — both in the 2020 campaign and in their 2023 congressional hearings — to have questions about Hunter Biden impact public opinion and I don’t think they will succeed now, regardless of what DOJ decides.”

    There is no Hunter Biden war room at the White House, according to four people familiar granted anonymity to speak freely. Defense for the president’s son is being handled by his personal attorneys and the White House is not involved with legal matters.

    The campaign and the Democratic National Committee officials will likely take the lead in responding to political inquiries, while White House staffers will respond if the accusations touch on official government business.

    No matter what DOJ decides at the end of its six-year investigation, the decision could have significant implications for the president’s just-announced reelection bid, giving fodder to Republicans as they seek to paint the Biden family as corrupt.

    There is a sense among Biden allies that he’ll face some blowback either way. If Hunter Biden is charged with a crime, Trump and Republicans will try to link his behavior to his father’s conduct and fitness for office. And if charges are not brought, Republicans have telegraphed that they will claim that the Department of Justice was biased and that Attorney General Merrick Garland, a Biden appointee, rigged the decision.

    “The Biden administration is the most corrupt administration in American history. Hunter Biden is a criminal, and nothing happened to him, nothing happened,” said Trump at a recent rally. “Joe Biden is a criminal and nothing ever seems to happen to him because you know, say what you want, but the Democrats stick together.”

    Largely, aides said, the Biden campaign will continue to move forward and focus on other issues that they believe are more pertinent to voters. The White House believes that many Americans, especially those with addictions in their own family, are, and will be, sympathetic to the Bidens.

    “First of all, my son has done nothing wrong. I trust him. I have faith in him,” Biden said in an interview Friday with MSNBC. “It impacts my presidency by making me feel proud of him.”

    Aides to the president stress that the White House is not involved with the Department of Justice’s decision. The matter is being investigated by U.S. Attorney David Weiss of Delaware, a Trump appointee.

    The probe into Hunter Biden began in 2018 and initially centered on his finances related to overseas business ties and consulting work. Investigators later shifted their focus to whether he failed to report all of his income and whether he lied on a form for buying a gun by denying that he was a drug abuser. Hunter Biden has spoken openly about his crack addiction and other drug problems.

    The investigation into Hunter was discussed prior to launching the 2024 campaign. First lady Jill Biden made clear last year that it would not play a decisive role in whether or not the president would run for reelection. But the impact that the scrutiny of another campaign might have on Hunter Biden was weighed, according to three people not authorized to speak publicly about private conversations.

    Biden advisers acknowledge Republicans will revive the issue for the 2024 campaign, according to multiple people familiar with the discussions. But they also point out that Trump made many of these allegations during the 2020 campaign, even springing one of Hunter’s ex-business partners, a man named Tony Bobulinski, as a surprise guest at the last 2020 general election debate. It had little impact.

    But the claims about Hunter Biden have continued to flourish in conservative media, which has grown convinced that the 2020 attacks would have landed harder if the press corps and social media companies had not been initially skeptical of the provenance of his former laptop. POLITICO has not authenticated the hard drive files that underpinned a New York Post story about the laptop, but POLITICO confirmed the authenticity of some emails on the drive in a 2021 book.

    Republicans assert that the content of the laptop offers evidence of corrupt dealings, which has fueled investigations from the GOP-controlled House of Representatives. Sen. Josh Hawley (R-Mo.) on Thursday deemed the allegations against the younger Biden as “very serious.”

    “I just hope that he is being treated like everybody else,” Hawley said. “There [are] various whistleblower allegations that there’s been interference, that people have tried to stymie the investigation. That better not have happened.”

    Biden advisers believe the focus on Hunter could backfire on Republicans and serve as another sign the GOP is out of step with normal Americans, much as polling suggests the party is on issues like abortion and guns.

    Moreover, they suggest GOP attacks could very well divert attention to Trump’s own legal peril. The former president has already been indicted in New York for falsifying business records in connection to a hush money payment to a porn star and is the subject of several other probes. Moreover, Democrats have claimed that Trump’s own family benefited financially from their access to his political power and are quick to point out that Trump himself was impeached in 2019 for pressuring Ukraine to investigate the Biden family’s business dealings there.

