Why don’t you lodge FIR against MLAs who took money from Shah: LoP to Gehlot

    [ad_1]

Jaipur: Rajasthan Chief Minister Ashok Gehlot’s statement about MLAs taking money from Union Home Minister Amit Shah has triggered a political controversy in the state.

A political backlash has started over Gehlot’s statement advising the MLAs of former deputy CM Sachin Pilot’s camp to return the money taken from Amit Shah.

Leader of Opposition Rajendra Singh Rathore targeted Gehlot and said, “Why the MLAs whom the Chief Minister accuses have been made ministers, the public understands all equations. If your MLAs took money then why are you not taking action against them?”

    MS Education Academy

Rathore said “CM Ashok Gehlot is reciting the old drama again. His MLAs who went to Manesar took money, he lodged an FIR at that time and on the instructions of the Chief Minister, who is also the Home Minister, an FR was also lodged. When he is fully aware which of his MLAs took how much money and where it was used, then why is the Chief Minister seeing such a big crime happening as the Home Minister? Why doesn’t he register an FIR? The people of Rajasthan are seeing the difference between words and actions very well with their own eyes,” he added.

Two years have passed, why are you not releasing the list of MLAs who were sold, Rathore said adding, “The MLAs who were traitors in your eyes are sitting in the cabinet. ACB and SOG registered cases in the phone tapping case, FIR No. 47, 48, 49, 129 was also lodged on your instructions and now you are making allegations. The MLA who was a cheater in your eyes is sitting in the cabinet today.”

Gehlot on Sunday had said our MLAs should return the money taken from Amit Shah. Gehlot had said that Amit Shah, Dharmendra Pradhan and Gajendra Singh Shekhawat conspired together to topple our government. Money was distributed to the MLAs in Rajasthan. These people are not taking the money back. I am worried, why are they not taking the money back? I even told our MLAs that those who have taken 10 crores, 20 crores, have spent some of it, then I will give that spent portion, I will get it from AICC. You give the money back to Amit Shah. Don’t keep his money, if you keep his money then there will always be pressure on you.

Security to 7 women wrestlers who lodged FIR against WFI prez Bhushan

    [ad_1]

New Delhi: The Delhi Police on Sunday provided security to all seven women wrestlers who have lodged complaints against Brijbhushan Sharan Singh, the president of the Wrestling Federation of India.

The Supreme Court had asked the Delhi Police to provide appropriate security to the victims who have levelled allegations against Singh.

The Delhi Police have also called all the women wrestlers to join the probe and get their 161 CrPC statement recorded so that they could decide the future course of action.

    MS Education Academy

Sources said that in a day or two the women wrestlers can come to Delhi Police’s Connaught Place Police Station to get their statements recorded.

On Saturday, a copy of one of the two FIRs lodged against Singh was handed over to the top grapplers who are protesting at the Jantar Mantar here.

However, the copy of the other FIR registered under the Protection of Children from Sexual Offences (POCSO) Act has not been given to the wrestlers as it will be handed over to the victim’s family, the police added.

A senior police official said that they will soon record the statements of the victims.

On Friday evening, police registered FIRs against the WFI president in response to the allegations made by the women wrestlers.

  • FIR filed against Shekhawat for his ‘Ravana’ remark against Gehlot

FIR filed against Shekhawat for his ‘Ravana’ remark against Gehlot

    [ad_1]

Jaipur: An FIR was registered against Union Jal Shakti Minister Gajendra Singh Shekhawat in Rajasthan’s Chittorgarh on Saturday over his alleged remarks against Chief Minister Ashok Gehlot at a rally two days ago, police sources said.

The FIR was registered on a complaint filed by Congress leader and former MLA Surendra Singh Jadawat.

At the BJP’s ‘Jan Aakrosh’ rally in Chittorgarh on Thursday, Shekhawat had allegedly described Gehlot as the “Ravana of politics in Rajasthan” and asked people to “resolve to establish Ram Rajya in the state”.

    MS Education Academy

Jadawat told PTI, “I have filed a police complaint tonight against Union minister Gajendra Singh Shekhawat for using such derogatory language against the chief minister of Rajasthan. He tried to outrage religious feelings while addressing a BJP rally.”

