    Boasberg’s ruling is the latest ripple caused by McCarthy’s decision to widen access to 44,000 hours of Capitol security footage from Jan. 6. The Capitol Police had previously turned over about 14,000 hours of the day’s footage that leaders said encompassed crucial time periods of the riot, as well as the relevant camera angles.

    It’s unclear whether the additional footage includes evidence that will influence any of the 950-plus Jan. 6 criminal cases. But several defendants have said they intend to access the materials, which House Republicans have agreed to facilitate. The Justice Department has yet to indicate whether it, too, will attempt to obtain and review the footage.

    At Friday’s hearing, prosecutors opposed Carpenter’s request, saying they had pieced together the “overwhelming” amount of her movements using CCTV footage, leaving only “a matter of seconds” unaccounted for. Carpenter already has access to a “massive” trove of CCTV footage, they noted, and defendants have the ability to request specific camera angles they would like to focus on if they believe they need additional material.

    Prosecutors also suggested that they remain largely in the dark about what the cache of footage newly unearthed by McCarthy might include.

    “We don’t have what the speaker has,” said assistant U.S. Attorney Christopher Cook, adding, “In any case, there’s always the possibility some information may be out there.”

    Prosecutors are required to disclose to defendants any potentially exculpatory evidence they possess — a particularly thorny challenge in Jan. 6 cases as a result of the massive amounts of video evidence captured by Capitol security cameras, policy bodycams, journalists and rioters themselves, who recorded hundreds of hours worth of footage.

    But that requirement isn’t limitless, particularly when it comes to evidence that is in the possession of another agency — like the Capitol Police, an arm of Congress — and if courts determine the government has made good-faith efforts to provide as much material as possible to defendants.

    Carpenter’s attorneys argued in court Friday that McCarthy’s batch might help fill “gaps” in the footage that would provide context to the actions Carpenter took inside the Capitol. They contended that it might help contextualize some of the actions she took that resulted in the felony charges DOJ lodged, including for obstructing Congress’ proceedings and for participating in a civil disorder. She sought a 60-day delay in her trial, which is set to begin Monday, in order to determine whether any of the new footage might be relevant.

    Boasberg agreed that the request was legitimate. Any attorney would want to see a new batch of potentially exculpatory evidence, he said.

    “It’s certainly not a frivolous request by any means,” he said.

    But Boasberg agreed that the gaps Carpenter’s attorneys described were “minimal” and that the defense lawyers didn’t explain specifically why any additional footage might help Carpenter’s case.

    Prosecutors trying the seditious conspiracy case of several leaders of the Proud Boys also recently confronted the issue, when a defense attorney asked the Justice Department whether it would help organize access to the additional footage. Assistant U.S. Attorney Jason McCullough called it a “serious question” and a “serious issue,” but said it was too soon to say how DOJ would be handling the matter.

    Tunis: Tunisia denied that it had deported immigrants from sub-Saharan African countries by force, according to a statement released by the Ministry of Foreign Affairs.

    “Following allegations concerning the forced deportation of a number of immigrants from the brotherly sub-Saharan African countries, the Ministry of Foreign Affairs confirms that none of the citizens from those diaspora has been expelled by force,” Xinhua news agency quoted the statement as saying.

    The Ministry said “some requests for the voluntary return of illegal residents in Tunisia to their countries have been registered”, adding that applications are examined in full compliance with the legal procedures.

    It stressed that foreign nationals have equal access to protection in Tunisia and there was no discrimination.

    During a meeting of the Superior Council for National Security on February 21, President Kais Saied spoke of the illegal immigration of people from sub-Saharan African countries to Tunisia and the means to deal with it.

    Saied considered the current situation “not normal”, calling for an end to this phenomenon.

In 2004, he chronicled the military’s torture of prisoners at Abu Ghraib in Iraq. But he has also drawn criticism for some of his reporting in recent years, including his challenges to the official U.S. account of the killing of Osama bin Laden in Pakistan.

    Russia, which invaded Ukraine a year ago this week, has relied on its income from energy exports to fund the war. President Joe Biden sanctioned the Russian company behind the pipelines last year.