    A Trump spokesman did not respond to a request for comment.

    The White House did bolster its team ahead of the 2022 midterms to prepare for a more hostile environment and a GOP House. It brought on communications specialist Ian Sams as a spokesperson and several lawyers to handle personal investigations into the president, including Dick Sauber, a longtime Washington defense attorney in investigations.

    And Hunter Biden has taken a more aggressive tack in recent months, bringing on longtime D.C. lawyer Abbe Lowell and pushing back more forcefully against Republican attacks on his personal history and how his personal effects ended up in the hands of GOP operatives like Steve Bannon and Rudy Giuliani. But some Democrats are anxious about talk that Hunter Biden may create a legal defense fund, which would raise scrutiny about the president’s son raising money to pay for his legal woes.

    “The president loves his son and is proud that he has overcome his addiction and is moving forward with his life,” said Sams. “Republican officials’ politically motivated, partisan attacks on the president and his family are rooted in nonsensical conspiracy theories and do nothing to address the real issues Americans care about.”

    Hunter Biden has written extensively about the challenges in his life, including his addictions and struggle to cope with the 1972 car accident that killed his mother and sister and critically injured him and his brother, Beau. He also lived much of his life in the shadow of Beau Biden, the former Delaware attorney general who died of brain cancer in 2015, at the age of 46.

    The president, some of his friends say, checks on his son nearly every day. Hunter kept a low profile during the 2020 presidential campaign but has recently taken on a more public role. He appeared with his father at events including the state dinner for French President Emmanuel Macron in December. And he was a nearly constant presence at the president’s side at nearly every stop during last month’s trip to Ireland, their ancestral homeland.

    But there have been recent sightings that serve as a reminder of the unfortunate headlines that he can sometimes create.

    Hunter Biden appeared in an Arkansas courtroom this week as part of a bitter dispute with the mother of his 4-year-old child over reducing his child support payments. The mother of the child, Lunden Roberts, has accused the younger Biden of ignoring court orders to provide information about his finances and has asked a judge to declare him in contempt and have him jailed until he complies.

    The president and first lady have yet to publicly acknowledge the existence of the child, who is their seventh grandchild. White House press secretary Karine Jean-Pierre this week declined to discuss the subject during her briefing.

    The Biden campaign declined to comment. Democratic lawmakers, many close to Biden personally, often decline to weigh in on the ongoing probe.

    “There’s an investigation. It’s up to the prosecutors to decide what action to take,” said Sen. Peter Welch (D-Vt.). “Whatever is appropriate, that’s the action that should be taken independent of what the political consequences are. It’s not our business and Congress to interfere with the prosecution.”

    Mac Isaac turned the laptop and external hard drive over to the FBI in 2019 and attempted to share the information from the devices with former President Donald Trump’s personal attorney Rudy Giuliani.

    Biden’s lawyers are also seeking depositions from Steve Bannon and Giuliani in the suit.

    Biden doesn’t confirm in the filing that the laptop is his. “Mr. Biden is without knowledge sufficient to admit or deny the allegations,” the filing states.

    The data from the laptop became a point of interest after stories were published by the New York Post before the 2020 election.

    POLITICO has not authenticated the Biden hard drive files that underpinned an October 2020 New York Post story, but POLITICO reporter Ben Schreckinger confirmed the authenticity of some emails on the drive in a 2021 book.

    Last year, Mac Isaac sued POLITICO, CNN, Hunter Biden, Rep. Adam Schiff (D-Calif.) and the Biden presidential campaign committee for defamation and civil conspiracy in state court in Delaware. Earlier this month, the federal government stepped in for Schiff and removed the case to federal court in Wilmington, arguing that the suit pertains to acts he took in his official capacity as a member of Congress.

