    [ad_1]

SRINAGAR: The High Court has invalidated seven detention orders that were issued under the Public Safety Act and has directed the authorities to release the detainees who were held in preventive custody. The seven individuals are Suhail Ahmad Bhat from Srinagar, Altaf Ahmad Bhat from Kupwara, Farooq Ahmad Khan from Bandipora, Shamim Ahmad Wani from Anantnag, Mohammad Khumani Dar from Pulwama, Tanveer Ahmad Malik from Anantnag, and Imtiyaz Ahmad Dar from Kulgam. The orders to detain them were issued on different dates, namely 21.1.2023, 4.12.2021, 25.6.2022, 7.4.2022, 18.10.2021, 13.08.2021, and 29.03.2022.

The detention order issued against Suhail Ahmad Bhat in January 2023 has not been executed yet, and the petitioner is currently receiving specialized medical treatment in Delhi with a valid permission from the court of Special Judge Designated Under NIA Act, Srinagar.

In Bhat’s case, the court stated that the respondents are aware that he is not absconding or avoiding arrest but is instead in Delhi for medical treatment. The court further added that the detention order cannot remain in effect indefinitely and in violation of the provisions of the PSA, especially when it has not been executed due to the respondents’ failure without any reasonable explanation. Therefore, the court invalidated the order.

The court addressed the cases of three other detainees and stated that they cannot exercise their constitutional and statutory rights guaranteed under Article 22(5) of the Constitution of India unless they are given access to the material on which their detention is based.

The court also noted that the grounds for detention provided to these detainees were merely a copy of the dossier provided to the detaining authority, which indicates that the detaining authority did not apply its own judgment and passed the detention order in a mechanical and routine manner. The court emphasized that the detaining authority must use its own independent judgment when formulating grounds for detention and cannot simply reiterate what is written in the dossier, as this would render the detention order invalid.

The detention record produced by the respondents showed that the detaining authority passed the order of detention based on activities of the detenu that were considered prejudicial to public order, while the grounds of detention referred to activities prejudicial to the security of the State. This indicates that the detaining authority did not apply proper thought while arriving at its subjective satisfaction. The court, taking into account the aforementioned facts and the law, allowed the petitions and annulled the detention orders issued by the District Magistrates. The respondents were instructed to immediately release the detenues, provided they were not detained in any other case.

Regarding the case of detenue-Imtiyaz Ahmad Dar, the court stated that the regular law should have been sufficient to prevent the detenu from engaging in activities deemed prejudicial to the security of the State by the detaining authority.

In the case of detenue Tanvir Ahmad Malik, the Division Bench found that the grounds of detention did not provide sufficient compelling reasons to justify his continued detention, especially since there was no evidence to suggest that he would engage in such activities if released on bail.

On the other hand, the court upheld the PSA of detenue-Muntazir Ahmad Mir, who was detained by the District Magistrate Pulwama. The court found that the grounds of detention against Mir were specific and included the names of alleged terrorists with whom he had close association, showing his involvement in subversive activities. Therefore, the court deemed the grounds of detention against Mir to be clear and specific, and not vague.

  • Generous Givers: British Muslims Give Rs 10,000 Crore In Charity In A Year

    [ad_1]

SRINAGAR: The British Muslims are Europe’s generous givers as far as charity goes. A survey report made public early this year said that British Muslims give nearly one billion pounds a year, which is more than Rs 10,000 crores.

A research report published by the London-based think tank, the Ayaan Institute, reports that UK Muslim humanitarian charities raised £708M for causes in 2020. It also estimates that this amount, combined with Muslim giving to UK charitable causes (including 2752 mosques and prayer venues), means UK Muslims generously give at least £1Bn a year to charity, projected to reach £4Bn by 2050.

Ramzan, the Muslim month of fasting, is a major contributor to charity across Europe and especially in the UK. A report said UK Muslims give on average more than £130 million to charity this month.

The donations are so hugely expected that the Charity Commission for England and Wales issued an advisory. “Ramadan is a time of huge generosity among British Muslims, and the recent earthquake in Turkey and Syria, as well as the ongoing impact of the cost-of-living crisis, make it especially important that their charitable contributions support good causes through registered charities. Regulators are therefore issuing advice to remind British Muslims to make checks, ensuring their donations reach registered charities.”

