PMO need not furnish degree certificates of PM Modi: Gujarat HC

    [ad_1]

The Gujarat High Court ruled on Friday that the degree and post-graduate degree certificate of Prime Minister Narendra Modi are not required to be provided by the Prime Minister’s Office (PMO).

Judge Biren Vaishnav’s one-judge panel overturned the Chief Information Commission’s (CIC) directive to the PMO, Gujarat University, and Delhi University PIOs to provide information about Modi’s undergraduate and graduate degrees.

Delhi chief minister Arvind Kejriwal was also charged 25,000 rupees in expenses by the Gujarat high court for his request for the PM’s degree certificate’s specifics. The Gujarat University appealed the Chief Information Commission’s decision, and the high court was now hearing it.

“In a democracy, there won’t be a difference if a person holding the office is a doctorate or an illiterate. Also, there is no public interest involved in this issue. Even his privacy is affected”, legal website Bar and Bench quoted Solicitor General Tushar Mehta, who was appearing for the university.

Prime Minister Narendra Modi stated that he earned his undergraduate degree from Gujarat University in 1978 and his postgraduate degree from Delhi University in 1983.

Kejriwal’s lawyer Percy Kavina argued that, “If you see the nomination form (filed during elections), it mentions his educational qualifications. Thus, we are asking for a degree certificate and not his marksheet”.

  • Gujarat: 8 AAP workers held for putting up anti-Modi posters

Gujarat: 8 AAP workers held for putting up anti-Modi posters

    [ad_1]

Ahmedabad: Eight workers of the Aam Aadmi Party (AAP) have been arrested for allegedly putting up posters saying “Modi Hatao Desh Bachao” in different parts of Ahmedabad city in Gujarat, police said on Friday.

The Gujarat unit of AAP condemned the arrests saying the action has proved their point that “democracy is in danger”.

In a release, the city crime branch said eight persons have been arrested on the charge of damaging public property by putting up posters with the text “Modi Hatao Desh Bachao” in areas like Isanpur, Maninagar, Vatva, Narol and Vadaj. The posters were put up by the AAP workers on Thursday, it said.

The arrests were made on Thursday night after the registration of first information reports (FIRs) in different police stations earlier in the day, said the release.

Police have identified the AAP workers as Natwar Thakor, Jatin Patel, Kuldeep Bhatt, Bipin Sharma, Ajay Chauhan, Arvind Chauhan, Jivan Maheshwari and Paresh Tulsiani.

AAP’s Gujarat vice president Sagar Rabari said though the party posted such posters in many other states on Thursday, only Gujarat police booked their workers.

“Ahmedabad is the only city where people are deprived of their Constitutional rights because police can arrest you anytime and book you as per their whims and fancies. This police action proves that our apprehension that democracy is in danger is not misplaced and we were not wrong in carrying out that poster drive,” said Rabari.

In last year’s Gujarat Assembly elections, AAP won five seats and secured 13 per cent of the popular vote, in a performance that belied its high-decibel campaign in the state. BJP registered a record 156 wins in the house of 182 seats.

IPL 2023: CSK captain MS Dhoni may miss opening match against Gujarat Titans, here’s why – Report

    [ad_1]

New Delhi: The Chennai Super Kings captain attended the IPL captain’s meet in Ahmedabad on Thursday and seemed to be in good spirits.

Mahendra Singh Dhoni, captain of the Chennai Super Kings, is questionable for Friday’s first game of the Indian Premier League 2023 against the Gujarat Titans in Ahmedabad owing to a soreness in his left knee, according to The Indian Express.

According to the source, Dhoni is experiencing pain and does not want to risk further injury because of the team’s current lack of wicketkeepers. When asked for comment, though, the franchise declined.

Meanwhile, Dhoni was present at the captain’s meet held at the Narendra Modi Stadium earlier that day. Rohit Sharma, captain of the Mumbai Indians, was absent due to sickness.

Dhoni has been putting in a lot of work in Chepauk in preparation for the IPL. The 41-year-old still seemed to be in peak physical condition.

It would be intriguing to watch who takes charge of the team if Dhoni is unable to play on Friday. Ben Stokes should be considered for the captaincy. In seven games last year, Ravindra Jadeja was the captain.

At CSK’s training session on Thursday, Dhoni reportedly did not bat at nets but instead spoke with Gujarat Titans coach Gary Kirsten, with whom he won the ODI World Cup in 2011.

