    New Delhi: Former NDTV promoter Prannoy Roy’s lawyer said that he will take instructions while Republic TV Editor-in-Chief Arnab Goswami’s counsel apprised the Delhi High Court that he will tender an unconditional apology in a contempt case filed by late environmentalist and former The Energy and Resources Institute (TERI) chief R.K. Pachauri.

    Pachauri had filed a contempt of court petition in February 2016, alleging several media houses for deliberately and contemptuously not following the court’s orders restricting them from publishing sexual harassment claims against him.

    “The counsel for respondent No. 5 (Arnab Goswami) states that she as well will file an affidavit tendering unconditional apology within a period of one (1) week. It is ordered accordingly,” Justice Manmeet Pritam Singh Arora recorded in his order.

    The Economic Times and its Senior Assistant Editor Raghav Ohri have already tendered an unconditional apology in the matter.

    “The learned counsel for the Respondent Nos. 2 (Economic Times) and 3 (Ohri) states that he has filed an affidavit on behalf of Respondent Nos. 2 and 3, tendering their unconditional apology. Let the same be brought on record within a period of three (3) days,” Justice Arora ordered.

    Pachauri had said that he was being subjected to a media trial and that the reports carried by the publications were defamatory and prejudiced his case.

    Pachauri, who passed away in 2020, was accused of sexually harassing a colleague while he led the TERI.

    New Delhi: Demonstrating its overall commitment to India, New Zealand on Tuesday announced an investment of 400K NZ dollars towards internationalisation and student mobility initiatives. These include further engagement with the New Zealand Centre at IIT Delhi to include fellowship grants and the re-launch of the partial scholarships under the New Zealand Excellence Awards. Around 10 different projects are currently going on at the IIT Delhi’s New Zealand centre.

    The announcements were made at a roundtable session hosted at the New Zealand High Commission in the presence of David Pine, the New Zealand High Commissioner to India.

    Speaking about the several initiatives taken to strengthen the educational ties between India and New Zealand, Pine said, “New Zealand and India share a longstanding relationship that has been growing through various mutually beneficial initiatives.

    “The New Zealand-India Education Week, which started on April 17, allows us to lay our ear to the ground and hear the key stakeholders so that New Zealand can continue its varied partnership and collaboration in India’s leading institutions.”

    According to Pine, over 3,000 visa applications from India have been approved recently by New Zealand and most of these applications came from students. Over 90 per cent visa applications seeking higher education opportunity in New Zealand have been approved, the official said.

    Education experts from New Zealand said that the educational ties between New Zealand and India are set to strengthen following one of Education New Zealand’s biggest events of the year, the India-New Zealand Education Week.

    It will encourage a dialogue on research while fostering innovation and cultural exchange and cooperation in the context of international education.

    Also, the New Zealand Excellence Awards (NZEA) is a unique scholarship scheme designed exclusively for Indian students. The awards are jointly funded by Education New Zealand and all the eight New Zealand universities. Since the launch of the scholarship in 2016, it has supported over 200 Indian students to pursue overseas study at the world-class universities in New Zealand.

    Education New Zealand’s Chief Executive, Grant McPherson, said, “New Zealand’s education system is future focussed and multicultural, offering the students an opportunity to earn work-ready degrees.”

    “India is one of New Zealand’s priority partner countries for collaborations, exchanges and student mobility. We are excited that today’s announcements around the New Zealand Centre and the launch of the New Zealand Excellence Award scholarships demonstrate our commitment to India as an education partner,” said McPherson.

    IIT Delhi’s James Gomes, Dean International, said, “The New Zealand Centre embodies IIT Delhi’s efforts to embrace internationalisation, providing opportunities for new research collaborations and global exposure to our students. The first round of jointly-funded research collaboration, awarded in 2022, has helped foster collaborative, sustainable and self-supporting research programmes.

    “Today’s MoU has further enhanced the partnership and cooperation in research, teaching and fellowships between India and New Zealand and provides an opportunity to explore other innovative ventures.”

    New Delhi: A court here has convicted a father-son duo for rioting and arson in a case of the 2020 North East Delhi riots, saying the prosecution proved the charges against them beyond a reasonable doubt.

    The case against Mithhan Singh and his son Jony Kumar was being heard by Additional Sessions Judge (ASJ) Pulastya Pramachala.

    The duo was accused of being part of a riotous mob that set many properties on fire in lane number 4 in Khajuri Khas on February 25, 2020.