Early March, William and Catherine, the prince and princess of Wales, showered praises on British Muslims for raising record funds to aid victims of the earthquakes that struck Turkey and Syria. The royals, with the princess wearing a headscarf, visited the Hayes Muslim Centre to thank volunteers who raised 30000 pounds within a few hours. Late last year, they raised more than 13 million pounds for flood-devastated Pakistan.

Part of the charity goes to the relief and rehabilitation of refugees across the world. A report by Brown University in the United States said that around 37 million people (3.70 crore), mostly Muslims, have become refugees or displaced since the start of the War on Terror in 2001.

This year, local issues will remain the key pressure on Muslim charities in the UK. Islamic Relief, the London-based major Muslim charity said that an estimated 16 lakh British Muslims have landed in poverty and deprivation because of the cost-of-living crisis. This makes up almost half of the British Muslim population.

From Tragedy To Triumph: Insha Bashir Soars On Wheels

    [ad_1]

SRINAGAR: Around 15 years ago, a tragic accident not only shattered the dreams of a Budgam woman of becoming a doctor but also confined her to a wheelchair. But nothing stopped her from working hard and becoming the first wheelchair-bound basketball player of Kashmir.

Insha Bashir (29), a resident of Beerwah area of Budgam, despite her disability, is climbing the ladder of success, not only for herself but also helping other specially-abled children to make their dreams come true. Insha said, “I was not disabled from birth. I had a regular life like every other girl. When I was in 12th grade, I had been diagnosed with gastric ulcers and suffered oral bleeding. In the same year, one day, I was at the terrace with dizziness and nausea and started vomiting blood from where I fell down and hit the ground underneath, resulting in grievous injuries to my spine.”

“It wasn’t just a spinal cord injury, but this incident shattered my dream of becoming a doctor and made me wholly and solely dependent on my family. I started suffering from depression, facing taunts from relatives and other issues. My health started deteriorating despite full support from my family,” she said.

“Despite facing the entire trauma, though I had to change my subjects, I continued my studies and passed the 12th grade. Then I pursued a bachelor’s degree and B.Ed as well, and currently, I am pursuing a master’s in social work,” Insha said.

“My dad’s deteriorating health pushed me to take charge of my life. And so, I began researching my condition and what I could do about it. I came across the Shafqat Rehabilitation Center in Srinagar that gave six months of physiotherapy,” she recalls. Her father, her steadfast cornerstone, had been diagnosed with Parkinsonism, and this proved to be the final nail in the coffin, ensuring that she finally mustered enough strength to stand up on her own feet.

After repeated attempts by her father, Bashir Ahmad Wani, and constant counselling sessions by Dr. Saleem Wani- the valley’s famous urologist, Insha was able to overcome this difficult phase of her life.

“Though it took me a long time to accept this reality, when I realized it, I started taking everything positively and saw my disability as a challenge that had become a hurdle. At the center, when I saw more people with more complex problems than me, it gave me the courage that I am not the only person who is facing this problem in the world. When I saw specially-abled boys playing basketball and other games in a very happy mood, it reignited my childhood inclination towards it as well,” she added.

“Once I overcame my initial hesitation, I found the game to be enjoyable, convenient, and suitable to partake in, from a wheelchair. I found the game very interesting, and it got me impelled by the enthusiasm of representing Jammu & Kashmir,” she said.

“I was the first wheelchair-bound woman from Kashmir to play basketball. I started training others, and in some time, a team was ready following which I played at the national and international levels and won many medals,” Insha said.

She represented India in the US in 2019 and participated in the National Championship as the captain of the J&K Wheelchair Basketball Women’s team in 2019. Besides that, she was invited by the US consulate to be a part of the prestigious Sports Visitor Program.

She now motivates and inspires others in the valley to overcome their inhibitions and impediments and take up sporting pursuits.

“Besides playing and training my team, my major area of focus is to encourage differently-abled girls in sports, not just in Kashmir but across the country, and ensure that they have a say in their own lives,” she said.

She practices on a daily basis following a professional schedule. After practice, she returns to the hostel and mentors, counsels, and instructs young girls who wish to rise beyond their struggles and play like her.

“My message to other specially-abled persons will be that your disability isn’t the end of life. Rather, you need to be courageous to fight all odds and overcome challenges,” she said. “If one of your organs isn’t functioning, your brain is working and that is enough to dream and work on your dreams to make them come true.” (KNO)

    [ad_1]

SRINAGAR: In an unusual development, Ladakh is witnessing massive rise in dog bites. This led the Jammu, Kashmir Ladakh High Court to take suo moto action asking the administration to submit response within a fortnight.