    Friday’s filing comes as Rep. James Comer (R-Ky.), chair of the House Oversight Committee, prepares an investigation into Biden. The suit is also part of a broader campaign of legal pushback from Biden’s attorneys, warning those involved in publicizing assertions about his laptop computer that they could face unspecified litigation over their claims.

    The Justice Department is reported to be in the final stages of deciding whether to bring criminal charges against Hunter Biden in connection with alleged tax offenses and his alleged failure to disclose his status as a drug user when applying to buy a handgun in 2018.

    When Garland was nominated as attorney general, he agreed to leave Weiss — an appointee of former President Donald Trump — in place to complete the Hunter Biden investigation.

    While offering those assurances about independence, Garland did not share any substantive update on the investigation into the president’s son. The probe is reportedly focused on Hunter Biden’s failure for years to pay a federal income tax bill that eventually amounted to about $1 million and a false statement Hunter Biden allegedly made about his drug use when purchasing a gun in 2018. Hunter Biden has said he is confident the investigation will clear him of wrongdoing.

    While the Hunter Biden questions were the most politically explosive issues aired in the early hours of Wednesday’s hearing, questioning from senators was a potpourri, spanning concerns ranging from violent crime to drugs to guns to the impact of social media platforms on American society.

    Sens. Mike Lee (R-Utah) and Ted Cruz (R-Texas) challenged Garland about federal law enforcement’s handling of protests that broke out at the homes of several Supreme Court justices after POLITICO reported last May on a draft Supreme Court opinion that would overturn the federal constitutional right to abortion established in 1973 in Roe v. Wade. The protests intensified after the court formally issued its ruling the next month in Dobbs v. Jackson Women’s Health Organization, with the opinion in much the same form as the earlier draft.

    Lee, a former law clerk to the author of Justice Samuel Alito, who wrote Dobbs, pressed Garland on why no one has been arrested under a federal statute that prohibits trying to influence the administration of justice by picketing or parading near the homes of federal judges.

    “It’s very clear they’re tying to influence in one way or another that those serving on the United States Supreme Court,” Lee said of the protesters. “Yet, not one person to my knowledge has been prosecuted for such things.”

    Cruz, who served as a law clerk to the late Chief Justice William Rehnquist, later thundered at Garland over the department’s failure to act against what the senator called “rioters” at the justices’ homes.

    “You’re perfectly content with justices being afraid for their children’s lives,” the Texas Republican shouted.

    Garland stressed that he responded rapidly to the leak and the protests by assigning more than 70 deputy U.S. Marshals to guard the justices and their families around the clock. “As soon as the Dobbs draft leaked, I ordered the marshals to do something that the marshals had never done in United States history before, which was to protect the justices and their families, 24-7.”

    The attorney general eventually conceded that no protester has been charged under the federal law, but he said the “priority” of the marshals is keeping the justices and their families safe, not policing the demonstrators. Garland insisted, however, that no directive has been given to the marshals to ignore that law.

    “They have full authority to arrest people under any federal statute, including that statute,” Garland said.

    Some experts have said the federal law could be open to a First Amendment challenge, although the attorney general noted that the Supreme Court marshal wrote to local law enforcement in Maryland and Virginia last year urging them to enforce similar local ordinances.

    Sen. Josh Hawley (R-Mo.) also challenged Garland on abortion-related issues, grilling him over alleged “anti-Catholic bias” at the Justice Department. Hawley pointed to an intelligence memo prepared by the FBI’s Richmond, Va., field office and dated in January that warned of the potential for violence from “radical-traditionalist Catholics,” particularly among those who favor the Latin mass.

    “It’s appalling. It’s appalling. I’m in complete agreement with you,” Garland replied. “I understand that the FBI has withdrawn it and is now looking into how this would ever have happened….It does not reflect the methods the FBI is supposed to be using.”

    “Are you cultivating sources and spies in Latin-mass parishes and other Catholic parishes around the country?…How many informants do you have in Catholic churches across America?” Hawley asked.

    “I don’t think we have any informants,” Garland said, pointing to longstanding Justice Department policies.

