    Justice Katju Affirms Right to Celebrate Eid Milad un Nabi

    There are two Eids which are celebrated with joy by all Muslims viz Eid ul Fitr, which is celebrated at the end of the Holy Month of Ramzan, and Eid al Adha ( also called Bakrid in India ) in which an animal is sacrificed, in memory of the sacrifice of a lamb by Prophet Abraham.

    However, there is a third Eid called Eid Milad un Nabi, which is the birthday of Prophet Mohammad, and which is falling tomorrow, 28th September 2023.

    About this third Eid there is a controversy among Muslims. The orthodox Muslims known as Salafi or Wahabi are against celebrating it, as they say that this is ‘shirk’ i.e. giving a companion to God, or deification or worship of someone other than God. 

    According to such Muslims, celebrating the birthday of the Prophet implies treating the Prophet as a God, and thus there will be two Gods viz Allah and the Prophet, whereas Islam recognises only one God.

    On the other hand, the more liberal and tolerant Muslims say that celebrating the birthday of the Prophet is only giving him respect, and not elevating him as a God.

    In this connection I may relate a case which came before my court when I was a Judge in the Allahabad High Court.

    A petition was filed before me by some Salafi Muslims, and their prayer was that I should prohibit the taking out of a procession in Saharanpur district in UP on the occasion of Eid Milad un Nabi, which was on the next day.

    I asked the learned counsel for the ;petitioners why I should pass such an order ? He replied that celebrating Ed Milad un Nabi was unislamic and offends the religious feelings of the petitioners.

    I said that if the petitioners did not wish to celebrate Eid Milad un Nabi they need not participate in the procession or look at it. But this was a free country, and there was no law prohibiting such processions. I would only enforce the law, not religious feelings. 

    Saying this I dismissed the petition.

    I may relate another incident.

    When I was a Judge in the Supreme Court a petition was filed before a bench presided over by me by some orthodox Muslims who prayed that an order should be passed prohibiting any Muslim from saying ” Ya Ali ” or ” Ya Gharib Nawaz ” ( Ali was the son-in-law of the Prophet, and Gharib Nawaz is the appellation often attributed to the saint of Ajmer dargah, Moinuddin Chishti ).

    I asked why we should pass such an order ? The counsel replied that saying ” Ya Ali ” or ” Ya Gharib Nawaz ” was shirk, as it treated Ali or Moinuddin Chishti as Gods.

    I said that saying it does not violate any law, and the petition was frivolous and without any merit. If the petitioners did not want to say ” Ya Ali ” or ” Ya Gharib Nawaz ” they need not say it, but how can they stop others from saying it in a free country ?  

    Saying this, we dismissed the petition

    Today 29th June is Eid al Adha ( also called Eid ul Zoha or Bakrid ) an important festival among Muslims in which an animal is sacrificed ( qurbani ).


    This reminded me of a case I heard in the Allahabad High Court shortly after I was appointed a Judge there in 1991.


    The petition, presented a few days before Eid al Adha, prayed that I should order ban on slaughter of buffaloes as a sacrifice during Eid.


    Now it is a belief among Muslims that sacrifice of one buffalo gives the same spiritual benefit of qurbani to 7 persons which sacrifice of a goat gives to one person. So poor persons who cannot afford to buy a goat, often collectively buy a buffalo and sacrifice it, as the per head cost is much less than the cost of a goat.


    I asked the counsel for the petitioner why I should ban killing of buffaloes during Eid ? He replied that buffalo is the carriage ( sawaari ) of the Hindu god Yamraj ( the god of death ). So slaughter of buffaloes hurts the religious sentiments of Hindus.


    I replied that mouse is the sawaari of Lord Ganesh. Should I ban killing of mice ? Most Hindu gods ( it is said there are 330 million of them ) have some animal as a ‘sawaari’ or ‘vaahan’. Should killing all of such sawaaris be banned ?

    I added that this would be absurd. I could only prohibit killing of some animal if there is a statutory law against it. For instance, there is a law against killing of cows in most ( but not all ) states of India e.g. the UP Prevention of Cow Slaughter Act, 1955. So I could pass an order prohibiting slaughter of cows.


    There is also a Wildlife ( Protection ) Act, 1972, so I could prohibit killing of wildlife.


    But to prohibit killing of some animal, though there is no law for that, just because someone’s religious feelings are allegedly ‘hurt’, would not only have no legal justification, but would also raise a host of problems.

    Which animal is sacred ?

    Opinions may differ on that ?

    When do religious feelings get ‘hurt’ ?

    Again, opinions may differ.


    I dismissed the petition, saying I would only enforce the law, not sentiments.

    1) Taking a bath (Ghusl).

    2) Wearing one’s best clothes, and for the men perfuming themselves.

    Syed Maqbool Hasan was the Shahr Qazi of Allahabad ( my home town ) for over half a century.

    Although he was also the Imam ( head priest) of Jama Masjid in Allahabad, he never took any money from the funds of Jama Masjid, and earned his livelihood as an ordinary stamp vendor in Allahabad High Court. 

    When I was a lawyer there ( 1970-1991) I used to see him sitting at the bottom of the stairs below the Bar Association Library, selling stamps. He wore a simple kurta pyjama, and on looking at him one could never make out that he was the Shahr Qazi.

    Until he agreed, Eid could not be declared in Allahabad. Since for declaring Eid two respectable Muslims must state that they have sighted the moon, he would rigorously cross examine the persons claiming that they had seen the moon, and he also strictly applied the parameters required before declaring Eid. His integrity was of such a high order that everyone in Allahabad accepted his verdict.

    Because of old age ( if alive he must be now in his  90s ) he retired, but before that he was coming to the High Court on a bicycle every working day from his home several miles away.

    In 1986 communal riots broke out in Allahabad, but he refused to take any police security, although it was offered to him. 

    He lived a simple life, and put all the money he earned in educating his children. Today one of his sons is in U.S.A. and the other children are also well settled, some in business, and others in other vocations.

    If he is alive, I request people in Allahabad to convey my Eid greetings to him.

    During the past 27 days of Holy month of Ramdhan, Amid the fluctuations in the rates people of kashmir has consumed 800+ trucks of Mutton, 110 trucks of dates and around 4-5Cr/day on watermelon.
    Mehraj ud din general secretary of Mutton Dealers has said: 30-35 trucks loaded with sheep arrive in kashmir on regular basis and would go up to 160 trucks a day upto Eid.
    Bhadur Khan:president of dry fruit association has said, around 110 trucks of dates reached kashmir since last 25 days. He said that most of the dates consumed are Ajwa.
    President of food and vegetable association kashmir had provided an estimation that 4-5cr/day watermelon is being consumed in kashmir during the Holy Month.

    Since the last 25-30 years I have observed 1 day roza in the Holy month of Ramzan ( usually on the last Friday, called Alvida ), out of respect and to show solidarity with my Muslim brothers and sisters, and each year I appeal to non Muslims all over the world to do the same.

    This year the last Friday in India is on 21st April. The sehri time in Delhi ( different localities have different times ), as I was informed by some Muslim friends here, is 4.20 a.m. so I have to remain without food or water after that till the time of iftaar, which is at 6.40 p.m.

    I appeal to all non Muslims all over the world to do the same.

    This does not mean you have to give up your religion. It is just a symbolic act, to show our solidarity with our Muslim brothers and sisters.