    “I find that it is proved beyond doubt against both the accused that they were part of the mob which burnt the property (of complainant Shabana Khatoon). Thus, they are held guilty of the offences under sections 147 (rioting) 148 (rioting, armed with a deadly weapon) 436 (mischief by fire or explosive substance with intent to destroy house, etc) read with section 149 (every member of unlawful assembly guilty of offence committed in prosecution of common object) of the Indian Penal Code and convicted accordingly,” the judge said.

    The court posted the matter for filing affidavits on April 19, following which the proceedings on sentencing will commence.

    An unlawful assembly was established with the shared goal of harming the properties of a specific community, according to ASJ Pramachala, who took note of the statements of various public witnesses. The riotous mob also committed acts of vandalism and arson, according to the judge.

    Regarding the claim that the two were members of the mob, the judge stated that none of the complainants, locals, or other witnesses backed the prosecution’s evidence and refused to label the accused as mob members.

    The judge stated that prosecution witnesses Mohd. Tahir and Constable Rohtash were the only witnesses to identify the duo as mob members.

    He said Tahir’s testimony was “reliable” to show both accused were out in the lane and that they had joined the riotous mob raising slogans, while Constable Rohtash was the beat officer of the area and saw the duo as part of the mob that torched Khatoon’s property.

    Because there was no entry in the daily diary or formal report on the occurrence, the judge ruled that the police official’s testimony could not be discarded.

    Based on the evidence of the two witnesses, there was “no doubt that both accused persons were part of the mob” that indulged in the incident of arson at Khatoon’s property, the judge said.

    Mumbai: Full emergency was declared at Delhi’s Indira Gandhi International Airport on Tuesday for a Delhi-bound Air India flight owing to a glitch, a source said.

    The flight had 180 passengers on board.

    Air India, in a statement, said that its flight AI858 operating on Pune-Delhi route landed ahead of its scheduled time following a minor crack on the aircraft’s windshield.

    “Full emergency was declared for the Air India Delhi flight from Pune at Indira Gandhi International airport at 5.44 pm on Tuesday due to a glitch. The aircraft was carrying 180 passengers on board,” the source said.

    “Air India flight AI 858 operating Pune-Delhi on April 18 safely landed in Delhi ahead of its scheduled arrival time, following a minor crack on the right (starboard side) of the operating aircraft’s windshield,” the airline said.

    All passengers and flight crew were safe, it said.

    The aircraft will undergo the necessary maintenance procedure, and its windshield will be replaced, Air India added.

    ASJ Pramachala noted the statements of several public witnesses and said it was safe to conclude that an unlawful assembly was formed with the common intention of attacking the properties of a particular community and that the riotous mob engaged in incidents of vandalism and arson.

    Regarding the identification of the duo as part of the mob, the judge said none of the public witnesses or residents of the lane, including the complainants, supported the prosecution’s case and refused to identify the accused persons as members of the mob.

    The only witnesses who identified both accused as members of the mob were prosecution witnesses Mohd. Tahir and Constable Rohtash, the judge said.

    He said Tahir’s testimony was “reliable” to show both accused were out in the lane and that they had joined the riotous mob raising slogans, while Constable Rohtash was the beat officer of the area and saw the duo as part of the mob that torched Khatoon’s property.

    The judge said the testimony of the police official could not be discarded because of the absence of the daily diary (DD) entry or a formal report on the incident.

    Based on the evidence of the two witnesses, there was “no doubt that both accused persons were part of the mob” that indulged in the incident of arson at Khatoon’s property, the judge said.

    The Khajuri Khas police station had registered an FIR against the duo on the basis of Khatoon’s statement. Later, six other complaints were also clubbed with the case.

    New Delhi: Gangster-turned-politician Atiq Ahmad is said to have left multiple high-value properties in Delhi, as per sources.

    These properties consist of both residential and commercial real estate, including apartments and office spaces situated in Shaheen Bagh, Okhla and Jamia Nagar.

    It is estimated that Atiq’s real estate portfolio in Delhi is worth several crores, said the sources.

    The significant question that arises now is who will inherit Atiq’s empire, which was allegedly acquired through unlawful means and is worth crores in multiple states.

    Atiq Ahmad and his brother Ashraf were shot dead in Prayagraj on Saturday night, in the presence of the police and in full glare of the media. Atiq and his brother were shot when they were taken for a medical test to the Colvin hospital. Both died on the spot.

