    Delhi HC asks Shehla Rashid to file response to affidavit filed by NBDSA

    New Delhi: The Delhi High court judge on Thursday asked former JNU student leader Shehla Rashid to file a response to the affidavit filed by the News Broadcaster and Digital Standard Authority (NBDSA). She has moved a plea against a news channel and its journalist.

    Justice Purushaindra Kumar Kaurav directed Shehla Rashid to file a rejoinder to the affidavit filed by the NBDSA. The matter has been listed on July 19, 2023, for further hearing.

    During the hearing, the counsel appearing for the respondent journalist submitted that he will adopt the reply filed by the respondent news channel in the matter.

    Rashid has alleged that one news channel aired a one-sided defamatory broadcast in which baseless allegations were levelled against her by estranged father. She had sought an apology from News Channel to mitigate the damage caused to her reputation and dignity.

    On September 16, 2022, the bench of justice Yashwant Varma had issued a notice on the plea of Rashid to the broadcaster regulatory authority, a news channel and a journalist. She moved a plea against a program that was telecast by a news channel in 2020.

    Rashid has sought a modification in an order passed by NBDSA on March 31, 2022, on her complaint.

    The News Broadcaster and Digital Standard Authority (NBDSA) had directed the news channel to take down links to the show about Rashid.

    The grievance of the petitioner was that the NBDSA refused to direct the channel to air an apology. She contended that NBDSA had given relief in other similar cases.

    Such unreasoned refusal is wholly arbitrary and unsustainable in law and this writ ought to issue to remedy the violation of public duty by the respondents, the plea said.

    Advocate S Prasanna, the counsel for Rashid, had submitted that it is important that there is a sense of responsibility of the media and people who make these allegations.

    The counsel for NBDSA had submitted that the broadcaster has removed all the links from all platforms of the programme.

    Turkish political analyst, Javad Gok, describes the Egyptian minister’s visit as “very important, not only for Egypt and Turkey, but for the entire region,” after 10 years of deadlock.

    Gok notes that Shoukry’s visit comes after the phone call he had with his Turkish counterpart Mevlut Cavusoglu, which is “the first tangible step in the framework of restoring relations between the two countries,” calling for the return of the ambassadors to Cairo and Ankara “because it is very important.”

    After agreeing to restore relations between the two countries, the Egyptian side will put forward requests regarding extremist groups, including the Brotherhood, and the Turkish government must take the necessary steps to prevent them from sabotaging relations between the two sides again, according to the Turkish analyst.

    Regarding the Turkish government’s position on the visit, he said it was “very happy” with it, especially in these difficult times for the Turkish people, “and they will appreciate Egypt’s efforts to help those affected by the earthquake and its sending of aid.”

    Egyptian aid

    Last Thursday, Egypt sent two relief aid planes to Turkey in solidarity with those affected by the earthquake, and as a contribution to mitigating its effects.

    The two planes come the day after the docking of the Egyptian Navy ship “Halayeb” in the international port of Mersin, southern Turkey, loaded with 650 tons of humanitarian aid.

    After the earthquake, Egyptian President Abdel Fattah El-Sisi made a phone call to Erdogan, during which he expressed condolences and solidarity over the disaster.

    On February 8, the Egyptian army announced the flight of 5 military transport planes loaded with large quantities of medicines and medical supplies to Syria and Turkey.

    Turkey is seeking to restore relations with Egypt, which have witnessed sharp differences since the Egyptian June 30 revolution in 2013, regarding Egyptian and regional issues, most notably Egypt’s anger at Turkish support for the terrorist Brotherhood in Egypt, and terrorist groups and militias in Libya.

    In the last two years, the two countries held two rounds of exploratory talks that began in 2021, headed by Turkish Deputy Foreign Minister Ambassador Sedat Onal and his Egyptian counterpart Hamdi Loza. At the end of the second round, which was held in Ankara last September, the two sides agreed to continue consultations, and affirmed their desire to make progress on issues. Discussed, and the normalization of relations between them.

    The highest level of communication before the earthquake was a handshake between Sisi and Erdogan during their attendance at the opening of the FIFA World Cup, which was held in Qatar last November.

    New Delhi: The Delhi High Court on Friday directed the Delhi Development Authority (DDA) and Delhi Urban Shelter Improvement Board (DUSIB) to file affidavits by February 21 in a plea filed by the Goshiya Colony Sewa Samiti and others residing in Mehrauli.

    Justice Manmeet Pritam Singh Arora dealing with a plea filed through advocate Anupradha Singh also directed the petitioner to file its rejoinder within three days after DDA and DUSIB file their affidavits.

