    Biden is not a dead man walking; he’s an old man getting around stiffly. Biden is vulnerable, but certainly electable; diminished, but still capable of delivering a message; uninspiring, but unthreatening.

    No one is going to mistake him for a world-beater. In the RealClearPolitics polling average, he leads Donald Trump by a whopping 0.8 percent. If his job approval has been ticking up, it’s still only at 44 percent. He walks as if he is only one step away from a bad fall, and an NBC poll earlier in the year found that just 28 percent of people think he has the mental and physical health necessary to be president.

    That said, he’s in the office, and no one else is. Incumbency bestows important advantages. The sitting president is highly visible, is the only civilian in the country who gets saluted by Marines walking out his door every day, has established a certain threshold ability to do the job, and can wield awesome powers to help his cause and that of his party.

    Since 1992, Trump is the only incumbent to have lost, failing to join Bill Clinton, George W. Bush and Barack Obama as re-elected incumbents.

    Biden was never going to be the next LBJ or FDR as a cadre of historians had seemingly convinced him early in his presidency. But he punched above his weight legislatively during his first two years, getting more out of a tied Senate and slender House majority than looked realistically possible. He’s set up to have the advantage in this year’s momentous debt-limit fight, since it’s hard to see how congressional Democrats aren’t united and congressional Republicans divided.

    Biden’s age is a liability for him, but comes with a significant benefit — he does not look or sound like a radical any more than the average elderly parent or grandparent. This has enabled him to govern from the left — he would have spent even more the first two years if he could have — without appearing threatening or wild-eyed. He hasn’t restored normality to Washington so much as familiarity as the old hand who has been there since 1973 and made his first attempt at national office in 1988.

    Since the midterms and likely in anticipation of a reelection campaign, Biden, who usually does whatever his party wants him to do, has shown a small independent streak. It’s hardly Bill Clinton-level triangulation, but the president is apparently mindful of the need to make a few feints to the center and of how progressive squawking can help him look more moderate.

    He said he wouldn’t veto congressional action blocking a D.C. crime bill, earning a rebuke from AOC among others. He’s considering bringing back family detention at the border, and pro-immigration groups are outraged. His approval of the Willow oil drilling project on Alaska’s North Slope “greenlights a carbon bomb,” according to the group Earthjustice.

    Importantly, in 2024, nothing Biden does will be considered in isolation, but instead compared to his Republican opponent. As of now, Trump has the best odds of being, once again, that adversary. Trump would have some significant chance of beating Biden, simply by virtue of being the Republican nominee, and there’s always a chance that events could be Biden’s undoing.

    But Trump would probably be weaker going into a rematch than the first time around. He lost to Biden in 2020 — before he denied the results of a national election, before a fevered band of his supporters stormed the Capitol on Jan. 6, before he indulged every 2020 conspiracy theory that came across his desk, before he said the Constitution should be suspended and before he made his primary campaign partly about rebuking traditional Republicans that the GOP suburbanites he’d need in a general election probably still feel warmly about.

    There’s also a strong possibility that Trump gets indicted once, or even twice, in coming months. Such charges would be perceived as unfair by Republicans — perhaps rightly so — but they would add to the haze of chaos around Trump.

    Ron DeSantis or another Republican contender presumably matches up better against Biden, based on the generational contrast and the absence of Trump’s baggage alone. Yet, if a non-Trump candidate wins the nomination, he or she will have Trump in the background, probably determined to gain revenge against him or her. Imagine, if after Biden defeated the rest of the Democratic field in 2020, they didn’t leave the race and collectively endorse him, but sulked and found ways to undermine him.

    Then, there’s the state of the GOP generally. It has an impressive crop of governors. Otherwise, it hasn’t seemed to take on board the lessons of the last couple of years. First, there’s a real chance that it will re-nominate Trump, after everything. Second, various state parties are irresistibly drawn to politically toxic, proven losers. In Pennsylvania, Doug Mastriano, who got wiped out in the gubernatorial race last year, is thinking about running for Senate next year and handily leads in early polling. Kari Lake, who threw away a winnable gubernatorial race that she still maintains she won, is looking to enter the GOP primary for Senate, and would be a prohibitive favorite.

    There’s no fortune quite like being lucky in your enemies, and Biden could well get a big break in this respect yet again. However much Republicans may wish he were a pushover, he’s not, and they should be acting accordingly.

    House GOP quickly sinks intel community’s hope for easy surveillance green light

    To add to the political headache, the Justice Department will need to win over a Republican House, where many of the lawmakers with oversight of the program are the very same who are leading a sweeping investigation into alleged political motivations within the DOJ and the FBI. The party’s relationship with the law enforcement apparatus soured sharply during former President Donald Trump’s tenure, amid GOP accusations that the Feds improperly targeted Trump and his allies.

    A group of House Republicans are already discussing letting the surveillance authority sunset entirely, according to a GOP aide. And in a significant red flag for supporters of the currently written program, Rep. Jim Jordan (R-Ohio) — who chairs the House Judiciary Committee, one of the four congressional panels that will lead the Section 702 discussions — said he won’t support extending the program without changes.

