    New Delhi: A bench headed by Chief Justice of India D.Y. Chandrachud everyday usually hears around 100 cases on an average seeking urgent listing before the benches of the Supreme Court. The Chief Justice’s court is often packed with lawyers, who mention their matter seeking urgent hearing.

    During the mentioning of the cases, the Chief Justice is very soft spoken while engaging with lawyers and has rarely lost his cool during the court proceedings. However, on Tuesday, he got irked and warned a lawyer: “Don’t mess around with my authority.”

    The lawyer had mentioned a case and requested the court for an early hearing in the matter but after the bench told him that his matter will be listed on April 17, he asked the liberty to mention the matter before another bench. “I can mention before another bench, if permitted,” said the lawyer.

    The bench, headed by the Chief Justice, and also comprising Justices P.S. Narasimha and J.B. Pardiwala, told the lawyer not to play tricks with him and said: “You can’t mention it here and then elsewhere for an earlier date.”

    The lawyer understood that his submissions have irked the Chief Justice and expressed regret and said he should be excused for his submissions.

    The Chief Justice told the lawyer, “Yes, you are excused. But do not mess around with my authority”, as he proceeded with the mentioning process.

    It’s unclear who obtained the documents and who first circulated them online. On Monday, Kirby said it was also unclear whether more documents are out there.

    “We don’t know who’s behind this. We don’t know what the motive is. And … we don’t know what else might be out there,” Kirby said. “This is information that has no business in the public domain.”

    SRINAGAR: The High Court of Jammu & Kashmir and Ladakh recently noted that violent crimes against women and children are on the rise, and therefore, courts should not show any leniency to persons booked for such crimes, Bar and Bench reported.

    Justice Mohan Lal refused bail to a man who was imprisoned since June 2021 for raping his neighbour’s 10-year-old daughter. The Court stated that no woman would falsely accuse someone of raping her own underage daughter, putting her character at risk.

    “Rape is the most hated crime in the society which leaves a scar upon the most cherished personality of a victim, and, therefore, no self-respecting woman would normally concoct a story of rape,” the order stated.

    According to the Bench, being lenient in cases related to sexual offenses is not just undesirable but also contrary to the public interest.

    “Courts cannot lose sight of the fact that crime of violence upon women and minor children are on increase and therefore the perpetrators of the crime must be dealt with iron hands…Showing leniency in such matters would be really a case of misplaced sympathy. The act of accused is not only shocking, but outrageous in contours. Granting of bail to him would lead to the danger of the course of justice being thwarted”

    The judge opined that such a heinous act would leave an enduring mark on the victim’s dignity, chastity, honour, and reputation in society, and if the accused were granted bail, it would shake the confidence of the people at large.

    The victim was raped by the accused while she was collecting water from a tap in her neighbourhood, and he threatened her not to disclose the incident to anyone. Nevertheless, a week after the incident, she informed her parents of her ordeal, and as a result, the accused was arrested and charged under Section 376 of the Indian Penal Code and Section 4 of the Protection of Children from Sexual Offences Act, 2012 (POCSO) Act. The accused claimed that he was falsely accused by the victim’s family because the two families were at odds over a civil matter involving the passage outside their homes.

    The Court stated that rape permanently scars a woman’s most treasured possession and has a significant psychological impact on the victim and her family. “The prosecutrix would not have concocted a rape story against the accused to falsely implicate him by putting her honour, character, reputation, and future marriage prospects on the line in society,” the judge said. In its order, the Court observed that the crimes alleged against the accused would result in a sentence of imprisonment for the remainder of his natural life or a minimum of 20 years in prison.

    “The more severe the punishment, the greater the likelihood that the accused will abscond or flee from justice if released on bail. There is a risk that he will abscond or flee during the trial if granted bail,” the Court stated while denying bail to the accused.

    Beijing: Chinese Foreign Minister Qin Gang on Sunday urged his Japanese counterpart Yoshimasa Hayashi not to “help a villain do evil” by backing the US tech restrictions against Beijing as the two ministers held rare talks here amid China’s increasing criticism against Tokyo’s backing for Washington-led Indo-Pacific strategy.

    The United States “used bullying tactics to brutally suppress the Japanese semiconductor industry, and now it is repeating its old tricks against China”, Qin told Hayashi.

    “Japan has suffered that pain, and should not help a villain do evil. The containment will only further stimulate China’s determination to become self-reliant,” Qin said, according to the Hong Kong-based South China Morning Post.

