    Atiq Ahmed moves SC claiming he may be killed in fake encounter by UP police

    New Delhi: Jailed former Samajwadi Party MP and gangster Atiq Ahmed on Wednesday moved the Supreme Court for protection, claiming that he and his family have been falsely “roped in” as accused in the Umesh Pal murder case in Prayagraj and he may be killed in a fake encounter by the Uttar Pradesh Police.

    In his plea, Ahmed, who is presently lodged at the central jail Ahmedabad in Gujarat, has referred to the statement made by Uttar Pradesh Chief Minister Yogi Adityanath on the floor of the Assembly to “completely ruin and destroy” him and claimed there is a “genuine and perceptible threat” to his and his family members’ lives.

    He said the Uttar Pradesh Police in all likelihood will seek his transit remand and also police remand to take him from Ahmedabad to Prayagraj and he “genuinely apprehends that he may be eliminated during this transit period”.

    In his plea filed in the apex court, 61-year-old Ahmed has sought directions to the Centre, state of Uttar Pradesh and others to protect his life against the “open, direct and immediate threat” to his life from high state functionaries of Uttar Pradesh.

    “After the murder of Umesh Pal, Opposition put fuel in the fire in the House which provoked the CM to say… ‘mafia ko mitti me mila doonga’ because petitioner was the main subject in argument in House,” the plea said.

    “Petitioner (Ahmed) genuinely apprehends and believes that the petitioner may be killed in a fake encounter on one pretext or the other by UP police particularly in view of the statement made by the Chief Minister of state of UP on the floor of the house,” the plea alleged.

    Umesh Pal, who was the prime witness in then BSP MLA Raju Pal’s murder in 2005, and his police security guard Sandeep Nishad were shot dead on Friday last outside his home in Dhoomanganj area of Prayagraj.

    Umesh Pal was a key witness in the 2005 MLA murder case in Prayagraj in which Ahmed and others are prime accused.

    Arbaaz, an accused in the Umesh Pal murder case, was killed in an encounter with the police on Monday. Dhoomanganj police station SHO Rajesh Maurya was also injured in the encounter.

    The petition was filed on a day the Prayagraj Development Authority (PDA) demolished the house of a close aide of Ahmed.

    Prayagraj Development Authority secretary Ajit Singh said the house belonging to Zafar Ahmed has been bulldozed. He said Atiq Ahmed’s wife Shaista Parveen used to stay in the same house earlier.

    “The said house was constructed without getting its map (naksha) passed from the authority and a notice regarding the same was issued in the past. Most of the house was destroyed by the afternoon,” the officer said.

    Meanwhile, in his plea, Ahmed sought a direction to the Centre to ensure his safety and security and that no physical or bodily injury or any other harm is caused to him and his family members.

    He has sought directions restraining the state of Uttar Pradesh and others from taking him from Ahmedabad to Prayagraj or any part of Uttar Pradesh.

    He has requested that his interrogation, if any, be carried out at the Central Jail Ahmedabad or at any other suitable place in Ahmedabad itself under the protection of Gujarat Police as well as central or paramilitary forces.

    He has sought the top court’s direction for his transit from Ahmedabad to Uttar Pradesh under the protection of any central police or paramilitary force if at all the transit is necessary.

    He has sought a direction allowing his advocate to remain present during his interrogation and also to quash the warrants against him, if issued by any court, for taking him to Prayagraj from central jail Ahmedabad.

    The plea claimed that the chief minister of Uttar Pradesh, without any investigation and merely on the basis of suspicion, had made a statement on the floor of the state Assembly that Ahmed will be “destroyed and eliminated completely”.

    “In such circumstances, the petitioner is constrained to file the present writ petition under Article 32 of the Constitution of India before this court for the protection of his life guaranteed under Article 21 of the Constitution of India,” it said.

    The plea claimed the petitioner and his family members have no connection in the Umesh Pal murder case and it seems that a conspiracy has been hatched to completely wipe out him and his entire family politically as well physically by falsely roping them in this case.

    It alleged that two minor sons of Ahmed have already been taken into “illegal custody” by the police since February 24 and they are kept at an undisclosed location.

