  • Minor Girl’s Harassment Case, Man Goes To Jail For Three Years

    SRINAGAR: A special Fast Track court in Srinagar presided over by Judge Aarti Mohan; dealing with cases registered under POSCO Act sentenced a man to an imprisonment of three years along with fine of Rs. 50000 under section 7/8 of POCSO Act.

    The matter pertained to the harassment of an 11-year-old girl and an FIR No.52 /2019 in this regard was registered at Kursoo Rajbagh police station Srinagar in 2019.

    The convict has been held guilty of offences punishable under section354, 354-A RPC and section 7/8 of POCSO Act 2018 by virtue of judgment dated 28-04-2023.

    Public Prosecutor Meena Gowher said that the accused should be awarded the maximum punishment  of five years as prescribed under law along with fine, which this court deems fit in the facts and circumstances of the case.

    Stating that the deterrence against the convicts in such cases is the need of the hour, the Public Prosecutor said, “The offence committed by the convict is against a minor girl and as such the convict does not deserve any leniency by the court and should be awarded the maximum punishment prescribed under law.”

    The convict was produced before the court from central jail in presence of the public prosecutor Meena Gowher and Advocate Mushtaq Ahmad Dar, convicts counsel in the case and heard the quantum of punishment.

    On the other hand counsel for the convict said that the court should take into consideration the mitigating circumstances while awarding the punishment to the accused.

    “The convict is a man of advanced age and falls in the category of senior citizen, a father of three daughters. Due to his involvement in the instant FIR, wherein he has been convicted, his reputation has suffered and two of his daughters have not been married,” the counsel submitted before the court, adding that court should also consider the fact that all the witnesses in the case were family members of the victim.

    “I have considered the arguments advanced by both the learned Public Prosecutor and learned defense counsel. The court while awarding punishment is influenced by numerous factors and no straight jacket formula is provided for determination of the quantum of punishment in law. The quantum of sentence depends upon the background facts of the case, antecedents of the accused, delay in conclusion of the case, age of the accused, his physical health condition, the nature of the offence and last but not the least the reformative deterrent and punitive aspects of punishment,” the court ruled.

    Court further ruled that, “In the case in hand the convict is senior citizen of more than 60 years of age at present having no prior criminal antecedents whatever. It also cannot be denied that he may be the sole bread provider for his family which comprises of two unmarried daughters. However, while awarding punishment the court is also required to take note that the object for which the penal laws have been enacted do not remain unfulfilled. The POCSO Act was enacted since a strong need was felt to take stringent measures to deter the rising trend of child sex abuse in the court. Its purpose is to ensure that there is a healthy physical, emotional, intellectual and social development of the child. The convict has committed sexual assault on a minor girl forgetting that he himself is a father of three daughters.” it said.

    Court stated that keeping in view the above facts while taking into account the mitigating the circumstances also the accused is awarded simple imprisonment of 3years along with fine of Rs. 50000/- under section 7/8 of POCSO Act.

    On failure of payment of fine accused shall undergo further imprisonment of 6 months.

    Court ruled that offence against the victim, who at the time of commission of offence was merely of 11 years of age caused her mental and psychological trauma. As such a compensation of Rs two lakh shall be awarded to the victim.

  • JKDMA Issues Avalanche Alert In North Kashmir

    SRINAGAR: Amid widespread rains lashing JK from last few days, Jammu and Kashmir Disaster Management Authority (JKDMA) on Saturday issued an avalanche warning over higher reaches of Baramulla district for next 24 hours.

    The DMA said that a ‘low’ danger level avalanche is likely to occur above 3000 metres above sea level over Baramulla district.

    People living in these areas are advised to take precautions and avoid venturing in the avalanche prone areas till further orders.

  • JeM Militant Arrested Along With Grenade: Police

    SRINAGAR: Police on Saturday claimed to have apprehended a militant associate of Jaish-e-Mohammad outfit in North Kashmir’s Handwara.

