  • Will consider the question of rehabilitation, says SC on night shelter demolition

Will consider the question of rehabilitation, says SC on night shelter demolition

    [ad_1]

New Delhi: The Supreme Court on Wednesday said it will now have to examine the rehabilitation issue, after it was informed about the demolition carried out by authorities of a night shelter located at Delhi’s Sarai Kale Khan earlier in the day.

Advocate Prashant Bhushan mentioned the matter before a bench of Justices Hrishikesh Roy and Dipankar Datta, saying that the night shelter, being availed of by over 50 people, has been demolished and that authorities carried out the demolition at 10 a.m.

The bench said if the night shelter has been demolished, then it would have to examine the question of rehabilitation.

Bhushan had mentioned the matter while the bench was in the middle of hearing a case. After the hearing of the case was over, Bhushan said that authorities have come there with bulldozers and the homeless matter is pending before this court, and this issue is about a night shelter for homeless people.

He contended that without providing alternative accommodation, a night shelter is being demolished by the authorities. Bhushan said matter regarding homeless people is scheduled to be taken up by the court on February 22 and his application on the issue pertaining to demolition of night shelter at Sarai Kale Khan may be heard along with it.

The bench told Bhushan it could hear the matter on February 22, and asked him to incorporate the subsequent developments in the matter.

Recently, the Delhi Police had asked the Delhi Urban Shelter Improvement Board (DUSIB) to shift the Sarai Kale Khan night shelter before the scheduled G20 summit in September, in view of concerns that it is being used by criminals and miscreants.

  • After DDA demolition drive stops, AAP seeks compensation for victims from L-G

After DDA demolition drive stops, AAP seeks compensation for victims from L-G

    [ad_1]

Delhi: After the much disputed DDA demolition drive in Mehrauli was stopped on Lt Governor VK Saxena’s direction, the Aam Aadmi party on Wednesday sought compensation from him for the victims of the area.

In a letter to the L-G, AAP MLA Somnath Bharti said, “Direct the concerned to assess the damages already caused to many houses by the said demolition and do the needful, including appropriate compensation and to get them reinstated at the locations from where they have been uprooted without any further delay”.

The AAP leader further said that till the time it takes place, please direct the concerned to put some makeshift arrangements like tents etc.

Bharti also sought the investigation into the issues, calling it “serious breach of transaction of business rules, Govt. of NCT of Delhi Act, Constitution of India and various judgments of Hon’ble Supreme Court of India” and has urged to punish the officials guilty of this severe dereliction.

“When it became apparent after making enquiries with District Magistrate (South) Office that the demarcation which became the basis of demolition, in Mehrauli, by DDA was neither in the knowledge of Chief Minister Arvind Kejriwal nor Revenue Minister Kailash Gehlot ji, then why the press release released from your office attributed the flawed demarcation to the Aam Aadmi Party Government? the letter reads further.

Such an attempt was surely political from the L-G office with the sole intent to malign the clean image of Arvind Kejriwal and Aam Aadmi Party government, he said.

“On 14.02.2023, the reason issued by your esteemed office for stopping the massive and inhuman demolition exercise being carried out by DDA in Mehrauli was the same which we have been agitating since day one under the leadership of Chief Minister of Delhi, Arvind Kejriwal i.e. the flawed demarcation report.

“Had you agreed on this most important flaw brought out to you/your officers’ notice by us on day one of the demolition exercise which rendered many people, including old people, women and children homeless then such a massive tragedy would have been avoided”, the AAP MLA stated in the letter.

The letter reads, “Since in the urbanised villages applicability of Delhi Land Reforms Act ceases and hence the demarcation work should be carried out directly by DDA following the due process, which requires the demarcating agency to invite objections from the people who at present are residing on the land being demarcated and ensure their full participation before finalizing the demarcation report or if you still wish to go ahead with the Revenue Office of Delhi government then it is urged that offices of Chief Minister and Revenue Minister must not be bypassed”.

  • Mehrauli demolition: HC directs authorities to maintain status quo on properties

Mehrauli demolition: HC directs authorities to maintain status quo on properties

    [ad_1]

New Delhi: The Delhi High Court Tuesday directed the authorities to maintain status quo till February 16 on various properties in the Mehrauli Archaeological Park area in the national capital which have been identified to be demolished as part of an anti-encroachment drive.

