    Matrimonial cases in India

    In the first half of the 20th century divorce was almost unknown in India. In fact it was not even legally permitted among Hindus ( it was first permitted by the Hindu Marriage Act, 1955 ), and even among Muslims, for whom it was permitted by the sharia law, it was very rare.


    India had one of the lowest divorce rates in the world, but in the last few decades this has increased rapidly.Today Indian law courts are flooded with cases of divorce, maintenance, child custody, etc, and such cases often double every few years.

    How did this happen ?
    To explain this drastic change one must go back in time.
    Upto the first half of the 20th century most people, particularly in rural areas, where 85% of India’s population lived, were married in childhood, the boy being 14-15 years old and the girl being 13-14, and their life partners were chosen by their parents. Thus they grew up together ( usually in a joint family ) and became friends, not just husband and wife. At that very young age one’s personality is flexible, so there was no problem of adjustment. Hence there was seldom any divorce.


    Today the position is very different. Now both boys and girls are grown up when they marry, the boy ( or rather young man ) often being 27 or 28, and the girl ( or rather young woman ) being 25 or 26. Sometimes both are highly qualified, and often both working.


    Dating system, as practised in Western countries, is still uncommon in India, and the way one gets married is usually this : the girl’s parents invites the boy and his parents for tea at their home, and the boy and girl are sometimes left alone for a short time in a separate room to talk with each other and assess each other. They may meet again a few times, and then they are asked by their parents if they are agreeable to get married. If they agree, the marriage is performed.


    However, after marriage, they may realise they are living wih a stranger. At their age their personalities have become rigid, and is no longer flexible, and they may have different interests and ambitions, and may find each other incompatible. Whereas in earlier times women were financially dependent on their husbands, and so had to put up silently with whatever treatment they got from their husbands or in-laws, now they do not put up with ill treatment, such as violence and abuses, particularly since many are working and financially independent, and have their self respect.


    This, and other factors e.g. infidelity, ego clashes, etc often results in divorce proceedings, claims for maintenance, child custody battles, etc.

    Another cause for this phenomenon is the rapid urbanisation of India over the last few decades. Whereas in former times most Indians ( about 85% ) lived in rural areas, now about 40% live in cities and towns. The financial hardships in these places, and other factors such as shortage of proper housing, often contributes to the break up of the marriage, and increase in divorce cases is more witnessed in urban areas, even in smaller towns.

    Many wives separate from their husbands without a legal divorce ( which often takes years to obtain as Indian court proceedings are usually very protracted ), as they prefer separation to life long abuse.

    Where is all this heading to no one can predict. But this much is evident that Indian society, particularly relations between men and women, is changing rapidly, and in the years to come this trend is going to grow exponentially, for better or for worse.

    He further added, “When they (Sania and Izhan) went to perform Umrah I had commitments here and when I took a break and went to Dubai to spend time with Izhan, she had commitments in IPL.”

    New Delhi: The Supreme Court has told a couple, who are software engineers seeking a divorce, why don’t they give a second chance to the marriage as both of them were not able to devote time to their union.

    A bench of Justices K M Joseph and B V Nagarathna said, “Where is the time for marriage? Both of you are software engineers posted in Bengaluru. One goes to duty during the day and the other at night. You have no regret for divorce but have regret for marriage. Why don’t you give a second chance to the marriage.”

    Justice Nagarathna said that Bengaluru is not a place where divorces take place so frequently and the couple may give a chance towards their union.

    However, the counsels for both the husband and wife told the bench that during the pendency of this petition, the parties were referred to the Supreme Court Mediation Centre in order to explore the possibility of a settlement between them.

    The bench was informed that both husband and wife have agreed upon a settlement agreement in which they have decided to dissolve their marriage by a decree of divorce by mutual consent under Section 13B of the Hindu Marriage Act, 1955 on certain terms and conditions.

    The counsels informed the bench that one of the terms was that the husband would pay a total sum of Rs 12.51 lakh towards a full and final settlement of all monetary claims of the wife as a permanent alimony.