    “It is even unknown to the petitioner whether they are dead or alive. The other two sons of the petitioner are also in jail in other false cases,” it said, adding that the petitioner fears for the safety of his family members and has apprehensions that they may be killed in a fake encounter.

    The plea alleged that the petitioner and his family members have been falsely implicated and named in the FIR due to political and various other reasons and the main reason seems to be that his wife has joined the BSP and the party has declared her as a candidate for the post of Mayor in the forthcoming election.

    “It was very well known to the rivals of the petitioner that if anything were to happen to Umesh Pal, then the petitioner would certainly be the prime suspect in view of the pending case against him by Umesh Pal and he will be made an accused. The same has been done,” the plea claimed.

    Srinagar: One terrorist has been killed in an ongoing encounter between terrorists and security forces at Padgampura area in South Kashmir’s Pulwama district, officials said on Tuesday.

    “One terrorist killed. Body of the killed terrorist yet to be retrieved. Encounter in progress,” the police said.

    The firefight started after a joint team of police and security forces got input about the presence of terrorists in that area.

    After security forces cordoned off the area, terrorists hiding there started firing drawing retaliation by the security forces.

    There have been a series of encounters between terrorists and security forces across Kashmir in the recent past in which many terrorists have been eliminated.

    Srinagar, February 28: One militant has been killed while as two army soldiers were injured in an ongoing encounter at Padgampora area of South Kashmir’s Awantipora on tuesday.

    Official sources told , that one militant has been killed in an ongoing encounter, however identity of the slain militant is yet to be ascertained.

    Meanwhile two army troopers also recieved bullet wounds in the gunfight, who have been subsequently shifted to hospital for further treatment.

    Earlier Reports reaching GNS that a joint team of Police and army launched a cordon and search operation in Padgampora.

    As the joint team of forces approached towards the suspected spot, the hiding militants fired upon the forces, triggering off a gunfight.

    Prayagraj: One sharpshooter involved in the Umesh Pal murder case has been shot dead by the police after an encounter.

    The Special Operations Group of the Uttar Pradesh Police and the district police shot the accused, identified as Arbaz, at the Nehru Park in Prayagraj on Monday.

    Umesh Pal, the prime witness in the 2005 BSP MLA Raju Pal murder case, was shot dead on Friday evening at his residence in Uttar Pradesh’s Prayagraj.

    Umesh Pal was shot dead by an unidentified man while he was getting out of the backseat of a Hyundai Creta SUV in Prayagraj. Pal was rushed to Swaroop Rani Nehru Hospital, where he succumbed during treatment. Pal’s autopsy report revealed that he was shot seven times.

    Following the murder, Umesh Pal’s wife Jaya Pal approached Prayagraj police and filed an FIR.

    A case under relevant sections of the IPC and Explosives Act was registered against former MP Atiq Ahmed’s brother, wife Shaista Praveen and his sons and several others.

    SRINAGAR: A local court on Monday rejected the bail plea of a former police driver for his involvement in a ‘fake encounter’ 16 years ago in northern Kashmir’s Bandipora district.

    Principal Sessions Judge Bandipora Amit Sharma while rejecting the bail plea of accused police officer Faroooq Ahmad Padroo, said that bail cannot be granted to a person who has shaken the basic faith and confidence of the common man in the working of the police organization.

    The court observed that the accused persons involved in this FIR are none other than the police officers/officials and under the garb of the police uniform such type of “Fake encounter” was committed definitely shaken the basic faith and confidence of the common man in the working of the police organization and the said crime committed by this accused person become more severe simply because of this reason.

    Farooq Ahmad Padroo, a police driver is co-accused along with former SSP Ganderbal Hans Raj Parihar in an infamous fake encounter killing of a cloth merchant-Gh nabi Wani of Kokernag in 2006. Padroo is facing trial in cases FIR No.52/2006 police station Sumbal for commission of offences punishable under Sections 302 (murder), 364 (abduction), 120-B (criminal conspiracy), 201 (causing disappearance of evidence), 344 (wrongful confinement) RPC .