The high court also asked the Delhi Development Authority (DDA) to state its stand on a batch of petitions challenging the demolition action and seeking a bar on demolition in the Mehrauli Archaeological Park area in south Delhi till a fresh “demarcation report” has been prepared.

A large number of petitions on the issue were listed for hearing before two different judges Justice Mini Pushkarna and Justice Manmeet Pritam Singh Arora.

Nearly 20 multi-storey buildings, a large number of shops and houses and a private school building are among the structures constructed “illegally” over the last few decades in the Mehrauli Archaeological Park, which the authorities have identified as part of the anti-encroachment drive.

Without interfering with the demolition exercise at this stage, Justice Pushkarna issued notice to the Delhi government and DDA on the petition by Mehrauli Minorities Resident And Shop Owners Welfare and directed that the matter be placed before the division bench headed by the Chief Justice, where a similar matter is already pending.

The drive, which began on February 10, comes a month ahead of a proposed G20 meeting at the park in south Delhi. According to the DDA, the old park has about 55 monuments under the protection of the Archaeological Survey of India, state archeological department and the urban civic body.

The petitioner, who was raising the issue of demarcation report, submitted that Mehrauli has many slum clusters and several waqf properties, including mosques and dargahs, were located there.

He alleged the revenue minister of the Delhi government said on February 11 that a fresh “demarcation report” should be prepared as the present report has “certain objections” and, in the meantime, no demolition exercise should be carried out.

The DDA counsel said it is the land owning agency in the present case and the demolition exercise is in terms of the order passed by a division bench of the high court in December last year for removal of encroachments.

The lawyer contended the demarcation report is of the year 2021 and the minister cannot sit in review over it.

In the batch of pleas before Justice Arora, the court also directed the petitioners and their lawyers to meet DDA’s Deputy Director of Land Management at his office tomorrow at 3.30 PM to present their claims on respective land parcels.

It asked the DDA to file a demarcation report with respect to the subject properties by Wednesday afternoon.

Advocate Kamlesh Kumar Mishra, representing the residents of Green Apartments in Mehrauli, said there are 62 families residing in 62 flats and the entire action of the DDA is illegal because the authorities are going ahead with the drive without giving any opportunity to the residents to be heard.

He said the residents of the apartments have got their title deeds registered by the registrar and the DDA along with the Delhi government has gone ahead with the demarcation exercise without notifying the people residing there, something which is not allowed under law.

On February 10, the high court had directed the authorities to maintain status quo on 400 jhuggis of Ghosiya Slum Colony in Mehrauli, which were also to be demolished.

The land on which the alleged encroachment was made belonged to multiple agencies including the DDA, Waqf Board, and the Archaeological Survey of India (ASI), it has been claimed.

According to the demolition notice, the land on which demolition is being carried out is a part of the Mehrauli Archaeological Park and the ‘existing unauthorised encroachment’ is acting as a hindrance to its development.

On December 23, 2022, the high court had refused to stay the demolition exercise proposed in Mehrauli Archaeological Park.

The DDA had then informed the court that no mosque or graveyard was being demolished by the authorities and that only the encroachers will be removed from places in and around the park. It said the exercise will be carried out in accordance with the demarcation report.

  • Rampant Demolition Drive Blind To People’s Miseries: NC

    [ad_1]

SRINAGAR: The Jammu and Kashmir National Conference Provincial President Nasir Aslam Wani on Tuesday called an end to the rampant demolition drive, saying administration’s face in Kashmir should be marked by compassion, not bulldozer.

This he said while interacting with party functionaries here at the party headquarters Nawa-e-Subha, Srinagar. Peer Afaq Ahmed, Imran Nabi Dar, Dr Sajad Shafi Uri, Syed Tauqeer, Ahsan Pardesi, Ifra Jan, Pirzada Faroz, Danish Iqbal were present on the occasion.

