School Edu Deptt seeks list of Pvt schools functioning on Govt land for implementation of RTE to EWS students

Srinagar, Apr 25: The School Education Department Tuesday sought list of all private schools functioning from government land and ordered its management to compulsorily admit 25 percent of students from weaker section from their catchment areas.

According to the news agency—Kashmir News Observer (KNO), Director of School Education Kashmir (DSEK), in a communique to Chief Education Officers (CEOs) of the region has asked to implement the free and compulsory education to children from weaker and disadvantaged sections by private unaided schools under section 12 (1) C of RTE Act 2009.

DSEK said that RTE, Act Section 12 (1) C envisages that all private unaided schools have the responsibility to dispense and provide free education to children from weaker and disadvantaged sections and admit at least one-fourth that is 25 percent of the total strength of class-I or pre-school education.

It further said, “All those private schools which are functioning on state land shall compulsorily admit the 25 percent of students from weaker section of their catchment area by properly publicizing the admission.”

The director of the region in this regard has requested all the CEOs to immediately furnish the list of all Private Schools functioning on the state land immediately.

Pertinently, the section 12 (1) (c) of the RTE Act, 2009 fixes the responsibility of private unaided schools to provide free and compulsory education to children from weaker and disadvantaged sections by admitting at least one- fourth of the total strength of class I or pre-school education—(KNO)

  • EWS quota in admissions not applicable to Jamia Millia Islamia, HC told

EWS quota in admissions not applicable to Jamia Millia Islamia, HC told

    [ad_1]

New Delhi: The Jamia Millia Islamia University told the Delhi High Court on Tuesday that it was declared a minority educational institution in 2011 and the provision of 10 percent reservation for students from the economically weaker section (EWS) will not be applicable to it.

The oral submissions were made on behalf of the university in a petition seeking directions to it to ensure 10 percent reservation for students from the EWS category at the time of admission from the academic year 2023-24.

A bench of Chief Justice Satish Chandra Sharma and Justice Yashwant Varma granted two weeks’ time to the university to file its reply to the petition and listed it for further hearing on May 22.

The public interest litigation (PIL) matter, filed by law student Akanksha Goswami, said the university ought to reserve seats for EWS category students at the time of admission from the academic year 2023-2024 in terms of the Constitution (103rd Amendment) Act, 2019, which provides for 10 percent reservation for them in higher education and government jobs.

Senior advocate Arun Bhardwaj, representing the petitioner, submitted that either Jamia could be a central university or a minority institution and cannot be both.

He said the admission process has begun from April and will go on till September.

The university’s standing counsel, Pritish Sabharwal, submitted that an order was passed by the National Commission for Minority Educational Institutions in 2011, declaring Jamia a minority educational institution.

He said the government issued a notification in 2019 that the office memorandum enabling the provision of 10 percent reservation for EWS students in admission to educational institutions will not be applicable to minority institutions and Jamia is covered by it.

The high court had earlier issued notices to Jamia, the Ministry of Education and the University Grants Commission (UGC) on the petition and sought their response.

The petitioner’s lawyer had earlier contended that Jamia should be directed to implement the EWS reservation as it is a central university that receives aid from the UGC.

The petitioner, also represented by lawyers Akash Vajpai and Ayush Saxena, said Jamia Millia Islamia was established by an act of Parliament and thus, is a central university and not a minority institution.

The plea asserted that the UGC has already written to the registrars of all the central universities, including Jamia, to implement the reservation for EWS students.

“Respondent no. 2 (UGC), through its letter dated January 18, 2019, requested all vice-chancellors of the central universities, including respondent no. 1 (Jamia), to implement 10 percent EWS reservation at the time of admission in their different courses from the academic year 2019-2020. Respondent no. 1 Jamia Millia Islamia issued a press release on February 5, 2019 through which it refused to implement the 10 percent EWS reservation, citing its status as a minority institution under Article 30 of the Constitution of India,” the plea said.

Besides the issue of reservation, the petitioner has also prayed for setting aside an order passed by the National Commission for Minority Educational Institution that declared Jamia a minority institution.

The petition stated that Jamia was neither established by a minority community nor does it administer it as it is established by an Act of Parliament and is also funded by the Government of India.

It further said there is no provision in the Jamia Millia Islamia Act, 1988 to allow the selection of only Muslims as members of its executive and academic council and treating a central university as a minority educational institution is repugnant to law.

“Respondent no. 1 (Jamia), after it was incorporated and established through the Jamia Millia Islamia Act, 1988, became another central university in the country like the Banaras Hindu University and the Allahabad University,” the plea said.