    The bench noted in its order dated April 18, “When queried by this Court, the parties stated that they have indeed agreed to settle their disputes amicably by parting ways and seeking divorce by mutual consent. They also state that the terms of settlement would be adhered to by them and hence the marriage may be dissolved by a decree of divorce by mutual consent.”

    The bench added that in the circumstances, “We have taken on record the settlement agreement as well as the application filed under Article 142 of the Constitution. We have perused the same. On perusal, we find that the terms of the settlement agreements are lawful and there is no legal impediment for accepting the terms of settlement”.

    It also took on record that the husband paid a total sum of Rs 12,51,000 to the petitioner-wife who has acknowledged the receipt of the demand drafts.

    “In the circumstances, we exercise our power under Article 142 of the Constitution and dissolve the marriage between the parties by a decree of divorce by mutual consent under Section 13B of the Hindu Marriage Act, 1955,” the top court said.

    It also quashed various other proceedings lodged by husband and wife in Rajasthan and Lucknow under the Dowry Prohibition Act, domestic violence Act and other connected cases.

    Kolkata: A division bench of the Calcutta High Court has upheld the right of a husband to seek divorce from his wife on ground of mental cruelty if the wife constantly abuses the husband by describing him as “coward” and “unemployed” and at the same time force him to get separated from his parents.

    Hearing a matter related to a woman challenging a lower court order dissolving her marriage on the ground of mental cruelty against her husband, the division bench of Justice Soumen Sen and Justice Uday Kumar noted that as per Indian culture, the husband stays with his parents and there need to be some justifiable reason for the son to live separately.

    In this particular case, a family court in West Midnapore district had dissolved the marriage in July 2001 after accepting the husband’s contention accusing his wife of mental cruelty. The woman had challenged that order at the Calcutta High Court in May 2009.

    On the issue of describing the husband as “coward” and “unemployed”, the court noted that it was because of a false complaint by the wife that the husband had lost his government job.

    The court also took note of some contents of the diary of the petitioner where she time and again described her husband as “coward” and “unemployed”.

    In the diary, she had also made it clear a number of times that she was forced to marry him because of pressure from her parents. As per the court’s observation, the petitioner had also made it clear in the diary that she was more keen to get married elsewhere.

    In such cases, the marriage just remains a legal tie and hence tantamount to nothing but fiction, the court noted.

    After hearing the arguments, the division bench upheld the verdict of the family court dissolving the marriage in 2001.

    Mumbai: Queen of controversies Rakhi Sawant has announced that she will soon divorce her husband Adil Khan Durrani. This comes less than a month after she stated that she would not divorce him. Speaking to paparazzi, Rakhi confirmed the same and said, “Meri khushi ka raaz? Mera divorce hone waala hai. Hum abhi azaad ho chuke hain (The secret to my happiness? I am getting divorce, I am free now).”

    “Hum Azaad ho jaana chahtein hain, ab use jiske saath shaadi karni hai Kar lene do (I want to be free now. Let him get married to whoever he wants),” Rakhi said speaking to media outside her gym.

    Rakhi married Adil earlier this year, but only a few weeks after announcing her marriage officially, she filed an FIR against him, accusing him of mishandling funds, domestic violence, and cheating on her. Adil was later arrested in February. A viral paparazzi video, on the other hand, showed Rakhi yelling on her phone that she would not divorce Adil.

    Rakhi yelled on her phone that she would not divorce Adil. It appeared as if she was on the phone with Adil. “Sochna bhi mat main tumhe divorce ya talakh dung (Don’t even think I’ll divorce you),” she could be heard saying.

    Adil is also a part of another FIR filed against him in Mysuru last month after an Iranian student accused him of rape.

    Rakhi appears to be focused on her work despite the divorce announcement. She revealed that she will be travelling to Lucknow soon to film a major web series based on a true-life ‘legend. ‘She will play that character, and the show will also be shot inside the Lucknow jail. Rakhi also urged the Uttar Pradesh government to provide her and her crew with subsidies and security during the shoot. She has already spoken with Ravi Kishan, who will also appear in the web series, about her demands.