    In fact, he isn’t convinced yet that it needs to be continued at all.

    “We’re working on the kind of reforms we think need to happen, but frankly I think you should have to go get a warrant,” Jordan said in a brief interview.

    The Ohio Republican didn’t support reauthorizing the program in January 2018, so his skepticism is hardly surprising. But his influence has grown significantly since then: He is now wielding a gavel and has transitioned from leadership foe to ally. And his panel is now stacked with several members who not only oppose the specific surveillance authority set to sunset this year, but also have concerns about the broader Foreign Intelligence Surveillance Act.

    Those calls are being fueled, in part, by a recently declassified report on the use of Section 702 between December 2019 and May 2020. In a sign of the odd political bedfellows who are likely to push reforms, conservative Rep. Andy Biggs (R-Ariz.) and progressive Rep. Pramila Jayapal (D-Wash.), both members of Jordan’s panel, vented publicly over a detail tucked into a footnote of the report: An FBI intelligence analyst queried surveillance databases using only the name of a U.S. House member.

    The administration is aware that they are facing a heavy lift and aren’t ruling out changes to the program. Officials have stressed in interviews and in the Tuesday letter to congressional leadership that it is open to potential improvements.

    And they’re taking initial steps to try to quell a fight on the front end. Biden administration officials’ opening pitch is coming much earlier than it did in past years — they estimated they waited until September to begin discussions last time — and they’ve dropped their pitch for a permanent extension, which lawmakers balked at in 2018. They’re also offering to give lawmakers classified briefings to make their case for reauthorization.

    But the Biden Administration is drawing a red line on an overhaul that would change the essential function of the authority. Director of National Intelligence Avril Haines and Attorney General Merrick Garland, in a letter to congressional leadership, wrote that they needed to “fully preserve its efficacy.”

    In a second prong of the administration’s opening salvo, Assistant Attorney General Matthew Olsen made his pitch for continuing the program during a Brookings Institution event on Tuesday using stark terms.

    “What keeps me up at night is thinking about what will happen if we fail to renew Section 702 of FISA,” he said.

    And Biden administration officials are preemptively pushing back on likely proposals from privacy advocates who want to change the program. One area that is already coming under early reform chatter is so-called “backdoor” searches, when government agencies sift through already acquired data for information that was “incidentally” collected on Americans. A senior administration official argued that banning or trying to restrict searches involving U.S. persons “would either ban or restrict the government from accessing in a timely way potentially critical information.”

    The administration does have its congressional allies, particularly among Senate leadership and members of both the House and Senate Intelligence Committees. Senate Majority Leader Chuck Schumer and Minority Leader Mitch McConnell, as well as the Intelligence panel’s bipartisan leaders, all voted to reauthorize the program in 2018. Of the 65 lawmakers who previously voted to reauthorize 702, roughly 20 have left the Senate — meaning supporters will need to pick up new allies.

    And in a nod to the difficult debate ahead, Reps. Darin LaHood (R-Ill.), Brian Fitzpatrick (R-Pa.) and Chris Stewart (R-Utah) have been quietly working on the reauthorization effort since last year. The three Republicans, each on their chamber’s Intelligence Committee, want to reauthorize the program, though they are expected to pair that with broader FISA reforms — including in how judges are assigned to surveillance applications.

    Rep. Mike Turner (R-Ohio), who chairs the House Intelligence Committee and who tapped the trio to take the lead, echoed their general direction, saying FISA is a “critical tool in our national security arsenal” and that he supports extending it but “with reforms that will protect American’s civil liberties.”

    But privacy advocates believe they are at a point of maximum leverage. Unlike in 2020 when a congressional stalemate — and mixed signals between then-President Trump and Attorney General Bill Barr — led to three unrelated surveillance powers lapsing, critics of Section 702 believe the administration views the program as so critical that they will agree to sweeping changes that might have once been off the table.

    The administration is urging lawmakers to stay narrowly focused on Section 702, but officials admit that’s unlikely. That’s in part because of a high-profile series of reports from DOJ Inspector General Michael Horowitz that found “widespread” non-compliance by the department when it came to a key step in FBI procedure that was designed as a guardrail for ensuring accuracy in surveillance applications.

    We are “aware that there are those who want to talk about reforms or changes,” said a senior administration official, granted anonymity to speak candidly. “And in the months to come, of course, we anticipate hearing what it is that others who want to have those conversations have in mind.”

    Elsewhere, Trump has praised the anti-abortion movement and his role in picking conservative justices, but has also criticized some leaders in that movement for not doing enough in the 2022 midterm election. He has also said the issue was “poorly handled” by Republicans, pointing to members and candidates who advocated for no exceptions to bans on abortion.

    Trump’s team believes that he can thread the needle between touting the work he did in facilitating the end of Roe while staying on the popular side of public opinion about abortion restrictions.

    “Especially in the primary, it’s a very strong talking point for the president. He’s got a good record, and he’s on good ground going into the primary and general election,” said John McLaughlin, a Republican pollster who advises Trump. “His position since he ran for office and since he was in office has been consistent.”