    Hyderabad: Larsen and Turbo (L&T) spokesperson for the Hyderabad metro rail on Tuesday denied a report published in a vernacular newspaper that the metro was “making sound and peeling off”.

    “As per L&T Hyderabad Metro Rail’s SOP, we do regular preventive maintenance work for all the civil structures including viaduct parapets across the metro rail network. During these preventive measures, wherever any superficial hairline cracks are noticed, which is a common phenomenon for areas subjected to continuous vibrations, we rectify them immediately by applying an epoxy coating for protection from weather and as a proactive measure towards the safety of the public,” said the statement issued by L&T.

    L&T further said that the contextualized photographs shown in the article are incorrect and misleading in nature, as they are in fact those of post rectification work process for hairline cracks, and not any cement peeling off as claimed in the story.

    The statement further read, “Regarding noises, Hyderabad Metro Rail is the only metro in the country, to have such a unique alignment with many sharp curves and steep gradients due to the topography of Hyderabad city. Under these circumstances, rail and wheel metal interaction creates more vibrations and screeching sounds, compared to straight-line metros. To address this issue, regular monitoring of the structure is done as part of the SOP, which also includes continuous/frequent track lubrication to reduce both vibration and noise levels.”

    “We also monitor the noise levels regularly and the values are kept well within the permissible limits,” L&T added.

    New Delhi: A Delhi court on Wednesday denied bail to businessman Ajay Ramesh Nawandar in a Rs 34,615-crore bank fraud case involving Dewan Housing Finance Limited (DHFL), and also cancelled the interim bail granted to him earlier.

    Special Judge Ashwani Kumar Sarpal noted that the accused had manipulated the medical record in procuring interim bail in the case, and said that the chances of tampering of evidence and influencing public witnesses by the accused were greater.

    “After considering the above facts and circumstances, I am of the view that allegations against accused Ajay Nawandar are somehow serious in nature and he being known to the main accused, former DHFL CMD Kapil Wadhawan and former director of the company Dheeraj Wadhawan, intentionally conspired with them for the purpose of concealment, diversion and disposal of the funds of the company and properties purchased from the same which ultimately belonged to banks,” the judge said.

    The court said that the accused and his family did not have financial constraints and simple fact that he was having wife behind to be looked into did not create any ground to release him on bail.

    “No ground exists to grant bail to this accused and accordingly bail application on merits is rejected. His interim bail granted on August 31, 2022 which was extended from time to time is hereby cancelled,” the judge said.

    The judge noted that the accused allegedly entered into conspiracy with main accused Wadhawan brothers in order to dispose of and conceal the proceeds of embezzled funds.

    The CBI had conducted searches at Nawandar’s premises and recovered a large collection of uber-luxury watches worth crores of rupees, including Rolex Oyster Perpetual, Cartier, Omega and Hublot Michael Kors, and two paintings worth Rs 33 crore.

    The agency said that these valuable items belonged to Kapil Wadhawan and Dheeraj Wadhawan, who allegedly defrauded banks to the tune of Rs 34,615 crore, making it the biggest such case probed by the agency.

    These were allegedly purchased using the proceeds of the scam and kept at Nawandar’s premises to evade recovery and seizure by enforcement agencies, the CBI said.

    The CBI said that Nawandar was acting as a conspirator aiding and abetting Wadhawans to hide the proceeds of the crime and he was in the process to dispose these items of when he was arrested by the agency.

    “During the investigation, it was found that the (DHFL) promoters had allegedly diverted the funds and made investments in various entities. It was also alleged that the promoters had acquired expensive paintings and sculptures worth about Rs 55 crore (approximately) using the diverted funds,” the CBI had said.

    The CBI had acted on a complaint from the Union Bank of India (UBI), the leader of a 17-member lender consortium that had extended credit facilities to DHFL to the tune of Rs 42,871 crore between 2010 and 2018.

    The bank has alleged that Kapil and Dheeraj Wadhawan, in a criminal conspiracy with others, misrepresented and concealed facts, committed criminal breach of trust and abused public funds to cheat the consortium to the tune of Rs 34,615 crore by defaulting on loan repayments from May 2019 onwards.

