    New Delhi: The Delhi High Court on Tuesday was informed by Shahrukh Pathan that there is no role attributed to him and that the “entire case is a farce” in a matter related to rioting and causing injuries to police personnel, including one Rohit Shukla, by an armed mob during the 2020 North-East Delhi riots.

    Justice Dinesh Kumar Sharma was hearing Pathan’s bail plea. Simultaneously, Pathan is facing charges in another case in connection with pointing a pistol at a policeman.

    A trial court had rejected Pathan’s bail plea in December 2021.

    It is to be noted that the charges have already been framed against Pathan in the matter, and he had moved the high court in January last year seeking bail.

    Even though there are four more accused in the case, the petitioner is the only one not named in the FIR or identified by anyone and yet he is behind bars whereas others have been released on bail, Pathan’s counsel Khalid Akhtar told the court.

    “The bail application and arguments on the charges were heard together. Bail was rejected on the ground that he [Pathan] is accused in another case, that he could be a flight risk and that there were contradictions in his statements which are the subject matter of trial. There are total five accused persons in the FIR. I am the only person who is neither named nor identified while all others were named and identified. Their addresses were also disclosed by the victim and yet all of them have been granted bail and I am the only one behind bars. This entire case is a farce,” Akhtar submitted on behalf of his client.

    Akhtar also apprised the court that the bail application has been pending for 15 months now, and that his client is lodged in jail for three years and one month.

    “No role is attributed to me. It is not their case that I shot the victim. Examination of the main victim is complete. That is full of contradiction. There is nothing,” he submitted.

    Justice Sharma then directed the special public prosecutor for Delhi Police to file a chart indicating the role of the accused persons, including Pathan, and the evidence attributed against them.

    The court then listed the matter for further hearing on July 24.

    Earlier in February, Pathan had informed the high court that the conclusion of the trial has been delayed for a long and that for more than a year now, only two witnesses have been examined out of 40.

    Akhtar had earlier submitted: “There is a huge delay in the conclusion of the trial. Only two witnesses have been examined so far out of about 40. I have been attacked in jail too.”

    New Delhi: In probably the first case of a Big Tech giant paying a penalty to the Indian regulators as the government aims to bring a new Digital India Act, Google has paid the entire penalty amount of Rs 1,337.76 crore imposed by the Competition Commission of India (CCI) in the Android case.

    Reliable sources told IANS on Tuesday that the entire penalty amount has been deposited in the Consolidated Fund of India, within the 30-day deadline given by the National Company Law Appellate Tribunal (NCLAT) in its order.

    The Indian market regulator had imposed the penalty on Google in October 2022 for allegedly exploiting its dominant position in the Android market.

    Earlier this year, Google announced to comply with the CCI’s directives for Android.

    “The CCI’s recent directives for Android and Play require us to make significant changes for India, and we’ve informed the CCI of how we will be complying with their directives,” Google had said in a statement.

    “We’re updating the Android compatibility requirements to introduce changes for partners to build non-compatible or forked variants,” said Google.

    Through user choice billing, developers can offer users the option to choose an alternative billing system alongside Google Play’s billing system when purchasing in-app digital content.

    The changes came as a Supreme Court bench said that the findings by the CCI cannot be said to be “without jurisdiction or with manifest error” and affirmed the NCLAT order, declining to grant interim relief to Google.

    The bench directed the NCLAT to dispose of Google’s appeal by March 31, and granted Google seven days to deposit 10 per cent of the Rs 1,337.76 crore penalty imposed by the CCI.

    Google had alleged that the CCI copy-pasted parts of a European court order without examining associated evidence in India.

    The CCI has also imposed a penalty of Rs 936.44 crore on Google in a separate case for abusing its dominant position with respect to its Play Store policies.

    In response to Google’s announcement of implementing its new Google Play payments policy, the Alliance of Digital India Foundation (ADIF) had expressed deep concern over the policy change and has demanded that the new policies must be put on hold, since Google charging a nearly 30 per cent service fee on app developers will prove to be a significant blow to the Indian startup ecosystem.

    New Delhi: Heatwaves in India are becoming more frequent and severe due to climate change, with over 90 percent of the country in the “extremely cautious” or “danger zone” of their impacts, according to a new study.