    Democrats also used the hearing to cajole Garland for support for their key issues, with Senate Judiciary Committee Chair Dick Durbin (D-Ill.) railing against social media companies for enabling drug trafficking and dangerous behavior by teenagers.

    “This is out of hand,” Durbin told the attorney general. The chair also bemoaned the influence of the 1996 law known as Section 230, which gives online platforms broad immunity from being sued over content third parties post online and from being sued over the adequacy of their efforts to police that content.

    “I think Section 230 has become a suicide pact. We are basically saying you are absolved from liability, make money and deaths result from it,” Durbin said.

    Garland called the situation Durbin described “horrible,” but was careful to limit his specific criticism to the role social media plays in drug dealing.

    “We do have to do something to force them to provide information to search their own platforms for drugs,” the attorney general said.

    “It may be necessary to produce this material in litigation,” Lowell added, without elaborating on the type of litigation or the potential defendants.

    A spokesperson for Lowell declined to comment on what litigation he was alluding to or to say whether Hunter Biden planned to file a suit in the near future.

    An adviser to Giuliani dismissed the letters as an intimidation tactic.

    “Instead of gossiping with reporters and leaking this stuff to the press, Abbe Lowell should focus on the facts because the facts don’t support his allegations,” the adviser, Ted Goodman, told POLITICO. “This is yet another failed attempt by Mr. Lowell to silence and intimidate Mayor Giuliani and Mr. Costello. That’s why he made sure to send this letter to you guys.”

    Costello, confirming that he had received similar letters for Giuliani, former Trump White House counselor Steve Bannon and himself, said on Wednesday night: “This is just another foolish attempt to intimidate. It will not work.”

    The new fusillade of letters is part of a series of increasingly acrimonious exchanges in recent days between the younger Biden’s lawyers and people connected to efforts to publicize details about the alleged contents of the laptop in advance of the 2020 presidential election.

    Last week, Lowell sent letters to the Justice Department and Delaware attorney general asking for investigations into various people allegedly connected to handling of the laptop and the data said to have come from it.

    Mac Isaac’s lawyer, Brian Della Rocca, did not respond to a message seeking comment on Wednesday but scoffed last week at Hunter Biden’s increasingly combative legal strategy.

    “Hunter’s current actions are desperate attempts to continue to blame everyone else for his own actions,” Della Rocca told the New York Post.

    The tit-for-tat volleys come as the Justice Department is said to be in the final stages of deciding whether to bring criminal charges against Hunter Biden in connection with alleged tax offenses and his alleged failure to disclose his status as a drug user when applying to buy a handgun in 2018.

    Hunter Biden has said he is confident he will not be charged.

    Lowell’s latest missives were sent on the same day that Republicans in Congress convened the first of what are expected to be a series of hearings on allegations related to the laptop, as well Hunter Biden’s business dealings in Ukraine and his alleged efforts to profit from influence over his father.

    The first hearing, held by the House Oversight and Accountability Committee, focused on efforts by Twitter to suppress on their platform a New York Post article about the alleged contents of the laptop days before the 2020 election. Twitter officials quickly concluded that their initial reaction was a mistake and gradually lifted nearly all the limits they imposed.

    In fact, Oversight Committee Chair James Comer (R-Ky.) suggested in a brief interview with POLITICO that the Justice Department should hold off on issuing any indictment against Hunter Biden so Republicans can complete their probe. He openly acknowledged that criminal charges could hinder his investigation, giving any witnesses in the DOJ case clearance to assert their Fifth Amendment rights.

    If the DOJ does go that route, one option would be for the panel to pivot to focus more heavily on other Biden family members, including brothers of the president, the GOP chair said.

    “If they indict Hunter Biden, there’s still a lot of stuff out there. And say we can’t touch anything [Hunter-related], it freezes up all the evidence — there’s still a lot of stuff out there,” Comer said.