    The Uttar Pradesh (UP) Police have compiled a list of Atiq’s and his associates’ assets in districts such as Prayagraj and Kaushambi, among others, following the crackdown on their “illicit” properties.

    In the past 50 days, Atiq’s entire family has been on the run and his son Asad was killed in an encounter in Jhansi.

    The mafia don also lost his property and assets worth Rs 1,400 crore in Prayagraj, and his several properties have been demolished by the government.

    The Enforcement Directorate has also dealt a severe blow by exposing assets worth over Rs 1,400 crore and discovering nearly 50 shell companies that Atiq and his gang used to convert black money earned from extortion into white money.

    A day before he was killed in Prayagraj, the law enforcement agencies unearthed a huge cache of arms that belonged to him.

    Besides confiscating Atiq and his gang’s property worth Rs 1,400 crore, 15 teams of the Enforcement Directorate have also expedited their money laundering probe against Atiq and exposed assets worth another Rs 108 crore.

    The documents recovered during the ED’s raids on Atiq have revealed more than 50 shell companies which are dummy companies owned by someone else in the documents, but they were invested in by Atiq and his gang.

    All these companies were involved in the black money business network and the ED dragnet has fallen on a lawyer, Atiq’s accountant, a real-estate businessman, a former BSP MLA, a builder and a car showroom owner who have been central to running Atiq’s ‘business’.

    The crackdown on Atiq Ahmad has also ‘destroyed’ his family.

    Of his five sons, one has been killed, two are in jail and two minor sons are in juvenile home.

    His wife, Shaista Parveen is absconding and so is the wife of his slain brother Ashraf. His sister, Noorie is in hiding and brother-in-law Akhlaq is in jail.

    His relatives are afraid of admitting to any kind of links with him and his family.

    New Delhi: Shiv Sena (Uddhav Balasaheb Thackeray) leaders Aaditya Thackeray and Sanjay Raut on Monday opposed before the Delhi High Court a defamation plea filed against them by Maharastra MP Rahul Ramesh Shewale for allegedly levelling frivolous corruption charges against him and the Eknath Shinde-led Shiv Sena faction.

    While Raut’s counsel submitted that they have a right to criticise in a democratic space, former Maharashtra minister Aaditya Thackeray said there was nothing slanderous about the political statements made by him.

    Pursuant to an earlier high court order, former Maharashtra chief minister Uddhav Thackeray, his son Aaditya Thackeray and Rajya Sabha member Sanjay Raut made their appearances in the court through their respective lawyers.

    The three defendants filed their replies to the plaintiff’s application seeking an interim relief to remove the alleged defamatory content from social media platforms.

    Justice Prateek Jalan listed the suit for the completion of the pleadings before the joint registrar on May 10.

    During the hearing, senior advocate Devdutt Kamat, appearing for Raut, said for the first time in the history of common law, a political party is suing for defamation.

    He claimed that the plaint was not maintainable and it was an attempt to gag free speech.

    “Is it that in a democratic space there can’t be any criticism?” the counsel asked and said there was no question of any interim relief to be given to the plaintiff.

    To this, the judge said, “We will see what is the nature of the criticism. We will see what the statements are and surely, I have due regard for freedom of speech.”

    The high court issued summonses to Uddhav Thackeray, Aaditya Thackeray and Raut on March 28 and asked them to file their written submissions within 30 days.

    It had also asked Google and Twitter to file their written statements within 30 days on the plea.

    In his reply to the application for interim relief, Aaditya Thackeray said it is a regular practice for politicians to comment upon each other’s conduct in a political discourse and as a public figure, the plaintiff ought to take the “bouquets as well as brickbats” and that “public figures cannot be allowed to be thin-skinned as it would entirely stifle all criticism of them”.

    “The entire suit is nothing but a malicious attempt at clamping down on free political speech, which ought not to be permitted by this court. It is submitted that the allegedly slanderous statements made by defendant no. 3 (Aaditya Thackeray) are nothing but political speech and the same is protected under the right to freedom of speech under the Constitution of India,” the reply filed through advocate Naman Joshi stated.

    It said the plaintiff has filed the suit in his personal capacity and not as an office-bearer of either his own political party — Shiv Sena (Shinde faction) — or the Election Commission and has made no whisper as to how he, his party or the EC has been defamed and in whose eyes.

