Hyderabad: A student from Telangana was killed in the US when a gun he was holding went off accidentally, as per his family here.
Mahankali Akhil Sai, 25, from Khammam district lost his life in the incident that occurred at Auburn in Alabama state on Monday night (local time).
Sai had gone to the US about 13 months ago and was studying MS at Auburn University. He was also doing a part-time job at a nearby gas station.
According to information reaching his family, he took the gun of a security guard and was having a close look by holding it in his hands when it went off accidentally. The bullet hit him in his head. The gas station staff rushed him to a hospital, where he succumbed.
The youth was hailing from Madhira town in Khammam district. His family was shocked on receiving the information.
The family has requested the Indian government to help in bringing the body home.
But then last year, the U.S. Supreme Court issued a new ruling in a case known as New York State Rifle & Pistol Association v. Bruen. That case set new standards for interpreting the Second Amendment by saying the government had to justify gun control laws by showing they are “consistent with the Nation’s historical tradition of firearm regulation.
The appeals court withdrew its original decision and on Thursday decided to vacate the man’s conviction and ruled the federal law banning people subject to domestic violence restraining orders from owning guns was unconstitutional.
Specifically, the court ruled that the federal law was an “outlier that our ancestors would never have accepted” — borrowing a quote from the Bruen decision.
The decision came from a three-judge panel consisting of Judges Cory Wilson, James Ho and Edith Jones. Wilson and Ho were nominated by former Republican President Donald Trump, while Jones was nominated by former Republican President Ronald Reagan.
The U.S. Justice Department Thursday night issued the following statement from Attorney General Merrick B. Garland following the decision: “Nearly 30 years ago, Congress determined that a person who is subject to a court order that restrains him or her from threatening an intimate partner or child cannot lawfully possess a firearm. Whether analyzed through the lens of Supreme Court precedent, or of the text, history, and tradition of the Second Amendment, that statute is constitutional. Accordingly, the Department will seek further review of the Fifth Circuit’s contrary decision.”
Thursday’s ruling overturned the federal law and is not likely to impact similar state laws, including one in California. Still, California Gov. Gavin Newsom, a Democrat, called the judges who issued the ruling “zealots” who are “hellbent on a deranged vision of guns for all, leaving government powerless to protect its people.”
“This is what the ultra-conservative majority of the U.S. Supreme Court wants. It’s happening, and it’s happening right now,” Newsom said. “Wake up America — this assault on our safety will only accelerate.”
Chuck Michel, president of the California Rifle and Pistol Association, said the problem with laws like the one the federal appeals court struck down is that they are too broad and don’t take into account the details of each case.
He offered as an example a client of his whose neighbor filed a restraining order against them because they had pointed a security camera on their property.
“They lost their gun rights,” he said. “When they do a blanket prohibition without considering individualized circumstances, they shoot the dogs with the wolves.”
Thursday’s ruling demonstrates the far-reaching impacts of the Bruen decision. In California, the decision has prompted lawmakers to overhaul their law regarding permits to carry concealed weapons.
Wednesday, Newsom endorsed a bill in the state Legislature that would ban people from carrying concealed guns in nearly all public places, with an exception for churches and businesses who put up a sign saying guns are OK.

The letter by the coalition — also led by Brady United, Community Justice Action Fund, March for Our Lives and Newtown Action Alliance — illustrates the breadth of the issues the president will be pushed to tackle during this year’s State of the Union, a speech that comes at the halfway point of his first term. It also underscores the degree to which progressive-leaning institutions aren’t simply content to let Biden rest on his accomplishments as he begins gearing up for a likely reelection bid.
The coalition’s latest effort comes amid a flurry of mass shootings. But it is also reminiscent of the early days of Biden’s presidency, when many of the same groups wrote the president a letter outlining executive actions they sought, frustrated he hadn’t come out as aggressively as he promised on the campaign trail.
“Now two years later, we’re circulating another letter,” said Po Murray, chair of the Newtown Action Alliance. “We want Biden to address this and tell the world what his plan is to tackle this issue.”
The Biden White House has made historic strides on gun policy. The president has taken a slew of executive actions, and his administration has invested in community violence intervention. And following back-to-back shootings in Buffalo, N.Y., and then Uvalde, Texas, in 2022, the White House worked with a bipartisan coalition in Congress to pass the first gun legislation into law in nearly three decades. That deal, signed by Biden in June, toughened background checks for young gun buyers, helped states implement red flag laws and kept firearms from more domestic violence offenders. The following month, the Senate confirmed the first director of the Bureau of Alcohol, Tobacco and Firearms since 2013.
Earlier this month, the administration announced a new rule to tighten regulations on guns with stabilizing braces, used by shooters in Boulder, Colo., and Dayton, Ohio. The White House did not respond to requests for comment on the president’s next policy moves, but press secretary Karine Jean-Pierre said last week that Biden’s team would continue to examine avenues for executive action.