    But navigating those twin achievements from his time in office could become tricky to handle over the course of a potential primary and general election run. Trump has begun taking steps to try and maneuver that political landscape.

    At the Council for National Policy summit last weekend at Trump Doral in Miami, he called in to praise the group’s work promoting conservative policies and touted his anti-abortion legacy, according to a recording of the call shared with POLITICO. The call came amid reports that evangelicals and pro-life leaders have been keeping their options open going into the 2024 Republican primary.

    “We appointed 300 judges. We appointed, as you know, the three Supreme Court judges that made your whole right to life, and everybody was trying to get this for many, many years, for many, many decades, and we were able to get that done. And we’re very proud of it, and it was a tremendous tribute to many of the people in the room that worked so hard with us,” Trump said in the roughly five-minute call. “But it was the whole pro-life movement. They say I’m the most pro-life president in American history.”

    Steve Cheung, a Trump campaign spokesperson, called the former president’s record “unmatched” when it came to “nominating pro-life federal judges and Supreme Court justices that overturned Roe v. Wade.” Of his boss, he added, “there has been no bigger advocate for the [anti-abortion] movement.”

    Trump is not the only Republican grappling with the issues of vaccines and abortion.

    His only official challenger in the race, Nikki Haley, ignored the latter issue in her launch speech but was confronted on it after in interviews. Haley, who has said she is “pro-life” because of her experiences as a mother and as governor of South Carolina, signed a law banning abortions past 20 weeks, said she would not support a “full-out federal ban” on abortion, but wouldn’t articulate exactly what she would stand behind now, only saying that there should be “consensus” on when exactly abortion should be banned.

    The issue confronting both Haley and Trump is that any abortion policy stance that plays well in a primary may present problems in a general election. While only 35 percent of Republicans said they disagreed with the Supreme Court’s decision to overturn Roe v. Wade, the decision is overall unpopular among Americans, with a majority — 56 percent — saying they did not support the decision, according to a recent Ipsos poll.

    Trump could be rewarded by GOP voters for putting conservatives on the Supreme Court. But Erick Erickson, a conservative radio host who does not plan to endorse any candidate in the GOP primaries, said the former president had an altogether different “vulnerability” on the topic: “that it is no longer an issue.”

    “The conservative voters don’t need Donald Trump now to put conservatives on the court, he did it. If anything, he’s kind of hurt himself among social conservatives after Dobbs, by coming out and saying maybe it wasn’t a good idea,” Erickson said.

    The more complicated issue, Trump allies say, will be how he navigates his role in the Covid-19 pandemic. Privately, Trump has expressed pride in the historic efforts to produce a vaccine. But he is also quite aware that the far-right has made vaccinations and especially mandates a toxic issue. He was personally booed for telling a crowd he had gotten a booster shot.

    Cheung called Operation Warp Speed a “once-in-a-lifetime initiative that gave people the option of utilizing therapeutics if they wished to do so.” But he also stressed that Trump “fought against any attempt to federalize the pandemic response by protecting every state’s right to ultimately decide what is best for their people because of the unique challenges each state faced.”

    Since launching his campaign, Trump has attacked another likely 2024 political foe, Florida Gov. Ron DeSantis for trying to “rewrite history” on his coronavirus response. Trump’s campaign has built up an arsenal of video clips showing DeSantis as supportive of the Covid vaccine even as he has become favored by the anti-vaccine right. The video moments include DeSantis personally greeting a FedEx truck with the first batch of Pfizer vaccines arriving in Florida.

    And one person close to the campaign suggested trying to turn former Vice President Mike Pence and Trump’s son-in-law Jared Kushner into the faces of Operation Warp Speed, noting that they had leadership roles in the vaccine’s development. But it’s unclear just how effective those lines of attack would be as time passes since the pandemic.

    “There may be a small faction in the Republican Party that this applies to, but I don’t see how many Republicans are going to hold it against anyone for promoting the vaccine back in 2020, whether it was Trump, DeSantis or anyone,” said Matt Wolking, a former Trump campaign official and Republican strategist. “The true hardcore anti-vaccine [crowd is] found on the right and the left and it’s been that way for decades. So I think most Republicans are going to continue to advocate for personal choice and not mandates.”

    But distrust of the Covid-19 vaccine — not just the mandates — has been a central theme of far-right broadcasts, including Steve Bannon’s “War Room” podcast, which regularly features skeptics on the show. Bannon, a former Trump strategist, has called vaccines and vaccine mandates a “major issue” for Republican voters and Trump’s base. He has warned against Trump leaning into his role promoting the development of the vaccine.

    Still, McLaughlin said he doesn’t see any risk to how Trump handles the vaccine. Some conservative voters may recoil at it. But, he said, the more significant dynamic was that the issue itself was no longer as animating as it once was.

    “I think people have moved on,” McLaughlin said. “I think there are more pressing issues that people are looking at. When you talk to the average person, they’re struggling to buy food or buy gas.”