    In calling for the DOJ to delay, Comer said prosecutors had already “waited this long” and Republicans would only “need a matter of months.” But his recommendation is all but guaranteed to fall flat. If the DOJ did listen, it would mirror the sort of unfounded coordination accusations that Republicans have previously lobbed at Democrats.

    The DOJ tends to purposely avoid linking its work to Congress’ timeline — a frequent source of frustration for both parties. For example, members of the Jan. 6 select committee routinely groused that the department didn’t appear to be pursuing matters they had uncovered in their inquiry that they believed potentially rose to criminal levels.

    Republicans are formally kicking off their investigation into the Biden family this week with their first public hearing tied to the probe, focused on Twitter’s decision to restrict a New York Post story on Hunter Biden just before the 2020 election. (Twitter officials have publicly acknowledged that they view the decision as a mistake.)

    As part of the hearing, three former company executives — James Baker, former Twitter deputy general counsel; Yoel Roth, Twitter’s former global head of trust and safety; and Vijaya Gadde, Twitter’s former chief legal officer — are expected to testify. Comer formally subpoenaed them, but aides said it was meant to give the witnesses legal cover to appear before the panel.

    Democrats, meanwhile, are expected to use the hearing to ask their own questions about Twitter’s handling of former President Donald Trump’s controversial tweets. Their witness for the hearing will be Anika Collier Navaroli, a whistleblower who previously spoke with the House’s Jan. 6 committee over the social media platform’s handling of Trump’s tweets.

    The former president was banned from the platform in the wake of the Jan. 6, 2021 attack on the Capitol by his supporters, only to be allowed back on recently by its current owner, Elon Musk.

    The hearing serves as Comer’s opener into his larger Biden family investigation, which is expected to take a broad dive that specifically touches on Hunter Biden’s business dealings, bank records and art sales but also spans beyond the First Son. Republicans are hunting for a smoking gun that ties Joe Biden’s decisions to his son’s business agreements, though no evidence has yet emerged linking the two.

    POLITICO has not undergone the process to authenticate the Hunter Biden laptop that underpinned the New York Post story, but reporter Ben Schreckinger has confirmed the authenticity of some emails on it. A committee aide described themselves as highly confident that the information gleaned from the laptop was connected to Hunter Biden, but argued that the onus was on skeptics of its veracity to prove that any specific email or document on it isn’t valid.

    Rep. Gerry Connolly (D-Va.), a member of the Oversight Committee, questioned the need for either the DOJ or House GOP investigation, arguing that they were both “based on false premises.” But he also identified the undeniable political pickle that the DOJ’s active investigation would present for Republicans by limiting their requests for information and cooperation from potential witnesses.

    “Why not, in some cases, say … we know DOJ is investigating, and we’re gonna wait to hear the results before we do. We did that with the Mueller report,” Connolly added.

    The DOJ declined to comment for this story. But the department previously outlined how it responds to congressional investigations in a letter last month to Rep. Jim Jordan (R-Ohio), chair of the Judiciary Committee and a member of the Oversight panel.

    That letter detailed how the DOJ handles information requests spawning from congressional investigations, effectively warning that it was reserving the right not to cooperate with GOP demands if they’re tied to an ongoing internal matter.

    Carlos Uriarte, DOJ’s legislative affairs chief, noted in the letter that “consistent with longstanding policy and practice, any oversight requests must be weighed against the Department’s interests in protecting the integrity of its work.” The DOJ, in accordance with long-standing policy, hasn’t formally confirmed the existence of a Hunter Biden investigation.

    Regardless of whether the DOJ ultimately issues any Hunter Biden-related indictments, though, the ongoing federal probe has cast a shadow over Congress’ fight on that front.

    Republicans say they are basically in the dark about the tightly held inquiry, which has reportedly gone on for years. And some Democrats view the DOJ probe as a legitimate counterpart to House Republicans, saying it is the proper lane for investigating any of Hunter Biden’s potential missteps.

    Hunter Biden and his team are also going on offense, urging the DOJ, Delaware attorney general and IRS to investigate many of the figures who came to possess the files culled from his alleged laptop — and some of the “inconsistencies” in stories about how those various offices came to access the records.

