SC junks Kerala’s plea against translocation of rogue elephant to tiger reserve

    [ad_1]

New Delhi: The Supreme Court on Monday declined to entertain a Kerala government plea challenging the state high court order asking it to translocate a rogue elephant to the Parambikulam tiger reserve in the state’s Palakkad district.

The Kerala government, earlier in the day, mentioned the plea for hearing before a bench headed by Chief Justice of India D.Y. Chandrachud and it decided to hear the plea during the day.

During the hearing, the bench, also comprising Justices P.S. Narasimha and J.B. Pardiwala, observed that the high court had considered the view of the expert committee and passed a reasoned order. However, the state government pressed that the elephant should be sent to a training centre, since it had killed seven people and destroyed several homes.

The bench told the Kerala government counsel that experts have said that the elephant needs to be relocated, while declining to interfere with the high court order. It further added that the committee has suggested something and the state government cannot go over it.

The state government contended that one week was given by the high court to relocate the elephant to an alternative space, and if the state government fails, then it has to be shifted to Parambikulam. Counsel pressed that the government had decided to relocate the elephant to a training centre against the backdrop that the elephant had killed people and destroyed several homes.

After hearing arguments in the matter, the bench declined to entertain the appeal by the state government against the high court order.

The Kerala High Court, last week, declined to review its decision to translocate the rice-eating tusker to the Parambikulam tiger reserve.

On April 5, the high court had directed relocation of the elephant to the tiger reserve in accordance with the suggestion made by the expert committee.

TN: Forest dept tracking movement of orphaned elephant calves

    [ad_1]

Chennai: The Tamil Nadu forest department is tracking the movement of two nine-month-old elephant calves orphaned after three female elephants were electrocuted to death on March 7 at Kali Kavundar Kottai Village in Kundalahalli in Dharmapuri district of Tamil Nadu.

Dharmapuri forest range officer Nagaraj told IANS, “The calves were present in the area where the female elephants of the herd were found dead. We tried to feed them fruits and grains but they ate banana leaves and fed on maize fields in the area.”

He said that the elephant calves might continue in the area due to the grief. Elephants, he added, have emotions like humans.

The officer said that the elephant calves were now seen following a tusker and added that the forest department is tracking their movement for which an eight-member team has been deputed.

Dung samples of the calves to learn about the health condition of these animals and found them to be healthy.

Notably, six days after the female elephants were electrocuted, the calves remained in Marandahalli where the tragedy took place. The Madras High Court had directed the state forest department to closely monitor the movement of the calves after hearing a public interest petition filed by a wildlife enthusiast on the condition of the calves.

  • Why not create National Elephant Conservation Authority, SC asks Centre

Why not create National Elephant Conservation Authority, SC asks Centre

    [ad_1]

New Delhi: The Supreme Court on Wednesday sought reply from Centre on a 2010 ‘Gajah Report’ recommendation on conferring statutory status to a proposed body National Elephant Conservation Authority (NECA) for the preservation of elephant corridors.

A bench headed by Chief Justice D.Y. Chandrachud said, “In the recommendations submitted in Gajah report, there was a recommendation to the effect that ‘Project Elephant’ be converted into a statutory agency.”

The top court was hearing a plea by activist Prerna Singh Bindra.

According to the government, the elephant population has reached 29,964 (as per the census 2017) in India, the elephant habitats are being consolidated across India, and the Elephant Reserves area has been increased.

The government emphasised that it is deeply committed to protect the safety of the elephants and continued to take various steps to prevent their death including electrocution. Additional Solicitor General Aishwarya Bhati represented the central government in the apex court.

The bench, also comprising Justices P.S. Narasimha and J.B. Pardiwala, added that the task force has proposed that the new body may be termed as the ‘National Elephant Conservation Authority’ (NECA). It further suggested that amendments can be introduced to effectuate the conferment of a statutory status on the authority.

“Since the proposal would envisage requisite legislative amendments, this is something of which would be appropriate for the Ministry of Environment and Forest and Climate Change to respond,” it said.

During the hearing in the matter, the bench also sought a status report on setting up of the central project elephant monitoring committee for the purpose of monitoring and implementation of relevant directions and guidelines in connection with the protection of elephants.

In a written response, the Central government said: “Continuous efforts have been made to minimise the human elephant conflict and also to ensure the welfare of captive elephants in India.”

After hearing arguments, the apex court directed the Ministry and the Central Electricity Authority to facilitate an inspection of the protected areas to avoid electrocution of elephants.

The bench gave Centre four weeks’ time to file a response in a PIL filed by activist Bindra.

The petitioner had contended that the electrocution is one of the major reasons for deaths of elephants and sought a direction for insulation of high voltage power transmission lines passing through protected areas, elephant reserves, identified elephant corridors and known areas of elephant movement.

  • Amid outrage among locals, TN forest dept chasing away wild elephant into deep forests

Amid outrage among locals, TN forest dept chasing away wild elephant into deep forests

    [ad_1]

Chennai: After strong protests by the people in the Gudalur area in Nilgiris district, the Tamil Nadu forest department is chasing away a tuskless male elephant, also knwon as ‘Makhna’, into the deep forests in the Madumalai Tiger Reserve (MTR).

Forest officials of MTR told IANS that the elephant, which is around 40 years old, has not yet posed threat to humans. But of late, there have been complaints from the local people that elephants have been creating havoc in their agricultural lands, causing damage to crops.

While the Makhna has not been antagonistic towards human beings, recently it destroyed three farm lands, causing extensive damage to crops.

A senior official of the forest department told IANS, “People have launched a campaign in Gudalur and other areas of Nilgiris to drive this elephant into the forest. Even though we know that it’s a harmless elephant, we have now decided to chase it into the deep forest land in the MTR area.”

The official said that the forest department is driving the elephant into deep forests taking into account the safety of the tusker.

It is to be noted here that the Palakkad Tusker 7 (PT7), which had killed a morning walker and damaged crops extensively in the Dhoni area in Palakkad district in Kerala, was captured a few days back by the Kerala forest department. Medical check-up showed that 15 pellets were fired at it from air guns.

Kerala Forest Minister A.K. Saseendran had said that farmers should not resort to such cruel acts against elephants.

Tamil Nadu forest department officials are hence driving the Makhna into the deep forests to prevent it from the wrath of the local people.
