  • SC notice to UP govt on disqualified Abdullah Azam Khan’s plea for stay on conviction

SC notice to UP govt on disqualified Abdullah Azam Khan’s plea for stay on conviction

    [ad_1]

New Delhi: The Supreme Court on Monday sought response from the Uttar Pradesh government on a plea by Samajwadi Party leader Azam Khan’s son challenging the high court refusal to stay his conviction in a more than a decade-old case, which led to his disqualification as an MLA.

An advocate, representing Mohammad Abdullah Azam Khan, submitted before a bench headed by Justice Ajay Rastogi that his client was a juvenile when the incident took place.

The bench, also comprising Justice Bela M. Trivedi, said that the court was not examining petitioner’s juvenility, rather looking at his prayer seeking stay on conviction. The top court was informed that the election to Suar assembly constituency, which has been vacant after Khan’s disqualification, is scheduled for May 10.

    MS Education Academy

Khan filed an appeal in the apex court challenging the April 13 order of the Allahabad High Court, which declined to stay his conviction.

The bench issued notice to the UP government and sought its reply, and made it clear that the election will be subject to the outcome of the petition.

It asked Additional Solicitor General K.M. Nataraj, representing the UP government: “Can we test the morality of an individual, convicted and sentenced? Can he not be an elected representative?”

The bench said the state has to demonstrate prima facie that he has done a crime in his own capacity. Nataraj submitted that he will file his response to the appeal filed by Khan.

After hearing submissions, the bench said: “Let the counter be filed. Let the election to be held on May 10 be subject to the outcome of this special leave petition.” It has scheduled the matter for further hearing in the second week of July.

In February, Khan was awarded two years’ imprisonment in the case by a Moradabad court. His conviction led to his disqualification as MLA.

It has been alleged that Khan and his father had blocked traffic after their vehicle was stopped by the police for checking.

A criminal case was registered in 2008 against Khan and his father Azam Khan at Chhajlet police station in Moradabad under sections 341 and 353 of the IPC.

  • Nothing wrong in spreading Christianity, no case of forceful conversion: TN govt to SC

Nothing wrong in spreading Christianity, no case of forceful conversion: TN govt to SC

    [ad_1]

New Delhi: The Tamil Nadu government has told the Supreme Court there is nothing wrong in the acts of missionaries spreading Christianity as Article 25 of the Constitution guarantees every citizen the right to propagate his religion.

The M.K. Stalin government said, “Conversion of poor people to other religions by intimidating, threatening, deceivingly, luring through gifts and also by using black magic and superstition are not reported in Tamil Nadu.”

In an affidavit to a PIL filed by advocate Ashwini Kumar Upadhyay, the DMK government said: “As far as Tamil Nadu is concerned, there have been no incidents of forceful conversion reported in the past many years. The allegations raised by the petitioner…are alleged to have taken place only in certain tribal areas in Madhya Pradesh, Odisha and India’s Hindi belt and therefore even according to the petitioner, it does not apply to the State of Tamil Nadu”.

    MS Education Academy

The state government contended that Article 25 of the Constitution guarantees every citizen the right to propagate his religion, therefore the acts of missionaries spreading Christianity by itself cannot be seen as something against law. “But if their act of spreading their religion is against public order, morality and health and to the other provisions of Part III of the Constitution it has to be viewed seriously,” it said.

The DMK government contended that the citizens are at liberty to choose the religion they want to follow.

“The Constitution does not give a fundamental right to any person to turn another man into one’s own religion. But it gives a right to any person to propagate his religion. Likewise, the Constitution does not prevent any person from getting converted to the religion of his choice. The citizens of the country should be allowed freely to choose their religion and it would not be appropriate for the government to put spokes to their personal belief and privacy,” it said.

The state government submitted that the petitioner has made sweeping allegations against it saying that the government was determined to remove the conversion angle from the case of Lavanya’s suspicious death.