    Shewale was represented in the court through senior advocate Rajiv Nayar and lawyer Utsav Trivedi.

    In the suit, Shewale has sought a permanent injunction and damages against the defendants on account of alleged false, malicious and unsubstantiated allegations levelled and circulated on social media platforms and other offline and online media.

    He has said the allegations are libellous, unfounded and misconceived and tainted with collateral objectives, which were made knowingly and deliberately to harm the dignity of the plaintiff and his political party.

    “The present plaint demonstrates that the defendant nos 1 to 3 have conspired with each other and with other unknown individuals or organisations to launch a series of scathing and belligerent attacks against the plaintiff and the political party which the plaintiff belongs to, that is, Shiv Sena, with the oblique motive to malign, defame and injure the plaintiff’s reputation, based on a series of blatant falsehoods and gross misrepresentations,” the plea has said.

    New Delhi: A court here on Monday extended former Delhi Deputy Chief Minister Manish Sisodia’s judicial custody by two weeks in connection with the excise policy case being investigated by the Enforcement Directorate (ED).

    Before the bench of special judge M.K. Nagpal of the Rouse Avenue Court, the ED had earlier submitted that Sisodia had planted fabricated e-mails to show that there was a public approval for the policy.

    “We have evidence that Sisodia had e-mails planted. These have been received not only in the official e-mail account of the Excise Department but even in his personal e-mail account. The content of the e-mails was given by Sisodia which suited his agenda,” the counsel for the ED had told while opposing the bail plea.

    “Fabricated e-mails were sent to show that there was a public approval of the policy. This is a sham approvala Illegal ecosystem was created to give benefits to the liquor cartels in lieu of kickbacks.”

    The ED’s special public prosecutor Zoheb Hossain had then told the judge that the agency wanted to show him the case diary.

    To this, Sisodia’s counsel had said that it should not be done so in secrecy.

    “Sealed cover business should go. If something is used against me to deny me my libertya If they are relying on something behind my backa It should be put to me as well,” the counsel said.

    However, the probe agency said that the 60 days to complete the investigation against him are not over yet.

    The ED said: “We will put it to you after 60 days.”

    The court then adjourned the hearing in bail matter for Tuesday.

    On April 5, the ED had informed Judge Nagpal that it has found fresh evidence indicating Sisodia’s involvement in the alleged excise scam, and the investigation is at a crucial stage.

    The court had extended AAP leader’s custody till April 17 in this case.

    On March 21, Sisodia had moved a plea seeking bail plea in ED’s case.

    After the CBI arrested the AAP leader on February 26, the ED also arrested him in the same case on March 9.

    The probe agency had earlier claimed that within a span of one year, 14 phones have been destroyed and changed, and that Sisodia has been evasive from the start.

    New Delhi: A group of Delhi BJP leaders and workers on Sunday staged a sit-in at Rajghat here over alleged insult to Mahatma Gandhi by the AAP.

    The BJP leaders led by state president Virendra Sachdeva also prayed at the Gandhi’s memorial prior to AAP convener and Delhi Chief Minister Arvind Kejriwal reached there before going to the CBI headquarters for questioning in connection with the alleged liquor scam.

    “When Kejriwal gets trapped, he remembers Mahatma Gandhi, although he has ordered for removing Gandhi’s portrait from offices of his government,” Sachdeva charged.

    He further attacked Kejriwal over AAP workers holding protests across the city, and said, “Kejriwal’s politics is inspired by his actor friend Prakash Raj’s villainous roles in the movies. The call of AAP for road blockade in Delhi is inspired by the role of Raj in film Policegiri.”

    Sachdeva said Kejriwal was called by the CBI for liquor scam of his government but he went to the Samadhi of Mahatma Gandhi, and nothing can be “more shameful” than this.

    Leader of Opposition in Delhi Assembly Ramvir Singh Bidhuri said that due to the hard work of BJP workers, Kejriwal who is “mastermind” of the liquor policy scam will also be in jail soon.

    “Whenever Kejriwal was asked about the liquor scam in the assembly, he ran away. Kejriwal will now have to face the consequences of his actions and will have to resign and also go to jail,” Bidhuri said.

    Former Delhi BJP chief Adesh Gupta said the party workers’ struggle has paid off today. Kejriwal’s aides Satyendar Jain and Manish Sisodia are already in the jail waiting to welcome him there, he said.