    The accused petitioner through his counsel Advocate Parvaiz Nazir had appealed for bail on the grounds that the accused is facing trial for more than 15 years and there is no chance for the conclusion of the trial in the near future. Petitioner pleaded that the long detention of the accused under trial prisoner developed various ailments including psychiatric disorder, with the result that the accused is not in a position to communicate and behave properly.

    The petitioner prayed that it is old and falls within the exception of bail while the court has also granted bail to two other accused in the same case thus sought the same treatment. Counsel for the petitioners pleaded that he has got right to speedy trial enshrined under Article 21 of the Constitution, but in the instant case, the applicant has been deprived of the same, as none of his faults therefore indulgence of this court is imperative.

    However the state on behalf of the victim’s family through Public Prosecutor Abdul Majid and Additional Public prosecutor Bilal Ahmad objected to the bail plea and prayed for rejection of the bail.

    The Public Prosecutor pleaded that the entire evidence on record recorded during the proceedings of trial proves the involvement of the accused person in the offence of gruesome murder of an innocent individual of the soil. He pleaded that the offence is more heinous and more serious in nature because it has been committed by the persons who were supposed to uphold and implement the law of the land and were guidance and protectors of life and liberty of a common citizen.

    Counsel for the victim family stated that the accused is involved in abduction of an innocent person and thereafter staging a drama of fake encounter and the accused persons thus turned to be beasts rather than protectors of life and liberty of those for whom they were appointed so as such, the above named accused is not entitled to the concession of bail.

    “The offence is heinous and grave besides non-bailable in character, as such, the above named accused are not entitled to the concession of bail,” they pleaded.

    The court rejected the plea of the accused petitioner and stated that the discussion and the evidence available on record of the file as well as taking into consideration the conduct of the accused and without commenting upon the merits of the case, this court is not inclined to enlarge the petitioner on bail.

    While rejecting the bail application of the accused, court stated that the accused persons involved in this FIR are none other than the police officers/officials and under the garb of the police uniform such type of “Fake encounter” was committed has shaken the basic faith and confidence of the common man in the working of the police organization and the said crime committed by this accused person become more severe simply because of this reason.

    The court highlighted the plea of the counsel for the victim family that “the deceased killed in this encounter was actually the resident of the village of the accused and the said deceased who used to sell Dastarkhan sheets (dining cloth) on the Biscoe School pavements. It is from this place when he had been lifted by the police team. Thereafter he was kept in the SOG Camp at Manasbal and during these in between period the learned PP submitted that, “the wife of the said deceased approached the petitioner for tracing out her husband who was missing then and not returned to his house as the wife of the deceased never ever being the poor lady was having only the approach of the petitioner who was working as a police official and from the village of the said deceased. But the petitioner never bothered about the tears and cries of the wife of the deceased and cleverly carried forward the nefarious design and mode of committing this horrendous crime of murder”.

    The judge added ‘meaning thereby any concession of bail either on medical grounds or on other grounds at this stage of the trial definitely shaken the spine of the common man in the present setup of the criminal justice system. “Hence the bail application moved by the accused person under Section 439 Cr.P.C rejected,” the court observed.

    San Francisco: An asteroid, about the size of a box truck, will have a very close encounter with the Earth this week, NASA Systems has predicted.

    The asteroid, called Asteroid 2023, is expected to fly over South America. During its flight, the asteroid is predicted to be only 2,200 miles above Earth’s surface, making it the closest in recorded history, according to NASA.

    However, the space agency said that there is no risk of the asteroid impacting Earth, and even if it did, the small asteroid, which is estimated to be 11.5 to 28 feet (3.5 to 8.5 metres) across, would disintegrate harmlessly in the atmosphere, with some of the larger debris potentially falling as small meteorites.

    The asteroid was initially spotted by amateur astronomer Gennadiy Borisov on Saturday and reported to the Minor Planet Center (MPC).

    NASA’s Scout impact hazard assessment system was then used to analyse MPC’s data and predict the near miss.