The FIR has been registered under sections 143 (unlawful assembly), 153-A (promoting enmity between different groups on grounds of religion, race, etc.), 295-A (deliberate and malicious acts intended to outrage reli gious feelings of any class by insulting its religion or reli gious beliefs), 500 (defamation) and 504 (intentional insult with intent to provoke breach of the peace) of the Indian Penal Code, the police sources said.

According to the FIR, the BJP organised a meeting at a public place on April 27 where Shekhawat was the key speaker and he gave a speech to “incite” people.

The minister spread false information about “popular” Chief Minister Ashok Gehlot and spread hatred. Shekhawat insulted the chief minister by addressing him as the “Ravana of politics” with the intention of tarnishing his reputation, the FIR stated.

Man caught doing inappropriate act on Delhi Metro, police register FIR

    [ad_1]

New Delhi: The Delhi Police has registered a case after a video in which a man can be seen indulging in an inappropriate act inside a moving Delhi Metro train went viral on social media, an official said on Friday.

Police took a suo-moto action and a case under section 294 (obscene acts and songs) of the IPC has been registered, a senior police officer said, adding an investigation into the matter is underway.

The video has sparked outrage among the public. The man can be seen seated inside the train and engaging in an inappropriate act without any fear or shame.

    MS Education Academy

The incident has raised serious questions about the safety of women and children traveling on the Delhi Metro.

Taking cognisance of the video, the Delhi Commission for Women (DCW) earlier on Friday issued a notice to the Delhi Police and Delhi Metro to take strict action.

“Came across a viral video wherein a man can be seen shamelessly masturbating in Delhi Metro. It is absolutely disgusting and sickening. I am issuing a notice to Delhi Police and Delhi Metro to ensure strictest possible action against this shameful act,” DCW Chairperson Swati Maliwal said in a tweet.

The DMRC, in a tweet on Friday, said it will intensify the deployment of flying squads in the metro.

“We request the commuters to conduct themselves responsibly while travelling by Metro. If the other commuters notice any objectionable behaviour, they should immediately report the matter on the DMRC Helpline detailing the corridor, station, time etc.

“DMRC will intensify the number of flying squads comprising Metro and security staff to monitor such behaviour in the Metro and necessary action under relevant provisions of law shall be taken,” it tweeted.

Don’t trust Delhi police, might file loose FIR against Brij Bhushan: Wrestlers

    [ad_1]

New Delhi: The protesting wrestlers rejoiced “the first step towards victory” as Delhi Police decided to file an FIR against WFI chief Brij Bhushan Sharan Singh. However, they will continue their agitation and demanded that the BJP MP be removed from all the positions he holds.

Solicitor General Tushar Mehta, appearing for the Delhi Police, told a Supreme Court bench comprising Chief Justice DY Chandrachud and Justice P S Narasimha that the FIR would be registered on Friday.

The wrestlers, who have accused the WFI chief of sexual harassment and intimidation, have been demanding that an FIR be filed since they resumed their agitation on April 23.

    MS Education Academy

“This is first step towards victory but our protest will continue,” Sakshi Malik told reporters at Jantar Mantar, where they put up huge banners, with one of those listing all the ongoing criminal proceedings against Brij Bhushan.

Vinesh Phogat said it took Delhi Police six days to file an FIR and they don’t trust the probe agency.

“It (Police) might file a loose FIR. We we will see, observe then take a decision (on calling off protest). He should be behind the bars and removed from all the posts he holds, otherwise he will try to influence the investigation,” World Championship medallist Vinesh said.

  • Rape case can’t be quashed just because victim agrees for it, says HC on FIR against Bhushan Kumar

Rape case can’t be quashed just because victim agrees for it, says HC on FIR against Bhushan Kumar

    [ad_1]

Mumbai: A case of rape cannot be quashed merely because the victim granted her consent to do so, the Bombay High Court said on Wednesday while expressing its disinclination to quash an FIR of rape registered against T-Series owner Bhushan Kumar.

Kumar had filed the petition seeking for the FIR to be quashed on the ground that the victim took back her complaint and consented for the same to be set aside.

A division bench of Justices A S Gadkari and P D Naik, however, noted that merely because the complainant was granting her consent was not ground enough to quash the first information report (FIR) alleging rape.

    MS Education Academy

“Merely because the parties are consenting does not mean an FIR under section 376 (rape) of the Indian Penal Code should be quashed. We have to see the contents of the FIR, the statements recorded to see if the crime was heinous or not. The relationship (in this case) from the contents does not seem consensual,” the court said.