“The petitioner, who belongs to the Bharatiya Janata Party, has attempted to convert the court proceeding into a political fight by bringing in ideological politics into the matter. All the allegations made against the Government of Tamil Nadu are politically motivated. There are no instances of forceful conversion of religion reported in Tamil Nadu…,” it said.

The DMK government contended that the state shall have the responsibility to take measures against persons who deliberately and maliciously intend to outrage the religious feelings of any class by insulting their religion or religious beliefs.

The state government said: “One of the rights guaranteed by the Indian Constitution is the right to Freedom of Religion. As a secular nation, every citizen of India has the right to freedom of religion, i.e., the right to follow any religion.”

It said, “As one can find so many religions being practiced in India, the Constitution guarantees to every citizen the liberty to follow the religion of their choice. According to this fundamental right, every citizen has the opportunity to practice and spread his religion peacefully. The right to have faith in a particular religion can be traced under Article 21 of the Constitution and it is an inviolable right”.

Many states have passed their own version of the anti-conversion laws and some are still in existence. The Tamil Nadu government said the anti-conversion laws are prone to misuse against minorities and there is no data on convictions under the various anti conversions’ laws of the states.

“In 2002, the State of Tamil Nadu passed the Tamil Nadu Prohibition of Forcible Conversion of Religion Act, 2002 (Tamil Nadu Act 56 of 2002). However, the same was repealed by the Tamil Nadu Prohibition of Forcible Conversion of Religion (Repeal) Act, 2006 (Tamil Nadu Act 10 of 2006) due to popular opposition. In the year 2003, the State of Gujarat passed the Gujarat Freedom of Religion Act, 2003. In 2017 and 2018, Jharkhand and Uttarakhand States passed anti-conversion laws, respectively. In 2021, the Karnataka State Legislative Assembly passed the Karnataka Protection of Right to freedom of religion bill”, said the state government.

In connection with Upadhyay’s plea, the state government said: “The prayers sought by the petitioner in the present writ petition do not only attack a specific community with intentions to divide the society through hate, fuelling religious intolerance in the country, bringing disharmony in the society.”

Upadhyay moved the apex court seeking a direction to declare that fraudulent religious conversion and religious conversion by intimidation, threatening, and deceivingly luring through gifts and monetary benefits offends Articles 14, 21 and 25.

  • Govt should work to realise Ambedkar’s ideals: KCR at TS Secretariat launch

Govt should work to realise Ambedkar’s ideals: KCR at TS Secretariat launch

    [ad_1]

Hyderabad: The new Secretariat of Telangana has been named after B R Ambedkar with the intention that people’s representatives and the entire government machinery should work to realise the ideals of the Architect of the Indian Constitution, Chief Minister K Chandrasekhar Rao said on Sunday.

Rao inaugurated the new Secretariat complex, which stands 265 feet tall and is spread over an area of 10, 51,676 square feet in a sprawling of 28 acres of land here.

Speaking after the inauguration, the Chief Minister said he considered it the opportunity of a lifetime to have inaugurated this “magnificent secretariat complex”.

    MS Education Academy

“In order to take forward his (BR Ambedkar) ideals, to make all the employees and ministers who regularly come to the Secretariat to remember his name and keep his message in mind while working, we named our Secretariat, the epicenter of the State administration after BR Ambedkar,” Rao said.

He further said that the Telangana agitation for a separate state had been peaceful following Gandhian ideology, and statehood was achieved due to Ambedkar’s vision of enshrining Article 3 in the Constitution.

Slamming his detractors, KCR said rebuilding of Telangana does not mean that old structures will be demolished and new edifices will be erected.

“I want to tell some (political) dwarfs who do not know about the reconstruction of Telangana. Reconstruction of Telangana means reviving all the lakes in the State that remained dry due to lack of attention in the undivided Andhra Pradesh,” he said.

He alleged that some forces, which could not digest the urge for reconstruction of Telangana, failed to see the overall development that the State is achieving.

Recalling the Telangana development, KCR said the State attracted investments worth lakhs of crores of rupees and was making rapid strides in the IT sector, even surpassing Bangalore as its hub.