Nasir said that these everyday demolition drives without serving mandatory notices to the alleged encroachers and denying them the right to defend themselves is a cause of worry. “Administration’s claims have done little to assuage the residents of the Valley, who are perpetually living under fear of their properties and business establishments being the next target of the ongoing drive. Outside Jammu and Kashmir, the government is providing homes to the homeless but here it is doing exactly the opposite by making people homeless. It’s vindictive. It has sparked panic and anxiety among the poor,” he added.

The paradoxical attitude of the government, Nasir said, is the clear physical manifestation of policy paralysis within J&K administration.

NC Says The Demolition Driver Will Add To The Poverty

    [ad_1]

SRINAGAR: National Conference on Sunday stated that the ongoing demolition drive is deepening the despair of poor and the rightful landowners across Jammu and Kashmir.

According to the statement pointing to the new disturbing trend of arbitrary acts of demolishing homes and structures, the party’s In Charge constituencies of Srinagar district Ali Muhammad Sagar, Mubarak Gul, Shameema Firdous, Irfan Shah, Tanvir Sadiq, Ahsan Pardesi, Mushtaq Guroo and Salman Ali Sagar issued a joint statement saying the meas has compounded the vulnerabilities of marginalized traders, women, children, senior citizens, socially and economically downtrodden.

Causing  immense distress, the eight segment In Charges said that the ongoing bulldozer rampage has created a humanitarian crisis. “The worrying trend of state demolishing homes, business units, and shops violates all due norms and established human rights procedures,” they added.

The leaders reiterated that the government should make the bulldozer its last resort, give people a chance to prove their claim and issue proper notices to the people having illegal possession of State land. “The ongoing bulldozer rampage has been carried out by government agencies professedly to ‘clear encroachments’ and remove ‘illegal structures’ from public land. However, the state authorities have used this reasoning to arbitrarily select and demolish settlements. All we seek is a strict adherence to due process and ensuring that informed demolition. The wanton rampage, it goes without saying, will only disproportionately affect marginalised communities and divest them from accessing the most basic facilities, essential for a life with dignity,” the leaders said.

They said the government should regularise  those sitting on the State land if such policies exist in other parts of the country. “This will bring ease in the common man’s life and help the government earn as well,” they added.

Calling out hypocritical condemnation of  demolitions by Apni Party, whose mayor is at forefront of harassing Srinagar residents, the Segment In Charges said, “On one hand we see party chief denounce bulldozer rampage and evictions. On the other hand,  the Apni party’s Mayor is at the forefront of the drive. They cannot run with the hare and hunt with the hound. Nothing brings the glaring paradoxes within Apni Party’s to the fore as this new diktat, asking traders to evict their complexes and shops from Doodh Ganga. They cannot continue to smokescreen the reality with their theatricals. People have seen their masks fall off.”

Hyderabad: Restoration of Gulzar Houz leads to ‘demolition’ rumours

    [ad_1]

Hyderabad: The state government here began restoration of the 16th century Gulzar Houz (fountain) in the Old City. On Monday night, workers started drilling out and removing concrete from the structure using a machine, leading to several false messages spreading on social media and also amongst local media, that the structure is being ‘demolished.

Using tin sheets, Gulzar Houz has been was covered from all sides by the contractor who is taking up the restoration works. A board put up at the site reads ‘ Deccan Terrain”, as the name of the heritage conservation company.

A person linked to the company said that restoration works at Gulzar Houz are being taken up for which first a study will be done on needs to be done to begin the actual process of restoring it. They expect the works to completed in two months time.

After noticing the workers at Gulzar Houz, people gathered in large numbers. The police were called and the cops dispersed the crowd after explaining about what was really going on, with regard to the restoration of the structure.

The Gulzar Houz was built some years after the Charminar, which was built as Hyderabad’s foundational monument in 1591 by Mohd Quli Qutb Shah, the city’s founder. The Gulzar Houz was originally called ‘Char Su Ka Houz’ (fountain of the four sides) and was built as a drinking water fountain for locals of the city.

The Golconda fort existed as a walled city until Hyderabad was built in 1591. The Qutb Shahi dynasty, which founded the city, ended in 1687.

However, after the destruction of Hyderabad in 1687 by Mughal emperor Aurangzeb, and subsequently with the Nizams coming in (1724) as governors of the Decan, changes were made to Gular Houz. The old massive structure was eventually broken down to what it is today.