  • Karnataka to abolish 4% reservation for minorities, places them under EWS category

Karnataka to abolish 4% reservation for minorities, places them under EWS category

    [ad_1]

Bengaluru: The Karnataka government has announced its decision to scrap the four per cent quota for minorities and add it to the existing quota of two dominant communities of the poll-bound state.

The 4 per cent reservation given to Muslims under 2B classification of the OBC category will now be divided into two equal parts and added to the existing quota of Vokkaligas and Lingayats for whom two new reservation categories of 2C and 2D were created during the Belagavi Assembly Session last year.

The cabinet decided to bring the religious minorities under the EWS category.

The decision comes ahead of the Assembly elections.

Briefing reporters after the cabinet meeting on Friday, Chief Minister Basavaraj Bommai said the religious minorities quota would be done away with and brought under the 10 per cent pool of the EWS category without any change of condition.

“The four per cent (reservation for minorities) will be divided into two between 2C and 2D. The four per cent reservation for the Vokkaligas and others will be enhanced to six per cent and Veerashaiva Panchamasali and others (Lingayats), who are getting five per cent reservation will now get seven per cent,” the CM explained.

The Cabinet had abolished 3A and 3B categories of reservation for Vokkaligas and Lingayats respectively and replaced them with two new categories of 2C and 2D last December.

Defending the decision to abolish the quota for Muslims, Bommai said there was no constitutional provision for religious minorities.

Citing a court verdict striking down the reservation provided for minorities in Andhra Pradesh, the CM said the architect of the Indian Constitution B R Ambedkar too had said that reservations were for caste.

“However, we cannot drop that community entirely. With a view that there should not be any problem, the religious minorities…if someone challenges reservation to them, we decided to take a proactive decision. In fact they will go from 4 per cent to the 10 percent pool of the EWS group without any change of condition,” Bommai explained.

Muslims are divided into three reservation categories 1, 2A and 2B.

The extremely backward religious minorities, who form the sub-sects of Muslims such as Pinjara, Nadaf, Daroji, Chapparband and are enlisted in category 1, will remain undisturbed and in the same reservation list.

Similarly, the government did not touch the Muslim communities under 2A category.

“Some other Muslim sub-sects in the 2B category will not be disturbed. They will only be moved to the EWS quota on the same conditions,” Bommai said.

There are some more small backward communities, who find mention in the Backward Commission’s report.

“They never figured in any list including the backward list. They are not in any category. Regarding them, the Backward Commission has mentioned in its second list. I will study the report in detail. Our government will take further decision on it in the coming cabinet.

Already, a recommendation has been sent to the Centre to include two shepherd communities Kadu Kuruba’ and Gonda Kuruba’ spread over four districts in the ST category.

Further, the Union government has made some references to two to three communities including Kadu Gollaru and Koli communities seeking the opinion of the department.

Bommai also said that the government will notify the communities under the EWS category.

Also, a decision was taken with regard to the SC community that 6 percent reservation would be given to SC left sub-category, 5.5 per cent to SC right, 4.5 per cent to touchables and 1 per cent to others.

Hailing the announcement, Adichunchanagiri Math pontiff and Vokkaliga leader Nirmalanandanatha Swami said the demand was made for 12 per cent reservation keeping in view the condition of the community.

“Given the situation, the government has increased the reservation from four per cent to six per cent for which we thank the government. We welcome the move,” he said.

The Panchamasali community of the Lingayat sect and the Vokkaligas have been demanding a hike in reservation for quite a long time.

Hyderabad: OU to consider EWS quota in its admission process

    [ad_1]

Hyderabad: The Osmania University (OU) on Wednesday gave its assurance to the Telangana High Court that the Economically Weaker Section (EWS) reservation will be taken into consideration during its admissions session.

The promise came after a student named N Uma from Chintal in the Rangareddy district filed a petition against OU and its Directorate of Admissions for failing to implement the EWS reservations in the PhD entrance test in 2022 conducted by the university.

“Admission to the PhD course is subject to the norms and regulations of the state government’s reservation policies for the PhD entrance test in 2022,” says the OU’s information brochure.

The Telangana government had issued GOMs No.244 dated August 24, 2021, to implement EWS reservations in admissions to educational institutions and appointments to posts provided in favour of EWS citizens other than Scheduled Castes, Scheduled Tribes, and the socially and educationally backward classes in the state.

The university however failed to oblige to this directive, the petitioner’s lawyer, Gadipally Malla Reddy claimed.

He further informed the court that the petitioner was denied a seat.

In response to the court’s inquiry, OU’s lawyer said the university would comply with the GO on EWS reservations.