The Chief Minister said the total paddy cultivation in the State stood at 56 lakh acres against 94 lakh acres all over the country during the current Yasangi (Rabi season).

He said that the earlier Planning Commission (since replaced by NITI Aayog) had kept nine districts of Telangana under the backward districts category, but now there were no villages as progressive as those of Telangana.

According to the Chief Minister, the per capita income of Telangana is the highest among all States in India even as per capita power consumption is also high which are the growth indicators and good economic development.

The Chief Minister thanked officials and stakeholders for striving hard for the development of the State.

A ‘Sudarsana Yagam’ was performed from 6 AM and Rao occupied his chambers in the sixth floor after the rituals concluded at around 1.30 PM. The Ministers of the State government also occupied their respective chambers.

Considering the inadequacies of the former Secretariat complex built during undivided Andhra Pradesh, a government-appointed expert committee favoured construction of a new building.

The Chief Minister had laid the foundation stone for the construction of the Secretariat on June 27, 2019 but the works started only in January 2021, delayed by the covid-19 pandemic, court cases and other issues.

The building stands 265 feet tall, and a press release issued by the government said no state had such a tall Secretariat. It is also one of the largest Secretariats in the country, the release added.

The domes of the new Secretariat have been built in the styles of the Neelakanteswara Swamy temple of the Kakatiya period in Nizamabad, designs of the palaces of the royals of Wanaparthy ‘Samsthanam’ in Telangana and the pattern of the Hanuman temple in Sarangpur, Gujarat, according to the release.

The construction was done “flawlessly” with the instructions of Roads and Buildings (R&B) department, IGBC (Indian Green Building Council), Telangana State Technological Services and the State police department, the release added.

The program has already been successfully implemented in nine anaemic districts.

A total of 13.08 lakh kits will be distributed through 1046 centres to 6.84 lakh pregnant women in 33 districts across the state.

Each kit is worth two thousand rupees, and the total estimated cost is Rs. 277 crores.

The kit includes 1kg nutrition mix powder, 1kg dates, 3 bottles of iron syrup, 500gm ghee cup, 200 gm Palli patti, and a plastic basket.

Harish Rao expressed his gratitude to the chief minister for launching the program and focusing on maternal and child care. He stated, “KCR kit for newborn baby, Nutrition kit for mother. Nutrition kits will be a boon for pregnant women.”

The program aims to reduce maternal mortality, which has already seen a significant decrease in Telangana, from 92 in 2014 to 43 at present, according to the central government’s sample registration survey. The expansion of the KCR Nutrition Kit program, along with four ANC checkups, KCR kits, Amma Oddi Vehicles, and the establishment of Mata Shishu Care Centers, will help further protect the maternal system in the state.

People of J-K can’t be deprived of elected govt for long time: Azad

    [ad_1]

Srinagar: Democratic Progressive Azad Party (DPAP) chairman Ghulam Nabi Azad on Sunday said that the time has come for the assembly elections in Jammu and Kashmir and it is undemocratic to deprive the people of an elected government for a long time.

The former Union minister said that DPAP is a party that believes in democratic values and will ensure that various pro-people initiatives are launched to benefit the weaker sections of people in our society if elected to power.

“If the DPAP is elected to power we will ensure the poor are provided free electricity and other benefits so that they won’t face burden on their budget. We will also work to create diverse economic opportunities in various sectors including tourism, agriculture and horticulture so that the economy of common people improves,” he said while addressing a public gathering at Bandipora.

    MS Education Academy

Azad said that when he was the Chief minister of the erstwhile state of Jammu and Kashmir, he granted the district status to Bandipora, opened hospitals, colleges and set up a long network of roads to benefit the people.

However, it has been a long time since then and the development in the district seems at a halt now and successive governments have overlooked the growing infrastructural requirements of the district, he said.

Azad said that unlike other people, he would not make false promises and keep people in the dark.

“I will make promises and will deliver on them unlike most of the politicians who visit you and make a number of promises never to deliver,” he said.