    “Scout quickly ruled out 2023 BU as an impactor, but despite the very few observations, it was nonetheless able to predict that the asteroid would make an extraordinarily close approach with Earth,” Davide Farnocchia, a navigation engineer at JPL who developed Scout, said in a statement.

    “In fact, this is one of the closest approaches by a known near-Earth object ever recorded,” he added.

    Although this asteroid poses no threat to Earth, NASA has been focusing on building planetary defences against them.

    Barely a month after Elena Rybakina won Wimbledon last year, she did not feel like a grand slam champion. She entered the US Open ranked world No 25, having received no points from the WTA-sanctioned All England Club, and lost her first-round match. In straight sets. Against the 131st-ranked Clara Burel.     On Monday the 23-year-old Moscow-born Kazakh opened her 2023 Australian Open campaign on Court 13 and has flown somewhat under the radar all week, despite her subsequent promotion to the show courts. “Well, I guess it’s a motivation to win even more,” she said on Friday. “Maybe next time they’re going to put me first match somewhere else, not the Court 13.”

    If ever there was a sign her march is destined for Rod Laver Arena, it was her third-round defeat of last year’s runner-up. Danielle Collins does not go easily. The American, with her signature resolve, pushed her to three sets on Kia Arena. But Rybakina is back in form and looking every bit the player who swept aside Bianca Andreescu, Simona Halep and Ons Jabeur en route to her first grand slam title.

    Her first-serve win percentage hovered in the 80s and 83 minutes passed before Collins fashioned a break point, from which she secured the second set before falling 6-2, 5-7, 6-2. “I’m feeling better, stronger,” Rybakina said. “So hopefully I can continue like this. Compared [to the] middle of the season, it was a bit tough for me because I was trying to play many tournaments … I would say I didn’t have good preparation for [the] hard-court season after Wimbledon. Definitely now I’m feeling much better.”

    This can only be a good thing given her next opponent also seems to be getting better. Iga Swiatek finished 2022 with two majors and nine months atop the rankings. Almost a fortnight after Rybakina’s premature departure from Flushing Meadows, Swiatek left with the trophy, and at Melbourne Park her dominance is yet to be tested. On Friday she punished Cristina Bucsa, the Moldova-born Spanish qualifier who had shocked Andreescu out of the tournament, but against the Polish 21-year-old Bucsa appeared nervous and destined for a double-bagel. When she finally won a game, the crowd at Margaret Court Arena roared in encouragement, only for Swiatek to serve out the match for a regulation 6-0, 6-1 win.

    “I felt like I’m in a little bit of a flow, so that’s nice,” said Swiatek. “I always try to focus on the same stuff, pretty technical stuff. It doesn’t matter if I’m winning or losing, it’s all the same to help me stay disciplined.

    “I’ve always wanted to be that kind of player who is consistent, so I’m pretty happy that I’m achieving that goal. I just remember how it was a couple of years ago: when I was in the fourth round I was really exhausted. Right now I feel like this is the right place to be.”

    The Swiatek v Rybakina last-16 showdown will be the first meeting of reigning grand slam champions since July 2021, when Ash Barty defeated Barbora Krejcikova in the Cincinnati Open quarter-finals. Both know what is coming, with Rybakina describing Swiatek as “very strong physically and mentally” and Swiatek saying Rybakina “really is a solid player”.

    “Since we played juniors, I knew that she’s like kind of going the right direction,” Swiatek said. “With her serve, she can do a lot.

    “But tactically I’m not prepared yet. We played exhibition in Dubai. I really treated [that loss in December] as a practice so it’s hard kind of to take a lot from that match. Also, we played in Ostrava two years ago [a win] and the surface was so slow it’s also hard to take anything tactically from that. We have both made such progress it doesn’t really matter what happened a couple of years ago.”

    This side of the draw gets interesting from there, with the second week tossing up a quarter-final against either Coco Gauff or Jelena Ostapenko, who defeated Bernarda Pera and Kateryna Baindl respectively on Friday. Jessica Pegula, the third seed, progressed in the draw’s other half after making short work of Marta Kostyuk and will face Krejcikova for a place in the quarter-finals.