It has also been learned that the decision on whether or not to include Dhoni in the starting Eleven will be made on the morning of the game. Devon Conway might maintain wickets if he makes the starting eleven. Either Ruturaj Gaikwad or Ambati Rayudu will wear the gloves if the New Zealand international is left off.

Dhoni’s left knee, it has been said, has been giving him trouble over the last few days. During CSK’s intra-squad encounter on Monday, Dhoni was reluctant to step out to bat and was spotted sitting with a knee cap.

As he attempted to go for a two, he would hobble and struggle to get there.

  • Will install 5G mobile jammers in jails for better security: Gujarat govt tells Assembly

Will install 5G mobile jammers in jails for better security: Gujarat govt tells Assembly

    [ad_1]

Gandhinagar: In the wake of recovery of mobile phones from some jails during a recent search operation in Gujarat, the state government on Wednesday informed the Legislative Assembly that it has now decided to install more powerful jammers that can block even 5G mobile signals.

In a mega overnight operation on March 25, the Gujarat police conducted simultaneous searches at 17 jails across the state, during which mobile phones were recovered from three jails, said Gujarat Minister of State for Home, Harsh Sanghavi, in the Assembly on the last day of the Budget session.

The police teams had found 16 mobiles, 10 electronic items, 29 lethal objects and even narcotics during the mega drive, he said.

The minister was speaking on this issue under rule 116 of the Assembly, which deals with “matters of urgent public importance”.

During this surprise search operation across the state, police teams also found tobacco products and a pen drive from the prison barracks. Of the total 17 jails searched, including Ahmedad’s Sabarmati central jail, nothing suspicious or illegal was found from five jails, Sanghavi said.

“At present, jammers which can block 2G mobile signals are installed in our jails. Such jammers have their limitations because phones available in the market today are even 5G-enabled. Hence, for better security, we have decided to install jammers that can block even 5G signals in our jails,” he told the House.

The search operation, in which 1,700 police personnel were involved, began on Friday night. The intention behind the move was to check if any illegal activity was taking place there and also to ensure that the inmates are getting facilities they are entitled to as per the law, the minister added.

According to him, the home department has already initiated a probe against officials of those jails where such illegal items were recovered from the inmates.

  • CAG points out several flaws in Gujarat govt’s financial management

CAG points out several flaws in Gujarat govt’s financial management

    [ad_1]

Gandhinagar: The Comptroller and Auditor General of India (CAG) has pointed out several flaws in the financial practices of the Gujarat government and said there was a need to formulate a realistic budget based on the needs of the departments.

The “State Finance Audit Report of the CAG for the year ended March 31, 2022” was tabled on the floor of the Gujarat Assembly on Wednesday, the last day of the month-long budget session.

Pointing out that financial accounts of 2021-22 were “affected” as capital expenditure was overstated and revenue expenditure understated, the CAG said, “The state government needs to formulate a realistic budget based on the needs of the departments and their capacity to utilise the allocated resources.”

“An appropriate control mechanism may be instituted by the government to enforce proper implementation and monitoring of budget so that large savings within the grant or appropriation are controlled, and anticipated savings are identified and surrendered within the specified timeframe,” it added.

The national auditor observed that though departments demand additional funds for different schemes and activities; they “finally end up spending less than the original budget provision and the supplementary provision or parts thereof. As a result, the unutilised funds cannot be made use of”.

The CAG noted that some departments could not utilise more than 50 per cent of the original provision (Rs 50 crore or more), leading to savings of Rs 3,528.83 crore at the end of the year in 21 schemes.

As per the Gujarat Budget Manual-1983, rush of expenditure, particularly in the closing months of the financial year, is a breach of financial propriety, the CAG said.

However, the CAG report revealed that expenditures in March were significantly higher than that of other months during the financial year 2021-22.

In some cases, CAG noted that 50 per cent of the total expenditure for a particular work was spent in March, while nominal funds were spent in the three previous quarters.

The CAG also noted that under 124 sub-heads, 100 per cent expenditure (Rs 4,747.17 crore) was incurred in March 2022.

“Thus, contrary to the spirit of financial regulation, substantial expenditure was incurred by the state government at the end of the financial year, indicating inadequate control over expenditure and poor budgetary management,” it added.