    An audit of DHFL’s account books showed that the company allegedly committed financial irregularities, diverted funds, fabricated books and round-tripped funds to “create assets for Kapil and Dheeraj Wadhawan”, using public money.

    Gandhi said that he had to call off his walk because “I can’t go against my security people.”

    He said J&K it was administration’s responsibility to provide security, “I hope security will now be ensured for remaining days of the yatra,” he said.

    Later in a series of tweets, the Kashmir Police said that “Only authorised persons as identified by organisers & frisked crowd was allowed inside towards the route of Yatra. “Organisers & managers of BJY did not intimate about large gathering from Banihal joining the Yatra, which thronged near the starting point.”

    Police said full security arrangements were in place including 15 Coys of CAPFs and 10 Coys of JKP, comprising of ROPs and QRTs, route domination. It said lateral deployment and SFs were deployed for high-ridge and other deployments.

    “JKP was not consulted before taking any decision on discontinuation of Yatra after conducting 1 km yatra by organizers. Rest of yatra continued peacefully. There was no security lapse at all. We will provide foolproof security,” it added.(GNS)

    Anantnag, Jan 27: Congress leader and Member Parliament Rahul Gandhi Friday accused the Jammu and Kashmir administration of a big security lapse at Jawahar Tunnel stating that police were missing to control the crowd that had come to his reception.

    “When we crossed from Navyug Tunnel at Qazigund, there was a huge crowd for my reception. But there was not a single police man to manage or control the crowd. My security guards advised me not to go ahead,” Rahul said addressing a press conference at Khanabal, Anantnag, as per news agency—Kashmir News Observer (KNO). “It is very difficult for me to go against what my security guards advise me.”

    He said that he was hopeful that security arrangements would be elaborate for his future programs that includes his culmination rally at Pradesh Congress Committee (PCC) office in Srinagar where he is supposed to unfurl the tri-colour on January 30 and address a mega rally.

    He said Yatra will continue and will conclude in Srinagar as per Schedule. Speaking on the occasion, senior Congress leader Jai Ram Ramesh said that Rahul was supposed to walk 16 kms today but he could walk only 4 kms due to breach of security. He said that administration must ensure proper security for the Bharat Jodo Yatra in the days ahead, especially when it reaches Srinagar.

    He said due to the wrong policies of BJP and RSS, India as a nation is falling apart and the Yatra is an effort to bring the folks together. Ramesh said that BJY has nothing to do with the election politics as of now. “We keep on stating that there are two ways: one that of BJP and RSS and another that of Congress which is the Gandhian way.”

    Meanwhile, several Congress leaders have also alleged security lapse in Banihal and Qazigund during Bharat Jodo Yatra on Friday.

    Omar while reacting to the security lapse said that he witnessed that outer layer of security vanished suddenly.

    “I’m witness to this. The outer ring of the cordon which was maintained by J&K police simply vanished within minutes of @RahulGandhi starting to walk. We had just crossed into Kashmir from Jammu & were looking forward to the 11 KM walk but unfortunately it had to be cancelled,” he tweeted.

    Rahul was welcomed by several party leaders including former JKPCC president G A Mir at the entrance of the tunnel from Qazigund side along with hundreds of workers.

    He was joined by PDP leaders and workers led by PDP spokesperson Suhail Bhukhari as well.

    POLICE DENIES SECURITY LAPSE: Jammu and Kashmir police said there was no security lapse at all in the Bharat Jodo Yatra.

    In a statement, issued to the KNO, a police spokesman said police was not consulted before taking any decision on discontinuing the Yatra after conducting 1 Km Yatra by the organisers.

    Police also said only authorised persons as identified by organisers & frisked crowd was allowed inside towards the route of Yatra.

    Hyderabad: Tollywood star N. Balakrishna, better known as NBK, on Thursday denied making derogatory comments about late legendary actor Akkineni Nageswara Rao.

    Stating that he has a lot of respect for Nageswara Rao, the actor-politician said he did not use any word intentionally while referring to the late actor.

    At the success meet of his latest release “Veera Simha Reddy”, Balakrishna’s comment about Nageswara Rao had triggered a row.