    The court listed the matter for next hearing on February 28.

    The plea challenges the December 12, 2022 demolition notice, wherein DDA purports to carry out a demolition drive in the entire Goshiya Colony, which is in existence for more than five decades and consists of over 600 houses, with approximately 4,000 population.

    The plea stated, citing the ‘Ajay Maken and others vs Union of India’ case that a demolition drive cannot be carried out without following the protocol for removal of jhuggis as per the order of Delhi High Court.

    The plea stated that before beginning any demolition drive, the land-owning agency must send a request to DUSIB, which will determine if the jhuggis qualifies for rehabilitation in accordance with the cut-off.

    The petition claimed that the land-owning agency cannot begin the demolition process until DUSIB determines that the jhuggis are not eligible for rehabilitation.

    New Delhi: Amid protests in Sikkim over a reported observation of the Supreme Court referring to Sikkimese Nepalis as “immigrants”, Law Minister Kiren Rijiju on Sunday said the Centre is filing a review petition in the apex court to support the state government.

    The state government has already filed a review petition in the apex court on the matter.

    The protests are taking place after the Supreme Court reportedly mentioned the Sikkimese Nepali community as immigrants in an observation on January 13 while extending income tax exemption to all old settlers of the state.

    “I have spoken to CM of Sikkim P S Tamang Golay. Union of India is also filing a Review Petition in Supreme Court to support Sikkim Govt through Solicitor General of India. Govt of India stands with the people of Sikkim,” Rijiju tweeted.

    In another tweet, he assured the people of Sikkim that “this judgment does not deal with or dilute Article 371F of the Constitution (relating to the state) and has nothing to do with anyone’s citizenship.”

    “We value the Constitutional status of every genuine Indian and will be protected at any cost,” he wrote.

    Gangtok: Sikkim Chief Minister Prem Singh Tamang on Monday said his government will file a review petition in the Supreme Court with a prayer for rectification of its “inadvertent mention of the Sikkimese Nepali community as foreigners” in an order two weeks ago.

    “Let me reiterate and reassure that no injustice will be meted out to anyone with regard to the inadvertent mention of Sikkimese Nepali Community as foreigners in the observation part and not in the judgment part of the verdict of Hon’ble Apex Court in the matter of income tax exemption for the old settlers of Sikkim,” he said in a social media post.

    “I express my solidarity not only with Sikkimese Nepali Community but with all the communities of our dear state. We all are one, and will always remain united,” Tamang said.

    The state government has already initiated steps for filing the review petition for addressing the concerns of the Sikkimese Nepali community, the chief minister said.

    Tamang said he has already spoken to Union Law Minister Kiren Rijiju and the latter has assured that the Government of India will support the review petition of the Government of Sikkim, and if required will file a review petition itself as well on similar lines.

    Tamang appealed to all people to be patient and keep faith in the judiciary. It is just a matter of time that this issue will be addressed for the good of one and all, he said.

    The Supreme Court in its order dated January 13, 2023, had directed the Centre to amend the definition of ‘Sikkimese’ in Section 10 (26AAA) of Income Tax Act 1961 for including income tax exemption to all Indian citizens domiciled in Sikkim on or before the merger date of April 26, 1975.

    “The Union of India shall make an amendment to Explanation to Section 10 (26AAA) of IT Act, 1961, so as to suitably include a clause to extend the exemption from payment of income tax to all Indian citizens domiciled in Sikkim on or before 26th April, 1975.

    “The reason for such a direction is to save explanation from unconstitutionality and to ensure parity in the facts and circumstances of the case,” said the apex court while disposing of two writ petitions filed by Association of Old Settlers of Sikkim (AOSS) and others with a prayer for grant of income tax exemption at par with the Sikkimese people as given under Section 10 (26AAA) of IT Act following an amendment in 2008 by the Parliament.

    SRINAGAR: A teenager was injured after hit on the face by a shot fired from a 12 bore rifle by an unknown person at Payerpora Hyhama area of north Kashmir’s Kupwara district, officials said on Friday.

    Quoting a police officer, GNS reported that information was received that one unknown person has “utilized” 12 bore illegally at Payerpora Hyhama, resulting in minor injuries on face of a teenager identified as Sahir Ahmad Khan son of Niyaz Ahmad Khan of Payerpora Hyhama.

    The Injured was shifted to SDH Kupwara wherefrom he was referred to GMC Baramulla. In this regard, he said, a case (FIR No 12/2023) under section 307 IPC (attempt to murder) and 3/27 Arm Act (use of prohibited arms or ammunition) stands registered investigation taken up.