The CAG found a major flaw in the allocation of funds by the Health and Family Welfare Department in running “HLT 29 Epidemics Diseases Programme” in the state.

Though non-communicable diseases (NCD) do not come under epidemics, a provision of Rs 50 lakh was made under HLT 29 for NCD in 2019-20, 2020-21 and in 2021-22.

“Similarly, a budget provision of Rs 20 lakh was made under HLT 29 for Thalassemia every year during 2019-20, 2020-21 and 2021-22 though it is not an epidemics/communicable disease. Provision for NCD and Thalassemia could have been made under the general planning instead of under HLT 29 epidemics,” said the CAG.

The CAG also pulled up the Finance Department over the issue of “non-submission of information as well as accounts regarding grants and loans paid to various institutions”.

“Non-submission of 4,563 Utilisation Certificates amounting to Rs 10,309.47 crore within the specified period not only weaken the financial accountability mechanism but also indicate failure of the departmental officers to comply with the rules and procedures to ensure timely utilisation of grant for the intended purpose,” it said.

Non-submission of accounts by autonomous bodies and authorities violated the prescribed financial rules and directives. These point to inadequate internal controls and deficient monitoring mechanisms of the state government, the report said.

The CAG further suggested that the “state government needs to institute a rigorous monitoring mechanism to ensure that the Departments comply with the prescribed rules and procedures regarding submission of utilisation certificates”.

According to the CAG, Article 205 of the Constitution of India states that no money shall be drawn from the Consolidated Fund except under appropriation made by law by the state legislature.

However, “excess expenditure of Rs 14,367 crore pertaining to the period from 2007-08 to 2011-12 and 2013-14 to 2021-22 had escaped legislative oversight, as it was pending regularisation as per Article 205”, the auditor noted, adding that excess expenditure over provision vitiates the system of budgetary and financial control.

  • Gujarat judge nixes 3-month jail for Mevani, 9 others in 2017 case

Gujarat judge nixes 3-month jail for Mevani, 9 others in 2017 case

    [ad_1]

Mehsana: A sessions court in Gujarat’s Mehsana district on Wednesday set aside a lower court order sentencing Congress MLA Jignesh Mevani and nine others to three months in jail in a 2017 case of taking out a public rally without police permission, noting debates and bona fide criticism of government actions are essential for the existence of democracy.

In its judgment, the sessions court also quoted former US President Abraham Lincoln, “Those who deny freedom to others deserve it not for themselves, and under a just God, cannot long retain it.”

Observing that the entire case of prosecution was baseless and without any substance or evidence, Additional Sessions Judge CM Pawar allowed the appeal of Mevani, Aam Aadmi Party (AAP) leader Reshma Patel, and others against the May 2022 order of a judicial magistrate court which had found them guilty under sections 143 (unlawful assembly) of the Indian Penal Code (IPC).

Following the conviction, the magistrate’s court had sentenced them to three months in jail.

The case dates back to July 2017 when an FIR (first information report) was lodged against Dalit rights activist Mevani and others at the Mehsana ‘A’ division police station for taking out an “Azadi march” from Mehsana town to Dhanera in Banaskantha district without police permission.

The rally was organised in support of rights of landless farmers of the region.

While setting aside the lower court’s order, the sessions judge observed that “deliberations, discussions, debates and bona fide dissent against policies of government and even bona fide criticism of action of government are essential for the existence of democracy in the nation.”

It also flagged the issue of misuse of power and process of law by authorities for suppressing the voice of people, and noted showing “dominance of power” is not unknown even in a democratic set up.

In a democracy, elected leaders are not meant to rule over people but to serve them, observed the sessions court.

“It is the pious duty of the ruler of every democratic nation to protect the rights of citizens without any fear of criticism for survival of the ethos of democracy in the nation,” it said.

Judge Pawar said if dissent or peaceful protest is branded as an offence in a democracy, then the right of freedom will have no place.

The accused persons had sought permission from authorities to organise a rally under the banner of Rashtriya Dalit Adhikar Manch to air grievances of members of the Dalit community.

Permission for the event was first granted by the executive magistrate via an order dated June 27, 2017, and later cancelled on July 7 on grounds of public disorder.

Despite this, the organisers decided to go ahead with their planned rally and were subsequently booked by the police under IPC section 143 (unlawful assembly).