    The talks between the two ministers took place two days after Japan announced it would restrict semiconductor equipment exports from July, following months of lobbying by the US.

    The two countries should “overcome obstacles and move forward”, Qin said, adding that “clique-forming” and containment was “not helpful” to managing conflicts, in an apparent reference to Japan’s backing for the Indo-Pacific strategy.

    China opposes the Quad comprising the US, India, Japan and Australia, saying that it is aimed to contain its rise.

    “Peaceful coexistence and friendly cooperation are the only correct choices for China-Japan relations,” he said.

    “In the face of contradictions and differences, forming cliques, exerting pressure through rhetoric will not help solve the problem, but will only deepen the estrangement between each other,” he said.

    “(We) hope that Japan will establish a correct understanding of China, show political wisdom and responsibility, and work together with China to strengthen dialogue and communication, and promote practical cooperation,” he said.

    This was the first visit by the Japanese Foreign Minister to China since 2019.

    China and Japan have a long-festering dispute over uninhabited East China Sea islands controlled by Japan but claimed by China.

    The islands are called as the Senkakus by Japan, while China named them as Diaoyu.

    Taiwan also claims the islands but has forged agreements with Japan to avoid any conflict as Japan maintains close defence ties with Taipei.

    Ahead of Hayashi’s visit, China and Japan on Friday set up a military hotline to strengthen their capability of managing and controlling maritime and air incidents arising out their aggressive patrolling of the disputed waters in the East China Sea.

    Hayashi said the two countries were neighbours separated by “a narrow strip of water”.

    China is also opposing Japan’s move to discharge nuclear-contaminated water from the Fukushima Daiichi nuclear power plant into the Pacific Ocean.

    Qin asked his Japanese counterpart to handle the disposal responsibly, as it is a major issue concerning public health and the safety of humanity.

    On the question of Taiwan, which Beijing claims as part of it, Qin said it is the very core of the core interests of China, which bears on the political foundation of China-Japan relations. He asked Tokyo to refrain from interfering in the Taiwan question or undermining China’s sovereignty in any form.

    In the case of a Japanese citizen suspected of engaging in espionage activities in China, Qin stressed China would handle it following relevant laws.

    According to Japanese media reports, Hayashi’s talks with Qin lasted around four hours, longer than the planned two and half hours. The two also agreed to resume trilateral dialogue with South Korea.

    Hayashi also met Premier Li Qiang and had dinner with top Chinese diplomat Wang Yi.

    Hyderabad: Telangana senior congress leader and Nalgonda MP N Uttam Kumar Reddy clarified that Nirav Modi and Lalit Modi do not belong to the BC community, refuting the ‘false claims’ made by the BJP.

    He expressed astonishment at the BJP’s attempts to garner sympathy for the two notorious ‘scamsters’ by wrongly associating them with the BC community.

    He addressed a dharna of the BC Welfare Association organized by its Telangana State President, Jajula Srinivas Goud, at Jantar Mantar, Delhi on Wednesday.

    “Nirav Modi is accused of defrauding Punjab National Bank of nearly Rs. 14,000 crore, while Lalit Modi allegedly embezzled thousands of crores from Indian cricket fans and tarnished the reputation of Indian cricket worldwide. Both scamsters are reportedly living a luxurious life somewhere in Europe. It is perplexing that the BJP would choose to use these controversial figures in their campaign, falsely associating them with the BC community,” he said.

    Uttam Kumar Reddy endorsed the demand for a BC census in the country. He stated that the Congress party fully supports it at both the AICC and TPCC levels. He questioned Prime Minister Narendra Modi’s commitment to the welfare of the BC community and asked why a BC Census has not been conducted, a demand made by BCs across the country.

    He also emphasized the BC community’s long-standing demand for a separate ministry in the union government, similar to those for SC, ST, and Minority affairs. “The absence of such a ministry, despite the community’s requests for the past nine years, is quite astounding,” he said.

    He also concurred with the BC Welfare Association’s demand for the removal of the creamy layer from the BC reservation quota.

    Uttam Kumar Reddy asserted that the BC quota in jobs and education should be increased proportionately to their population, on par with SCs and STs.

    He said that previous Congress governments implemented several measures to improve the lives of BCs at the national level and in the undivided Andhra Pradesh. He accused the BJP government of completely neglecting the welfare of the BC community in the last nine years.

