    New Delhi: With the Congress planning to bring a no-confidence motion against Lok Sabha Speaker Om Birla on Monday, he could become the third Speaker to face such a motion after G.V. Mavalankar and Balram Jakhar. All three share a common factor they headed the Lower House when the treasury benches had a brute majority.

    Congress sources said that they are consulting like-minded allies on the issue while the party MPs have already started signing the petition for the move.

    On Wednesday papers were hurled at the Lok Sabha Speaker’s chair when Congress MPs were protesting against Rahul Gandhi’s disqualification.

    The first resolution against the Speaker was brought in 1954 when G.V. Mavalankar was the Speaker and Jawaharlal Nehru was the Prime Minister. In 1987, it was against Speaker Balram Jakhar. Rajiv Gandhi was the Prime Minister and the resolution was moved by Somnath Chatterjee. In both cases, the Deputy Speaker presided over the House but in the current Lok Sabha, there is no Deputy Speaker.

    Both resolutions were defeated in the House. The opposition is now mulling to bring a no-confidence motion against Speaker Om Birla for ‘not allowing their leaders to speak in the Lower House’ and for not accepting any adjournment notice, sources said.

    The opposition is miffed with the disqualification of Congress leader Rahul Gandhi and alleged that the decision has been taken in haste.

    The opposition is likely to bring the no-confidence motion coming Monday and the signatures of MPs are being taken. The idea was mooted during an opposition meeting.

    Gandhi was disqualified as an MP 24 hours after being convicted by a Surat court on Friday.

    The Surat district court in Gujarat on March 23 convicted the Congress MP in a criminal defamation case over his alleged ‘Modi surname’ remark in 2019.

    He was convicted under Indian Penal Code sections 499 and 500. The maximum punishment under this section is two years.

    Bharatiya Janata Party MLA and former Gujarat minister Purnesh Modi had filed the case against Rahul Gandhi for his alleged “how come all the thieves have Modi as the common surname…” remark.

    Hyderabad: Telangana’s Minister for Industries and Information Technology, K.T. Rama Rao, on Tuesday served legal notice to state Congress chief Revanth Reddy and BJP president Bandi Sanjay over their allegations against him in the Telangana State Public Service Commission (TSPSC) paper leak case, asking them to withdraw their allegations and tender a public apology or face defamation suit to the tune of Rs 100 crore.

    KTR’s lawyer sent legal notices to Reddy and Sanjay, stating that they cast aspersions on the minister and damaged his reputation through their their ‘false’, ‘baseless’ and ‘defamatory’ statements.

    The notice said that unless the leaders refrain from making such defamatory statements and tender a public apology, KTR will take forward the legal proceedings and file a defamation suit in the courts of competent jurisdiction.

    Reddy and Sanjay were told that by levelling the allegation, they rendered themselves liable for both prosecution for an offence of defamation punishable under Section 500 of the Indian Penal Code as defined under Section 499 of the IPC, and also made them liable for exemplary damage.

    “Though the loss suffered by my client on account of your above said acts are incalculable and irreparable in terms of money, my client calculates damages at a token sum of Rs 1,00,00,00,000 (Rupees Hundred Crore only),” read the notice.

    Both the leaders were asked to refrain from making any further derogatory/defamatory statements/imputations in any form against the minister and tender an unconditional apology forthwith by conducting similar press meets.

    “Else my client shall be constrained to prosecute you for an offence of defamation apart from claiming damages to the tune of Rs 100 crore by initiating appropriate proceedings in the courts of competent jurisdiction holding you solely responsible for all the costs and consequences thereof,” it added.

    KTR had earlier said that Reddy and Sanjay proved their ignorance by dragging the Telangana government and him into the issue of paper leakage without understanding the autonomous nature of the constitutionally constituted Public Service Commission.

    Stating that there is a terrible conspiracy by both the BJP and the Congress to stall the entire recruitment process, KTR also said that Sanjay and Reddy had earlier termed Telangana government’s job notifications as a conspiracy and their comments that the youth should put aside their preparation and get into politics reflect the deceitful mentality of these leaders.

    SRINAGAR: Jammu and Kashmir police on Tuesday asked all drawing and disbursing officers to direct all officials of the department to update their Income Tax Returns after complaints of bogus and fraudulent claims by some officers surfaced.

    According to a circular, the police authorities have warned of action if the officials fail to update their ITR-U by March 31.

    The circular reads during analyses by Income Tax Department to the refunds issued in (ITR) FY 2021-22 and 2022-23 in respect of the Income Tax Returns filed by the taxpayers of Jammu & Kashmir, it has been revealed that huge number of individual taxpayers, particularly those who derive income from salaries and which includes many police officers/officials have claimed excessive deductions and refunds under various sections of the Income Tax Act viz. 80C, 80D, 80D0, 80DDB, 80E8, 80E, 80EE, 80G, 80GGC etc. without actually being eligible for the same.

    “The data of every individual tax payer has been analyzed by the Director General of Income Tax (Systems) and cases of fraudulent claims/bogus refunds have been selected for scrutiny from which fraudulent claims of deductions/refunds under the IT Act have come to light,” it reads.

    It added Income Tax Department has a list of all persons who have claimed excessive or bogus deductions and refunds on TDS made by their DD0s. It is a matter of grave concern that large number of employees belonging to JKP also figure in the list.

    “Such cases of bogus refunds may lead to selection of their cases for scrutiny and recoveries will be made by IT Department besides levy of penalty under section 270A of the Income Tax, which would be 200% of the tax levied. The cases of such employees may also be taken up for prosecution under section 276C of the IT Act.”