At that time, Mevani was the independent MLA from Vadgam in Banaskantha district. The prominent Dalit leader was elected from the same Assembly seat in the December 2022 polls on a Congress ticket. He is also a working president of the Gujarat Congress.

An Ahmedabad court in September last year sentenced Mevani and 18 others to six months’ simple imprisonment in a 2016 case of rioting.

SRINAGAR: The wife of Kiran Patel, a conman who was arrested in Jammu and Kashmir for impersonating a high-ranking official from the Prime Minister’s Office (PMO), was taken into custody on Tuesday for attempting to illegally acquire an elderly citizens residence, reports appearing in media said.

As per a release by Ahmedabad city crime branch, Malini Patel was apprehended from a relative’s residence in Jambusar town of Bharuch district. A few weeks after her husband’s detention in Srinagar Kashmir, an initial information report (FIR) was filed against the couple on March 22, following which Malini Patel had been on the run.

According to the release, Malini Patel, who had previously been arrested in 2017 for cheating and criminal conspiracy charges filed against her at Naroda police station in Ahmedabad, has been taken into custody once again. It was stated that Kiran Patel, her husband, has faced similar charges in at least four cases in Gujarat and has previously also been detained.

Bihar woman teacher found taking salary for 5 months while in Gujarat

    [ad_1]

Patna: A woman assistant teacher in Bihar’s Khagaria district was found taking salary for the past 5 months while staying in Gujarat, an Education Department official said on Tuesday.

The incident came to light when Block Education Officer Ram Uday Mahto went to the government primary school located at ward number 4 and found the teacher, named Seema Kumari, absent for a few months. She was deployed at this school on deputation.

“When we enquired with the department, it appeared that the department is releasing the monthly salary on the basis of attendance being shown by the headmaster of her original middle school located at Bhadas village,” Mahto said.

“The primary school was sending the absentee report to her original school located at Bhadas village. Headmaster Vikas Kumar of the school converted her absentee attendance into attendance. On this basis of her attendance, the department was issuing her salary from September 2022.

“We have sent the report to the District Education Officer with the recommendation of stopping the salaries of Seema Kumari and Vikas Kumar. The department has done it,” he added.

Sources have said that more than 400 teachers are on the radar of the Education Department for using the deputation ploy to take salaries without going to work at school for a a single day.

Police cavalcade with Atiq Ahmad leaves for Gujarat jail after conviction by UP court

    [ad_1]

Prayagraj: A police cavalcade carrying gangster-politician Atiq Ahmad left for the Sabarmati Central Jail in Gujarat Tuesday evening, hours after he was sentenced to rigorous life imprisonment in a 2006 kidnapping case by a court in Prayagraj in Uttar Pradesh, a senior official said.

Ahmad was brought from the Sabarmati Central Jail by road for the hearing in the MP-MLA court here. He was kept at the Naini Central Jail in Prayagraj before the hearing.

“As per the orders of the honourable court, Atiq Ahmad has left for Sabarmati Central Jail,” Naini Jail Senior Superintendent Shashikant told PTI.

When asked about Ahmad’s brother Khalid Azim alias Ashraf, who was acquitted in the case, Shashikant said he has “left for Bareilly”.

Ashraf, lodged in the Bareilly District Jail since July 2020, was brought to the Naini Central Jail on Monday evening amid tight security arrangements for his production in the court.

A former Samajwadi Party MP from Phulpur, Ahmad was shifted to Sabarmati Central Jail in Gujarat in June 2019 following a Supreme Court order after he was accused of orchestrating the kidnapping and assault of real estate businessman Mohit Jaiswal from a prison in Uttar Pradesh.

Tuesday’s conviction of Ahmad was his first in over 100 cases registered against him over the years.

Special MP-MLA court judge Dinesh Chandra Shukla held Ahmad, Saulat Hanif, a lawyer, and Dinesh Pasi guilty under IPC Section 364-A (kidnapping or abduction in order to murder) for kidnapping Umesh Pal in 2006.

“The court has awarded the three rigorous life imprisonment and Rs 1 lakh fine to each,” Government counsel Gulab Chandra Agrahari said.

The amount will be given to the family of Umesh Pal, a witness in the 2006 BSP MLA Raju Pal murder case who was gunned down last month. Ahmad and his brother Ashraf are also accused in the murder case.