    However, he alleged that BJP leaders were misusing the name of the BC community to shield scamsters like Lalit Modi and Nirav Modi by disseminating false propaganda. “The BC community is both laughing at and shocked by the BJP’s propaganda tactics,” he said.

    Hyderabad: The South Central Railway (SCR) on Tuesday appealed to the public not to indulge in anti-social activities such as stone pelting on trains after instances of the same on trains including Vande Bharat Express took place across different locations under its jurisdiction.

    Some of the vulnerable sections (of stone pelting) have been Kazipet Khammam, Kazipet Bhongir and Eluru Rajahmundry, a press release from SCR said adding in recent times, Vande Bharat trains were targeted by miscreants and nine such incidents have been reported since January this year.

    Stone pelting on trains is a criminal offence and stringent action will be taken against the perpetrators under Section 153 of the Railways Act, which is punishable with imprisonment which may extend up to 5 years, it said.

    So far 39 offenders were arrested by the Railway Protection Force (RPF) after several cases were registered.

    Some of the stone pelting incidents also involved children aged between 6 and 17 years. Therefore, it is the responsibility of every parent, teacher, and elders in the society to counsel, educate and guide children to desist from such activities, the SCR said.

    Such instances have not only led to precious damage of public property but also led to the rescheduling of the train, besides as many as five passengers were seriously injured as a result of being hit by stones, it said.

    SCR General Manager Arun Kumar Jain appealed to the public to refrain from indulging in such unlawful activities which damage national property and causes serious injuries to passengers.

    The Railway Protection Force is also undertaking several preventive measures including awareness campaigns and coordinating with Sarpanches of villages near tracks and making them village mitras’, SCR Chief Public Relations Officer Ch Rakesh said.

    In addition, the staff have also been deployed in all stone pelting black spots, the release added.

    New Delhi: There are a total of 44 operational airports in the country which do not have night landing facilities for civil operations, the Rajya Sabha was told on Monday.

    These airports include Shimla, Kushinagar, Darbhanga, Deoghar, Bilaspur and many others.

    The provision of night landing facility, which is purely based on the demand and operational requirements of the airlines, is a continuous process and is undertaken by Airports Authority of India (AAI) and other airport operators from time to time depending on the availability of land, commercial viability, socio-economic considerations, traffic demand and willingness of airlines to operate to/from such airports etc., said a written reply by the Ministry of Civil Aviation on Monday in Rajya Sabha.

    The Central government has granted ‘in-principle’ approval to set up 21 Greenfield airports in the country.

    Out of these, Mopa (Goa), Noida (Jewar), Navi Mumbai, and Dholera will also act as additional airports to the existing airports.

    As a second airport to Chennai, the state government of Tamil Nadu has submitted an application to Ministry of Civil Aviation for grant of ‘Site-Clearance’ for development of a new Greenfield airport at Parandur, Kancheepuram District, Tamil Nadu and the proposal is under examination by Airports Authority of India (AAI), Directorate General of Civil Aviation (DGCA) and Ministry of Defence (MoD), said another reply by the Ministry on Monday.

    The Ministry of Civil Aviation had received an application for ‘Site-Clearance’ for the development of a new Greenfield airport at Pantnagar in Uttarakhand.

    However, in December 2022, the Uttarakhand government requested to keep their application in abeyance, as expansion of existing Pantnagar airport is being alternatively considered, said the reply.

    New Delhi: The Supreme Court on Monday dismissed Uttar Pradesh government’s plea against high court direction to consider giving a job to a family member of the victim in Hathras case and also the relocation of the family, saying “the state should not come up in such matters”.

    A bench headed by Chief Justice of India D.Y. Chandrachud and comprising Justices P.S. Narasimha and J.B. Pardiwala told Garima Prasad, additional advocate general (AAG) of Uttar Pradesh, “State should not come up in such matters… Prasad submitted that the state government is ready to relocate the family but they wanted a job either in Noida or Delhi.”

    She further added that whether the elder married brother of the victim could be regarded as a ‘dependent’, was a question of law to be considered.

    Declining to entertain the state government’s plea, the Chief Justice said, “these are facilities provided to the family. We should not interfere. State should not come up in these matters…”

    After the order was pronounced, the AAG urged the apex court to keep the question of law open, the bench said that the order has specified that it is passed in the special facts and circumstances of the case.

    In July last year, the high court passed directions in a matter connected with Hathras case, where a 19-year-old Dalit woman was alleged to have been raped and murdered in September 2020 in Hathras.