    Talking about his father, late former Andhra Pradesh Chief Minister and creator of the Telugu Desam Party, N.T. Rama Rao, Balakrishna had said rather dismissively: “My father had some contemporaries, Ranga Rao (S. V. Ranga Rao), Akkineni, Thokkineni, and some others.”

    Nageswara Rao’s grandsons — Akkineni Naga Chaitanya and his brother Akhil Akkineni — posted a statement on Twitter in reaction to Balakrishna’s remark.

    They said: “Nandamuri Taraka Rama Rao garu, Akkineni Nageswara Rao garu and S.V Ranga Rao garu’s creative contributions have been the pride and pillars of Telugu Cinema. Disrespecting them is degrading ourselves.”

    With Nageswara Rao’s family reacting to the actor’s comment, NBK has come out with the clarification. He claimed that Nageswara Rao used to love him more than his own children and he too used to address him as uncle.

    “Defendant has failed to come forward with any evidence to support the claimed assertion of privilege. And, because the claimed assertion of executive privilege is unproven, Defendant cannot avoid prosecution for contempt,” Mehta wrote in the 39-page ruling.

    It’s a significant decision in an area with little precedent: what current and former presidents must do to assert executive privilege. Mehta acknowledged that there’s not much to guide how courts should determine when a proper assertion has been made. But he said limited court rulings on the subject suggest there must be at least some formal evidence it occurred.

    Mehta noted that two other Trump aides whom the House sought to hold in contempt — Mark Meadows and Dan Scavino — produced letters from Trump ordering them to assert executive privilege on his behalf. The Justice Department declined to prosecute the men, and Mehta indicated that the absence of a similar letter from Trump to Navarro led to a reasonable conclusion that Trump had not asserted executive privilege over his testimony.

    Mehta’s ruling means that Navarro’s trial on two charges of contempt of Congress is likely to commence later this month. He faces a maximum sentence of a year in prison on each charge — one for refusing to testify and the other for refusing to provide documents — if convicted.

    The select committee had hoped to interview Navarro about his coordination with former Trump adviser Bannon and efforts to strategize with members of Congress seeking to challenge the 2020 election results on Jan. 6, 2021, during the counting of Electoral College ballots. The committee recommended that Navarro be held in contempt in April 2022, and the full House quickly followed suit. The Justice Department charged him in June.

    Mehta’s ruling also gutted a series of defenses Navarro had hoped to raise at his trial, including that he had a “good-faith belief” that he was immune from the committee’s subpoena. Mehta also agreed to prohibit Navarro from arguing that the select committee’s subpoena was invalid because the panel didn’t have a full complement of 13 members or a ranking Republican member appointed by GOP Leader Kevin McCarthy.

    Although he declined to say whether the committee was operating improperly, Mehta noted that Supreme Court precedent required Navarro to first raise his rules complaint with Congress itself. Because he didn’t do that, he effectively waived that argument. Navarro had argued that raising his complaints to Congress would have been “futile” because the House would have simply rejected them. But Mehta said the rules were clear.

    “Neither the Supreme Court nor the D.C. Circuit has recognized a futility exception. … And, given the rationale of the rule, it is doubtful that higher courts would recognize one,” Mehta wrote.

    The ruling essentially puts Navarro on a track similar to his close ally Bannon, who was tried and convicted of contempt of Congress in July. Bannon, like Navarro, had hoped to argue that he believed he was immune from testifying and that longstanding Justice Department precedents precluded Congress from subpoenaing advisers to former presidents. But in that case, U.S. District Court Judge Carl Nichols relied on a decades-old appeals court ruling — United States v. Licavoli — to reject Bannon’s proposed defenses, ruling that prosecutors simply needed to show that Bannon deliberately refused to appear before Congress.

    Mehta cited the case, as well, in tossing most of Navarro’s defenses.

    “Defendant apparently believes the law applies differently to him,” he wrote of Navarro. “Because he is a former aide to the President of the United States, he contends, a more stringent state-of-mind standard applies, meaning that the government must be held to a higher burden of proof to convict him as opposed to the average person.”