Kumar’s advocate Niranjan Mundargi told the court that the FIR was registered in July 2021 for an incident that was allegedly happening since 2017.

He said that a B-summary report (false case or no case made out against the accused) had been filed by the police before the concerned magistrate’s court.

A local politician Mallikarjun Pujari filed a protest petition against such B-summary, claiming he had helped the woman register the FIR, however the woman had granted her consent to close the proceedings.

The magistrate’s court rejected the police’s report in April 2022.

The high court on Wednesday perused the FIR, the affidavit submitted by the complainant woman giving her consent for the case to be quashed and the order passed by the magistrate’s court.

The bench was of the opinion that the material did not reflect that the relationship between the accused and the woman was consensual.

“Contents of the consent affidavit are not sufficient to quash FIR. Generally under section 376, FIR can be quashed with the consent of the complainant. But then that is after the FIR or the affidavit shows that there was a consensual relationship. Here the complainant is only saying she doesn’t want to proceed with the case due to ‘circumstantial misunderstanding’,” the court said.
When the bench expressed its disinclination to allow the petition and quash the case, Mundargi sought time to submit further material in support of the plea.

The bench then posted the matter for further hearing on July 2, 2023.

SC issues notice on wrestlers’ plea seeking FIR against WFI chief

    [ad_1]

New Delhi: The Supreme Court on Tuesday issued a notice on a plea by the country’s seven top wrestlers seeking a direction for the registration of an FIR against Wrestling Federation of India (WFI) chief Brij Bhushan Sharan Singh.

A bench headed by Chief Justice of India D.Y. Chandrachud and comprising Justice P.S. Narasimha, said: “There are serious allegation in plea on behest of international wrestlers with regards to sexual harassment meted out to them. Issue notice returnable on Friday. Liberty to serve standing counsel NCT Delhi. The complaints which form an attachment in sealed cover and shall be again resealeda.”.

The plea was mentioned before the bench by senior advocates Kapil Sibal and Narendra Hooda, representing the wrestlers.

    MS Education Academy

Sibal submitted that this is the wrestlers’ matter and they are sitting in dharna, and seven women have complained and one is a minor.

He stressed that an FIR has not been registered and added that the plea seeks one against Singh over alleged sexual harassment by women wrestlers.

During the hearing, Sibal argued that there is a committee report which has not been made public.

The Chief Justice asked Sibal to show the case papers.

Sibal said please see the complaint by the minor, the young girl had won a gold medal and added even the police personnel can be prosecuted for not registering an FIR.

He emphasized that the court should look at the allegations and the police are not acting.

After hearing submissions, the top court sought response from the Delhi Police.

According to the plea, the wrestlers have cited an inordinate delay in registration of FIR by the Delhi Police against the WFI President and urged the apex court to issue a direction to police to lodge a case.

The top court agreed with the petitioners to suppress their identity mentioned in the petition.

  • SC junks PIL seeking FIR against Vijayvargiya over his remarks on women’s attire

SC junks PIL seeking FIR against Vijayvargiya over his remarks on women’s attire

    [ad_1]

New Delhi: The Supreme Court on Friday dismissed a PIL seeking registration of an FIR against senior BJP leader Kailash Vijayvargiya and others over his controversial remark on clumsily attired women.

A bench of Justices KM Joseph and BV Nagarathna rejected the plea which sought a mechanism at the central and state level to deal with people making such remarks.

The bench said if the petitioner, Delhi resident Anjale Patel, and others had grievances over the statement, they could approach an appropriate forum including the lower court.

    MS Education Academy

On April 6, Vijayvargiya, a BJP general secretary, had said “badly dressed” women looked like “Shurpnakha”. In Ramayana, Shurpnakha is the sister of demon king Ravan.

Vijayvargiya came under fierce attack from women’s groups who called his comments, made at a function in Indore, “sexist and misogynistic”.

Advocate Satya Mitra, appearing for the petitioner, sought registration of an FIR against the BJP leader under section 354 (outraging the modesty of woman) and section 500 (punishment for defamation).

He said there should be a mechanism, either at the Centre or state level or both, to deal with and take action against those making such statements.

The bench said although it is dismissing the petition, it should not be construed that it is approving the statement.