“We’ll continue to pursue executive actions to reduce gun violence,” Jean-Pierre said, noting she didn’t have “anything right now to share or preview.” She added the administration is always striving to find ways “to deal with an issue, again, that is devastating communities across the country. But I also want to be very, very clear here. In order to deal with this, we need Congress to act.”
Already in 2023, there have been 41 mass shootings in which four or more people were injured or killed, according to the Gun Violence Archive. At least 69 people have been killed, and that’s not counting the thousands dead this month due to other acts of gun violence or firearm suicide. Now, with a split Congress, the coalition of gun groups argues Biden has more of a responsibility to shoulder the burden for pushing reform — and they insist that he has options on the table.
The groups encouraged Biden to focus on implementation of the Bipartisan Safer Communities Act he signed into law more than six months ago, including by making use of the federal statute outlined in the legislation to target gun traffickers. They also called for the administration to ensure FBI investigators are properly trained in conducting background checks on buyers under the age of 21.
The letter also asked the administration to address the background check loophole by clarifying who is considered “engaged in the business” of selling firearms. The Bipartisan Safer Communities Act updated federal law, requiring anyone who sells guns for profit to be licensed. The coalition argues that by issuing a new rule, the ATF could clarify who qualifies as a firearms dealer and, therefore, who must conduct background checks on gun buyers.
Much of Biden’s rhetoric on guns has been focused on his intent to reinstate the assault weapons ban that he helped pass in 1994 as senator, but which lapsed in 2004.
But Peter Ambler, executive director of Giffords, which sent its own, separate memo to the White House on Monday, said the narrow focus on the ban reduces the need to talk about other weighty issues like background check loopholes and the need for investment in community violence intervention.
“Because when you just say assault weapons, honestly, you just think about mass shootings But gun safety solutions are also critical to combatting crime, intervening in cycles of community violence, addressing suicide, and more,” Ambler said. Along similar lines, the coalition’s letter asked the president to use his office “to communicate the scope of this crisis.”
And though the president doesn’t appear to have the votes for an assault weapons ban in Congress, the groups argue that Biden has tools at his disposal to further limit the proliferation of these guns in the U.S., including by fully enforcing the importation ban of foreign-made assault weapons that do not have a “sporting purpose.” As Giffords notes in its memo, the ATF, which oversees the importation of guns in the U.S., “has not conducted a comprehensive review of semi-automatic assault rifles and handguns under the sporting purposes test” since the Clinton administration.
The groups also are seeking a leader in the White House to oversee this work. Right now, the White House, Department of Justice and ATF are working in silos, Ambler said, and could benefit from greater capacity and coordination across agencies.
Susan Rice, whose portfolio as head of the White House Domestic Policy Council spans across a multitude of issues, is primarily seen as the point-person on gun policy. White House policy adviser Stefanie Feldman also works extensively on the issue. Tuesday’s letter specifically asks the president to establish a federal office of gun violence prevention, a move that would ensure someone is “driving this issue every single day,” said Volsky, who has routinely pushed the White House to place a gun-policy centric portfolio under a cabinet-level aide.
“They’ve clearly failed to do so thus far,” he said. “And so we’re using this opportunity — in light of all the recent tragedies — to call on him not to just ask Congress to do something, but to also do more himself.”

The new law, which Gov. Phil Murphy signed in December, revamped the state’s gun carry application process and requirements, and established “sensitive places” where guns could not be carried. The law was in response to the U.S. Supreme Court’s ruling in June which drastically expanded the scope of who could carry guns outside the home.
A legal challenge was filed immediately after Murphy signed the measure into law.
New York enacted a similar law prohibiting where guns can be carried, but that law is also the subject of ongoing litigation.
Gun rights groups did not get everything they sought from Bumb. For example, the judge said the plaintiffs did not have standing to challenge the prohibition of guns being carried in zoos, medical facilities, airports and on movie sets. Gun rights groups also wanted her to block the prohibition of carrying guns on playgrounds. Bumb denied that request, declaring that playgrounds were analogous to schools — area courts have suggested guns cannot be carried.
Challenges to those provisions of the law, however, are expected to resurface in later phases of the litigation.
“This marks the beginning of the end for Governor Murphy’s blatantly unconstitutional new carry law, which is going down in flames,” Scott Bach, executive director of the Association of New Jersey Rifle & Pistol Clubs, said in a statement. “Murphy has clearly demonstrated that constitutional issues are indeed above his pay grade.”
In her 46-page opinion, Bumb, sitting in Camden, wrote that the state failed to provide evidence that some “sensitive places” defined in the law were analogous to “a historical tradition of firearm regulation,” the legal standard for bearing guns being carried somewhere.