    The study, conducted by Ramit Debnath and colleagues at the University of Cambridge, also revealed that Delhi is particularly vulnerable to severe heatwave impacts, though its recent state action plan for climate change does not reflect this.

    It suggested that heatwaves have impeded India’s progress towards achieving the United Nations’ Sustainable Development Goals (SDGs) more significantly than previously thought, and that the current assessment metrics may not fully capture the impacts of heatwaves linked to climate change on the country.

    Heatwaves claimed more than 17,000 lives in 50 years in India, according to a paper authored by M Rajeevan, former secretary of Ministry of Earth Sciences, along with scientists Kamaljit Ray, S S Ray, R K Giri and A P Dimri.

    The paper published in 2021 said there were 706 heatwave incidents in the country from 1971-2019.

    Thirteen people died from heatstroke at a Maharashtra government award function in Navi Mumbai on Sunday, making it one of the highest death tolls from a single heatwave-related event in the country’s history.

    To assess India’s climate vulnerability and the potential impact of climate change on SDG progress, researchers at the University of Cambridge conducted an analytical evaluation of the country’s heat index with its climate vulnerability index.

    The heat index (HI) is a measure of how hot it feels to the human body, taking into account both temperature and humidity. The climate vulnerability index (CVI) is a composite index that uses various indicators to account for socioeconomic, livelihood, and biophysical factors to study the impact of heatwave.

    The researchers accessed a publicly available dataset on state-level climate vulnerability indicators from the government’s National Data and Analytics Platform to classify severity categories.

    They then compared India’s progress in SDGs over 20 years (2001-2021) with extreme weather-related mortality from 2001-2021.

    The study showed that more than 90 percent of India is in the “extremely cautious” or “danger” range of heatwave impacts through HI, otherwise considered “low” or “moderate” vulnerability through CVI.

    States that were categorized as “low” in CVI rankings were found to be in “danger” HI categories, indicating that heatwaves put more people at extreme climate risk across India than estimated by CVI.

    The authors concluded that the use of CVI may underestimate the actual burden of climate change concerning heat, and suggested that India should consider reassessing its climate vulnerabilities to meet the SDGs.

    They warned that if India fails to address the impact of heatwaves immediately, it could slow progress towards achieving sustainable development goals.

    The study also highlighted that the current heat-action plans designed and implemented according to the Delhi government’s vulnerability assessment do not include HI estimations, which is concerning since even the “low” climate-vulnerable areas in Delhi are at high heatwave risks.

    The high intensity of development in Central, East, West, and North-East districts can further elevate the HI risks through heat island formation, it said.

    The authors said some of the critical variables in Delhi that will aggravate heat-related vulnerabilities include concentration of slum population and overcrowding in high HI areas, lack of access to basic amenities like electricity, water and sanitation, non-availability of immediate healthcare and health insurance, poor condition of housing and dirty cooking fuel (biomass, kerosene and coal).

    The threshold for a heatwave is met when the maximum temperature of a station reaches at least 40 degrees Celsius in the plains, at least 37 degrees Celsius in coastal areas, and at least 30 degrees Celsius in hilly regions, and the departure from normal is at least 4.5 degrees Celsius.

    Earlier this month, the India Meteorological Department predicted above-normal maximum temperatures for most parts of the country from April to June, except parts of the northwest and the peninsular regions.

    Above-normal heatwave days are expected in most parts of central, east, and northwest India during this period.

    In 2023, India experienced its hottest February since record-keeping began in 1901. However, above-normal rainfall in March kept temperatures in check.

    March 2022 was the warmest ever and the third driest in 121 years. The year also saw the country’s third-warmest April since 1901.

    In India, about 75 percent of workers (around 380 million people) experience heat-related stress.

    A report by the McKinsey Global Institute warns that if this continues, by 2030, the country could lose between 2.5 percent to 4.5 percent of its Gross Domestic Product (GDP) per year.

    New Delhi: Delhi Chief Minister Arvind Kejriwal on Sunday said the CBI asked him around 56 questions regarding the excise policy case and he answered them all.