    In a handout ,the police said that during routing checking at Ganai Mohalla Pazalpora Magam, a joint party of Handwara Police and Army (15RR) intercepted an individual who attempted to evade the joint party suspiciously but was apprehended by the joint party.

    On search, one hand grenade and other incriminating material were recovered from his possession. He has been identified as Khursheed Ahmad Bhat son of Gulzar Ahmad Bhat, a resident of Amargarh Tarathpora.

    Police spokesman further said that preliminary investigation reveals that he was working as a militant associate for proscribed militant outfit JeM.

    Accordingly, a case FIR No 95/2023 under relevant sections of law has been registered at Police Station Handwara and further investigation has been initiated, reads the statement.

  • Body Of Non-Local Found In Central Kashmir

    SRINAGAR: A body of non-local man was found at Batamallo area of Central Kashmir’s Srinagar district on Saturday afternoon.

    A 40-year-old non local identified as Rakesh Kumar resident of Katra was found unconscious in a road at Batamallo.

    He was shifted to SMHS hospital where doctors declared them brought dead.

  • Two Soldiers Killed As Army Vehicle Falls Into Gorge

    SRINAGAR: Two soldiers were killed when a army vehicle they were travelling in met with an accident near Line of Control in Rajouri district on Saturday.

    Official sources said that the vehicle skidded off the road and fell about 200 feet down into a gorge near Dungannon Nallah. Two soldiers suffered critical injuries and were shifted to army hospital Rajouri were they succumbed to injuries.

    A police official said that a case has been registered and further investigations have been taken up.

    SRINAGAR:  A man from Jammu died after he jumped from roop top of his house in Jammu district on Saturday.

    An official said that a man identified as Parveen Kumar son of Ruldhu Ram resident Rajinder Nagar Canal Road jumped from the roof top of his house.

    Locals took him to the GMC hospital for treatment but doctor declared brought dead, he said.

    An official said that Muhammad Abdullah (70) son of Ab Jabbar, a resident of Wachi Zainpora in Shopian fell from the slab of his house on Saturday morning. He was rushed to nearby hospital where doctors declared him brought dead, he said.

    SRINAGAR: Secretary, Tourism and Culture, Dr Syed Abid Rasheed Shah on Friday said that in the run-up to the G-20 event, slated to be held in the last week of May, massive participation of the general public has been witnessed in Jammu & Kashmir and that the young minds are being given an of how things operate on a global platform through the participatory exercises.

    Shah spoke to the reporters on the sidelines of the model G20 summit, which was organized by the Tourism department at SKICC, Srinagar.

    Shah said that a very important event is going to be held in Kashmir in the last week of May and as part of a participatory exercise where students from various colleges and schools and especially universities are being involved, a model G20 summit was organized to give these young minds a taste of how things operate on a global platform.

    “In the run-up to the G-20 event, there is massive participation that we have seen from the people of Jammu & Kashmir, the government of J&K is organizing different events in the run-up to the main event to give a sense of public participation for the massive event for us on the international scale and has a potential to promote J&K tourism on the next level,” he said.

    We are also making sure that while we are preparing for the main event, we encourage a lot of public participation to give a sense of involvement to the general public, especially the young bright minds, he said.

    “Majority of the GDP comes from tourism as it is the backbone of our economy, so therefore, we have to project, promote and manage tourism in J&K in the right perspective so that it is taken to the next level on a local stand,” he added.

    He added that J&K was always the prime destination for film tourism where the movies were being shot. “Now, I am happy to inform you that in the last year, over 200 movies have been shot in J&K. At present, the big film stars are coming in and today also we have a very big film crew in the town and there are queries for the future as well. The department has come up with a very strong facilitator ecosystem concerning film tourism,” he said.

    “We are trying to promote new tourism destinations. For this calendar year, we have planned 300 new destinations while some of them are already up and there are 75 offbeat destinations among them. The government as well as the tourism department is trying to project other destinations where fewer tourists are visiting,” he said, adding that 75 cultural heritage and adventurous destinations, and religious destinations have been shortlisted. “We are taking a holistic view in this regard,” he said.