    The high court said the state authorities must abide by the promise, which was made to the family in September 2020, to give employment to one member and also directed the authorities to consider relocation of the family outside Hathras but within Uttar Pradesh.

    The high court’s order came on a PIL registered suo motu as Right to Decent and Dignified Last Rites/Cremation in 2020 after victim’s last rites were performed in haste after midnight allegedly in the absence of the consent of the family.

    The Regional Transport Officer (RTO), Syed Shahnawaz Bukhari has appealed the people, government departments and others not to hire any private vehicles as Taxi that doesn’t have a commercial permit.

    In this regard, RTO, Kashmir, has issued a public notice, a copy of which is in possession of Asian News Hub (ANH).

    “Multiple complaints have been registered in this office claiming that some private vehicles are being used as Taxis, including by the government departments,” the notice reads.

    It added that Section 66 of the Central Motor Vehicles Act, 1988 provides that ‘no owner of a motor vehicle shall use or permit the use of the vehicle as a transport vehicle in any public place whether or not such vehicle is actually carrying any passengers or goods, save or accordance with the conditions of a permit granted or countersigned by a Regional or State Transport Authority or any prescribed authority authorizing him the use of the vehicle in that place in the manner in which the vehicle is being used’.

    Section 53 of the Central Motor Vehicles Act, 1988, inter alia, also provides for suspension of Registration Certificate if there are reasons to believe that a vehicle has been, or is being, used for hire or reward without a valid permit,” it said.

    It added that accordin g to norms, all outsourced vehicles used by the government departments are required to be registered in commercial category.

    “Now, therefore, this is for notice of the general public, all government departments, PSUs, Banks, Educational Institutions and individuals not to hire any private vehicles as a Taxi and not to enter into any commercial contract with any vehicle owner for a vehicle that does not have a Commercial permit and that does not sync with the stated law and rules under the MVA, 1988. In particular, the Drawing and Disbursing Oficers are advised not hire any private vehicle that is not registered under commercial category. Strict action will be taken in case of
    violation in this regard,” the notice added.

    New Delhi: Delhi Chief Minister Arvind Kejriwal wrote to Prime Minister Narendra Modi on Tuesday requesting him to “not stop Delhi’s budget”, amid a row between the Centre and the AAP dispensation in the national capital over the issue.

    The presentation of the Delhi government’s Budget for 2023-24, which was scheduled for Tuesday, has been put on hold with the Kejriwal dispensation and the central government trading charges over allocations under various heads.

    “This is the first in the last 75 years that a state’s budget has been stalled. Why are you upset with Delhiites? Please don’t stall Delhi’s budget. With folded hands, Delhiites urge you to pass their budget,” the chief minister said in the letter.

    Speaking at a News18 programme on Monday, Kejriwal charged that the Centre was resorting to “gundagardi” and said it was the first time in the country’s history that the budget of a government was put on hold. A video clip of his speech was tweeted by the Aam Aadmi Party (AAP).

    Sources in the city government said the Ministry of Home Affairs (MHA) has stopped the budget and it will not be tabled in the Delhi Assembly on Tuesday.

    As the chief minister lashed out at the Centre, sources in the MHA said the ministry has sought clarification from the AAP government as its budget proposal had high allocation for advertisement and relatively low funding for infrastructure and other development initiatives.

    Taking to Twitter on Tuesday, the chief minister referred to the Economic Survey report on per capita income rising by 14.18 per cent in Delhi said the national capital was doing “exceedingly well” despite obstacles.

    “Delhi is doing exceedingly well, despite all obstacles being created on daily basis. Imagine if such obstacles were not created and all govts worked together for the welfare of people. Then Delhi would grow multiple times faster,” he tweeted.

    According to the Economic Survey tabled in the Delhi Assembly on Monday, per capita income in the national capital rose by 14.18 per cent to Rs 4,44,768 in 2022-23 at current prices compared to Rs 3,89,529 in 2021-22.

    The per capita income of Delhi has been around 2.6 times higher as compared to the national average, both at current and constant prices. It was Rs 3,31,112 in 2020-21.

    The tax collection of the Delhi government registered a “tremendous” growth rate of 36 per cent during 2021-22 (provisional) as compared to the negative growth of 19.53 per cent in 2020-21 due to COVID-19 pandemic, the survey tabled by state Finance Minister Kailash Gahlot said.

    “Delhi’s growth speaks,” Kejriwal said in another tweet.