    That request from Hunter Biden would require the administration to take up the politically explosive matter at the same time House Republicans are preparing to seek similar information from the same offices. Administration officials have given no indication they plan to do so.

    No threats or offences were reported to Merseyside police, whose statement confirming they were liaising with Everton over the allegations contained a rebuke to the club. They were in contact, said the police, “to ensure that any future reports are received through existing channels”. A day after the police statement, and one from Everton saying they would not comment on “specific historic incidents”, an article appeared in the Athletic in which a club source doubled down on accusations that Barrett-Baxendale had been put in a headlock at an unspecified game. The claim remains unsubstantiated almost a week on. The only evidence of Everton fans crossing the line of late is footage of Anthony Gordon being abused and Yerry Mina being confronted as they drove away from Goodison last Saturday.

    The Everton doom loop continues. NSNOW, organisers of the protest, stated: “We are appalled by the Everton board’s recent statements and actions, including the use of unattributed leaks to the media, that have resulted in considerable damage to the good name of the club and especially the fans. For the board there is no recovery from this.” The Everton Shareholders’ Association, hardly a hotbed of revolutionary fervour in the past, said relations between the owner, board and fanbase were “at an all-time low”. The association, also angered by the removal of AGMs, has launched an online petition calling for a vote of no confidence in the board. It attracted almost 11,000 signatures in the first 24 hours.

    The upshot of this counterproductive debacle is that Everton have made their own manager’s job – and, by extension, their own prospects of avoiding relegation – more difficult. They have also exposed how Everton are run, and why there is such a clamour for Moshiri to sell up or impose the changes that were needed at the top when he bought into the club. Everton’s decline has accelerated under the British-Iranian billionaire, but it did not start with him. The club was lagging behind its Premier League peers commercially and had three failed stadium projects to its name when Kenwright, indebted to Moyes for keeping Everton competitive on a shoestring for 11 years, finally found a much-needed investor and invited Moshiri on board in February 2016.

    Moshiri has at least found a solution to Everton’s stadium problem with construction well under way on an impressive arena at Bramley-Moore Dock. He is yet to secure the additional investment required to complete the project, however, and that search would not be easier with the club in the Championship. Relegation would entail a fire sale of assets from the squad and raise the spectre of administration for a club that posted combined losses of £372.6m in its past three available set of accounts. About £700m has been spent on more than 50 players in the Moshiri era, with just over £400m recouped in sales. Lucrative commercial ties with companies owned by the oligarch Alisher Usmanov, Moshiri’s former business associate, have been cut since Russia’s invasion of Ukraine.

    By allowing Kenwright to remain an influential chairman Moshiri preserved the status quo when Everton needed a reset. Kenwright’s supporters would argue his influence has been vital in curbing the worst excesses of an impressionable owner who has no strategy or plan and has frequently followed the poor advice of a few friendly agents.

    Moshiri has not failed on his own terms. The same is true of Lampard, a dignified figure who has refused to blame the Everton circus for results he knows spell trouble. Nine league wins in 12 months and three league wins this season represent dreadful records. But, should the axe fall after West Ham, how accurately can his performance at Everton be judged? Lampard has spent the vast majority of the season without a recognised goalscorer who could have turned draws into victories and narrow defeats into draws when his rebuilt defence and midfield offered a foundation earlier in the campaign.

    Everton have known since 1 July last year that Richarlison’s goals needed replacing. Three weeks into the January window and still no signings have arrived. Meanwhile Southampton, West Ham, Bournemouth, Wolves, Leeds, Nottingham Forest and Aston Villa have strengthened. Danny Ings, now of Saturday’s opponents, Kevin Schade, Brentford’s new striker, and Georginio Rutter, Leeds’s record signing, were on Lampard’s wishlist.

    Last season Everton had the unity that Lampard fostered between the fanbase and a struggling team to “push them over the line” – his words – in an impassioned fight against relegation. That crutch has gone, kicked away by his club.