    It reads however, the Income Tax Act provides a limited window in the shape of ITR-U under section 139(8A) which provides that the taxpayers can update their returns of income by paying their actual due tax along with penalty which is 50% of additional tax + interest tor FY.2019-20 (A.Y.2020-21) and 25% for FY.2020-21 (A.Y.2021-22), if the ITR-U are filed before 30.03.2023.

     

    “Keeping in view the sensitivity and urgency of the matter, all the DDOs of J&K Police are enjoined to direct all the officers and officials under their charge to update their Income Tax Returns (ITR-U) on or before March 31, 2023, if they have claimed any bogus deductions and refunds failing which action under rules as mentioned above shall be taken against them by IT Department,” it reads.     SRINAGAR: Jammu and Kashmir school Education department has asked all the employees to file rectified ITR of face action in view of claiming refunds on the basis of fabricated documents.

    The government in an order said that all the HOD’s as well as DDO’s of subordinate offices in particular and all employees in general working under the Administrative Department of School Education Department UT J&K, are hereby informed that a meeting was convened by Principal Commissioner, Income Tax on 24/03/2023 in his office chamber at Rajbagh Sgr. wherein the DDO’s of various institutions attended the meeting.

    It said that the chair intimated that the number of income tax refund claims of employees has increased manifold from last two years as the employees are utilizing the services of some tax professionals wherein TDS deducted from their salaries by DDO is refunded by using various sections of Income Tax on the basis of fabricated documents.

    It also said these bogus refund claims have been viewed seriously by the Income tax Department and details of such employees who have claimed refunds have been prepared and intimated to Chief Secretary to Govt. J&K.

    “However, it has been felt that before their names are forwarded to their respective departments one time relaxation has been given to such claimants till 31-03-2023

    that a rectified ITR as (ITR-U) may be filed otherwise it shall have some serious repercussions followed by Departmental enquiries and imposition of penalties U/S 270(A) and U/S 276 (C) of Income Tax Act 1961,” the order said.(KNS)

    New Delhi: The Ministry of External Affairs on Friday reiterated that economic fugitives like Mehul Choksi should face justice.

    Speaking at a weekly media briefing, MEA spokesperson Arindam Bagchi said, “On the issue of Mehul Choksi. Look, I use the word, you know, red corner notice. Yes, let me just take the larger name. Our focus is on getting economic fugitives to face justice in India. And we will continue specific issues in today’s regarding red corner notice. Otherwise, look, I have to direct you to the concern. I think they issued a detailed press release. I really don’t have anything to add to that.”

    Notably, Interpol revoked the Red Corner list against Mehul Choksi. The removal from the Interpol database of Red Notices will make the fugitive diamantaire eligible to travel at will to any other country, apart from India where he faces multiple cases, according to government sources.

    However, the sources said the removal of the Red Corner Notice by the global police body against Choksi will have no bearing on the Punjab National Bank scam case, which is already at an advanced stage.

    Red Corner Notices are issued against fugitives and are considered as a request to law enforcement agencies across the world to locate and provisionally arrest a person pending extradition, surrender, or similar legal action.

    The 63-year-old diamantaire is wanted in India in connection with a Rs 13,000-crore fraud in the Punjab National Bank (PNB).

    Meanwhile, the Central Bureau of Investigation (CBI) on Tuesday said that it remains in active communication with Commission for Control of INTERPOL’s Files (CCF) and other bodies in INTERPOL after it removed the Red Corner Notice against Mehul Choksi.

    Washington: As Muslims around the world prepare to begin the holy month of Ramzan, Muslims in China are facing fasting ban while their cultural and religious traditions are increasingly coming under attack, according to a media report.

    Uyghurs in the northwestern region of Xinjiang are being ordered not to allow their children to fast, with the latter being quizzed by the authorities as to whether their parents are fasting, local officials and rights groups said, RFA reported.

    “During Ramzan, the authorities are requiring 1,811 villages [in Xinjiang] to implement a round-the-clock monitoring system, including spot home inspections of Uyghur families,” World Uyghur Congress spokesperson Dilshat Rishit said, RFA reported.

    During Ramzan, Muslims are called to fast during daylight hours.

    China’s 11.4 million Hui Muslims close-knit ethnic Chinese communities who have maintained their Muslim faith over centuries are in danger of being erased entirely under the Communist Party’s draconian religious rules, rights groups have warned in a new report.

    They have been identified by Beijing as “a threat to be resolved through forcible assimilation”, said a report from a coalition of rights groups, including the Network of Chinese Human Rights Defenders (CHRD), RFA reported.

    This is in stark contrast to the relative freedom they enjoyed before President Xi Jinping launched a renewed attack on religious worship, forcing Christians, Muslims and Buddhists alike to submit to party control and censorship of their religious lives under his “sinicisation”, the report said.

    “Hui community members were able to openly participate in mosque communities, Arabic schools, and for private worship, albeit under restrictions facilitated by party liaisons. Hui entrepreneurs were encouraged to develop business and tourism connections with the wider Muslim world as part of the Belt and Road Initiative,” it said, RFA reported.

    China has also targeted Muslim communities with its “ethnic unity” campaign under which officials impose Han Chinese “relatives” on ethnic minority Uyghur families, who then put pressure on them to observe non-Muslim traditions, including drinking alcohol and eating pork.

    “Unity” policies haven taken place in Xinjiang against the backdrop of the mass incarceration of at least 1.8 million Uyghurs and other ethnic minority Muslims in “re-education” camps, and their involvement in forced labour, as well as amid reports of the systemic rape, sexual abuse, and forced sterilization of Uyghur women in the camps, RFA reported.