Democratic leaders have insisted the new law is consistent with the constitution and the Supreme Court’s June ruling. Senate President Nick Scutari and Assembly Speaker Craig Coughlin, who played a key role in crafting the law, had their motion to intervene in the case to defend the law approved on Monday.
“Our law pursues common sense boundaries that keep dangerous weapons out of places of learning and recreation where there are children, families, and folks going about their lives in peace,” Coughlin said in a statement. “I am disappointed, but we have joined the lawsuit to ensure our voice is heard in the legal process and look forward to the full law taking effect to keep our communities safe.”
In separate statements, spokespeople for Murphy and Attorney General Matt Platkin also said they were “disappointed” by Bumb’s ruling.
“We are disappointed that the court invalidated common-sense restrictions on the right to carry firearms in public, which are fully consistent with the Second Amendment,” Murphy spokesperson Tyler Jones said. “We look forward to being able to appeal the ruling and are confident that it will be reversed.”
“We are disappointed that the court has undermined important and longstanding protections against firearms violence in our public parks and in casinos,” Platkin said. “Today’s order is bad for public safety and inconsistent with the Second Amendment. But these orders remain temporary, and we look forward to pressing our case, including ultimately on appeal.”

California has some of the most stringent gun policies in the nation, which the governor says helps explain why the state has a gun death rate 37 percent below the national average. Some of those restrictions, however, are in jeopardy following a Supreme Court decision in June on a concealed carry law in New York that invited challenges on a wide range of firearm laws.
Even with California’s laws, people can just bring weapons into the state from elsewhere — which is why Congress should take actions such as restricting the size of magazines and banning assault weapons, Newsom said.
“We can’t do this alone,” Newsom said. “And with all due respect, we feel like we are.”
The governor made the trip to Half Moon Bay, south of San Francisco, after the killing of seven farmworkers Monday, apparently by another worker. It came less than 48 hours after the attack by a gunman at a dance hall during a Lunar New Year celebration in Monterey Park, a small city east of downtown Los Angeles.
Newsom had harsh words for McCarthy, who represents the Bakersfield area, for not making any public statements addressing either shooting.
“I’m still waiting for Kevin McCarthy, the leader of the House of Representatives, who purports to represent the people of the state of California,” he said. “We haven’t heard one damn word from him, not since Monterey Park, not what happened here, not one expression of prayers, condolences, nothing, and it should surprise nobody.”
The Speaker addressed the shootings at a press gaggle on Tuesday in the Capitol, around the same time Newsom was speaking in Half Moon Bay.
“Let me begin by expressing my condolences to the families in California with the recent violence over the last couple days,” McCarthy told reporters.
Newsom said he was in the hospital in Southern California visiting victims and family members when he was pulled aside and informed of the second shooting in Half Moon Bay.
The governor, like others in his party, has doubled down on the need for gun restrictions in the wake of the Supreme Court’s decision. Last year the Democrat-dominated legislature passed a dozen more restrictions, and new bills are in the works for this year.
While the state does have a lower rate of gun death than the national average, it’s been impossible to insulate it from tragedies like the ones seen this week. Increasingly, California Democrats have been looking to Washington to place protections in areas that state policies simply can’t cover.
“We can figure this out — we can,” Newsom said. “We know what to do. It’s not complicated. We do. And we don’t have to do this again and again and again.”

Canberra: More than 17,000 weapons were surrendered in the first year of Australia’s permanent national firearms amnesty, the government revealed on Saturday.
The government released the first annual report on the amnesty program, which allows Australians to hand in unregistered, illegal or unwanted weapons without facing punishment, revealing 17,543 weapons were surrendered in the first 12 months, reports Xinhua news agency.
The permanent amnesty was set up in mid-2021 following temporary programs in the wake of the Port Arthur massacre in 1996 and again in 2017.
According to the Australian Criminal Intelligence Commission, there are approximately 260,000 illicit firearms in circulation in Australia.
Among the weapons handed in between July 2021 and June 2022 were 8,140 rifles, 2,896 shotguns and 789 pistols.
“It is an important measure to reduce the number of firearms circulating in our community, and keep Australians safe,” the country’s Attorney-General Mark Dreyfus said on Saturday.
District Development Commissioner Doda issued an order on Tuesday stating that all those licence holders have not yet uploaded their gun licences on the NDAL portal (online), which is why these licences have not been renewed yet.
According to the order—a copy of which lies with The Chenab Times—it states that some gun licence holders have expired but their licences have not been transferred to any of their legal heirs.
“Therefore, the concerned licence holders / legal heirs of licence holders are hereby directed to submit the complete details particulars of licence holder alongwith the photocopy of such licences in the Judicial Section of the Office of District Magistrate, Doda within a period of 15 days, failing which no application for uploading on the online portal and renewal / transfer of such licences shall be considered (as and when the facility will be open) for which the gun licence holder shall be personally responsible,” it added.