    “I want to say that the entire excise policy case is false. They do not have any evidence that the AAP is wrong. It’s a result of dirty politics,” he told reporters.

    He was speaking to the media at his residence after around nine hours of questioning by the probe agency.

    “AAP is a kattar honest party. We did nothing wrong. They asked me 56 questions. The total case is fake. They don’t have anything against us. No evidence. The entire case is bad politics,” Kejriwal said.

    As of now, no date has been given to Kejriwal for the second round of questioning.

    Thanking the CBI officials for their “hospitality”, Kejriwal said, “They asked me questions in a friendly and harmonious manner. I answered all the questions asked by them.”

    “The CBI asked around 56 questions regarding the excise policy, including when and why the policy was started,” he added.

    The AAP chief, who arrived at the heavily fortified agency headquarters at around 11 am in his official black SUV, was taken to the first-floor office of the Anti Corruption Branch where he was quizzed by the investigation team, officials said.

    A team of senior officials recorded his statement. The CBI has filed a charge sheet in the matter and now they are all set to file a supplementary charge sheet.

    Kejriwal was asked about AAP leader Vijay Nair, businessman Sameer Mahendru and how the policy got leaked before it was implemented.

    Delhi’s then Deputy Chief Minister Manish Sisodia was arrested by the CBI and the ED in the case and is presently behind bars.

    The Delhi Police had imposed Section 144 in and around the CBI’s headquarters to avoid any problems and detained 1,305 AAP workers.

    “We are looking towards making certain amendments in the entire election process but I can’t keep any commitment because it’s a consultation process that is going on,” the law Minister told reporters after inaugurating District Court Complex and District Aid Legal Council in Central Kashmir’s Budgam district.

    Kiren Rijiju declined to give an appropriate date for elections in Jammu and Kashmir, however, as per news agency Kashmir News Trust he maintained that elections will be held at an appropriate time.

    He said that the Government of India is in a process of defining what ‘fake news’ is all about and deliberations in this regard are going on.

    “The definition of fake news, false news, misrepresentation, these are important things which require lots of deliberation and we are doing it,” he said.

    When asked National Conference leader Dr Farooq Abdullah has appealed to all opposition parties to get united to defeat BJP in the next elections, Kiren Rijiju who is a native of Arunachal Pradesh said that all this shows that BJP is a strong party.

    When asked about the conditional passport issued to Iltija Mufti – the daughter of Mehbooba Mufti, Kiren Rijiju said that he is a Law Minister and doesn’t issue passports. [KNT]

    New Delhi: Open source developer platform GitHub has laid off its entire engineering team in India, its second largest developer community after the US, which affected at least 100 employees as part of the “reorganisation plan”.

    Tech writer Gergely Orosz, who tracks global tech layoffs especially among the engineering/developer teams, the Github team in India has been let go at once.

    “We’re talking of 100 engineers. This was done as the team was smaller than other locations, owning fewer and lower priority stuff,” he said in a tweet.

    Orosz said he confirmed the layoffs after “talking with (now former) GitHub India engineers”.

    A GitHub spokesperson told IANS that as part of the reorganisation plan shared in February, “workforce reductions were made today”.

    It was “part of difficult but necessary decisions and realignments to both protect the health of our business in the short term and grant us the capacity to invest in our long-term strategy moving forward,” said the company spokesperson.

    Microsoft-owned open source developer platform in February announced it was laying off 10 per cent of its workforce through the end of the company’s fiscal year.

    GitHub had about 3,000 employees before the layoffs were announced.

    In an email to employees, GitHub CEO Thomas Dohmke had said that sustained growth is important for every business.

    “Today, we are the home of 100 million developers, and we must become the developer-first engineering system for the world of tomorrow. We must continue to help our customers grow and thrive with GitHub, expedite and simplify their cloud adoption journey, while supporting them every day,” the CEO wrote.

    “Unfortunately, this will include changes that will result in a reduction of GitHub’s workforce by up to 10 per cent through the end of FY23. The hiring pause that I announced on January 18 remains in effect,” he added.

    The open source developer platform has reached 100 million members globally, and is growing fast in India too where it has crossed 10 million developers on the platform.

    This makes India the second largest developer community on GitHub, behind the US.

    New Delhi: Finance Minister Nirmala Sitharaman said on Saturday that the entire GST compensation cess for June 2022 totalling Rs 16,982 crore will be cleared.

    She said this while addressing a press conference soon after the 49th meeting of the GST Council ended.

    She also informed that Rs 16,524 crore to six states which have submitted the accountant general’s (AG) certificate will also be released.

    Delhi, Tamil Nadu and Telangana are among the six states which have submitted AG certificates.

    Though submission of AG certificate is a requirement for the states to seek GST compensation, Sitharaman said that it wasn’t a strict pre-requisite, as 90 per cent of funds are anyway released to the states, while the remaining amount is given after the AG certificate is submitted.

    The GST Council meeting, which was held at Vigyan Bhavan here, discussed matters pertaining to setting up of appellate tribunals and curbing tax evasion in pan masala and gutkha businesses.

    The groupf of ministers’ (GoM) report on taxation for pan masala was accepted by the council.

    At the meeting, the GST Council decided to reduce GST on pencil sharpeners and certain tracking devices. Exemption on coal rejects supplied by and to the washeries was also approved by the Council. Also, GST on a type of liquid jaggery has been reduced to nil from 18 per cent if sold loose. If its pre-packaged and labelled, the tax rate on it would be 5 per cent.

    The GST Council also recommended rationalisation of late fee for delayed filing of annual returns.

    However, no decision could be arrived at by the fitment committee for SUVs and MUVs.

    Sitharaman said that the GST Council decided to tax services supplied by courts and tribunals under the reverse charge mechanism.

    She also informed that the decision on the GST Appellate Tribunal has been accepted with change in language and the modification in draft will be circulated within a week.

    Sitharaman said that she expects to finalise the GoM report on GST tribunals with slight modifications so that it is ready by March 1 and can be included in the Finance Bill.

    The GoM’s report on online gaming could not be taken up at the meeting as the Chairman of the GoM, Meghalaya Chief Minister Conrad Sangma, could not attend the meeting due to the upcoming Assembly elections in the state, the Finance Minister said.

    SRINAGAR: Thousands of fish died after some people allegedly poisoned them in a farm at Bhatnoora village in Pulwama, an official said.

    Quoting Manzoor Ahmad Mir son of Ab Salam Mir of Bhatnoora who was running the farm for the last eight years news agency KNO reported that unknown people mixed some poisonous substance in the water entering the farm causing death to fish.  He said that some fishes were even 5-6 year old, weighing about 2 kg each.

    “It has caused loss in lakhs and shattered my dreams. It was a source of livelihood for me,” he said.

    He along with his family members requested concerned authorities to look into the matter and nab those responsible for the incident.

    A police official said that prima facie it seems an act of mischief committed by someone to inflict damages to the owner.

    He said a case has been registered and further investigations have been taken up.

    New Delhi: Chinese short video-making app TikTok has reportedly sacked its entire India staff — about 40 employees — and February 28 will be their last working day.

    According to a report in The Economic Times, the ByteDance-owned platform, banned in India in June 2020 over national security concerns, told its employees they would receive up to nine months of severance package.

    However, most of the staff will only get three-month severance.

    In June 2020, the government banned TikTok along with 59 other Chinese apps citing security concerns.

    Since then, the country has banned over 300 Chinese apps, including WeChat, Shareit, Helo, Likee, UC News, Bigo Live, UC Browser and many more.

    The Centre last week blocked over 230 apps, including 138 betting and about 94 loan apps, which were traced to Chinese links.

    The Ministry of Electronics and Information Technology (MeitY) was recently instructed by the MHA to ban such apps, which operate through a third party link.

    All these apps were found violating Section 69 of the IT Act and contained materials which were deemed as a threat to India’s sovereignty and integrity.

    Meanwhile, US Senator Michael Bennett has urged Apple CEO Tim Cook and Google CEO Sundar Pichai to immediately remove TikTok from their app stores, calling it an unacceptable risk to American national security.

    The US plans to ban Chinese short video-making app TikTok nationwide, and the House Foreign Affairs Committee will hold a vote next month on a bill to completely block the platform.
